ABOUT THE COLLEGE

Chanderprabhu Jain College of Higher Studies & School of Law has been promoted by the Rishi Aurobindo Educational Society to run market focused professional programmes in the emerging areas of higher education in the disciplines which have high job potential. The Institute runs full time BBA (General) (3 year programme in two shifts), BBA CAM (3 year programme in two shifts), BCA (3 year programme in two shifts), B.Com (Hons) (3 year programme in 2 shifts) and B.A. LL.B (Hons) & BBA LL.B (Hons) (5-year integrated programmes) courses affiliated to Guru Gobind Singh Indraprastha University, Delhi. The credibility of education at the Institute is increasingly being realized and recognized by the corporate world.

The College

The college is situated in its own sprawling one acre campus in Narela, Delhi. Being away from the hustle and bustle of the metropolis, the campus provides a pleasant and intellectually stimulating ambience. It has spacious, airy and well lit lecture rooms, seminar halls, well equipped and air-conditioned multi-lab computer centers, well-stocked libraries and other essential academic infrastructural facilities as per the GGSIPU norms.

The stark and majestic building in brick has modern architecture with bold openings, creating monumental spaces with minimal decor that provides a perfect setting for learning. The multi-storied building of the college has a spacious auditorium, a corporate development cell meant for placement activities, faculty cubicles, cafeteria, boys & girls common rooms and the moot court.

The Institute aims to impart high quality professional education in a vibrant academic ambience with a faculty of distinguished lecturers and resource persons from the industry. Intensively involved in stimulating academic work, students will also have ample time for sports, cultural and other enriching activities.

The CPJ college of Higher Studies & School of Law has about 1800 students, 70 faculty members and a similar number of supporting staff. CPJ has a state-of-the-art infrastructure including laboratories, library and computer facilities.

The CPJ College of Higher Studies was established in 2007 at Narela, Delhi and the School of Law commenced with the 5-year Integrated course in B.A.LL.B (H) from the Academic Year 2008-09 while the BBA LL.B (H) course is being run in the college from the Academic year 2014-15. Presently, CPJ School of Law has more than 1000 students enrolled for the 2 courses.

In its continuing endeavor to deliver the best possible education, the School of Law has been organizing various stacademic and allied events that expose the students to practical learning in the legal field. The 1 National Law Festival

of CPJ School of Law– “Loi Fiesta-2016” was held in the college campus w.e.f. April 5-7, 2016 which was attended by leading personalities and luminaries from the field of law and participated by students from Law colleges across India.

National Seminar

Topic: Health Laws in India: Issues & Challenges

Health and well being are deeply personal matters but being on the receiving end of it is what gives us new awareness on various aspects related to health. Every human has a right to highest attainable standard of physical and mental health. This right to health has thus evolved a whole system for protection of health. It ensures that every human has equal access to good quality of services for maintenance of sound health. Indian judiciary has recognized right to health as an indispensable part of right to life under Article 21.

Right to life does not connote merely animal existence rather it has a much wider meaning which includes right to health and medical care being essential for making the life of every person meaningful and purposeful with dignity of person. It is a basic human and fundamental right. Thus right to health was held as an as integral part of right to life and government has constitutional obligations to provide health facilities and medical services. At the same time implementation of right to health has its own highest challenges. Access to healthcare is compromised with poor services, deficient resources, lack of effective policies and legislations and similar hurdles. The role of local authorities thus arises to ensure creation and maintenance of appropriate conditions for protection and promotion of health of citizens. Being a mediatory between government and society as a whole, the local bodies, municipal corporations, health departments, etc. play a vital role in safeguarding right to health of public. Science and technology being synonymous to progress, also have an important role to play in promoting and protecting health of people.

Recent trends like organ transplantation, medical research, patenting, etc have raised many issues of ethics, morality quality, affordability and accessibility. Intellectual Property Rights acts as an incentive to innovators whereas on the other hand, the beneficiaries of technologies feel economically exploited.

The IPR laws, therefore, must strike a balance between these conflicting and competing values. Apart from this, these is a need to have other legislations also to address the ethical, moral and social issues arising out of technological advances and thus we have legislations like The Transplantations of Human Organs Act, 1994; Biomedical Waste Management and Handling Rules, 1998; Drugs and Cosmetics Act, 1940, etc.

Being directly related to the well being of an individual, maintenance of specific standards of nutrition, safe disposal of bio-medical waste, food safety, healthy and pollution free environment form substantial part of healthcare regime in India. The human tendency to exploit the market creates various ethical and moral duties for the healthcare service providers. Hence, a need arises to ensure that there is no exploitation of consumers of medical services.

Thus keeping in mind the broad perspectives of health laws in India, this seminar focuses on intersection between law and health.

Topic: Should Right to Health be Fundamental Right or Not

Debaters have been proven to become leaders and successful professionals. Countless corporate executives, influential lawyers, wealthy entrepreneurs and elected officials credit their debate experience in college with making them successful. The anecdotal evidence is overwhelming and suggests some of the following benefits.

Ÿ Debaters become better critical thinkers and communicators. People begin to see them in a different way.

Ÿ Debaters improve their social interactions. Debaters are not argumentative with their family and friends, but oddly enough, more understanding.

Ÿ Debaters improve their personal expression. There seems to be something in us as human being which wants to express ourselves. Their voices are heard.

Ÿ Debaters are more often seen as leaders. Studies in America show that those who communicate often and well, and give a balance of positive and negative comments, are seen as leaders. Leadership is given, not taken. Debaters are more likely to be given leadership.

Ÿ Debaters tend to become citizens in the real sense of the world - informed, active, participating, a force to be harnessed for the betterment of all.

National Legal Drafting Competition

“Drafting is one of the most intellectually demanding of all lawyering skills. It requires knowledge of the law, the ability to deal with abstract concepts, investigative instincts, an extraordinary degree of prescience, and organizational skills."

Legal drafting is a type of technical writing used by Lawyers, Judges, Legislators and others in law to express legal analysis and legal rights and duties.

Legal writing in practice is used by advocates to express the resolution of a client's legal matter. The creation of legal documents is integral to the practice of law. Litigators draft complaints and other pleadings, interrogatories, and jury instructions. Business lawyers draft articles of incorporation, and contracts ranging from employment of individuals to security of goods. Even criminal lawyers rely on plea agreements, motions in limine, appellate briefs, and writs of habeas corpus in representing their clients. Because of this, drafting skills are essential for every practicing lawyer.

Our National Legal drafting competition aims to provide the opportunity of learning and mastering this art. By this competition, an effort will be made to tap the drafting abilities of the students. In this competition, a legal problem will be given to the participants. The participants will have to draft the document within the stipulated time. These written submissions will then be judged by a panel of judges and marked.

National Client Counseling Competition

The Competition simulates a law office consultation in which two law students, acting as lawyers (attorneys/solicitors/legal practitioners), are presented with a client matter. The students conduct an interview with a person playing the role of the client. Students are expected to elicit the relevant information from the client, explore with the client his or her preferred outcome, outline the nature of the problem, and present the client with a means (or range of alternatives, if appropriate) for resolving the problem. The interview with the client is then followed by a post-consultation period during which the students, in the absence of the client, analyze the interview and discuss the legal and other work to be undertaken. The interview and post-consultation period last a total of 15 minutes. The students are evaluated by a panel of judges, usually composed of two lawyers and a counselor (e.g., social or welfare worker, psychologist, or another person with extensive experience in counseling). The inclusion of a non-lawyer counselor on the judging panel is designed to broaden the interdisciplinary perspectives of the panel both in terms of skills and possible solutions to a problem. The students are evaluated against specific criteria that emphasize the use of listening, questioning, planning, and analytical skills in a lawyer/client interview. Once the judges have completed their evaluation of the interview, the students are called back in and the Judges provide a brief critique of the team's handling of the consultation and post-consultation periods.

RULES FOR NATIONAL SEMINAR

Call for Papers

Quality research papers, including field studies, from scholars, researchers, bar & bench, teachers, NGOs/civil societies and students are invited based on the topics mentioned in the Seminar theme. The list in the sub themes is not exhaustive. Any other contemporary themes related to the main theme are admissible. The papers should be original and unpublished. One or more authors may be included in the paper. The paper must be presented either by the author or co-author.

All papers are subject to scrutiny by an expert committee and selected papers alone are permitted for presentation in the Seminar. Please bring hard and soft copies of the full paper on the day of the seminar. Soft copy of power point presentation should be in CD or in Pen Drives. Only those papers which are accepted by the Editorial Committee will be included in the seminar proceedings.

Kindly send a soft copy in MS word format and hard copy (Font: “Times New Roman”, Size 12 and 1.5 line spacing with normal print margin) of the abstract and full paper not exceeding 8 pages including statistical data, figures and other annexure as per the schedule given below.. At the end of the paper, there should be a brief profile of the author with E-mail ID, contact number and address. Articles received after the stipulated deadline will not be entertained for presentation in the seminar. Further, forward a copy to the following Email id: [email protected]. Selected papers will be published as a book with ISBN number. Certificate for actual participation shall be issued after completion of your presentation. No certificate shall be issued in absentia and there shall be no refund of registration charges at any stage.

1. Eligibility

Ÿ Member of the team must be undergraduate students pursuing recognized Bachelor of Law & B.A.LL.B, BBALL.B (5 year integrated course).

Ÿ Only one team can register from a particular college or Law School for participation in the competition. If more than one team attempts to register for the competition, the team which applies first will be register and all subsequent applications from the same college or Law school will not be registered. In the event to registrations are received from the same college or Law school , the team which submits the Letter by the Head/ Dean of the institution / convener of Moot court committee, authorizing them to participate on behalf of the college or Law School shall be entitled to participate, will be registered.

2. Team Composition

Each team shall consist only of two speakers and one researcher. The team may consist of only two speakers only, as well. The organizers will assign a team code to each team and its members. If a fourth member is brought by the teams, s/he shall not be permitted to sit with or assist the teams during the rounds and would be provided accommodation at his/her own cost. Certification shall not be awarded to the fourth member.

3. Dress Code

The dress code for the competition is formal Moot Court Dress. Men are required to wear a Black suit with white shirt and a black tie. Women are required to wear a white shirt, black trousers/skirt and a black jacket or Salwar Kameez and black jacket. Gowns and bands are not permitted to be worn by the Participants in the Competition.

4. Memorials

Each team is expected to be ready with written briefs and oral arguments to argue for either side of the case. The Court will follow its own procedure within the accepted norms of judicial practice, and in case of doubt or dispute in the matter of procedure or facts, the decision of the presiding member of the Panel of Judges of each Court shall be final. The soft copy of memorial for the Petitioner and Respondent to be sent on Convener's e-mail address i.e. [email protected] on or before 10th March, 2017. Additionally, five hard copies of Memorials for the Petitioner and Respondent shall be submitted at the time of registration on 29-03-2017. The memorials will be handed over to the Panel of Judges for the award of marks. The Memorials shall not contain any information that will reveal the identity of the participating team. The violation of which will attract penalty.

5. Content:Ÿ Memorial dealing with jurisdiction, issues involved in the problem, summary of arguments and

arguments supported by authorities, conclusions and prayers shall be prepared by each team both for the petitioner's side and respondent's side. The body of the Memorial shall not exceed more than 25 typed pages. The cover page, table of contents, index of authorities, jurisdiction, statement of facts, questions presented, and summary of pleadings, title page and back cover are not included in these 25 pages. But these 25 pages will include the pleadings, conclusions, and footnotes. Any issue or pleading,

not discussed within the body of the Memorials shall not be included in any other section of the Memorials.

6. Evaluation

Ÿ The best researcher shall be chosen through researcher test to be conducted in the morning after the formal registration of the teams is duly completed. Team comprising of three members i.e. two speakers and one researcher are eligible for the researcher test and team comprising of two members are not eligible for the researcher test.

Ÿ There shall be a Quorum of judges selected for each court from among a panel of judges constituted for the purpose including eminent Judges, Lawyers, and Law Teachers from all over India.

Ÿ Marks will be awarded to the memorials by the Committee of Judges out of a maximum of 20 marks. Each Court will assign marks for oral arguments to each individual participant and the team. Each individual's marks for oral arguments will be added with memorial marks to make the individual's marks out of 100. Out of 100 marks, the division of marks for each individual participant is as follows:

Marks are awarded on agreed criteria by the Committee of Judges and the factors constituting the criteria shall be such as “EXCELLENT”, “GOOD”, “AVERAGE”, and “POOR”, based on the performance of the participants. The decision of the Committee of Judges shall be final.

The individual prizes will be awarded on the basis of total marks secured by the individual participant in the preliminary round.

7. Oral Rounds

Ÿ The order of the competitions including the days, if any, and the side (petitioner/respondent) for which each team appears will be declared on the basis of taking lots before the commencement of the competition during the briefing session. The entire scheme of the competition thus drawn out will be notified to the participating teams. The Society reserves the right to make any necessary alterations in respect of the side to be taken by the competing teams, in case, it becomes absolutely necessary due to withdrawal of any team/teams at the last minute, or if the competing teams had no opportunity to argue the other side of the problem. The host team, if it gets qualified for the finals, will not be eligible to participate in the finals of the competition.

Ÿ The duration of each Court will not exceed one hour. To be precise each participating team will get 30 minutes including the rebuttals/sur-rebuttal. One speaker must speak not less than 10 minutes.

Ÿ REBUTTAL/SUR-REBUTTAL: The maximum time provided would include the time that each team may want to reserve for their rebuttal/sur-rebuttal. At the commencement of each session the team shall notify the Court Officer as to the division of time between the 2 speakers (including rebuttal/sur-rebuttal). In case any speaker continues to speak after the completion of his/her time, the additional time that was used, will be deducted from the time allocated to his/her co-speaker, or from the time allocated for the rebuttal/sur-rebuttal, as the case may be. The teams can reserve maximum of 5 minutes for the rebuttal/sur-rebuttal. The final decision as to the time structure and the right to rebuttal/sur-rebuttal will vest with the Judges.

Ÿ The language of the Court will be English.

Ÿ During the oral rounds, the team shall not be allowed to use any type of electronic devices such as laptops, mobile phones, tablets etc.

8. Miscellaneous

Ÿ SECRECY OF IDENTITY: During the course of the Oral Submissions, the speaker shall neither reveal his/her identity nor the identity of their College/University by any means whatsoever. Such actions on part of any member of the team will lead to disqualification of the team from the competition.

Ÿ SCOUTING: Scouting is strictly prohibited. Teams found scouting will be disqualified immediately.

Ÿ APPEAL COMMITTEE: In case of complaints/disputes, the same shall be submitted to the Appellate committee, which shall consist of Prof. Dinesh Babu, the Vice Principal of CPJHS & SOL as its Convener and the Co-convener of the event and the decision of the Appellate committee shall be final.

Ÿ There will be a briefing session for all the participants on 29th March, 2017 (Wednesday) followed by a draw of lots & exchange of memorials after the inaugural function.

9. Dress Code & Discipline

Ÿ Dress code shall be as prescribed by the Bar council of India for Advocates , except gowns

Ÿ Participants are expected to follow the discipline while in campus and accommodation provided by the organizers.

Incidents of eve –teasing or any kind of misbehavior will be taken cognizance of with the help of police, and the teams will be disqualified from further participations.

10. Moot Problem

Dr. Rohit Sharma, after completing his graduation and post graduation in medicine, started working as an Assistant Professor at ABC Medical College in Delhi. He joined the college on 28-1-2016. Dr. Rohit Sharma was very happy with his job. One of his friends Tammana who did MBBS with him joined the ABC Medical College, Delhi on 28-4-2016. Both of them were happily enjoying their professional life during which they fell in love with each other and decided to marry each other. Both of them took the consent from their parents and they agreed for their marriage. Their marriage solemnized on 8-8-2016. They were enjoying their married life happily.

After two months, Tamanna got pregnant. In the eighth month of her pregnancy, one day she was not feeling well. She suggested Rohit to go to college; while she would take rest as she was not feeling well. She was having stomach ache. Due to illness, she took 1 dose of pain killer. Even after 2 hours of taking that medicine, she was not feeling well so she took another dose of pain killer.

Immediately after that, she developed other problems like vomiting, weakness, stomach pain, etc. When she realized that the situation is out of control, she called up Rohit. He suggested her to call the ambulance and that he would be reaching to the hospital directly. She called the ambulance and was admitted to BRB hospital Delhi, which was a well known hospital of Delhi. She was straight away admitted in the ICU. Staff of the hospital took proper care of Tamanna. After midnight, she was shifted to the operation theatre (hereinafter referred as OT) for her delivery. Mr Rohit Sharma gave the consent and filled the consent form. No senior doctor was available at that time as the doctor on duty, Dr. Sanjay Vashisht, was occupied in the delivery of another critical patient, which also required the supervision of a Senior Doctor. However, the Junior Resident doctor, named Dr. Ronak Singh, examined her and prescribed one injection. The injection was to be injected just before the operation. Rohit hurriedly ran and went to the medical shop for buying the medicine. Rohit was under a lot of stress and tension. At the cash counter the injection got exchanged with some other person. Rohit gave that medicine to Dr. Ronak Singh, who was in a hurry for operating the pregnant lady on urgent basis. So, after giving it a passing glance once, he directed an Intern Doctor, who was undergoing his internship and research training under him, named Vakul Khosla, to give that injection to Tamanna. However, that was not the particular injection which

was to be given. It was immediately observed by Dr. Ronak Singh that the dosage given to the patient was very high and incorrect due to which the CTG machine showed that the heart rate of the child started sinking (80/min.). At the very moment, the Senior Doctor, Mr. Sanjay Vashisht arrived at the OT. Thereafter the Senior Doctor directed to conduct emergency caesrean (LSCS) at 2:00 AM and at 3:0 AM a female dead baby was delivered by LSCS.

Mr Rohit filed a suit for compensation against the BRB hospital for the negligence of the doctor and for the damage caused to the health of Tamanna because of the wrong dosage given to her.

RULES FOR NATIONAL DEBATE COMPETITION

1. The topic for National Debate Competition is “Should Right to Health be Fundamental Right or not”

2. Each team shall be presented by two students. One shall speak for the motion and the other against the motion.

3. Each Participant shall be given maximum five (5) minutes to speak. The warning bell shall sound after four minutes and final bell after five minutes.

4. The participants may speak either in English or in Hindi.

5. The participants with written speech are liable to be disqualified.

RULES FOR NATIONAL LEGAL DRAFTING COMPETITION

Primarily, drafting is a very important aspect of the legal profession. This competition will test the participant's use of legal language in drafting of legal document.

The following are the rules for the National Legal Drafting Competition, 2017:

1. Students pursuing B.A.LL.B.(Hons.)/BBA. LL.B. (Hons.) and LL.B course from any recognized university are eligible to participate in the competition.

2. A team may comprise of a maximum of two members. However, only one entry is allowed per student.

3. The drafting competition shall consist of only one round.

4. The participants shall be given one common problem on the said topic.

5. Drafting problem will be given on the spot and 30 minutes shall be given to the participants to plan the draft and one hour to draft the document.

6. After completion of 30 minutes, only one Writing sheet for draft will be provided to one team. However, the Participants can ask for extra sheets only in case of need.

7. The Draft must be in English Language only.

8. The Draft shall consist of 1000-1500 words.

9. On basis of the drafting skill, as judged by the judges, the 'winner' and 'runner up' will be declared. The participants will be judged on the following parameters:

Ÿ LanguageŸ Brevity of the documentŸ Understanding of facts Ÿ Understanding of law Ÿ Identification of issues and creativity Ÿ Structure/coherence

10. The participants are free to add certain clauses in their legal documents as they deem fit, provided that the clauses so added, do not defeat, contradict or nullify the intention of the problem given.

11. The decision of the judges shall be final and binding on all participants. 12. Use of Mobile phones or any other electronic devices is prohibited and if any of the participants is found

carrying or using the above mentioned prohibited devices, he/she is liable to be disqualified.

13. The participants shall use only their team codes as identification and if any other identification marks is used, such team is liable to be disqualified.

14. CPJCHS & SOL reserves the right to change any rules without any notice.

15. The decision of CPJCHS & SOL with regard to the competition, eligibility, submissions, selection criteria, results, or any other matter shall be final and binding.

RULES FOR NATIONAL CLIENT COUNSELING COMPETITION

1. A team may comprise of two members.

2. All the problems will be based on the subjects of Family Law, Cyber Law, Health Law, Corporate Law, Indian Penal Code, and Law of Torts.

3. There will be one round. Each team will get one opportunity to represent them in the completion. Each team will get a total of 15 minutes. The following 15 minutes are to be divided in two parts, as follows:

Ÿ First 10 minutes is termed as “Client Consultation period”. The participants are expected to extract the relevant information, make an outline of the problem and make legal suggestions for its resolution.

Ÿ Next 5 minutes is termed as “Post Interview period”. The participants shall discuss the interview with the judges. The judges may question the teams during this period.

4. It is on the discretion of the teams to decide, “How will they share the work?”

5. The winning team will be awarded the Loi Fiesta National Client Counselling Competition, 2017 Trophy and other prizes. The first runners-up will also be awarded a trophy and other prizes.

6. Each group will be judged by a panel of one or two judges. Each panel of judges may be from among the following categories: Practicing Lawyers, Academicians, Judges, Counsellors, and Psychologists.

7. The participating teams shall never indulge in any form of conversation with any other client, except the one provided to them during of the round. Such a conversation will be considered as misconduct and the teams so interacting shall be disqualified.

8. If a tie persists, the team scoring the higher marks as according to the Point 5 of Judging Standard will be entitled to the title of the winner. If a tie still persists, the marks of the tied teams will be compared with respect to the following Points in the Judging Standards, until either of the team come out as a clear winner:

Ÿ Point 4, if still a tie, then Ÿ Point 3, if still a tie, then Ÿ Point 7, if still a tie, then

Post Consultation Session with the Judges.

Format

1. Each team shall consist of two student participants and would be allotted a room for the interview and counseling. Here, the two student participants will present themselves as advocates in a lawyer's chamber. The client will be a person trained by the organizers and the advocates will counsel the clients regarding the given problem. The two participants are required to elicit all relevant information from the client by interviewing or questioning the client and then counsel the client.

2. All teams will be given their team codes (as, T1, T2, T3 etc.) by the organizers through e-mail to their respective e-mail IDs.

3. The Competition consists of one round.

4. The highest scoring team among all the teams will be titled as the Winner of Loi Fiesta 2017 National Client Counseling Competition.

5. The Consultation Period (Interview Period) All teams will go through a 15 minutes session. The first 10 minutes are devoted for consultation with the

client during which lawyers are expected to elicit the relevant information, outline the problem and propose a solution or other means of resolving the problem (Further information is contained in the Judging Standards for the Client Counseling Competition.) During the consultation and post-consultation, the team may use books, notes and other materials. The team may also use office props (Dictaphones, Files, desktop, furnishings, bookshelves etc.) and any other material to furnish their consultation room.

6. Post Consultation Period (Post Interview Period) During the post-consultation period, the students may either talk to each other loudly enough to be

overheard by the judges, or dictate a file memorandum on the interview, or both. The concept behind the post-consultation period is to summarize the interview, indicate the scope of the legal work to be undertaken, and state the legal issues that should be researched. Explanation of the position or attitude taken by the students may be useful. Judges may question the teams during the post consultation period.

7. If the students feel that some documents are appropriate, like a letter to the client confirming their retention as attorneys, the fee arrangement etc, or a letter to opposing counsel or to the party with whom the client is having their legal problems, they may dictate such a document at the post consultation stage.

8. The Judges may penalize students who allow the interview session to run excessively beyond the 10 minute period allotted in the rules. However the judges in their discretion, taking into account the circumstances, may allow some more time beyond the 10 minute period for the interview session. If the extended consultation session allowed an opportunity for a team to gather more information than other teams, this circumstance should be taken into consideration by the judges in making their decision. Judges should stop students after 15 minutes regardless of whether the students are in the consultation or post-consultation process.

Judging Standards

1. Establishing the working atmosphere: The lawyers established the beginning of an effective professional relationship and working atmosphere and at an appropriate point oriented the client to the special nature of the relationship (confidentiality, duration and plan of interview, methods of contact, explanation of fees and responding to client's concerns, mutual obligations and rights, after hours availability, complaints procedure etc.) in a courteous, sensitive and professional manner.

2. Listening to the problem: The lawyers learnt how the client viewed his or her situation, using a combination of listening and questioning, drawing out both information and feelings, as appropriate, to develop a reasonably complete and reliable description of the problem and reflecting this understanding to the client. In this regard relevant information voluntarily said by the client could be elicited by asking relevant specific questions.

3. Identification of client's goals, expectations and requirements: The lawyers learned the client's goals and initial expectations and modified or developed them as necessary, giving attention in doing so to all aspects of the problem, including the emotional ones.

4. Problems Analysis: The lawyers analyzed the client's problem with creativity and from both legal and non-legal perspectives, resulting in a clear and useful formulation of the problem by asking relevant specific questions.

5. Legal analysis, alternative courses of action and the giving of advice: Legal analysis and the consequent legal advice given should be both accurate and appropriate to the situation and its context. Consistent with the analysis of the client's problem develops a set of potential and feasible alternatives, if any, both legal and non-legal.

6. Effective conclusion: The lawyers concluded the interview skillfully, and left the client with feeling of reasonable confidence and understanding, with appropriate reassurance, and with a clear sense of specific expectations and mutual obligations to follow.

7. Team work: The lawyers as collaborating counsellors, worked together as a team, with flexibility and an appropriate balance of participation.

8. Continued an ethical and professional relationship throughout the interview: The lawyers recognized, clarified and responded to any moral or ethical issues which may have arisen, without being prejudicial in judgments. The lawyers developed an appropriate balance in dealing with the legal and emotional needs of the client.

9. Debriefing (Post interview Reflection): The lawyers, during the post consultation time, gave evidence of having recognized their own and the client's feelings; the strengths and limitations of their interviewing skills; their handling of the substantive aspects of the client's problems (both legal and non-legal); the quality and appropriateness of their Advice and provided for an effective follow-up. Judges should expect to see evidence of students learning through making this reflection on the experience of the interview

Call for Papers

Guidelines for Submission of Articles in CPJ Law Journal [Vol. VII, July 2017]

The CPJ Law Journal requests the contribution comply with the following guidelines:

Submissions

The Journal is accepting contributions for Articles, Essays, Notes and Comments (Case Comments, Book Comments, Legislative Comments, Policy Comments and Scholarship Comments). Contributions should be sent by post along with CD (RW) of the same in MS word and also by E-mail id.

Covering Letter

All submissions must be accompanied by a covering letter stating the title, author's full name, designation, institute they belong and postal address and the author's contact details. Only the covering letter should contain the above mentioned details and not the manuscript.

Manuscript

Ÿ Main Text – Times New Roman, font size 10, 1.15 spacing, justified, with a margin left 1.5 inch and right 1.0 inch, top 1.0 inch and bottom 1.0 inch.

Ÿ Foot Notes – Times New Roman, font size 8. Substantive foot notes are accepted.

Ÿ Citation – The standard ISI method of reference would be maintained.

All the contributions should be the original work of the contributors and should not have been submitted for consideration in any other Journal. The author would be liable for any type of plagiarism.
