McAllister & Quinn Federal UpdateHEROES Act (4th Stimulus Package)

• The House of Representatives passed the $3 trillion HEROES Act stimulus package on Friday, May 15th.

– Next Steps: To be taken up in the Senate, requires Senate passage, then requires the President’s signature.

• $3 trillion stimulus package is a non-starter for Senate Republicans. Bipartisan support for state and local government aid. Expect the House version of the HEROES Act to change dramatically.

• Senate Republicans and Trump Administration “red-line” on liability protection for businesses. Still no draft Senate legislation addressing this.

• Expect a delay – Senator McConnell has stated that the Senate will not take up 4th stimulus package until after July 4th. Likely late-July time period.

PPP Loan Forgiveness Legislative Changes –Payroll Protection Flexibility Act

• Payroll Protection Flexibility Act has been signed into law, making the loan forgiveness modifications in effect.

• Reminder on PPP Loan Forgiveness changes:

– Existing PPP borrowers can choose to extend the eight-week period to 24 weeks, or they can keep the original eight-week period.

– The payroll costs expenditure requirement drops to 60% from 75%

– Borrowers now have five years to repay the loan instead of two. The interest rate remains at 1%.

– Borrowers can use the 24-week period to restore their workforce levels and wages to the pre-pandemic levels required for full forgiveness. This must be done by Dec. 31, a change from the previous deadline of June 30.

– Deferral period on loan has been changed from six months to the time that the forgiveness amount is received by the borrower.

Federal Reserve’s Main Street Lending ProgramNew Changes/Guidance

• Main Street Lending Program is an additional loan program option for small and medium-sized businesses. Eligible for firms up to 15,000 employees. Detailed information has been covered in past CCAT webinars (see CCAT website).

• Minimum loan amounts available have been reduced (from 500k to $250k) and maximum loan amounts increased for all loans (max for new loans now $35M).

• Maturity date of all loans extended to five years with no principal payments until the end of year three.

• Lender risk retention reduced from 15% to 5%, allowing greater access for companies with high debt loads.

• Program has been plagued by delays, should be up and running soon.
