The primary changes made to the previous July 2016 version of this document are as follows:

1. PURPOSE OF DOCUMENT

This document is intended as a supplemental guide to the CBP Customs and Trade Automated Interface Requirements (CATAIR), PGA Message Set chapter (also referred to as an implementation guide). That PGA CATAIR chapter outlines the overall data relationships and rules for data submission on a CBP system level.

REMINDERS: The PGA Message Set does not stand alone and must be submitted with an entry filing such as an ACE Entry for Cargo Release or ACE Entry Summary certified for cargo release. There are times when a PGA and CBP may need the same data. In those instances, the PGA will not ask for the data to be provided again in the PGA Message Set, if it is already being asked for by CBP. That is, the PGA Message Set data requirements for an agency will not duplicate those common data elements. Instead, the PGA Message Set is used to provide the additional data needed for a PGAs purpose.

2. OVERVIEW OF AMS PROGRAMS

The Agricultural Marketing Service (AMS) of the United States Department of Agriculture (USDA) administers three programs that relate to import product entry and release into the United States. These programs generally relate to agricultural products such as fruits, vegetables, specialty crops, shell eggs and peanuts. The programs are:

1. USDA-AMS Marketing Order Quality Inspection Compliance (MO) 2. USDA-AMS Imported Egg Inspection (EG) 3. USDA-AMS Minimum Quality Standards For Imported Peanuts (PN)

3. AMS-MO PROGRAM: MARKETING ORDER QUALITY INSPECTION COMPLIANCE

3.1. AMS-MO PROGRAM DESCRIPTION

Certain imported fruits, vegetables, and specialty crops are subject to quality inspections or aflatoxin testing in accordance with Federal marketing orders and agreements. These inspections and testing ensure that imported products meet the same quality requirements that domestically produced products meet during periods that quality requirements are in effect.

3.1.2. Program Restrictions:

Certain fruit, vegetable, and specialty crop products imported into the US are only subject to marketing order quality requirements when the same or comparable requirements are in effect for the same domestic market products. Generally, quality requirements are in effect year-round, but for three commodities – oranges, table grapes, and tomatoes – the period when requirements are in effect are as indicated below. The MO7 message set is used to indicate seasonal exemptions.

Fresh or processed fruit or vegetable product, or specialty crop product subject to marketing order quality requirements that is intended for exempt purposes and an Importer’s Exempt Commodity permit (FV-6) has already been issued for this shipment by AMS and is being used to request admittance. Pearl onions and onion sets are exempted from quality requirements but must be inspected for size and be accompanied by an FV-6.

Fresh or processed fruit, vegetable, or specialty crop product subject to marketing order quality requirements that is intended for an exempt outlet at import or may be exempt from inspection requirements but an exemption form is required; importer requests that AMS issue an Importer’s Exempt Commodity Permit (FV-6) for this shipment. Pearl onions and onion sets are exempted from quality requirements but must be inspected for size and be accompanied by an FV-6.

CASE 5: Request Aflatoxin Testing of Pistachios by AMS

Pistachios subject to marketing order quality requirements that are intended for human consumption; importer requests that AMS draw samples for aflatoxin testing by USDA lab or USDA-accredited lab upon arrival.

3.2. AMS-MO1 MESSAGE – REQUEST FOR MARKETING ORDER INSPECTION

3.2.1. When to Use the MO1 Message Set

Use this message set when importing fresh or processed fruit, vegetable or specialty crop products subject to marketing order quality inspection that have not been previously inspected for compliance and are to be sold to consumers.

NOTE: Entries using this message set SHOULD be filed at least 48 hours before the time that the product is first available for inspection to allow time for the scheduling of inspection personnel. Entries with this message set filed after that time may delay product inspections and shipment movement.

3.2.2. MO1 Example Description

Fresh kiwifruit in cartons are imported at a time when marketing order quality inspection requirements are in effect. The importer is notifying AMS that the product needs to be inspected, who the applicant is that will pay for the inspection, where the product will be located, and who the contacts are for arranging the inspection.

In the example, 27,000 pounds of fresh kiwifruit of the variety ‘Hayward’ are being imported and are subject to inspection for quality requirements. There are 1,000 27-pound cartons of 60-count product.

3.2.3. Records Used in the MO1 Message Set

PG Record Description

PG01 Designates AMS as the recipient, provides the AMS program message code (MO1), provides the product’s global trade item number (10123450000637), and provides the intended use code for products intended for consumer use as a human food (230.000).

PG02 Designates information is provided at the Product level (P), provides the required UNSPSC global classification code for Hayward kiwifruit (50303904). See Appendix A for UNSPSC codes.

PG10 Provides the commercial description of the product.

PG19 Provides the company name and address of the applicant requesting inspection (AP1), and the address location of the product after entry is released by CBP but before the product enters the supply chain (LG).

PG 20 Continues the address of the locations above.

PG 21 Provides the name and contact information for the applicant (AP1), the person at the inspection site (GC), the importer of record (IM), and the customs broker (CB). These are the people that USDA will contact with any questions concerning the inspection.

PG26

Provides the packaging information for the product from the outermost unit to the innermost. PG26 at level 1 (PG261) represents the total number of cartons with 2 decimal places (1000.00 cartons); and PG26 at level 2 (PG262) represents the count (size) of product in each carton (the smallest container) with 2 decimal places (60.00 items per carton).

PG29 Provides the net weight of the product with two decimal places (27,000.00 pounds).

PG30

Provides AMS with the request for an inspection of the product using the date qualifier “I” and the date (11252012) and time (1300) that the product is expected to be available for inspection at the inspection site. All product to be presented for inspection at the same time must have the same date, time, and inspection location. Optionally, a 50-character text remark can be provided to supplement information provided in PG 19 and PG20. A second PG30 provides the estimated date of arrival using the date qualifier “A”. Time is not required with the date of arrival.

3.7.1. When to Use the MO6 Message Set

Certain varieties or types of fresh or processed fruit, vegetable or specialty crop products have been designated as not subject to marketing order quality inspection. Quantities of products under an HTS entry line item that are identified by the filer as one of these exempt varieties or types will be considered to be exempt from the quality requirements of the MO program.

The types and varieties that are not subject to MO requirements are listed in Appendix A. Types and varieties that are subject to MO requirements are listed in Appendix B.

Note: The code lists in Appendix A and B are under regular review and some newer variety codes may need to be added. Please contact the MO program at [email protected] for assistance with varieties not listed.

3.7.2. MO6 Example Description

Fresh wine grapes are imported at a time when marketing order quality inspection requirements are in effect for table grapes. The importer is notifying AMS that although products generally imported under the fresh table grape HTS code are subject to MO quality requirements, the table grapes in this entry are wine grapes of the Tokay variety and not subject to program requirements.

When certain products are imported in amounts less than minimum weights established by regulation, they are not subject to marketing order quality requirements. When the importer believes that the products are at or below the minimum weights and therefore are not subject to inspection, the MO8 message set must be filed with AMS for that entry line. 4. AMS-EG PROGRAM: IMPORT EGG INSPECTION

4.1. AMS-EG PROGRAM DESCRIPTION

Poultry eggs in the shell may be imported into the US for table egg use, as hatching eggs, or as eggs intended for breaking at an official egg products processing plant (i.e., breaking stock). Imported table eggs must be inspected by AMS for compliance with quality, temperature, and container and package labeling requirements before entering the supply chain. Admissible poultry hatching eggs (chicken, duck, turkey, guinea, or goose) may be inspected by AMS at the point of entry to examine labeling and import documents. Additionally, AMS will confirm the use of the eggs at the destination hatchery. Imported breaking stock eggs will either be inspected by FSIS personnel at the breaking facility or at port of entry by AMS to verify labeling, temperature, documentation, and that seals are intact. Results of these inspections will be relayed to AMS headquarters for final release of the load. De-characterized inedible egg products (egg out of the shell) not for human food may also be imported and also require inspection by AMS before released into commerce.

USDA-AMS inspection and processing can be requested electronically at the time the entry is filed using the guidance below, or optionally, the importer can submit a hard-copy request in advance to USDA-AMS using Form LPS-222 and reference that approval number at the time the entry is filed.

Only eggs meeting the animal health requirements produced in a country recognized by the USDA Animal and Plant Health Inspection Service (APHIS) are eligible for import to the United States. Additionally, a foreign government certificate is required declaring compliance with APHIS animal health requirements, , and verification that the shell eggs have been stored and transported at an ambient temperature not exceeding 45 degrees Fahrenheit (7.2 degrees Centigrade) as stated in the Inspection of Eggs and Egg Products promulgated under the authority of the USDA Food Safety and Inspection Service. Table eggs and breaking stock eggs are subject to the provisions in the FDA Egg Safety Rule regarding refrigeration of the eggs no later than 36 hours after the eggs are laid.

4.2.1. When to Use the EG1 Message Set

Use when importing shell eggs, either in the form of table eggs, breaking stock, hatching eggs, or de-characterized inedible liquid, frozen, or powdered eggs out of the shell.

NOTE: Entries using this message set SHOULD be filed at least 48 hours before the shipment arrives at the US border to allow time for inspection arrangements. Entries with this message set filed after that time may delay product inspections and shipment movement.

NOTE: A digital copy of the recognized foreign government agency’s inspection document MUST be uploaded to the ACE Document Image System with the associated entry number at least 48 hours before the shipment arrives at the US border.

NOTE: When a PGA message set is sent to AMS under program EG1, a PGA message set should also be sent to FSIS, APHIS, FDA, and the Fish and Wildlife (FW) Service.

4.2.2. EG1 Example Description

Two examples are provided; one for an entry with in-shell table eggs and de-characterized inedible frozen egg, and one for an entry with hatching eggs. Table eggs and de-characterized inedible egg product require USDA inspection so the importer is notifying AMS where the product is located, identifying the inspection location contacts, and requesting the product be

inspected by USDA prior to release for distribution in commerce. Hatching eggs require AMS to confirm receipt and use with the consignee.

The example shows an entry for in-shell large size table eggs in 6-egg consumer cartons in 900 cases, frozen, de-characterized inedible egg product in 76 100-pound drum containers, and hatching eggs on flats in 92 cases.

4.2.3. Records Used in the EG1 Message Set

The “Y” at position 17 indicates that a digital copy of the inspection document tagged with the entry number has been or will be provided electronically to the ACE Document Image System.

Designates information is provided at the Product level (P), and provides the global classification code of the table egg and breaking stock eggs (UNS 50131612), and de-characterized inedible egg product (UNS 50131630). Hatching eggs have not been assigned a UNSPSC code. See Section 5.3 below for other egg UNSPSC codes.

PG10 Provides the commercial description of the product. PG19 Provides the name and address of the applicant (APP) or location of the product (LG). PG20 Provides additional address information for the applicant or location above.

PG55 Identifies that the applicant’s address in the preceding PG19 and 20 records is also the location of the goods immediately after entry (LG).

PG21 Provides contact Information including name, telephone number and email address for the inspection site contact (GC) and importer (IM).

PG26

Provides the packaging information for the product with two decimal places. In the case of the table eggs (PG01001), PG26 at level 1 (PG261) represents the total cases in the invoice line (900.00 cases), the PG26 at level 2 (PG262) represents the total number of cartons in a case (30.00 cartons per case), and the PG26 at level 3 (PG262) represents the amount of product in the smallest container, the carton (6.00 eggs per carton). In the second line for the de-characterized frozen egg product (PG01002), the PG26 at level 1 (PG261) represents the total number of drums (76.00 drums), and the PG26 at level 2 (PG262) represents the weight of product in each drum (100.00 pounds).

PG29 Provides the total number of table eggs shipped in dozens (13500.00 DOZ), and the total weight of frozen egg product in pounds (7600.00 LB), each with two decimal places.

A hard-copy LPS-222 has been previously submitted by the importer and approved by USDA-AMS to arrange for the inspection or other processing of the table eggs, hatching eggs, breaking stock, or de-characterized inedible egg in an entry. The importer provides an LPS-222 permit number issued in advance by AMS as evidence of this approval at the time the entry is filed.

NOTE: A digital copy of the recognized foreign government agency’s inspection document MUST be provided in hard copy to USDA-AMS or may be uploaded to the ACE Document Image System with the associated entry number at least 48 hours before the shipment arrives at the US border.

The example shows an entry for 2,760 dozen of hatching eggs on flats in 92 cases.

NOTE: Entries using this message set SHOULD be filed at least 48 hours before the time that the product is first available for inspection to allow time for the scheduling of inspection personnel. Entries with this message set filed after that time may delay product inspections and shipment movement.

5.2.2. PN1 Example Description

Shelled peanuts are being imported for human consumption. The importer is notifying AMS that the product needs to be inspected for grade and sampled for aflatoxin and is providing the name of the applicant that will pay for the inspection, the location of the product for inspection and sampling, and the contacts are for arranging access to the product upon arrival.

In the example, 40 2000-pound nylon bags of shelled Virginia type peanuts from the 2014 crop year are being imported and are subject to inspection for quality requirements and sampling for aflatoxin. The product is to be graded against the minimum edible quality standards of 7 CFR part 996 or a US Grade which is of higher quality.

PG27 Provides information about the container(s) that the product is shipped in, including the type of container (2 = Not refrigerated), the length in feet (20), and the container numbers (PHGU2001135, CHAU1020617).

PG29 Provides the net weight of the product with two decimal places (80,000.00 pounds).

PG30

Provides AMS with the request for an inspection of the product using the date qualifier “I” and the date (07282015) and time (1300) that the product is expected to be available for inspection at the inspection site. All product to be presented for inspection at the same time must have the same date, time, and inspection location. Optionally, a 50-character text remark can be provided to supplement information provided in PG 19 and PG20. Estimated date of arrival is not required when requesting inspection of imported peanuts.

APPENDIX A – VARIETIES AND TYPES NOT SUBJECT TO MO INSPECTION

The following list provides United Nations Standard Product and Service Codes (UNSPSC) commodity codes for the varieties and types NOT subject to Marketing Order quality requirements. These varieties or types DO NOT require inspection for marketing order compliance by USDA at any time of the year. When one of these products is being imported, the importer should file an MO6 message and place the appropriate UNSPSC code in the PG02 record to indicate the product is not subject to program requirements.
