TO DISTRIBUTOR:

The various parts groups involved in this equ ipment are arranged in this manual in alphabetical order. Each alphabetical

parts group is page numbered separately with the page numbers prefixed by the alphabetical letter designated for that

group, i . e. , Al, B2, C3, etc. Following the alphab et ical and page n umb er designat ion, and separated therefrom by a

hyphe n ( - ), is the p age v ers ion num ber, i . e., Al - 1, B1 - 2, C3 - 3, etc.

This designation indicates the revision numbers to incorporate design changes in the equipment covered by that page.

Groups A thru G inc lude al l i tems furnished as standard equipm ent at date of this publ icat ion. Al l opt ional and

accessory items are listed under group H .

The page numbers are on right upper corner of pages with parts l ists (R.H. pages) and the serail numbers of machines

covered by this page are on r ight be low corner. The last machine ser ia l number covered by page must be n oted by the

distr ibutor, as soon as a new page is received indicating the first machine serial numbe r changed.

CLARK warrants each new Construction Machinery Group product, including attachments

and accessories thereto. sold by it to be merchantable and free from defects in material and

workmanship .

CLARK will cause any part of a CLARK product covered by this warranty (except as excluded

below) which proves to be defective in material or workmanship during six (6) months im-

mediately following the delivery of said product to the person who first puts it into use, to be

replaced without charge with a new or repaired part (whichever CLARK elects). CLARK also

will cause the labor to remove any such defective part and to install the new or repaired part

to be provided without charge to the owner of said CLARK product. The parts and labor to

meet this warranty will be furnished by a CLARK distributor designated by CLARK.

CLARK'S warranty

does not cover

(i) the replacement of parts found to have been damaged

by abuse, accident or a failure to maintain or use the CLARK product or part according to the

in s t r uct io n s a p p l i ca b le t o i t , ( i i) t he la bo r t o r e m o v e a n d r e in s t a l l a de fe ct iv e r e p la ce m e n t p a r t

after the expiration of the warranty period applicable to the product in which such part is

located. (iii) overtime labor premiums, (iv) transportation of the CLARK product to the

distributor's service facility or transportation of the distributor's service men to the product's

l oc at i on , (v) the en g i ne or th e t ires of any C LAR K prod uc t , nor d oes i t c over th e c ar r i e r on an y

truck mounted hydraulic cranes. The warranty of the respective manufacturers of these com-

ponents shall apply to said items unless said manufacturers make no warranty with respect

to said items, in which event CLARK'S warranty shall apply.

The Buyer accepts this warranty and the limitations of liability and disclaimers set forth

herein as part of the purchase of the CLARK product or part to which this warranty applies.

THIS WARRANTY IS EXCLUSIVE AND IS IN LIEU OF ALL OTHER WARRANTIES EX-

PRESSED OR IMPLIED AND THERE IS NO IMPLIED WARRANTY OF MERCHANTABILITY OR

FITNESS FOR A PARTICULAR PURPOSE.

Remedies available to any person claiming under this warranty are exclusive and expressly

limited to obtaining the parts and the labor, where applicable, in accordance with terms of

this warran ty.

CLARK'S liability for lostes, damages or expenses of any kind arising from its design.

manufacture or sale of the products or parts covered by this warranty whether based on con-

tract, tort or otherwise, including liability arising from a breach of this

warranty, is limited.

unless otherwise prohibited by law, to an amount not exceeding the cost of ,performing the

obligations contained in this warranty according to its terms, and in no event shall CLARK'S

liability exceed the value of the CLARK product giving rise to such liability.

CLARK disclaims all liability for loss, damage or expense attributable to a loss of use of the

CLARK product, a loss or damage to property other than the CLARK product, a loss of profits

or other commercial loss, or any special or consequential damages (except liability for conse-

quential damages which by law may not be disclaimed).

The term CLARK means Clark Equipment Company or one of its subsidianes. whichever last sold the product to which tnis warrann, applies

The term Construction Machinery Group products refers to machines of the following types Wheel loaders wheel dozers, scrapers. log skid

tiers. lOg loaders. motor graders. hydraulic cranes. cable cranes. excavators. and power snovels. Not included are lift trucks. straddle car

nail. skid steer loaders. agricultural products or other products sold by CLARK'S Material Handling Group or the General Products Group,

corn a primeira e no seu prOprio interesse, garante ao Com prador pelo prazo de 6 (leis) meses a par-

t ir da data de entrega do produto, todas as pegas de cada produto novo Clark que, sob condigOes

normais de use e m anutencao , apresentarem d efe ito de fabricagao ou de mater ia l, dev idamente

comprovado pelo D istribuidor, e aceito por EC LA.

A presente garantia nao abra nge pneus, cam aras de ar, baterias, mo tores de partida, alternadores,

reguladores de voltagem, bom bas e bicos injetores diesel, pegas, pertences ou acessorios que nao

sejam fabricados pela Clark, que sao garantidos diretamente p or seus fabricantes. E ainda, pegas

substituidas em decorrencia de rn anutencao n ormal, com o: elementos fi l trantes , correias , velas ,

condensadores, platinados, lampadas, escovas, pastilhas e Jonas de freio, etc...

A obrigaglo do Distribuidor Clark, nos termos desta garantia, consiste na substituigao gratuita de

pegas que sejam por ele (Distribuidor) reconhecidas como defeituosas.

A garantia sera nula para todo produto C lark que tenha sido submetido a sobrecarga, abuso, ne-

gligencia ou acidente e no qua l tenham sido usadas pegas de reposigao nao fornecidas pela Clark ou

que tenha sofrido alteracaes ou consertos por pessoas nao pertencentes a Red e de Distribuidores

Clark e qu e, a seu juizo exclusivo, afetem a seguranca, estabil idade e desemp enho para as quail

tenha sido fabricado ou, ainda, se

. :o produto objeto da presente nao for colocado em use dentro de

ma l, como: reapertos, l impeza , lavagem, verificacOes, regulagens, ajustes, etc.. . Para todos os efei-

tos, a garantia, wino definido acima, sera prestada nas oficinas dos Distribuidores Clark ou na fa-
