(Significant Deviation) Staff Recommendation: Denial Background: The proposed site is located south of Camp Bowie Boulevard and west of Bernie Anderson Road. The applicant is requesting to rezone the property to PD/CB-RUS Planned Development for all uses in the Camp Bowie/Ridglea Urban Village Core South zone plus a gambling/card house entertainment facility; site plan waiver requested. Gambling activities are allowed by PD only within the city. The activity of gambling is regulated per the state Penal Code, Title 10. Offenses Against Public Health, Safety, and Morals, Chapter 47. The determination of gambling is based on business operations and payouts. At the Zoning Commission, the applicant explained that they hope to operate a 12,000 sf business on the second floor of a commercial structure that was formerly occupied by Tuesday Morning. Hours are intended to end at midnight, and the applicant explained that 2 am or 24 hours could be an option. The business does not intend to sell alcohol but will operate as BYOB. Site Information:

1. Land Use Compatibility The applicant is proposing a zoning change from to PD/CB-RUS Planned Development/Camp Bowie District plus gambling card house facility. Surrounding land uses consist of commercial strip centers to the north and east, single-family to the south and commercial to the west. The proposed zoning request is not compatible with surrounding land uses.
2. Comprehensive Plan Consistency
The 2018 Comprehensive Plan designates the site as being within the Camp Bowie Mixed-Use Corridor. The proposed zoning is not consistent with the following Comprehensive Plan policies:
• Separate incompatible land uses with buffers or transitional uses. Some land uses have attributes such as height, proportion, scale, operational characteristics, traffic generated, or appearance that may not be compatible with the attributes of other uses.
Based on the lack of conformance with the future land use map and policy as stated above, the proposed zoning is not consistent (Significant Deviation) with the Comprehensive Plan.
