DEFINITIONS

A.Association:Theterm“Association”asusedhereinshallmeantheGeneralandConcreteContractorsAssociation,Inc.AlistofmembersissetforthinSchedule“B”oranysupple-mentsthereto.

B.Employer:Theterm“Employer”asusedhereinshallmeananycontractor, individual,partnership,firmorcorporationsignatory, orwho becomes signatory, to this LaborAgree-ment.

C.Union:Theterm“Union”asusedhereinshallmeanthePacific Northwest Regional Council of Carpenters of theUnitedBrotherhood ofCarpenters and Joiners ofAmerica,actingforalloftheirLocalUnions,assetforthonSchedule“C”attachedhereto.

D . GeneralForeman:Theterm“GeneralForeman”shallbedefinedasaforemanwithacurrentOSHA30Certificatethatsupervisesmorethanoneforemanledcrewandshallreceive10%overJourneymanRate .

E . Foreman:Theterm“Foreman”shallbedefinedasawork-ingmemberthatdirectlyorindirectlysupervises5ormoremembers working under the Collective BargainingAgree-mentandshallreceive8%overJourneymanRate .

F.Employee: The terms“Employee”,“Worker”and“Jour-neyman”asusedherein,shallmeananypersonwithoutre-gard to age, race, creed, color, religion, sexornationalori-ginwhoseworkforanEmployerintheareacoveredbythisAgreement falls within the recognized jurisdiction of theUnion.

G.Journeyman:Theterm“Journeyman”asusedhereinshallmeananypersonwhobecameaJourneymanmemberoftheUnited Brotherhood of Carpenters and Joiners ofAmericapriortoJune1,1980;or,whoattainedJourneymanstandingthereafteroutsidethisbargainingunit;or,whoqualifiedasaJourneymanthereafterinaccordancewiththeproceduressetforthinArticle12herein. H.Apprentice:Theterm“Apprentice”asusedhereinshallmeananypersonwhoisactivelyenrolledinastate-approvedjoint apprenticeship program for Carpenters, Millwrights,PileDriversorDrywalldesignedtoachieveoff-siteproficien-cyandon-siteproductivitysoastopermitapersontomeettheminimumuniformcompetencystandardsofaqualifiedJourneyman.

I . EqualRights: In recognitionof theequal rights laws forbothsexesandinrecognitionofthefactthatwomenarebe-comingmore involved in construction, anymasculinepro-nounor any reference inmasculine genderherein shall beconstruedtoincludeeithermaleorfemale.ThisAgreementacknowledgestheopportunitiesandrightsofqualifiedwom-enandmenaliketofunctionincrewandsupervisionposi-tionsofthetrade.

J.Competency:Theterm“competency”asusedhereinshallmeanprovenproficiencyandproductivitysufficienttomeettheminimumstandardsofaJourneymanorapplicablelevelApprentice.

PURPOSES OF THIS AGREEMENT

Theparties to thisAgreement recognize their longassocia-tionincollectivebargaining.WebelieveconstructionbytheUnion team of Contractors, Journeymen and Apprenticesproducesthebestproductatthebestcostfortheowner.

Historically,thepurposeofthisAgreementhasbeentopro-motethesettlementoflabordisagreementsbyconference,topreventstrikesandlockoutsandtopreventavoidabledelaysandexpense. Bothpartiespledge to continue theseeffortsandpurposes.

Effectivewith thisAgreement, thepartiesalsopledge theirbest efforts to implement andmaintain a program encom-passing special emphasis on Journeyman and Apprenticetraining so as to ensure an adequate supply of qualifiedWorkers.

Furthermore, the parties pledge to institute a cooperativeLabor-Management Task Force which continuously seeksmeansandmethodsofassuringourUnion team’scompet-itivepositioninthemarketplace.

Eachpartyshallimmediatelynameatleastthree(3)peopleastheinitialappointeesofthistaskforce.

ARTICLE 1TERRITORY

ThisAgreementshallcover theentireStateofOregon,andthefollowingareaintheStateofWashington:ThecountiesofKlickitat,Skamania,Clark,Cowlitz,WahkiakumandthatportionofPacificCountysouthofastraightlinemadebyex-tendingthenorthboundarylineofWahkiakumCountywest

toWillapaBaytothePacificOcean,andthencenorththroughthenaturalwaterwaytothePacificOcean.(ThiswillincludetheentirepeninsulawestofWillapaBay.)

ARTICLE 2WORK AFFECTED

Section 2.1. ThisAgreement shall govern all types of con-structionworkcomingwithinthejurisdictionoftheUnitedBrotherhoodofCarpentersandJoinersofAmericaashistori-callyrecognizedbytheAFL-CIOBuildingandConstructionTradesDepartment.

Section2.2.

(A) To clarify the scope of this Labor Agreement, and tothereby avoid futuremisunderstandings,utilities, highwayand heavy construction work is defined as including, butnot limited to the following: construction and reconstruc-tionofroads,streets,highways,alleys,sidewalks,guardrails,fences, parkways, parking areas, athletic fields, airports,railroads,streetrailways,bridges,overpasses,underpasses,gradeseparations,gradecrossings, trackelevations,elevat-edhighways,sewers,watermains,foundations,piledriving,sanitation projects, irrigation projects, flood control proj-ects, reclamation projects, reservoirs, dams, dikes, levees,revetments, channels, aqueducts, channel cutoffs, jetties,breakwaters,harbordevelopments,docks,piers,abutments,retainingwalls,transmissionlines,pipelines,ductlines,sub-ways,shafts,tunnels,excavationofearthandrock,clearingandgrubbing,landleveling,quarrying,industrialplantcon-structionotherthanbuildingconstructionasdefinedbelow;including operation, maintenance and repair of land andfloatingplantequipmentvehiclesandotherfacilitiesusedinconnectionwiththedescribedworkandservice,andallotherworkofsimilarnature.

(B)Buildingconstructionworkshallcover,butnotbelimitedto, the constructionof residential, commercialor industrialstructures,andtheon-siteworknecessaryforassembly,erec-tionandinstallationoffacilitiesandequipmentinoronsuchstructures, including any and all modifications, additionsandrepairsthereto.

(C) It isherebyagreedwhenaContractorsignatory to thisAgreementperformsthefollowingdefinedresidentialworkitshallbeperformedinaccordancewiththetermsandcon-ditionsoftheapplicablecurrentarearesidentialagreement.Residentialconstructionisdefinedasallworkinconnectionwithconstruction,alterationand/orrepairofallresidentialunitssuchassingledwellings,duplexes,rowhouses,town-housesandapartmentsnottoexceedfour(4)storiesinheightincludingabasement.

Section2.3. ThetermsofthisAgreementshallalsoapplytothatworkperformedattemporaryfacilities,suchasfabrica-tionyardsand/orassemblyplantslocatedatoradjacenttothe construction site,whichare integratedwithandsetupfor,thepurposeofservicingtheconstructionprojectorproj-ects;ratherthantoservethepublicgenerally.

Section 2.4. Craft jurisdiction is neither determined norawardedbyclassificationorscopeofworkcoverageinanyGCCALaborAgreement.

ARTICLE 3EFFECTIVE DATE – DURATION – MODIFICATION

Section3.1.Whenexecutedbythepartieshereto,thetermsandconditionsofthisAgreementshallbecomeeffectiveonJune1,2019,andshallremaininfullforceandeffectthroughMay31,2024.The“nostrike,nolockout”provisionsofthisAgreement shall remain in full force and effect during theentirefive(5)yeardurationofthisAgreement.Themonetaryconsiderations,i.e.wages,fringebenefits,etc.,shallbeassetforthinSchedule“A”forratestobeeffectiveJune1,2019.

Section3.2. Anypartyheretodesiringtermination,modifica-tionorchangesinthisAgreementtotakeeffectsubsequenttoMay31,2024,shallservewrittennoticeontheotherpartyatinterestsixty(60)toninety(90)dayspriortotheexpirationofthisAgreement,requestingnegotiation.

Ifnosuchnotice isgiven, thisAgreementshallcontinueinfullforceandeffectfromyeartoyear.

ARTICLE 4SUBCONTRACTORS CLAUSE – BUILDING

Section4.1.

(A)Asubcontractorisonewhotakesoveranypartoracom-pletesectionofageneralcontract,includingboththefurnish-ingofmaterialsforandtheperformanceoflaboronthejob,ortheperformanceoflaboronly.NoContractororjointven-turecoveredbythetermsandconditionsofthisAgreementshallsubcontractanyjobsiteworktoasubcontractororEm-ployerwhoisnotsignatorytoaCarpenterAgreementexceptasprovidedbelow.TheContractororjointventureshallbeheldresponsibleforthepaymentofWages,TravelPay,Pen-

sion,HealthandWelfare,Vacation,Training,DrugTesting,CMFandRCDincurredby thesubcontractorandshallseethatthesubcontractoradherestotheworkingconditions.

(B) Section 4.1(A) shall not be operative when potentialUnionsubcontractorsarenotavailableordonotbid.Whenasubcontractor isnotsignatory toaCarpenterAgreement,thereshallbeapre-jobconferencebetweenarepresentativeof the PacificNorthwest Regional Council, the Contractor,theSubcontractorandtheAssociation ifaffected. Thepar-tieswillattempttoreachanagreementregardingthissectionbeforethesubcontractorperformsanyworkontheproject.

(C)InordertocomplywiththisArticle,theUnionshallmakeavailableanAgreementforthedurationoftheprojectorsub-contracttocoveronlythesubcontractedwork.

Section4.2. Avendor,whomakesdeliveryofmaterials,sup-pliesorequipmentandwho, incidental tooraspartof thefurnishing or delivery ofmaterial, supplies, or equipment,does anywork at the job site, shall be aparty to aCollec-tive Bargaining Agreement with the Regional Council oritssignatoryLocalUnions,containingthefull termsofthisAgreement.IntheeventavendorisnotapartytosuchanAgreement,theyshallnotperformanyjobsiteworkexceptthatdeliveriesmaybemadebysuchvendortothejobsite.

Section 4.3.Noworkwill be let by piecework, contract orlumpsumdirectwithJourneymenorApprenticesforlaborservices.

Section4.4.

(A)Whenthelowresponsivebidfromasignatorysubcon-tractor exceeds a non-signatory bid by either five percent

(5%)orfiftythousanddollars($50,000),theContractorshallberelievedofSection4.1(A)ofthisArticle.Thissectionap-pliestothefollowingclassificationsofworkonly:(drywall/wetwall), insulation,manufacturedceilingsystems,manu-facturedwallsystems,or(MBE/WBE/DBE).

(B) The Employer agrees to limit the use of non-signatorysubcontractorstonotmorethantwo(2)perjoborproject.Toavailthemselvesofthisclause,theGeneralContractoragreestonotifythePacificNorthwestRegionalCouncilofCarpen-ters inwritingwithintwenty-four(24)hours,withtheper-tinentbid information,orwithin twenty-four (24)hoursofsub-contractornotificationofacceptedlowbid.

(C)TheContractorshallsolicitatleasttwo(2)bidsfromsig-natorysubcontractors.TheUnionandEmployershallmon-itor thefinancial records ofpayments to thenon-signatorysubcontractortoensurethatthesubcontractorcompletesthejobattheoriginalbidprice.Ifitisdiscoveredthatpaymentsinexcessoftheoriginalbidprice(excludingchangeorders)havebeenmadebytheGeneralContractorinviolationofthissection,theGeneralContractorshallbeprohibitedfromus-ingthissectionforthedurationofthisAgreement.

(D) TheUnion agrees tomake available anAgreement forthedurationoftheproject,orsubcontract,tocoveronlythesubcontractedwork.

SUBCONTRACTORS CLAUSE – HEAVY HIGHWAY

Section4.5.

(A)Asubcontractorisonewhotakesoveranypartoracom-pletesectionofageneralcontract,includingboththefurnish-ingofmaterialsforandtheperformanceoflaboronthejob,

ortheperformanceoflaboronly.NoEmployerorjointven-turecoveredbythetermsandconditionsofthisAgreementshallsubcontractanyjobsiteworktoasubcontractororEm-ployerwhoisnotsignatorytothisLaborAgreementexceptasprovidedbelow. TheEmployeror jointventureshallbeheldresponsibleforthepaymentofWages,TravelPay,Pen-sion,HealthandWelfare,Vacation,DuesDeduction,Train-ing, Drug Testing and CMF incurred by the subcontractorandshallseethatthesubcontractoradherestotheworkingconditions,exceptasprovidedbelow.

(B) Section 4.5(A) shall not be operative when potentialUnion subcontractors are not available. When a subcon-tractor isnotsignatory toa laboragreement, thereshallbeapre-jobconferencebetweenarepresentativeofthePacificNorthwestRegionalCouncil ofCarpenters, theContractor,theSubcontractorandtheAssociationifaffected.Thepartieswillattempttoreachanagreementregardingthissectionbe-forethesubcontractorperformsanyworkonaproject.

(C)InordertocomplywiththisArticle,theUnionshallmakeavailableanAgreementforthedurationoftheprojectorsub-contracttocoveronlythesubcontractedwork.

Section4.6.Intheevent,anEmployerisunabletofindqual-ified competitive Union MBE-WBE subcontractors whenthe Employer is obligated to satisfy MBE-WBE recruitingrequirements,theUnionandtheEmployershallwaivethisArticleprovidedthepre-jobconferencereferredtoinSection4.1(B)aboveisutilized.

Section4.7. WherethegeneralContractorreceivesbidsthatshowthenon-unionsubcontractorfivepercent(5%)ormorelower than theUnion subcontractor, theEmployerand theUnionshallwaivethisArticle,providedhowevertheUnion

and theEmployer shall review theprices submittedbeforesigningthenon-signatorysubcontractor.Duetothespecialnatureofsubcontractinginthisarea,thedifferentialforlaborsubcontractsshallbetenpercent(10%).Laborsubcontractsincludelaborandsmalltoolsonly;theydonotincluderent-als,equipmentormaterials.

Section4.8. Avendor,whomakesdeliveryofmaterials,sup-pliesorequipmentandwho, incidental tooraspartof thefurnishing or delivery ofmaterial, supplies, or equipment,doesanyworkatthejobsite,shallbeapartytoaCollectiveBargainingAgreementwith the Union, containing the fulltermsofthisAgreement.Intheeventavendorisnotapar-tytosuchanAgreement,theyshallnotperformanyjobsiteworkexceptthatdeliveriesmaybemadebysuchvendortothejob-site.

ARTICLE 5UNION RECOGNITION AND HIRING

Section 5 .1 .Inordertomaintainemploymentandpreserveworkablelaborrelationsaswellastoinsuretheorderlyac-complishments of private and public work, the followingshallprevailwithrespecttothehiringofWorkers.

Section5.2. TheAssociationrecognizestheUnionasthesolecollectivebargainingagentforallWorkersfallingwithinthejurisdictionofthisAgreementandtheUnionrecognizestheAssociationasthesolebargainingagentforitsmembersaslistedonSchedule“B”hereofandsupplementsthereto.

Section 5.3. Unlawful Discrimination & Harassment Free Workplace Government Requirements

(A)ThereshallbenounlawfuldiscriminationbytheEmploy-erortheUnionwithrespecttothehiring,tenureordischargeof anyWorkers and any requirement as tomembership ornon-membership inanyUnionshallbe inaccordancewiththeNationalLaborRelationsActasamendedandappropri-ateExecutiveOrders.

(B)TheEmployerandtheUnionrecognizethatanEmploy-er shall not lose jobsbecauseofGovernment requirementswhichare inconflictwith thehiringhall. Therefore,whenagovernmentcontractorgovernmentagencyrequiresadif-ferent hiringhall arrangement tomeet Federal or State re-quirements,thehiringhallarrangementwillbemodifiedtomeet thedemandsof those requirements. It isunderstoodthatthehiringhallarrangementwillbefollowedascloselyaspossiblewithoutbeinginconflictwiththegovernmentre-quirements.

TheEmployerwillnotifytheUnioninadvanceofthecom-mencementofthejoboftheGovernmentrequirements,anduponrequestwillprovidetheUnionwithacopyofpertinentprovisions.

It isalso furtherunderstoodandagreedthat thissection isnotintendedtocreatejobswherenoneexist.

(C)Thepartiesrecognizeandagreethat thediscriminationagainstandtheharassmentofanindividualbecauseoftheindividual’sgender,race,religion,age,nationaloriginordis-abilityandotherstateorfederallyprotectedclassisadversetotheinterestofboththeUnionandEmployer.Theparties,therefore,jointlydeclaresuchdiscriminationandharassment

TheUnionandtheEmployershallpostthisArticleatalljobsitesanddispatchpoints.

Section5.4. ItisrecognizedwithintheconstructionindustrythattheUnionaffordstheprimesourceofqualifiedJourney-menandApprenticesrequiredtoperformtheworkcoveredbythisAgreement.

(A) All persons seeking employment via the Union shallbechronologicallyenteredon theappropriateOut-of-Worklist(OWL)asmaintainedbythePacificNorthwestRegionalCouncilofCarpentersCentralDispatch .

(B)Out of Work List

1. Whenever the Employer requires Workers to be dis-patched,he/she shallnotify thePacificNorthwestRe-gional Council of Carpenters Central Dispatch office(253)945-8830or(800)953-6444,(seeSchedule“C”),ad-visingofproject location, starting time, thenumberofJourneymenandApprenticesneededand theskills re-quiredofeach.

2. TheUnionwilldispatchsuchWorkersfromthis listasfollows:

(a)Tosatisfy theEmployer’s request forWorkerswithspecifiedskills.PreferencewillbeaccordedsuchWork-erswiththeearliestinitialregistrationonsaidlist.

(3) The Employer confirms in writing his/her re-questfordispatchtotheUnionwithintwenty-four(24)hours(Saturday,Sunday,andholidaysexclud-ed)ofsuchemploymentwhereupontheUnionwillissuewrittendispatch.

(4)Apprenticesmayberequestedbynameonly,notbytermorperiod.

3. Should theUnionbeunable toreferqualifiedWorkersfor employment to the Employer within twenty-four(24)hoursfromthetimeofreceivingtheEmployer’sre-quest(Saturdays,Sundaysandholidaysexcepted)oratthetimemutuallyagreeduponattimeofrequest,orifaWorkerfailstoreporttothejobsiteintheagreedtime,theEmployer shallbe free to secure theWorkers fromanysource.TheEmployershallnotifythedispatchof-ficepromptlyofthenames,socialsecuritynumbersandthedateofhireofsuchEmployees.

4. TheUnionshallrequiretheremovalofEmployeeswhohave not been dispatched in accordance with 5.4(B)above.

5 . The PNWRCC shallmaintain a centralized hiring hallforreferralofmemberstosignatorycontractors.thecur-renthiringhallrulesandproceduresshallbepostedof

Inordertobeeligiblefordispatch,membersmustbeinGood standingorArrearsunless state/federal law su-persedesthisrequirement.MembersinArrearsshallbeexpectedtoprovidetotheirhomelocal,within10work-ingdaysafterdispatch,orasrequestedbythehomelo-cal,proofofGoodstanding.

(C)Evaluation Referral List

1. Non-Membersseekingemploymentvia theUnionandclaiming credit for previous experience shall be regis-teredontheEvaluationReferralList.

2. TheUnionshallrefertheseindividualstotheJATCforevaluation in accordance with procedures set forth inArticle12herein.

3. TheJATCshallevaluatetheindividualas:

(a)AJourneyman,or

(b) AnApprenticeatanassignedcompetencylevel.

4. IfanindividualisevaluatedasaJourneyman:

(a) He/sheshallsubmittheevaluationtotheUnion.

(b) TheUnionshallplacehim/herontheout-of-worklist.

(c) Dispatch eligibility shall be as per Section 5.4(B),above.

5. IftheindividualisevaluatedasanApprentice,he/sheshallbeprocessedinaccordancewiththeOregonand/orSouthwestWashingtonConstructionCarpenterSelec-tionProcedure.

6. Non-members seeking employment as an apprentice-shipapplicantviatheUnionandclaimingnocreditforprevious experience shall be processed in accordancewith the Oregon and/or Southwest Washington Con-structionCarpenterSelectionProcedure.

Section5.5. Composite Crew

(A) This provision shall first be arranged at a pre-job con-ferenceorsubsequentmeetingsof theEmployerandcraftsinvolved.Anydisagreementoverthisprovisionmaybeap-pealedtothechiefrepresentativesoftherespectivesignatorycraftsandGCCA.

(B) Employersmay establish for a project or job a creworcrewsknownasa“composite”whichshallconsistofthere-quiredcraftsinsuchproportionsasarerespectivetothetypeofworktobeperformed.Inrelaxationfromstrictcraftjuris-diction,providedtheEmployeesfromeachcraftareassignedtotheircraft’sjurisdictionasfaraspracticalandpossible,butnotinconsistentwiththeprovisionofthisAgreement.

Section5.6. Pre-Job Conference

Apre-jobconferenceshallbeheldwheneversorequestedbytheUnionorEmployer todiscuss theEmployer’s laborre-quirements,thetypeofwork,thedurationoftheproject,who

theknownsubcontractorsare,ifany,towhomtheContractorwill subcontract anywork covered by thisAgreement andarrangefortheorderlyplacementofWorkersontheproject.Thispre-jobconferenceshallbeheldinthelocalityofthejobsiteoratsomeothermutuallyagreed location. TheUnionshallbenotifiedinwritingofanysubcontractornotknownatthepre-jobconferenceatleastfive(5)dayspriortothesub-contractorstartingwork.

Section5.7. Transfer of Foreman/Specialty Workers

(A)TheUnionshallnotimposeanyrestrictionsonthetrans-ferofareasonablenumberofCarpentersprovidedthattheEmployer contacts the PacificNorthwest Regional CouncilofCarpentersRepresentativehavingjurisdictionoftheproj-ectpriortostartingwork.SuchagreeduponWorkersshallpresentthemselvestotheLocalUnionhavingjurisdictionforproperdispatchbeforegoingtowork.

(B)Non-membersmaynotberequestedasForeman.

Section5.8.TheUnionhavingqualifiedasrequiredbySec-tion8(a)(3)oftheNationalLaborRelationsActasamended,thefollowingprovisionsshallbeeffective:

All Workers employed by the Employer to perform workwithin the properly determined craft jurisdiction of theUnioninvolvedshallbecomemembersofsuchUnionnotlat-erthantheeighth(8th)dayfollowingthebeginningofsuchemployment,orsince the inceptionof thisAgreement,andthereafter shall maintainmembership in good standing insaidUnionasaconditionofemployment,subject,however,totheprovisionsofSection5.9and5.10ofthisArticle.

Section5.9.TheUnionacceptsallobligationsforthecontin-uedmembershipofitsmembersasprovidedinSection5.8ofthisArticleandforthecollectionoftheirinitiationfeesanddues.TheUnionshallhavetherighttorequiretheremovalofEmployeesforfailuretopayortenderinitiationfeesandduesasrequiredbythisAgreement.Thereshallbenostop-pageorslow-upofworkbecauseofdisciplinaryactiononthepartoftheUnion.

Section5.10.AllrequestsbytheUnionforremovalofanEm-ployeefornon-paymentoforfailuretotenderinitiationfeesandduesorforimproperdispatchshallbemadetotheEm-ployerinwriting.TheEmployerthenagreestoterminatetheEmployeenolaterthantheendofthenextshiftfollowingtheEmployer’s receipt of theUnion’swritten request for suchtermination, provided theUnion supplies, upon request, areplacementwithinthesameperiod.TheemployeragreestonotifytheUnionbyfaxoremailofthenumberofrepresentedemployeesandtheirnameswhowereemployedduringthatmonthuponrequest.TheUnionagreestolimitrequeststonomorethanthreetimesperyear.

Section5.11.TheEmployershallbethesolejudgeofaWork-er’s qualifications and may discharge any Employee forcause,whichshallbestatedonthestandardSeparationSlip.(Seecopyattached.) WheneveranEmployee isdischargedandisnoteligibleforrehire,itshallbesostatedonthestan-dardSeparationSlip.

Section5.12.AWorkerwhoreceivesthree(3)SeparationSlipsina twelve (12)monthperiodfor lackofcompetencyshallbe referred for evaluationand counselingasperArticle 12beforere-dispatch.AcopyoftheSeparationSlipshallbesenttothePacificNorthwestRegionalCouncilofCarpentersandtheGCCAnolaterthanseven(7)daysfollowingtermination.

ARTICLE 6WORKING CONDITIONS

SHIFTS-HOURS OF WORK-OVERTIME

Section6.2. Single Shift

Heavy Highway

Eight(8)hoursworkperdaybetweenthehoursof5:00a.m.to7:00p.m.andfive(5)daysperweek,MondaythroughFri-day,shallbethenormalworkingtimeofallEmployeescov-eredbythisAgreement.StartingandquittingtimesmaybeexpandedbymutualagreementbetweentheEmployerandtheUnion.

Building

Eight(8)hoursworkperdaybetweenthehoursof6:00a.m.to6:00p.m.andfive(5)daysperweek,MondaythroughFri-day,shallbethenormalworkingtimeofallEmployeescov-eredbythisAgreement.StartingandquittingtimesmaybeexpandedbymutualagreementbetweentheEmployerandtheUnion.

Section6.3. Workweek

(A)Theworkweekshallbeforty(40)hours,MondaythroughFriday,andtheworkdayshallnotexceedeight(8)hoursperday.

1.Alltimeworkedinexcessofeight(8)hours(butnotmorethantwelve(12)hours)ofcontinuousshiftworkshallbepaidforattherateoftimeandonehalf(1-1/2x).

(B)Minimum Time Between Shifts

WhenanEmployeehasworkedtheregularshiftandthenisrequiredbytheEmployertoworkattheovertimerate, theEmployeeshallnotgotoworkagainfortheregularrateun-tiltheEmployeeisrelievedforaperiodofatleasteight(8)hours.

(C)Onworkthatisentirelyfederallyfunded,theworkshallbeforty(40)hours,MondaythroughFriday.Allworkinex-cessofforty(40)hoursinone(1)weekorten(10)hoursinone(1)dayshallbepaidforattherateoftimeandone-half(1-1/2x).TheContractorshallnotemployasecondcrewtocircumvent overtimepay after forty (40) hours. This shallnotprohibit theEmployerand theUnion fromnegotiatinga“rolling”fourten-hourshifts(4-10)onaprojectbyprojectbasis.

(D)Special Operations–Onoperationssuchasgreensaw-ing,de-watering,curingandprotectionofconcrete,allover-timepayshallbetimeandone-half(1-1/2x),includingSun-daysandholidays.

(E)Overtimepay involved in theprotectionanddryingofmaterialtofacilitatethecontinuationofworkshallbeattimeandone-half(1-1/2x),includingSundaysandholidays.

(F) Four Ten-Hour Shifts (4-10) – Notwithstanding theabove, the Employer may, at his/her option, establish ten(10)hour shifts foraminimumofany four (4) consecutivescheduledworkdays,Monday throughThursday, on someoralloperationsonaproject,withoutbeingrequiredtopayovertime.Anythingoverten(10)hoursshallbesubjecttotheprovisionsabove.Failuretoworkthefour(4)dayminimumshallrequireovertimeunlesssuchfailureiscausedbyactualinclementweather,holidayorotherconditionsdefinitelybe-yondthecontroloftheEmployer.

(G)Fourten-hourshifts(4-10)atthestraighttimeratemaybeestablishedMondaythroughThursday.Intheeventthejobisdownduetoweatherconditionsorequipmentbreakdown,thenFridayonavoluntarybasismaybeworkedasamake-updayatthestraighttimepay.Makeupdayappliestothecrewsoaffected.

(H)Five Eight (5-8) Hour Days–Intheeventthejobisdowndue toequipmentbreakdownorweatherconditions,Mon-daythroughFriday,thenSaturdayonavoluntarybasismaybeworkedasamake-updayatthestraighttimerate.

Section6.4. Two Shift Operations

(A)On a two (2) consecutive shift operation, no shift pen-alty is involved forworkperformed in either of these two(2)shifts.Eachshiftmustbescheduledforatleasteight(8)hoursexceptasprovidedforintheReportingPay/MinimumPayrequirementsofthisAgreement.

(B)Thesecondorswingshiftshallbesevenandone-half(7-1/2)hoursofcontinuousemployment,exceptforlunchperi-od,andshallbepaidforateight(8)timestheregularstraighttimehourlywagerate.

(C)Thethirdorgraveyardshiftshallbeseven(7)hoursofcontinuousemployment,exceptforlunchperiod,andshallbepaidforateight(8)hoursattheregularstraighttimehour-lywagerate.Innoeventshalltheregularworkinghoursordifferentshiftsoverlapnorshallanyintervalbetweenshiftsexceedthereasonabletimenecessarytochangeshifts,andinnoeventshallsuchintervalexceedone(1)hour.Thirty-five(35)hoursofwork,MondaythroughFriday,shallconstitutearegularweek’sworkonallshiftsofseven(7)hours.

Section 6.6. The parties hereto mutually agree that in theevent,seriousunemploymentconditionsshouldwarrant,ap-propriateamendmentstothehoursofwork,shiftsandotherrelatedprovisionsof thisArticlemaybenegotiated for thepurposeofrelievingsuchunemploymentconditions.

Section6.7. Lunch Period/Rest Breaks

(A)A regular lunch period of not less than one-half (1/2)hourormore thanone (1)hourshallbeestablishedwithinone(1)hourofmid-shiftbutinnoeventlongerthanfive(5)hoursfromthebeginningoftheshift.IfanEmployeeisre-quiredtoworkmorethanfive(5)hoursfromthebeginningoftheshiftwithoutalunchperiod,he/sheshallbepaidahalfhour(1/2hour)attheapplicableovertimeandinadditionbegivenadequatetimetoeathis/herlunch.Employeeswillbegivenalunchperiodaftereachworkperiodofnotmorethanfive (5)hours. Employees requestedandnotifiedofwork-ingtwelve(12)hourshiftswillberequiredtobringasecondmealandbegivenadequatepaidtimetoeatsuchmeal.

(B)Innoeventshallanyshiftperiodorovertimeexceedfive(5) hours between providedmeal periods. Each providedmealperiodduringovertimehoursshallbeofsufficientdu-ration(notlessthanthirty(30)minutes),inaccordancewiththejobsituation,toallowtheworkmanadequatetimetose-cure themeal. If theworkwillnotpermit leaving the job,theEmployershall furnish lunch to theWorkersatnocosttothem.

(C) Paid rest breaks of ten (10)minutes shall be providedduring each work period or major part thereof. The restbreaksmaynotbeaddedtotheusualmealperiodordeduct-edfromthebeginningorendoftheworkperiodtoreducetheoveralllengthofthetotalworkperiod.Theordinaryna-tureandcircumstancesofconstructionworkmaynotallowforafixedregularschedule.However,effortshallbemadetohavetherestbreakstakenapproximatelyinthemiddleofeachworkperiod.

Noworkshallbeper-formedonLaborDayexcepttosavelifeorproperty.

(C)Workonanyoftheholidaysspecifiedhereinwillbepaidatdouble(2x)theregularstraighttimerateperhour.

(D)ShouldanEmployeeberequiredtoworkonPresidentialElectionDay,arrangementsshallbemadetoallowhim/herampletimetovote.However,theEmployerwillnotbere-quiredtopayforanytimenotworked.

Section6.9.Uponadeclarationofanemergencybyapropergovernmental agency and in all other situationswhere theAssociationandtheUnionmutuallyagreethatanemergencyexists,emergencyovertimeworktosavelife, limborprop-ertyshallbepaidattimeandone-half(1-1/2x)thestraighttimerate.

ARTICLE 7MISCELLANEOUS PROVISIONS

Section 7.1. The repair or adjustment of any equipment ormachinery,pursuanttothetermsofaguaranteebytheman-ufacturerthereoforhis/heragentoremployees,willnotbesubject to thisAgreement and theUnionwill not interferewith such employees on such exempted work; provided,however,thatthisdoesnotapplytotheassemblinganderec-tionofmachineryonandduringaconstructionjobpriortocompletionoftheerection.

Section7.2. Payday

A.Schedule:Employeesshallbepaidinfullonceeachweek(on thesameday),but innoeventshallmore thanfive (5)days (Saturday, Sunday andHolidays excluded)wages bewithheld,providedhowever,thatEmployerswhomakeuppayrollatsomedistantpointmayextendthisintervalasnec-essarytoenablethemtopreparethepayrollbutinnoeventshallsuchintervalexceedone(1)week.Iftheregularpaydayfalls on aHoliday, the employees shall bepaidon the lastregularworkdaybeforetheholiday.

B.Methods:AttheelectionoftheEmployeroneofthefollow-ingoptionsofpaymentwillbeutilized:

1.Bynegotiablecheckmadeonlocalbank,paidat jobsite,or

2.Directdepositinemployee’sbankaccount

3.Bymail(atelectionofemployeeinwriting). Ifpaidbymail,checkshallbepostmarkednotlaterthantwo(2)businessdayspriortotheestablishedpayday.

C.Documentation:TheEmployershall furnishtoeachem-ployee at the timeofpayment ofwages an itemized state-mentshowingthepaybasis(i.e.,hoursordaysworked),rateorratesofpay,grosswages,andalldeductionsforthatpayperiod.Inaddition,thename,addressandphonenumberoftheEmployershallbeindicated.

D.Adjustments:NoadjustmentofdisputedpaywillbemadeunlesstheworkerortheUnionshallmakeaclaiminwritingto theEmployer’s representativefifteen (15)days from thepayperiodinquestion .

E.Penalty:Ifthepaymentisnotmadeexpresslyasprovidedherein,thentheemployeeshallbepaideight(8)hourspayattheappropriatehourlywagerate foreach twenty-four (24)hourperiodthereafteruntilpaymentismade.Inthecaseofpaymentbymail,thepostmarkontheenvelopewillserveasthecutoffforanypenalty.Saidcheckshallbemailedtoanaddressoftheemployee’schoice.Inthecaseofdirectdeposittoemployee’sbankaccount,theemployer’sbankstatementElectronicFundTransfer (EFT)effectivedate shall serveasthecutoffforanypenalty.

F.Non-SufficientFunds:Intheeventanemployeereceivesanon-sufficientfunds(NSF)check,thepaymentshallbebymoneyorderorcertifiedcheck.Inaddition,anydocumentedbankfeesorchargesincurredbytheemployeeasaresultofreceivinganNSFcheckpayment,willbereimbursedtotheaffectedemployee.Ifrequested,aletterofexplanationwillbesent to theemployee’sbankandanycreditors thatmayhavebeenaffected.IfanemployeereceivesanNSFcheckforthesecondtimeinanyfour(4)weekperiods, themake-upcheckandallsubsequentpaymentsshallbebymoneyorderorcertifiedcheck.

G.Atthetimeoflay-offortermination,allhoursworkedupto and through thenormalwork shift onday of lay-offorterminationshallbepaidat that time. If itbecomesneces-saryfortheEmployeetoreturnatalaterdateforsuchpay-ment,suchEmployeeshallbeentitledtotheregularwagesduehim/herforeachdayitbecamenecessaryforhim/hertoreturnorwaitforhis/herpaycheck.

H. If an employee is laid-off outside normal office hours,paymentshallbemadewithintwenty-four (24)hours (Sat-urdays,SundaysandHolidaysexcepted).Payment,shallbemadeasestablishedin“B.Methods”ofthisarticle .

I. Discharge for Cause or Quit: Employees who are dis-chargedforcauseorquitshallbepaidnotlaterthanthenextregularpayperiod .

Section 7.3. The number of Employees at any time on anyjob,shiftorinanyemploymentshallbeatthediscretionofthe Employer. When any Journeyman is assigned the re-sponsibility of a Foreman for the prosecution of thework,he/sheshallreceivenotlessthantheForeman’srateofpay.AssignedForemenshallissueinstructionstotheWorkersex-ceptinunusualoremergencysituations.

Section7.4. Health and Safety

(A)TheEmployerandEmployeesshallcomplywithallap-plicablefederalandstatelawsgoverninghealthandsafety.Thesafetyandhealthstandardsofapplicablestateandfed-erallawsareminimumstandardsandarenotintendedtoim-plythattheUnionobjectstotheestablishmentandimposi-tionbytheEmployerofadditionalormorestringentrulestoprotectthehealthandsafetyoftheEmployees.ItshallbetheexclusiverightandresponsibilityoftheEmployertoinsurecompliancewithsafetyandhealthstandardsandrules.

(B)Anadequate supplyofpure, cool cleandrinkingwaterandsanitarydrinkingcupsshallbekeptincloseproximitytoWorkersatalltimes.Atnotimeshallwaterbagsbeper-missible.

(C)Toilets,urinalsorlatrinesofapprovedtypes,insufficientnumberandincleanandsanitaryconditionshallbeprovid-edonalljobs.AnyWorkerfoundnotcooperatinginkeepingthesefacilitiescleanandsanitaryshallbesubjecttodischarge.Whenperformingworkonexistingsewagetreatmentplantsoranyothersimilarunsanitaryworkprojects,theEmployershallprovidesuitablefacilitieswithinreasonableproximitytotheworkforEmployeestowashanddisinfecttheirhandspriortotheirlunchperiod.Timeallowancesforsameshallnotexceedfive(5)minutes,unlessadditionaltimeisdeemednecessarybysupervision.

(D)FirstAidKitsandotherapprovedemergencyequipmentshallbekeptinconvenientandeasilyaccessibleplacesatalltimes,andshallbe in thechargeofanaccreditedFirstAidOperator.

(E)Any transportation furnishedby theEmployershallaf-fordadequateprotectionagainsttheelementsofweatherandshallbeoperatedinasafemanner.

(F)AdequatefacilitiesshallbeprovidedwithinareasonabletimefortheEmployeesinwhichtodrytheirclothesandeattheir lunches. Sameshallbeequippedwithadequateheat.Thestorageofsuppliesorequipmentshallnotinterferewiththeuseofthesefacilitiesasprovidedherein.

(G)Shouldanemployeebetakentoanymedicalfacilityduetoaseriousinjury,theUnionRepresentativeresponsibleforthearea the job is located inshallbenotified (byphoneor

Section7.5. Drug and Alcohol Testing

(A)LaborandManagementagreethatitisinthebestinter-estsofalltopromoteanalcoholanddrug-freeworkingenvi-ronmentandpledgebothtoworkwithintheirownareasofinfluenceandtocooperatetothatend.

(B)TheEmployerhastherighttoscreenEmployeesforalco-holanddrugsasaconditionofemployment,aslongastheaboveisincompliancewithstateandfederallaws.

(C)ThepartieswillappointrepresentativestotheConstruc-tion Industry Drug-Free Workplace Program (DFW) TrustasprovidedintheTrustsummaryplandescriptionforjointLabor/Managementadministrationoftheprogram.TestingwillbeinaccordancewiththeDFWprogram.AlltestingwillbepaidbyEmployercontributionstotheDFWTrust.Iftestresults are negative, thememberwill be paid fifty dollars($50.00)bytheprogramandwillbeissuedaDrugCard.Thisexpenditureisnotfortimeworked,butfortheundeterminedamountofexpensebythemember.

(D)Exceptasprovidedinsection(E)and(F),allEmployerssignatorytothisAgreement,includingEmployerswhosigncomplianceagreementswith theUnion,shallparticipate intheDFWandberequiredtopaythehourlycontributionde-terminedbythemutualagreementoftheparties.

(E)Notwithstandingsection(D),asignatoryContractormayoptoutoftheprogramandnotpaythecontributionif:

2. It implements a drug and alcohol testing and treat-ment program which the DFW Trust has certified asmeetingorexceedingtheDFWprogram.

(F)Additionally,asignatoryContractorwhodoesnotmeetthesection(E)exceptionmaychoosetonotparticipateintheprogram. However, such Contractors must still make thecontributionsetforthinsection(D).

(G)IfanEmployeroptsoutoftheDFWprogramundersec-tion (E) or (F), prospective Employee/members who testnegative for any requireddrugandalcohol testwill be re-imbursedfiftydollars($50.00)fortakingsuchtest.Thisex-penditureisnotfortimeworked,butfortheundeterminedamount of expense by the prospective Employee/member.For existingEmployeeswho test negative for any such re-quireddrugandalcoholtest,theEmployeewillbepaidhis/herscheduledhourlywagerateandfringesforthetimere-quiredtotakethetest.

Section7.6. Stewards

(A)ThereshallbeaStewardonthejobatalltimeswhiletheworkof theBrotherhood isbeingperformed, except in theeventacreworportion thereof is requiredby theEmploy-ertoperformovertimework,thentheStewardshallbere-quiredonly ifhe/shewasperformingtheworkwhichwillcontinue into overtime. Thismethod of selecting overtimeWorkersshallnotbeconsidereddiscriminatory.

2.Inadditiontohis/herworkasaJourneyman,beper-mittedtoperformduringworkinghourssuchofhis/herUniondutiesascannotbeperformedatothertimes.

(C)His/herofficialdutiesasaStewardshallbelimitedto:

1.SecuringtheweeklyStewardReport.

2.PickupthetoolsforasickorinjuredpersonandnotifythePacificNorthwestRegionalCouncilRepresentative.

3.TransmittotheBusinessRepresentativeallcomplaintsandgrievancesemanatingfromthejob.

(D) It being expresslyunderstood and agreed that a Stew-ards’dutiesshallnotincludeanymattersrelatingtoreferral,hiringorterminationordiscipliningofEmployees.Thathe/sheshallnotinanywayobligatetheUnionorBusinessRep-resentative in anymatter of policy, interpretation of LaborRelationsAgreements or in any other prerogatives usuallyassignedtotheBusinessRepresentative.

(E)InnoeventshallanEmployerortheUniondiscriminateagainsttheSteward,norwilltheEmployerdischargehim/heronaccountofanyactiontakenbyhim/herintheproperperformanceofhis/herUnionduties.IfintheopinionoftheEmployer, theStewardisnotoperatingwithinthescopeofthisAgreementorthathe/sheisexceedinghis/herauthority,theEmployershallnotify theBusinessRepresentativewhoshallcorrectthematter.

(F)TheStewardwillnotbedischargedortransferredforac-tionstakenintheproperperformanceoftheSteward’sdu-ties.TheUnionandtheStewardshallbenotifiedinwritingforty-eight(48)hoursbeforehe/sheis tobe laidoffordis-chargedexceptwhenhe/she isoneof the last three ) jour-neymenonthejobotherthantheforemanorifthestewardisdischargedforcause.Insuchcases,suchwrittennotificationwillbeprovidedtotheUnionuponterminationordischargeoftheSteward.Intheeventofatemporarylayoff,theStew-ard,ifqualified,willbethefirstWorkergiventheopportunitytoreturntowork.ReductionofforceisnotconsideredcauseforseparationoftheStewardwhensaidStewardisqualifiedtoperformthescopeofworkremainingonthejobsite.

Section7.7. Tools

(A)AllEmployeesshallhavetoolssharpandingoodcondi-tionupongoingtothejob,andunlesstheEmployeremploysasaw-filer,theEmployershallhaveEmployees’sawsfiledatnocosttotheEmployee.NoEmployeeshallberequiredtotakehis/hersawsoffthejobforfiling.

(B)NoEmployee shall bepermitted to takeupon any job,loan,rentorotherwisefurnishanyopticalinstruments,pat-entedmiterbox,clamp(exceptsawclamp),ladder,sawhorseoranypowertool,orvehicle.TheForemanshallberespon-siblefortheproofofownershipofallpowerequipmentandotheritemsmentionedinthisparagraph.TheEmployershallfurnishexpendable toolssuchas taps,drills,files,hacksawblades,specialhandcleanersandsolvents,weldinggloves,standardwelderhoodandglasses.ItistheresponsibilityoftheEmployeestoreturnsuchitemstotheEmployerinlikeconditionlessnormalwearandtear.

Whenthey are so stored the Employer shall be liable for loss oftoolsand/orworkclothesduetoforcedentry,floodorfire.He/shealsoshallbeliableforaccidentaldamagetoWorker’stoolscausedbymovementofEmployer’sequipmentwhensuchsituationisbeyondtheEmployee’scontrol.Anyclaimforsuchlossmustbeitemizedinwriting,certifiedtobyhis/herForemanandsubmittedwithinfive (5)daysafter suchloss. TheEmployershallbepermittedseven(7)daysafterreceiptofsuchclaimtoeffectreplacementofequalquality.ClaimsforlossshallbelimitedtotoolsandclothesnecessaryfortheperformanceoftheEmployee’sworkontheprojectonwhichthelossoccurred,providedthattheEmployeeshavebeennotifiedofsuchrequiredtoolsandclothing.

(D)Whenstationarypowersawsorotherstationarywood-workingmachineryareusedonthejob,theymustbeoper-atedbyqualifiedJourneymenorApprenticesinaccordancewiththeappropriateapprenticeshipstandards.

(E) Employees shall be allowed such time as necessary tocollect,clean,andstoretoolsinthedesignatedplacebeforequittingtime.Whereverpracticablethetoolhouseshallbeplacedclosetothework.

Section7.8. Welding Certifications

(A)WhenanEmployerrequestsaCertifiedWelder(Carpen-ter,Millwright,Bridge&HighwayCarpenterorPileDriver)suchWorkershallpossessandmaintainanactiveCertifica-tionCardfromanAccreditedTestingLaboratorycertifyingthathe/shehaspassedanAmericanWeldingSociety(AWS)standardthree(3)positiontestwithinone(1)yearofdateofemployment.

1.PriorauthorizationfortestwasreceivedfromthePa-cificNorthwestCarpentersInstitute;

2.Testispassed;noreimbursementwillbeallowedforanytestfailures;

3.Receiptofpayment for such testmustbe submittedto thePacificNorthwestCarpenters Institute for reim-bursement.

(C)Ifanyweldingcard/certificationsareneededwhichre-quirestrainingoutsideofthenormalworkinghours,theEm-ployerandtheUnionshallmeetanddeterminewhatcom-pensationisneeded.

(D)Any charges incurred for additional welding certifica-tions requiredby theEmployer, not listed in 7.8(A) above,shall be paid by the Employer. Any time the Employeespendsobtainingadditional requiredweldingcertificationsshallbepaidattheapplicablewagerate.

(E)When,asaconditionofemploymentrequiresacertifiedweldertore-certifyatthejobsite,theEmployershallprovidetheEmployeewithacopyofhisorhercertificationpapers.

ARTICLE 8IMMIGRATION REFORM AND

CONTROL ACT (IRCA) REQUIREMENTS,REPORTING PAY, MINIMUM PAY AND STANDBY PAY

Section8.1. Immigration Reform and Control Act (IRCA)-AnyreferralwhoisunabletoqualifyforemploymentundertheprovisionsoftheIRCAshallnotbeeligibleforemploy-mentandtheattendantbenefitstherein.

Section8.2. Reporting Expense-WhenqualifiedWorkersre-portforworkasdirectedandforwhomnoworkisprovided,theyshallbepaidsixtydollars($60)reportingexpenseunlesspreventedfromworkingbycausesnotunderthecontroloftheEmployer.Itbeingunderstoodthattheabovereimburse-mentsare for the inconvenienceof reporting to the jobsiteand are not to be construed aswages forworkperformedandthatWorkersentitledtoreportingexpenseshallnotberequiredtoremainonthejobsiteexceptasprovidedbelow.

Section8.3. Minimum Pay

(A)Employeeswhowork less than four (4) hours shall bepaid for four (4) hours and if worked more than four (4)hoursbutlessthansix(6)hoursshallbepaidforsix(6)hoursandifworkedmorethansix(6)hoursbutlessthaneight(8)hoursshallbepaidforeight(8)hours.IfanEmployeeleavesorquitsofhis/herownvolition,he/sheshallbepaidforac-tualtimeworkedattheapplicablestraightorovertimerates.IfanewhireisputtoworkandjudgedbytheEmployertobeunsatisfactory,theworkershallbepaidonlyfortheactualtimeworked.

(B) The above shall not apply if thework stoppage is duetoequipmentbreakdownorweatherconditionsbeyondthecontroloftheEmployer.

Section8.4. Ifnotputtoworkduringthistwo(2)hourperiod,theEmployeeshallreceivetwo(2)hourswagesplusfringesbutshallnotreceivethesixtydollars($60)reportingexpense.Ifput towork, Employees shall receive pay for actual hoursworked in accordancewith theminimumpay requirementofthisArticle.

ARTICLE 10NON-RECURRING WORK

Section10.1.

(A) In times of emergency, necessarywork ordinarily per-formedbymembersofaparticularcraftandinvolvinglessthanone(1)day’slaborperWorker,maybeassignedtoan-othercraftsman. Insuchcases,wagescalesshallberecog-nizedasapplyingtotheclassificationratherthantheWorker,andanyEmployeeperformingsuchworkshallbepaidtherate for the classification of the work which he/she is re-quiredtodo;providedthatundernosuchconditionsshallanEmployeebepaidalowerratethanthatoftheclassifica-tionunderwhichhe/shewasworkingimmediatelypriortothetemporaryassignmenthereinreferredto.ThisprovisionisdesignedtocareforemergencysituationswhereWorkersofthepropercraftarenotavailable,orbecauseoftheshortdurationoftheparticularworktobedone,ortheremotenessofthejob,itwouldbeimpracticalfromboththeUnion’sandtheEmployer’sstandpointtodispatchtheWorkersordinari-lyused.

(B)ThisArticlewillonlyapplyincaseswherereciprocalcon-ditionsaregivenbyothercrafts.

ARTICLE 11GOVERNMENT REQUIREMENTS

Section11.1.

(A)ThisAgreementandallthetermsthereofshallbesubor-dinatetoeveryprovisioninanycontractwhichtheEmployermaybidfororenterintowithanypublicorquasi-publicorgovernmentalbodyfortheperformanceofworkcoveredbythisAgreement,and thepartiesheretoagree toconformtoandabidebyanyrestrictionsorrequirementsregardingem-ploymentcontainedinsuchcontract.

(B)TheUnionandtheEmployerpledgetheirmutualcooper-ationincomplyingwiththeEqualEmploymentOpportunityRegulationssupportedbyappropriateExecutiveOrdersandinthedevelopmentofaprogramofAffirmativeAction.

(C)AnyAffirmativeActionProgramoritsequivalentintend-ed to foster equal employmentwhich ismutually adoptedbyorimposeduponthepartiessignatoryheretoforanareawithin the jurisdiction of thisAgreement shall become anamendmenttoandsupersedethisAgreement.

(D)It isunderstoodthatboththeEmployerandtheUnionwilluseeveryeffort tocombatandpreventanyactivityorprocedurewhichwouldcreateasituationdetrimentaltothelaborstandardsestablishedbythisAgreement.

ARTICLE 12APPRENTICESHIP AND TRAINING

Section12.1.

(A)Recognizing theneed foranadequate supplyofquali-fiedCarpenters, theAssociationandUnionmutuallyagreetoactivelypromote,andparticipatein, jointapprenticeshipandskilladvancementprogramsdesignedtomeetthisneed.

(B)ThePacificNorthwestRegionalCouncilandtheAssoci-ationjointlybelievethatitisoftheutmostimportancetotheindustry that thecurrentapprenticeshipandskilladvance-mentprogrambeutilizedtoitsmaximumtoprovidequalitytrainingprogramsforallsegmentsandareasoftheindustryinordertoqualifyandmaintainaskilledworkforce.Tothatend,thePacificNorthwestRegionalCouncilandtheAssoci-ationagreetothefollowingagenda:

Section 12.2. Such programswhich exist or are developedtoachievethisendandaresupportedinwholeorpartfromfundsderivedfromthisAgreementshall:

(A)Bejointlyadministeredbyequalrepresentationofman-agement,asappointedbytheAssociation,andlabor,asap-pointedbytheUnion.

(B)ComplywithallapplicableStateandFederalregulationsgoverningsame.

(C)ComplywithOregonand/orSWWashingtonConstruc-tionCarpenterSelectionProcedure.

Section12.3 . Joint Apprenticeship Training Committee

(A) The Joint Apprenticeship Training Committee (JATC)shallhavesix(6)setsofStandards:Carpenter,Exterior/In-teriorSpecialists,Millwrights,MaintenanceMillwrights,PileDriversandScaffoldErectors.

(B)Geographic areawill includeall of theStateofOregonand thatpartof theStateofWashington currently coveredbytheOregon/SWWashingtonCollectiveBargainingAgree-ments.

(C)One(1)JATChasbeenestablishedfortheentireOregon/SWWashingtoncollectivebargainingarea. Allof theorig-inal JATC’s have become Area Sub-Committees and haveretainedtheirgeographicareas. Appointments to theAreaSub-Committee membership are per Labor/ManagementCollectiveBargainingAgreement.

(D) Labor shall appoint four (4) Labormembers and four(4)alternateLabormembersandManagementshallappointfour (4)Managementmembersandfour (4)alternateMan-agementmemberstotheJATC.Managementmemberswillbeappointedasfollows;AssociatedGeneralContractors,Or-egon-ColumbiaChapterone(1)plusone(1)alternate,Gen-eralandConcreteContractorsAssociationone (1)plusone(1)alternate,WallandCeilingAssociationone (1)plusone(1)alternate,Member-at-Largeone(1)plusone(1)alternate;

(E)Memberswillserveuntiltheyresignorarereplacedbytheappointingauthority,or in thecaseof theMembers-at-Large,removedbyagreementofatleasttwo(2)oftheAsso-ciations.

(F)TheChairandSecretarypositionsoftheJATCwillbero-tatedonanannualbasisbetweenLaborandManagement.

(G)TheJATCshallberesponsiblefortheevaluationandse-lectionofallapplicantsandApprentices.TheAreaSub-Com-mitteesshallconductselections,evaluationsandre-rates inaccordancewithJATCpolicy,subjecttothefinalapprovalbytheJATC.

(H)TheJATCshalladministertheapprenticeshipprogramtomaximizeitseffectivenessthroughoutthebargainingareainaccordancewithapplicablelawsandregulations.TheJATCshall utilize area and specific discipline sub-committees tocarryoutcertainofitsresponsibilities.

Section12.4. Apprentices

(A)ApprenticesshallbeindenturedtotheJATCbutwillbeunder the supervisionanddirectionof theAreaSub-Com-mitteetowhichtheApprenticeappliedandwasaccepted.

(B)Apprenticesshallworkinthetradetowhichtheyarein-dentured andmaywork for any approvedTrainingAgentthroughouttheOregon/SWWashingtonCollectiveBargain-ingArea.

(C) Apprentices may request transfer from one AreaSub-CommitteetoanotherasallowedintheJATCPolicy&Procedure.Thiswouldbean“inhousetransfer”andwouldnotrequirere-registrationwiththeStateofOregonorWash-ington.

Section12.5. Training Agents

(A)AllContractorssignatorytoa localareaCollectiveBar-gainingAgreementwiththeUnitedBrotherhoodofCarpen-ters in thisbargainingareaare recognizedTrainingAgentsthroughouttheOregon/SWWashingtonCollectiveBargain-ingAreaunlessdeterminedotherwisebytheJATC.

(B) TheEmployer shall take all steps necessary to see thateachApprenticeworksunderandwithcompetentJourney-men in the occupation for which the Apprentice is beingtrainedandisassignedtoworkingandlearningtaskssothattheApprenticemasters the on-the-job training and relatedinstruction.

(C)TheEmployermustcomplywiththeprovisionofthesestandards and any agreement applicable to the sponsor’sprogram.TheEmployer,onformsapprovedbytheOregonStateJointApprenticeshipandTrainingCouncil,mustmakeregularreportstotheappropriateapprenticeshipcommittee.

(D)TheJATCshallhavetheauthoritytodeterminewheth-ertheContractor is incompliancewiththerulesandregu-lations for the operation of the apprenticeship committee.Should the committeedetermine that theContractor isnotincompliancewiththeapprenticeshipregulationsandintheeventthatthecommitteeterminatesorsuspendstheEmploy-er’s training agent status, theEmployer shall no longer be

Section12.6. Employment of Apprentices

AContractorshallemployatleastone(1)Apprenticeonanyjobsiteonwhichfive(5)ormoreJourneymenareemployedand at least the equivalent of one (1)Apprentice for everyfive (5) Journeymen in his/her total workforce. The JointApprenticeshipandTrainingCommittee(JATC)shallpermitenrollmentsufficienttosatisfythisminimumratio.

Section12.7.Apprenticesshallberemovedfromthejob,forjustcause,bytheEmployeruponreceiptofwrittennotifica-tionfromtheApprenticeshipCommittee(JATC).

Section 12.8.Apprentice wage and fringe benefits shall beprovided in accordancewith the attached Schedule “A” attheappropriateApprenticeclassificationrate.

Section12.9.Programswhichexistand/oraredevelopedtoachieve training shall be expanded to provide competencyevaluation. Properly qualifiedWorkerswill be dispatchedbytheUnioninaccordancewithArticle5.4(B)ofthisAgree-ment.

(A)Allapplicants,unlessevaluatedpriortoplacementonajob,mayonlybedispatchedasproperlyregisteredfirsttermApprentices.

(B) Applicants not claiming prior experience will be pro-cessedaccordingtotheOregonand/orSWWashingtonCon-structionCarpenterSelectionProcedureashereinoutlined.

1. Those applicants evaluated as Journeymen will beplacedontheout-of-worklist.

2. Those applicants evaluated as Apprentices will beassignedtheappropriatelevelofcompetencyandpro-cessedaccordingtotheOregonand/orSWWashingtonConstructionCarpenterSelectionProcedure.

Section 12.10. An evaluation will be administered by theContractororUnionRepresentative.Theevaluationproce-durewilldetermine:

1.IftheindividualpossessestheminimumcompetencystandardsofaJourneymanor;

2. The applicableApprentice competency level of theregistrant.

EvaluationresultsshallbegiventotheSecretaryoftheap-propriateJointApprenticeshipandTrainingCommittee,thelocalunionandtheemployer.

Section12.11.WorkersadmittedtotheUnionasaresultoforganizational effort shall be afforded the opportunity ofevaluation in accordance with Section 12.10 above. SuchevaluationshallbesuppliedtheEmployertoassisthim/herinassigningthecompetencylevelofhis/herEmployees.

Section12.12. Specialized Journey Level Training

(A)WhentheEmployerhasaneedforSpecializedJourneyLevelTraining,consistentwiththesemi-annuallypublished

Carpenter Training Program schedule of classes, trainingwillbeprovidedatnocosttotheEmployerwhenasufficientnumberofEmployeesareavailableforclasses.IfascheduledclassisnotavailabletomeettheEmployers’needs,theEm-ployermayrequestthedevelopmentofanindustryprogramthroughtherespectiveestablishedJATC,oranotherexpedi-entvehicleifrecommendedbytheDirectorofTraining.

(B)TheAssociationandUnionjointlyagreetocooperateim-mediatelyinthedevelopmentofaprogramofcontinuinged-ucationfortheCarpenters’workforce.

Section12.13. Foreman Training

(A)Foreman Supervisory Skills .TheAssociation,theUnion,andtherespective trainingaffiliatesagree tocommenceef-forts on Journeyman skill advancement training programswhichfocusonForemen’ssupervisoryskillsandresponsibil-ities.Theseprogramswillbeofferedthroughoutthebargain-ingareawithparticularemphasisintheruralareas.

(B)Premium for Foreman .AnincreasedForeman’spremiumof twopercent (2%) fora total to tenpercent (10%)willbeprovidedfor:

1.IndividualswhosuccessfullycompleteajointlyagreeduponForman’sTrainingCurriculumand;

2.TheindividualisassignedasaForemanbyhis/herEm-ployer.

ARTICLE 13INVESTIGATION BY

UNION BUSINESS REPRESENTATIVE

Section13.1.

(A)TheauthorizedBusinessRepresentativeofanyUnionaf-fectedbythisAgreementshallhavetherighttoinvestigateconditionsexistingonanyjobatanyreasonabletime,uponfirstreportingtotheEmployerorhis/herrepresentativeandpresentingproperly certifiedcredentials. He/she shallnotbeallowedtoundulyinterferewiththeprogressofthework.

(B) Only the Business Representativewho has proper cre-dentialsfromtheUnionshallbeallowedonanyjobtosolic-itmembershipintheUnionandtocollectmoniesfromanyEmployee of theEmployer in accordancewithArticle 5 ofthisAgreement.

ARTICLE 14SETTLEMENT OF DISPUTES –

STRIKES AND LOCKOUTS

Section14.1. Jurisdictional Disputes

Ifajurisdictionaldisputearises,itshallfirstbesubmittedtolocalBusinessRepresentativesofthecraftsinvolvedforset-tlement; and, if nounderstanding or agreement is reachedwithinforty-eight(48)hours,itwillbereferredtotheInter-nationalUnions involved forsettlement. The InternationalUnions shall be requested to meet within forty-eight (48)hourstosettlethedisputeand,ifnoagreementisreachedonthislevelwithinfive(5)days,thepartiestothedisputemayextendtheperiodofsettlementtoanotherfixeddatemutual-lyagreedupon.ThedisputingpartiesmayimmediatelyseekresolutionthroughtheNationalLaborRelationsBoard.

Section14.2. Settlement of Non-Jurisdictional Disputes

Grievance Procedure

Inthesettlementofdisputesarisingoutofaviolation,misun-derstandingordifferenceininterpretationofthisAgreement,thefollowingprocedureshallbefollowed:

(A)TheUnion,EmployeesorEmployershavingagrievanceshall present such grievance to the Job Steward or UnionRepresentative. The Steward or Union Representative orEmployee,shallpresentsuchgrievancetotheEmployer’slo-calrepresentativeatthejobsite.Suchgrievanceshallbepre-sentedtotheEmployerinwritingwithacopyofsaidgriev-ancetobefiledwiththeLocalUnionRepresentativewithinfifteen(15)daysfromdateofviolationtobevalid.

(B) Therefore, no dispute, complaint or grievance shall berecognizedunlesscalledtotheattentionoftheContractororUnion inwritingwithinfifteen (15) calendardays after al-legedviolationwascommitted.FordisputeinvolvingwageclaimsrefertoArticle7“MiscellaneousProvisions”Section7.2.“Payday”. Theterm“grievance”shallnot includeandthisprocedureshallnotapplytoemploymentdiscriminationfor which a specific administrative or judicial remedy hasbeenprescribedbyStateand/orFederalstatute.

Step II

IfnosettlementisreachedunderStepI,thegrievanceshallbethenpresented,inwriting,totheEmployer’sauthorizedrep-resentativeattheEmployer’sofficeheadquarters.Theofficeheadquartersshallmean theEmployer’smainofficewhich

Step III

(A)IfnoagreementisreachedinStepIIwithinten(10)work-ingdays,eitherpartymaysubmit thegrievance inwritingtoaJointAdjustmentBoardcomposedoftwo(2)membersselectedbytheUnion,andtwo(2)membersselectedbytheAssociation.TheBoardmembersshallnotbeemployeesoftheLocalUnion involved,or theCompany involved. Anycomplaint, dispute or grievance not submitted in writing,requestingaJointAdjustmentBoardhearingwithinten(10)workingdays,shallberegardedaswaivedunlessthepartiesotherwiseagreeinwriting.

(B) The JointAdjustment Board shallmeetwithin ten (10)workingdaysofreceiptofsuchrequest.Adecisionbyama-jorityoftheJointAdjustmentBoardshallbefinalandbindingonbothparties.IntheeventthattheJointAdjustmentBoardfailstorenderadecisionwithinten(10)workingdaysfromtheirfirstmeetingdate,eitherpartymay,within10workingdays, give written notice to the other party of arbitration.Thepartiesmaymutuallyagreetoextendthetimelimits.

Step IV

(A) If no settlement is reachedunder Step III, either partymay request, in writing, to the arbiter, that the grievancebetakentoarbitration.Thearbitershallhearthegrievancewithinfifteen(15)daysafterreceiptoftherequestunlessitismutuallyagreedtoextendsuchtimelimit.Thearbitershallrenderhis/herdecisionwithinseven(7)daysafterthegriev-

(B)Ifthepartiesareunabletoagreeupontheimpartialarbi-tratorwithinaperiodoffive(5)days,theneitherpartymayrequesttheFederalMediationandConciliationServiceortheAmericanArbitrationAssociationtosubmitalistofseven(7)names.Ifthepartiescannotagree,thentheyshallgototheFederalMediationandConciliationService.Afterreceiptofthenamesoftheseven(7)arbitrators,thepartiesshallmeetandalternate in strikingnames from the list,with thefirststriking decided by the tossing of a coin. The remainingname,aftereachpartyhasstruckthree(3)names,shallbetheimpartial arbitrator. Thedecisionof thearbitrator shallbefinalandbindingonbothparties.

Section14.3.Saturday,Sundayandholidaysaredeemedex-cludedfromtimelimitscontainedinthisArticle.

Section14.4. Arbitrator

(A)Thejurisdictionofthearbitershallbeconfinedinallcasesexclusivelytoquestionsinvolvingtheinterpretationandap-plicationofexistingclausesorprovisionsofthisAgreement;therefore,thearbitratorshallnothavelegislativepower.

(B)Itisfurtherunderstoodandagreedthatthearbiter’sdeci-sionmayprovideretroactivitynottoexceedtwenty(20)cal-endardaysfromthedayofthewrittenfilingofthecomplaintassetforthinStepIofthisArticle.

Section14.5.Shouldthepartiesinvolvedfailtocomplywiththe time limits established in thisArticle, unlessmutuallyagreedtoextendsuchlimits,theneitherpartymayproceeddirectlytoarbitrationonaunilateralbasisinaccordancewithSection2.

Section14.6.Shouldthepartiesinvolvedfailtocomplywiththefindingswithinfive(5)daysafterwrittennotificationofthearbitrator’sdecision,theneitherpartymaytakesuchac-tionasitdeemsnecessarytoenforcethefindingsofthear-bitratorandtheyshallnotbeconsideredinviolationofanypartofthisAgreement.

Section14.7.TheUnionwillnotrecognizeanunauthorizedpicketline.ItshallnotbeaviolationofthisAgreementnorcausefordischargeforanyEmployeecoveredbythisAgree-menttorefusetocrossapicketline.TheUnionistonotifytheAssociationinwritingofasanctionedpicketline.

Section14.8.Itismutuallyagreedthattherewillbenostrikesorlockouts,orcessationofwork,byeitherparty,forthedu-rationofthisAgreement,andallnon-jurisdictionaldisputesarisingunderthisAgreementshallbesubmittedtothepro-ceduresforthesettlementofdisputesasprovidedforabove.

ARTICLE 15HEALTH-WELFARE AND DENTAL

Section15.1.InadditiontothewagescaleslistedinSchedule“A”herein,allpersons,parties,firmsorcorporationsaslist-edinSchedule“B”,orotherwisecomingunderthescopeofthisAgreement,whoare,ormaybecomesignatorypartiestothisAgreement, agree that theexistingHealthandWelfareTrustFundasestablishedJanuary1,1956,shallcontinuein

fullforceandeffectforthepurposeofprovidingHealth-Wel-fareandDentalbenefitsforalleligibleEmployeescoveredbythisAgreement,andshallpayintotheexistingOregon-Wash-ingtonCarpenters-EmployersHealthandWelfareTrustFundoritssuccessor:Forhealth-welfareanddentalthesumspercompensablehouraslistedinSchedule“A”.Suchpaymentsshallbemademonthlyinaccordancewiththerequirementsof theTrustAgreementandallapplicableprovisionsof theexistingTrustAgreementshallcontinueinfullforceandef-fect.TheFundestablishedbypriorcontributionsand/oritssuccessor shall be recognized as a fund held in Trust, andthereforeanappropriatedepositoryforthecontributionsre-ferredtohereinabove.

TheGeneral&ConcreteContractorsAssociation., Inc. andthePacificNorthwestRegionalCouncilofCarpentersagreethat theOregonWashingtonCarpenters EmployersHealthandWelfareTrustFundbemergedwithanotherCarpenters/EmployersHealthandWelfareTrust(s)withinthegeograph-ic territory servedby theCarpentersCouncil, andagree toapprovesuchamendments to theOregon-WashingtonCar-penters-EmployersHealthandWelfareTrustFundasmaybenecessarytoeffectsuchamerger,provided:

a)ThemergerdocumentspermittheOregonEmployerstoappointrepresentationonthemergedTrust;and

b)Thetermsofthemergerdonotviolatefiduciaryobli-gationsundertheEmployeeRetirementIncomeSecurityActof1974(ERISA),29U.S.C.§1001etseq.

Thiscondition isnotsubject to thegrievanceorarbitrationproceduresofthelaborcontract,butshallberesolvedifnec-essarybyacourtofcompetentjurisdiction.Eitherpartywillbedeemedtohavewaiveditsrightunderthisconditionto

objecttothemergerorthesigningofamendmentstoeffectthemergerunlessitnotifiestheother,inwritingnolaterthanthirty (30) days after receipt of the final (signature-ready)mergerdocuments,ofthedetailedbasisforitspositionthatthetermsofthemergerdonotsatisfythefiduciarydutypro-visionsofERISA.

Intheeventofatrustmerger,theEmployershallmakehealthandwelfarecontributionstothenewly-mergedtrustonthesamebasisasisprovidedintheAgreement.

Section15.2.ItshallbeaviolationofthisAgreementfortheUniontoallowWorkerscoveredbythisAgreementtoworkforanEmployerwhofails,afterduenotice,tomaketheprop-ercontributions to theHealthandWelfareFundor itssuc-cessorinaccordancewiththeprovisionsofthisAgreement.

Section15.3.IntheeventanEmployerfailstomakethemon-etary contributions in conformity with this Article of theAgreement, the Union is free to take any economic actionagainstsuchEmployer itdeemsnecessary,andsuchactionshallnotbeconsideredaviolationofthisAgreement.

ARTICLE 16PENSION

Section16.1.InadditiontothewagescaleslistedinSchedule“A”herein,allpersons,parties,firmsorcorporationsaslist-edinSchedule“B”,orotherwisecomingunderthescopeofthisAgreement,whoare,ormaybecomesignatorypartiestothisAgreement,agreethattheexistingPensionTrustFundasestablishedJuly1,1962,shallcontinueinfullforceandeffectforthepurposeofprovidingPensionbenefitsforalleligibleEmployeescoveredbythisAgreement,andshallpayintotheexistingOregon-WashingtonCarpenters-EmployersPension

Section16.2.ItshallbeaviolationofthisAgreementfortheUniontoallowWorkerscoveredbythisAgreementtoworkforanEmployerwhofails,afterduenotice,tomaketheprop-ercontributionstothePensionFundinaccordancewiththeprovisionsofthisAgreement.

Section16.3.IntheeventanEmployerfailstomakethemon-etary contributions in conformity with this Article of theAgreement, the Union is free to take any economic actionagainst suchEmployer itdeemsnecessaryandsuchactionshallnotbeconsideredaviolationofthisAgreement.

Section16.4.TheEmployershallprovideforavoluntaryde-ductiononanindividualbasisandforwardtotheEmploy-ee’sdesignated individual 401 (k) account through the ad-ministratoroftheexistingTrustatnocosttotheEmployer.Employees shalldesignate theamount tobedeductedandshownonthedispatchslip.Employeesmayincreaseorde-creasethepercentagetheycontributeorstoptheircontribu-tionstothePlanatanytime.Tomakeanyofthesechanges,theymust submit a new salary reduction agreement formto their Local Union and Employer at least fourteen (14)daysbefore theywant thechangetobeeffective. This isanon-matchingplanandshallnotbechangedtorequireEm-ployercontributionsnoworinthefuture.

ARTICLE 17TRUSTEE QUALIFICATION CRITERIA

Section17.1.InordertoqualifyasaManagementTrusteeonanyBoardofTrusteeshereinafterdesignated,aManagementTrusteemustbeasignatoryEmployer,orfull-timenon-bar-gainingunitEmployeeofthesignatoryContractor,oraregu-larofficeroftheEmployer,whocontributestotherespectiveTrustFund,orafull-timestaffpersonofasignatoryEmploy-erAssociation.

Section 17.2. The chairmanship of the various Trust andsub-committeesshallrotateonanannualbasisbetweenLa-borandManagementTrustees.

Section 17.3. For the purpose of thisAgreement, the term“Signatory Employer” shall mean: Any active ContractorsignatorytoaCarpentersMasterLaborAgreementandcon-tributingoncompensablehours to theOregon-WashingtonCarpenters-Employers Trust Funds or its successor TrustFund.

ARTICLE 18VACATION FUND

Section18.1.InadditiontowagescaleslistedinSchedule“A”hereinallEmployersshallpayintotheOregon-WashingtonCarpenters’VacationTrustFundthesumspercompensablehouraslistedinSchedule“A”.Suchpaymentsshallbemademonthly in accordancewith the requirements of the TrustAgreement.

Section 18.2. It is further agreed that the trust fund estab-lishedforthepurposeofprovidingvacationshallbejointlyestablished and equally administeredbyTrustees from theUnionandtheAssociation.

ARTICLE 19TRAINING FUND

(A)InadditiontowagescaleslistedinSchedule“A”allEm-ployers shall pay into theOregon-Washington Carpenters’TrainingTrustFundthesumspercompensablehouraslistedinSchedule“A”.

(B) The existing Oregon-Washington Carpenters’ TrainingTrustFund,asestablishedMay1,1965,shallcontinueinfullforceandeffect,shallberecognizedasafundheldintrust,andthereforeanappropriatedepositoryforthecontributionsreferredtohereinabove.

Section19.2.ItisfurtheragreedthatthetrustfundestablishedforthepurposeofprovidingtrainingforApprenticeshipandJourneyman skill advancement shall be jointly establishedandequallyadministeredbytrusteesfromtheUnionandtheAssociation.

Section19.3.ItshallbeaviolationofthisAgreementfortheUniontoallowWorkerscoveredbythisAgreementtowork

Section19.4.

(A)IntheeventanEmployerfailstomakethemonetarycon-tributionsinconformitywiththisArticleoftheAgreement,theUnion is free to takeanyeconomicactionagainst suchEmployer it deems necessary and such action shall not beconsideredaviolationofthisAgreement.

(B)TheUnionreservestherighttomovemonieswithinthetaxablewagepackage;i.e.wages,RCDorVacation,withoutapprovaloftheG.C.C.A.

ARTICLE 20REGIONAL COUNCIL DEDUCTION

Section20.1.

(A)Uponpresentationof aproperauthorization formexe-cutedby the individualEmployee, theEmployer agrees todeduct theRegionalCouncilDeductionmoniesandallne-gotiated increases thereto fromtaxablewageandremit thesametotheRegionalCouncilinaccordancewithapplicablelaw,andintheamountprescribedintheappropriatewageandfringebenefitSchedulescontainedhereinduringthelifeofthisAgreement.ItisunderstoodtheEmployerswillremiteachmonththisdeductioninaccordancewiththisArticleonthe transmittal forms used for fringe benefit contributionsandthattheproratacostsofsuchformsandthecollectionandaccountingthereofwillbepaidbytheUniontothefringebenefitadministrator.

(B)TheauthorizationformsshallbesuppliedbytheUnionandtheEmployerisundernoobligationtosolicitEmployeesforauthorization.

(C)TheUnionguaranteesthattheRegionalCouncilDeduc-tiontobedeductedshallbetheuniformamountapplicabletoallmembersoftheUnioncoveredbythisAgreementases-tablishedbythemembershipthroughtheirdulyelecteddele-gatesinaccordancewiththeUnionConstitution.TheUnionguaranteesthattheUnionfundcollectedinthismannershallnotbeusedasastrikefundagainsttheEmployers’partytothisAgreement. Should theUnionviolateeitherprovisionofthisparagraph,thisArticleshallbenullandvoidfortheremainingperiod of thisAgreement. This procedure shallnotbeapplicabletoinitiationfees,fines,orreadmissionfees.

ARTICLE 21SPECIAL AGREEMENTS

Section21.1 .

(A)TheUnionrecognizesthatthereexistsintheconstructionmarketplace a strongnon-unionelement inourbargainingarea,andagreestomeetthisthreatthroughtheuseof“Spe-cialAgreements”,and/or“JobAgreements”,negotiatedbymutualconsentbythepartieshereto.

(B)When conditions warrant, such anAgreementmay beusedinaspecifiedgeographiclocation(s)and/orforallproj-ectswithinacertainspecificandmutuallyagreeduponseg-mentoftheconstructionindustry.

(C)Allrequestsfor“SpecialAgreements”(andextensionsofsame)shallbe inwritingandtheContractoragreestogivethe Carpenters Union ample time to review the request.

Whenpossible, seven (7) days notice shall be given to theCarpentersUnionfortheirapproval.

(D) It is the obligation of theContractor to checkwith theoffice of the Regional Council of Carpenters to determineifprojectsonwhichtheyintendtobidarecoveredbysuchAgreements.

Section21.2.IftheUnionnegotiatesSpecialAgreementsforanyworkcoveredbythisAgreementwithanyotherEmploy-er or EmployerAssociation, all provisions of suchAgree-ments shall bemadeavailable andapply to anyEmployersignatorytothisAgreementforthespecificworkandspecificareacoveredbysuchSpecialAgreementonly.

ARTICLE 22RECIPROCAL GUARANTEE

Section22.1.

(A)Itisexpresslyunderstoodbythesignatorypartieshere-to,thattheirparticipationinthisAgreementisbasedontheguaranteethattheywillusetheirbestefforttorequireconfor-mancetothetermshereofonalltypesofconstructionworkcovered by thisAgreement andwithin the territory as setforthinArticle1.

(B) It shall not be a violation of thisAgreement for eitherpartytotakeeconomicactionfornon-compliancewiththisArticle. Anyviolationsof the termshereinshallbesubjecttoArticle14.

ARTICLE 23CONSTRUCTION MANAGEMENT FUND

TheConstructionManagementFund isherebyestablished.AnAgreementandDeclarationofTrustwhichprovidesforthedetailedoperationthereofhasbeenexecutedbytheAs-sociation and shall continue in full force and effect duringthetermofthisAgreement.AllEmployerssignatorytothisCollectiveBargainingAgreement,orwhobecomesignatoryorotherwisecomeunderthescopeofthisAgreement,shallcontribute thesumof twocents ($.02)perhourworkedbyEmployees covered under thisAgreement into said Fund.AnEmployershallnotberequiredtocontributemorethanatotalofonethousanddollars($1,000.00)inanycontractyear(i.e.June1sttoMay31st)totheFund,butamountserrone-ouslypaidinexcessofsaidonethousanddollars($1,000.00)yearly maximum shall be deemed to be voluntarily paidwithoutrightofrefund. AllcontributionsshallbemadeatthetimesandinthemannerprescribedbysaidTrust.ForthepurposeofadministeringthisFund,theIndividualEmployerbybecomingsignatorytothisAgreementdoesherebydesig-natetheEmployerTrusteestoactashisagentinallmattersconcerningsaidTrustFund.

ARTICLE 24AGREEMENT ALL INCLUSIVE

Section24.1.Exceptashereinaboveandhereinafterspecifi-callyprovided,thisAgreementcontainsallofthecovenantsandagreementsbetweentheparties,andnothingoutsideofthisAgreement not specifically noted herein shall modify,amendoraddto its termsexceptbymutualagreementbe-tween theparties. If situationsariseduring the lifeof thisAgreement which shall necessitate modifications, amend-mentsor additions, these same shall be arrivedat through

negotiationsandmutualagreement,andshallbeappendedheretobyawrittensupplement.

ARTICLE 25SAVINGS CLAUSE

Section25.1.ShouldanypartoranyprovisionofthisAgree-mentberenderedordeclaredinvalidbyreasonofanyexist-ingorsubsequentlyenactedlegislation,orbyanydecreeofacourtofcompetentjurisdictionortheN.L.R.B.,suchinvalida-tionofsuchpartorprovisionofthisAgreementshallnotin-validatetheremainingpartsorprovisionshereof;provided,however,uponsuch invalidation, thepartiesagree tomeetwithoutdelayandnegotiatesuchpartorprovisionaffected.Theremainingpartsorprovisionsshallremaininfullforceandeffect.Ifthepartiesareunabletonegotiatesuchchangeorclassification,withinthirty(30)days(unlessextendedbymutualconsent),eitherpartymay,afterthree(3)dayswrittennotice to the other, submit thematter toArbitrationunderStepIV(B)ofArticle14.2.

ARTICLE 26LABOR MANAGEMENT BOARD

Section30.4. Computation of Zone Pay Differential

It isagreed that for thepurposeofdetermining theproperwagescaleunderthisAgreement:

(A) All job or project locations shall be computed (deter-mined)onthebasisofroadmilesandinthefollowingman-ner.Amileagemeasurementwillstartattheentrancetotherespectivecityhall,facingtheproject(ifpossible),andshallproceedbythenormalroute(shortesttime-bestroadviagoo-glemaps) to thegeographical center onhighway, railroad,andstreetconstructionprojects (endofmeasurement). Onallotherprojectcontracts,thegeographicalcenterwherethemajorportionoftheconstructionislocated,shallbeconsid-eredthecenteroftheproject(endofmeasurement).

(B)Allrelatedjobsorprojects(suchasacrusher’slocation)shall, for the purpose of determining the proper pay zonerates,beconsideredasapartoftheprimejob,withtheexcep-tionofjettieswhich,forthepurposeofthisAgreement,willhaveseparatelocationsandmay,therefore,haveadifferentpayzoneforthequarryandjettysites.

Section 30.5. Bridge and Ferry Toll Fees . The Employeragrees topay toll fees onbridges and ferriesprovided theEmployeeshallfurnishreceiptsforsame.Receiptsshallbeturnedinweekly.

Section 30.6. Job Site Transportation . Whenever, becauseofremotenessofparkingareas,hazardousroadconditions,orsecurityrestrictions, theEmployer is required to furnishtransportationforWorkerswithintheworksitetotheplaceoftheirworkandsuchtransportationisfurnishedtotheEm-ployeewithoutcosttohim/her,theequipmentshallincludeseatsandprotectionfromtheelements.Definitepickupanddischargepointsshallbedetermined.Thetimetoleavefrompickuppointshallnotexceedthirty(30)minutespriortostartoftheshift.Ifthereismorethanthirty(30)minutesoftimeconsumedfromworksiteattheendoftheshifttothepointofpickup,theEmployeeshallbepaidathis/herregularwagerateforfullround-triptimespentinjobsitetravelbothbe-foreandafterhis/hershift.Itshallbetheintentofthispro-visionthatjobsitetravelfrompickuppointtoworksiteandfromworksitetopickuppointshallbeapproximatelyequalintimeconsumed,anditisalsotheintentthattheEmployeewillberequiredtobeatthepickuppointsonlyinsufficienttimetoreachworksiteathis/herregularlyestablishedstart-ingtime.TheprojectmanagementandtheUnionwillmeetto establish any special conditions surrounding suchman-hauloperations.Ifsuchjobsitenegotiationsfail,theproce-duresetforthinthisAgreementshallprevail.

Section 30.7. Camps . Where andwhen standard camp fa-cilitiesareprovidedbytheEmployer,atornearthejobsite,costtotheEmployeeshallbedecidedbymutualagreementbetweentheUnionandEmployer.ItisunderstoodanEm-ployeewillbepaidZoneAwagesifhe/sheavailshimself/herselfofacampfacility.UseofacampfacilityissolelytheoptionoftheEmployee.

(H)Alltimberandformworkintheconstructionandrepairofconcretedocks,piers,andwharves,waterfrontbulkheadsandwaysofeverykind,anddrydocksandgravingdocksshallbeatthePileDriver’sclassificationandscaleandshallextenduptoandincludingthedeckandmooringfacilitiesthereof.

(I)Framing,handlinganderectionoftimbertrusses,towersandallsimilarstructuresandallriggingandsignalingcon-nected therewith, shallbeat thePileDriver’s classificationandscale.

(J)ThedivisionbetweenPileDrivers’andMiners’workonsubwaysor tunnelswhere the interior is tobe constructedbytunnelingmethodsshallbeattheportalofthesubwayortunnel.

(K) In the construction ofwaterfront andmarine facilities,suchasdocks,piers,wharves,bulkheads, jetties, andsimi-larstructures,thePileDriver’sclassificationshallcontinuetoapply,uptoandincludingthedeckingthereof.

(L)ThePileDriver’sclassificationshallapplyonallpiledriv-ingandcaissonworkonboth landandwater, theerectionofplatformsordrillrigsofvariousdesignusedforoffshoreoildrilling,andthederricksandbargesusedtooverhaulorsetoilpipelinemooringsatthesiteofoperations,includinganyworkthatmaynecessitateuseofDiversandTenders(seeSectiononDiversandTendersinArticles33,34and35).

(M) In the construction of wooden bridges, whether overlandoroverwater,whencomposedofheavytimber,thePileDriver’sclassificationshallapply.

(N) 1. In the constructionof concrete or steel bridgesoverland,thePileDriver’sclassificationshallapplytothedriv-ingofthepilesand/orcaissonworkincludingtheformsre-quiredforthecappingofthepilesorcaissonsimmediatelyontopofthepilesorcaisson.The“cappingofthepiles”ishereininterpretedasbeingthatconcrete,wood,orotherma-terialrestingontopofthepiles,wheredrivenorplacedanddoesnotincludeanyfurtherformworkabovethecapping.Theaboveshallapplyonsuchconcreteorsteelbridgescon-structedoverland,highways, railroads,overpasses, and in-cludecloverleafs,interchanges,etc.

2.On“bridgeoverwater”thecolumnorabutmentsinwaterandat thewater’sedge,or thefirstcolumnorabut-mentonlandadjacenttowater’sedge,shallcomeunderthePileDriver’sclassification. “Thewater line for freshwaterstreams shall be considered normal water’s edge.” “Thewaterlineontide-affectedstreamsshallbeatthehighnor-malwater’sedge.”“Bridgesoverwater”shallalsoincludebridgesoverriversthataredryinseason;bridgesconstruct-edoveradryby-passdesignedtocarryfloodwater;bridgesoverravinesordepressionswhichcarrywaterduringspringrun-off;bridgesoverman-madecanalsoraqueducts.

Section35.1 SUBCONTRACT

EmployersagreetheywillnotsubcontractanyCommercialSubaqueousDivingWorkorHyperbaricTunnelWorkwithinthejurisdictionthatistobeperformedatthejobsiteexcepttoacontractorwhoholdsanagreementwiththeInternationalUnion(UBC)oroneofitssubordinatebodiesorwhoagrees,inwritingpriortooratthetimeoftheexecutionofthesub-contractor(s)tobeboundbythetermsoftheareaPrincipalAgreementandthisAddendum.

If anyprovisionsof thisAddendum,or theapplicationsofsuchprovisionstoanypersonorcircumstances,shallbe inconflictwithprovisionscontainedintheapplicablePrincipalAgreements, theprovisionsof thisAddendumshall super-sedethosecontainedinthePrincipalAgreements.

To avoid duplicationoforderandtoaffectanorderlyhiringprocedure, theEm-ployeragreesthatwhencallingtheUnionforpersonnel,todesignatearesponsiblerepresentativewhichtheUnionwillrecognizeastheAgentoftheEmployerwiththeauthoritytohire.TheUnionshallmaintainanexclusivenon-discrimina-toryhiringhalltofillrequisitionsforpersonnelonthedivingcrew.

Divers canbeflowndirectly to the jobsitewithadispatch,afterfirstnotifyingthehiringhall.Allpertinentinformationsuchasname,socialsecuritynumberandtheirLocalUnionNumberandlocationwillbegiventotheUnionpriortoworkornotlaterthantwenty-four(24)hours.TheContractorshallbethesolejudgeofthequalificationsofthepersonnel.

Section35.3 COVERAGE

TheworkcoveredbythisAddendumshallincludeallworkunderthejurisdictionoftheUnionandtheUnitedBrother-hoodofCarpentersandJoinersofAmericaandshallinclude,butnotbelimitedto,suchworkasdescribedasfollows:com-mercial subaqueous diving in all its branches and phases,suchasthesalvageofallships,vesselsandbarges,etc.,theunderwaterrepair,removing,dismantlingdemolition,burn-ingandweldinginallmarinesalvageoperations;allunder-

Theworkalsoincludes,butisnotlimitedto,suchworkde-scribedasfollows:allworkinconnectionwithcompressedairhyperbaricchamberworkareasinmining,tunnelingandboring operations. This includes tunneling methods thatutilize pressurized ductile pipe, gravity pipe,HDPE fusedandnon-fusedpipe,segmentedconcretepipeandothersuchmethodsofshoringandconstruction.

Section35.4 SAFETY

TheUnion and theContractors recognize that thework inwhichtheyengageisbothhighlyspecializedandextremelytechnicalinnature,andthatunlesscontinuousandeffectivesafety practices are employed, the possibility of accidentsofextremegravitytolife,limbandpropertywillalwaysbepresentandtherefore;

AllFederalandStateSafetyRules,Regulations,OrdersandDecisions shall be binding upon the individual contractorandshallbeappliedtoallcoveredwork. Noworkershallberequiredtoworkunderunsafeconditions.Theindividu-alcontractorsshallbesolelyresponsibleforimplementationandmaintenance of such Safety Laws, Rules, Regulations,Standards,OrdersandDecisions.NeithertheUnionnoranyLocalUnionsorRegionalCouncilsareresponsibleforsuchimplementationormaintenance.

AcopyoftheappropriateRulesandRegulationsmustbeonthejobsiteandbeavailabletoallMembersoftheTeam.

Allequipmentutilizedfordivinginanenvironmentcontain-ingbiohazardssuchasoil,humanwaste,nucleardebrisorsimilarenvironmentswherediveequipmentmaybewornoreffectedinafashionotherthannormalwearandtearshallbeprovidedbytheemployer. Incaseswherepersonalequip-mentisutilizedanddamagedduetothedivingenvironmenttheequipmentwillbereplacedbytheemployerwithequiv-alentequipmentacceptabletothediver.

Section35.5 DIVING RULES

When aDiver is performingdivingwork under the termsand conditions of thisAddendumhe shall be tended by aTenderwhoissatisfactorytotheDiverconcerned.

5 . Diver: ADiverisapersonwhowearsatypeofdivinggearwhichdirectlysupplieshimwithcompressedairorothergas-esforbreathingpurposesandwhopersonallyentersandde-scendsbelowthesurfaceofthewater,oranyliquidmedium,toworkattheambientpressuresencounteredtherein.ForthepurposesofthisAgreement,apersonworkinginasubmergedone-atmospherebell/vehicleisconsideredaDiver.

6 . Stand-by Diver: AStand-ByDiverisadiveratthedivelocationavailabletoassistinthewaterandwhosedivehatisonline.

Section35.7 MISCELLANEOUS

(A) This Agreement does not include any gear or specialequipmentrentals.

(B)Thecurrentcostofasoftgoodspackageforrequiredhatcertifications shall be paid by the employer for employeeswith at least 750hoursworked for that employerover thepastcalendaryear.DuringtheCertificationprocess,anyre-pairbeyondthecurrentcostofasoftgoodspackageshallbepaidbytheDiver.

Bounce of Short Duration Diving Using the Pressurized Bell: Consists of a Diver going under pressure to a givendepth,spendingashortperiodoftimeconsistentwithcur-rentdiving tables, and then coming to the surface andde-compressing on short decompression profile. Minimumcrewsizewillbeatotalofseven(7)men/women.

Bell Diving Under Pressure: Forshortdurationdivesusingabell,inadditiontotheDiverregularhourlyrate,plusdepthpremium. Thispremiumisperday,midnight tomidnightandshallbepaidregardlessofwhetherornottheDiverac-tuallyleavesthebell.

2 . Saturation Mode of Diving:

Whenworkingtwelve(12)hourshifts,startingtimeforDiversshallbeestab-lishedasbeginningwhentheDiverissummonedtoperformtasksbyDiveMaster/Supervisororbyapartytowhomhehas delegated this authority. If extenuating circumstancespreventatleasteight(8)hourrestperiodbetweenshifts,thepersonnelworkingsuchshiftsshallbepaidduringtherestperiodandovertimerateswillapply.Thecontractorsagreethattheywillmakereasonableefforttorestrictsuchactivitytostrictlyextraordinarysituations.

2 . Working Conditions

InadditiontotheitemslistedinthePrincipalAgreement,theEmployer shall furnish all goggles, shockproof gloves andother protective clothing. Waterproof clothing, boots andrubberglovesshallbe furnishedbytheemployer for thoseworkersworkinginwetenvironments.

ForemanandMedicalTechniciansshallreceiveanadditional10%perhourabovetheHyperbaricWorkerrateofpay.Fore-mansupervisingcrewsusingmixedgaswillreceiveanaddi-tional$5.00/hr.Premium.HyperbaricSupervisorsinchargeoftheinterventionshallreceiveanadditional10%perhourabovetheForeman.

Only competent and qualified journey level workers shalloperateairlocks.OutsidelocktendersandgaugetendersnotworkingunderpressureshallbepaidattheCrewTenderPayrate.

Noemployeeshallworkmorethanoneshiftatstraighttimein any 24-hour period, although when required to returnforadditionaldecompressioninthemedicaldecompressionchamber, the timespent inmedicaldecompressionshallbepaidatthestraighttimeHyperbaricWorkerrate.

Medicalexaminationswillbeperformedpriortoandimme-diatelyfollowingexposuretocompressedairenvironments.TheseexaminationsshallbeprovidedbytheemployeratnocosttotheemployeeandtimeforsuchexaminationsshallbepaidattheappropriateCrewTenderrateofpay.

Whenithasbeendeterminedbythemedicalfacilitythatanemployee cannot return to work because of complicationsresulting fromworking inapressurizedenvironment, theyshall be allowed asmany shifts offwithout penalty as re-quiredtoallowthecomplicationstoheal.TheemployeewillnotbepaidforthelostshiftsunlessrequiredbyFederal,StateorLocallaw.

OvertimepayshallbeasspecifiedintheOregon/SWWash-ington Area Principal Agreement and shall be computedbased on the classification ofwork being done during theovertimehours.

Field Engineer Internship / Superintendent Management Training Program

The undersigned parties listed below hereby agree tomodify theterms and conditions in theCarpentersMaster LaborAgreementsdatedJune1,2019,whichwasnegotiatedwiththePacificNorthwestRegionalCouncilofCarpentersof theUnitedBrotherhoodofCar-pentersandJoinersofAmerica,tocovertheperiodoftimebetweenJune15,2019andMay31,2024 .

Inanefforttoaddressanindustryneedforprofessionalconstructionmanagersthathavemanagementexperienceinjobsitecoordination,andabasicworkingknowledgeofthecarpentertrade,thefollowingprogramshavebeendeveloped.Weagreetothefollowing:

Field Engineer Internship • Collegestudentsenteringtheirsecondyear(orabove)ofschool

willbeeligibletoapplyfortheFieldEngineerInternshipPro-gram.

• FieldEngineerInternsgenerallywillspendlessthanforty(40)hoursweeklyperformingworkdeemedtofallunderCarpenterjurisdiction.
