SUBJECT: UNCLAIMED CHECKS DRAWN FROM ACTIVE BANK ACCOUNT

Honorable Members:

It is recommended that City Council authorize the transfer of $3,957.84 from the Treasury Active Account to the City General Fund in accordance with the procedures and notification requirements of the City of Los Angeles Administrative Code and current state law.

BACKGROUND

From December 2000 to September 2003, checks were issued by the Office of the Treasurer from the Bank of America Active Account which remain unclaimed to date. The State of California Government Code Section 50050-50055 (State Law) provides that any money remaining unclaimed in the City Treasury for three years or more may become the property of the City after publication of a notice, provided that within the specified period of time, no verified complaint seeking to recover all or a designated · part of the money is filed in a court of competent jurisdiction.

Instruction in Council File No. 10-0818 requested to include the total cost of advertising in this report. State Law requires that notice of escheatment must be published in a newspaper of general circulation published in the City. However, this particular notification process adhered to the guidelines set forth in Council File No. 07-3503, and the total cost for these notices was approximately $2,800.

Attached herewith is the Office of the City Clerk's proof of publication advertisements dated Thursday, April 29, 2010 and Thursday, May 6, 2010. The notice stated that on June 14, 2010, this money would become the property of the City. No claims have been fi led as of the aforementioned dates. Section 50053 of the Government Code provides that if such money becomes the property of the City agency, the legislative

body may transfer it to the General Fund. Consequently, the sum of $3,957.84 from the Registered Bond Account may be escheated to the City as of this date.

RECOMMENDED ACTION

In accordance with the authority of the State Government Code and City of Los Angeles Administrative Code, it is recommended that City Council, subject to the approval of the Mayor, authorize the City Treasurer to transfer $3,957.84 from the Registered Bond Interest Account to the General Fund.
