ARTICLE1.DEFINITIONS

§3500.MeaningofWordsandGeneralDefinitions.

(a)Wordsshallhavetheirusualmeaningunlessthecontextoradefinitionclearlyindicatesadifferentmeaning.Wordsusedintheirpresenttenseincludethefuturetenseandwordsinthesingularformincludethepluralform.Useoftheword“shall”or“must”denotesmandatoryconduct;“may”denotespermissiveconduct;and“should”denotesrecommendedconduct.

(b)Asusedintheseregulations,thefollowingwordsandphrasesshallhavethefollowingdefinitions:

(1)“Applicant”meansanaturalpersonwhohasmadeapplicationtobeaStateLicensedRealEstateAppraiser,aStateCertifiedRealEstateAppraiser,aCourseProviderorapersonwhohasappliedforaTraineeLicense,aReciprocalLicenseoraTemporaryPracticePermit.ApplicantalsomeansanentityorControllingPersonthathasappliedforaCertificateofRegistrationasanAppraisalManagementCompany;

(2)(A)“AppraisalManagementCompany”meansanypersonorentitythatsatisfiesallofthefollowingconditions:

1.Maintainsanapprovedlistorlists,containing11ormoreindependentcontractorappraiserslicensedorcertifiedpursuanttoPart3(commencingwithsection11300),ofDivision4oftheBusinessandProfessionsCodeoremploys11ormoreappraiserslicensedorcertifiedpursuanttothatPart.

2.Receivesrequestsforappraisalsfromoneormoreclients.

3.Forafeepaidbyoneormoreofitsclients,delegatesappraisalassignmentsforcompletionbyitsindependentcontractororemployeeappraisers.

(B)“AppraisalManagementCompany”doesnotincludeanyofthefollowing,whenthatpersonorentitydirectlycontractswithanindependentappraiser:

1.Anybank,creditunion,trustcompany,savingsandloanassociation,orindustrialloancompanydoingbusinessundertheauthorityof,orinaccordancewith,alicense,

certificate,orcharterissuedbytheUnitedStatesoranystate,district,territory,orcommonwealthoftheUnitedStatesthatisauthorizedtotransactbusinessinthisstate.

2.AnyfinancelenderorfinancebrokerlicensedpursuanttoDivision9(commencingwithSection22000)oftheFinancialCode,whenactingundertheauthorityofthatlicense.

3.AnyresidentialmortgagelenderorresidentialmortgageservicerlicensedpursuanttoDivision20(commencingwithSection50000)oftheFinancialCode,whenactingundertheauthorityofthatlicense.

4.AnyrealestatebrokerlicensedpursuanttoPart1(commencingwithSection10000)ofDivision4oftheBusinessandProfessionsCode,whenactingundertheauthorityofthatlicense.

(C)“AppraisalManagementCompany”doesnotincludeanypersonlicensedtopracticelawinthisstatewhoisworkingwithoronbehalfofaclientofthatpersoninconnectionwithoneormoreappraisalsforthatclient;

(3)“AppraisalStandardsBoard(ASB)”meanstheboardofTheAppraisalFoundation;

(4)“AppraisalSubcommittee(ASC)”meanstheAppraisalSubcommitteeoftheFederalFinancialInstitutionsExaminationCouncil;

(5)“Appraiser”meansanindividualwhoholdsalicenseissuedbytheBureauofRealEstateAppraisers;

(6)“AppraiserQualificationsBoard(AQB)”meansthesubcommitteeofTheAppraisalFoundation.The“AppraiserQualificationsBoard”(AQB)istheboardofTheAppraisalFoundationwhichpromulgatestheminimumnationalrequirementsforlicensureforlicensedappraisers.Theminimumnationalrequirementsincludestheinterpretationsandclarification'softheappraiserqualificationscriteriaissuedbyAQB;

(7)“CertificateofRegistration”meansacertificateissuedbytheCaliforniaBureauofRealEstateAppraisersverifyingtheregistrationofapersonorentityasapprovedtoconductbusinessinCaliforniaasanAppraisalManagementCompany.

(8)“ControllingPerson”meansoneofmoreofthefollowing:

(A)AnofficerordirectorofanAppraisalManagementCompany,oranindividualthatholds10%orgreaterownershipinterestinanAppraisalManagementCompany.

(B)Anindividualemployed,appointedorauthorizedbyanAppraisalManagementCompanythathastheauthoritytoenterintoacontractualrelationshipwithclientsfortheperformanceofappraisalservicesandthathastheauthoritytoenterintoagreementswithindependentappraisersforthecompletionofappraisals.

(C)AnindividualwhopossessesthepowertodirectorcausethedirectionofthemanagementorpoliciesofanAppraisalManagementCompany.

(9)“CourseProvider”meansapersonororganizationthathasbeenapprovedbytheBureauofRealEstateAppraiserstoprovideeducationalcourseswithintheparameterssetforthherein.

(10)“DesignatedOfficer”meansaControllingPersonauthorizedbythegoverningstructureoftheAppraisalManagementCompanytoactonbehalfofthecompanyforpurposesofapplicationfor,andcompliancewith,aCertificateofRegistrationtooperateasanAppraisalManagementCompanypursuanttoCalifornialaw.TheDesignatedOfficershallberesponsibleforthesupervisionandcontrolofactivitiesconductedonbehalfoftheAppraisalManagementCompanybyitsofficersandemployeesasnecessarytosecurefullcompliancewiththeprovisionsofSB237(Chapter173,Statutesof2009),includingcontractservicesprovidedtotheAppraisalManagementCompanyfortheperformanceofappraisalactivitiesforwhichaCaliforniaRealEstateAppraisallicenseisrequired.

(11)“Chief”meanstheChiefofBREAorhisorherdesignee;

(12)“FIRREA”meanstheFinancialInstitutionsReform,RecoveryandEnforcementActof1989,PublicLaw101-73andanyamendmentsthereto;

(13)“Non-residentialproperty”meansallotherpropertyexceptonetofourunitresidentialstructuresandlandsuitableforonetofourunitresidentialuse;

(14)“Bureau”meanstheBureauofRealEstateAppraisers,and/ortheChief;

(15)“BREA”meanstheBureauofRealEstateAppraisers;

(16)“Registrant”meansapersonorentityauthorizedtoconductbusinessasanAppraisalManagementCompanyinCaliforniathroughissuanceofaCertificateofRegistrationbytheCaliforniaBureauofRealEstateAppraisers.

(17)“Registration”meanstheproceduresandrequirementswithwhichapersonorentityshallcomplyinordertoqualifytoconductbusinessasanAppraisalManagementCompany;

(18)“Residentialproperty”meansrealpropertycontaining,andlandsuitablefor,fourorfewerresidentialunits.

(19)“UniformStandardsofProfessionalAppraisalPractice;(USPAP)”meansthosestandardsasadoptedbytheAppraisalStandardsBoardoftheAppraisalFoundation.

ARTICLE2.GENERALREQUIREMENTS

§3521.ScopeofPractice.

ThetypesoffederallyrelatedtransactionswhichshallbeperformedbyeachclassoflicensedappraisersshallbeasprovidedinSection323.3ofPart323ofSubchapterBofChapterIIIofTitle12oftheCodeofFederalRegulations.

§3522.LicenseorCertificateofRegistration.

EachlicenseorCertificateofRegistrationshallshowonitsfaceinclearandconciselanguagethefollowinginformation:

(a)Thenameoftheholder;

(b)ThelicensenumberorCertificateofRegistrationnumber;

(c)Thescopeofauthorityconferredbythedocument;

(d)Whetherrestrictedorlimitedinanymanner,andifso,thenatureoftherestrictionorlimitation;and

(e)Thedatesofissuanceandexpirationofthedocument.

§3523.LicenseorCertificateofRegistrationPropertyoftheBureau.

EachlicenseorCertificateofRegistrationshallremainthepropertyoftheBureauandshallbesurrenderedtotheBureauoritsauthorizedrepresentativeuponorderoftheChief,unlessotherwiseorderedpursuanttotheseregulations.

§3524.TermofLicenseorCertificateofRegistration.

EveryoriginallicenseorCertificateofRegistrationshallbevalidforthetermsetforthinSections11341and11345.1oftheBusinessandProfessionsCodeunlessotherwiseorderedpursuanttotheseregulations.

§3525.TemporaryPracticePermit.

(a)Inlieuofobtainingalicense,appraiserswithcurrentlyvalidunrestrictedlicensesissuedbyanotherstatemaybeissuedaTemporaryPracticePermittoperformasingleappraisalassignment.

(b)ATemporaryPracticePermitisnotrequiredifanappraiserfromanotherstateassociateswithanappraiserlicensedinCaliforniaandtheworkislimitedtoassistinginthepreparationofanappraisalundertheconditionsspecifiedinBusinessandProfessionsCodeSection11324.

(c)TheapplicantshallhavesatisfiedtherequirementsforalicenseinastateorterritorywherethelicensingprovisionscomplywithTitleXIofFIRREAandwheretheAppraisalSubcommitteehasnotissuedafindingthatthepolicies,practices,orproceduresofthestateorterritoryareinconsistentwithTitleXI.

(d)Thelicenseheldshallbecurrentandingoodstandingwiththeissuingstateorterritory.

(e)ATemporaryPracticePermitisrequiredwhenanyappraiserentersCaliforniatoappraiseorprovidetechnicalreviewservicesinafederallyrelatedtransactionandtheappraiserisnotlicensedinCalifornia.

(f)ApplicationforaTemporaryPracticePermitshallbemadeonRequestforTemporaryPracticePermitFormREA3009(Rev.3/16/10)whichishereinincorporatedbyreference,oranyfederally-approvedequivalentformtotheBureauatitsprincipalofficeinSacramento,togetherwiththefeesspecifiedinSection3582andsuchinformationasmayberequestedbytheChief.

(g)AnappraisalassignmentundersuchtemporarypracticeshallbecompletedwithinoneyearafterissuanceoftheTemporaryPracticePermit,orwithintheperiodoftimethattheapplicantholdsavalid,currentlicenseinhisorherissuingstate,whicheverissooner.Shouldtheapplicant'slicensefromtheissuingstateexpirelessthanoneyearfromtheissuancedateoftheTemporaryPracticePermit,theBureaushallextendthetermoftheTemporaryPracticePermitforuptooneyearfromtheinitialdateofissuanceuponproofofrenewalofthelicensefromtheapplicant'sissuingstate.ThetermoftheTemporaryPracticePermitshallnotbeextendedbeyondoneyearfromtheinitialdateofissuance.

§3526.ConsenttoServiceofProcess.

(a)Eachapplicantforalicenseortemporarypracticepermitwhoisanon-residentofCaliforniashallcompletetheConsenttoServiceofProcessFormREA3006(Rev.5/8/00),whichishereinincorporatedbyreferenceoranyfederally-approvedequivalentform.

(b)AnyControllingPersonapplicantwhoisanon-residentofCaliforniashallcompletetheConsenttoServiceofProcessFormREA3006(Rev.5/8/00).

§3527.PersonalInformationorContactChange.

§3528.MinimumRequirements.

(a)Allapplicantsfor,andholdersof,anylicenseorpermitauthorizedbythischaptershallmeettheminimumrequirementssetforthinthischapterorthoseestablishedbytheAppraiserQualificationsBoard,whicheverisgreater.

(b)NotwithstandinganyotherprovisioninthisChapter,applicantsshallbeevaluatedbasedontheminimumrequirementsineffectonthedatebothacompleteapplicationisreceivedbytheBureauandtheapplicanthassuccessfullypassedtheexamination.

(1)“Completeapplication,”asusedinthissection,includes,butisnotlimitedto,completededucationandexperiencerequirements.

(2)“Applicant,”asusedinthissection,includes,butisnotlimitedto,existingBREAlicenseesapplyingforadifferentBREA-issuedlicense,includingappraiserslicensedpursuantto§3541(d)applyingforafederallyrecognizedlicense.

(c)AnyholderofaCertificateofRegistrationissuedbytheBureauofRealEstateAppraisersasauthorizedbythischapter,andanypersonorentityactinginacapacitythatrequiresaCertificateofRegistrationunderthischapter,shallmeettherequirementssetforthinArticle4forregistrationasanAppraisalManagementCompany.

§3529.Audits.

TheBureaumayreviewandaudittherecordsofapplicants,licensees,educationalproviders,registeredAppraisalManagementCompaniesandpersonsorentitiesactinginacapacitythatrequiresaCertificateofRegistration,todeterminecompliancewiththerequirementsofthischapterandstateandfederallaw.Applicants,licensees,educationalproviders,andregisteredAppraisalManagementCompaniesshallcooperatewiththeBureauintheconductofsuchauditsandprovideaccessduringnormalbusinesshourstorecordsandsuchinformationastheBureaudeemsreasonablynecessaryforthecompletionoftheaudit.

ARTICLE3.EXPERIENCEANDEDUCATIONREQUIREMENTS

§3541.MinimumExperienceRequirements.

(a)Tomeettheminimumexperiencerequirements,applicantsforcertifiedgeneralshallhaveaminimumof3,000hoursofrealpropertyappraisalexperienceobtainedcontinuouslyoveraperiodofnotlessthan30monthsinoneormoreofthecategorieslistedinSection3542.Ofthe3,000hours,

certifiedgeneralapplicantsmusthaveaminimum1,500hoursofnon-residentialappraisalexperienceinoneormoreofthecategorieslistedinSection3542.

(b)Tomeettheminimumexperiencerequirements,applicantsforcertifiedresidentialshallhaveaminimumof2,500hoursofrealpropertyappraisalexperienceobtainedcontinuouslyoveraperiodofnotlessthan30monthsinoneormoreofthecategorieslistedinSection3542.

(c)Tomeettheminimumexperiencerequirements,applicantsapplyingtobeastatelicensedrealestateappraisershallhave2,000hoursofrealestateappraisalexperienceobtainedoveraperiodofnotlessthan12monthsinoneormoreofthecategorieslistedinSection3542.

(d)Tomeettheminimumexperiencerequirements,realestatebrokersapplyingtobearesidentiallicensedrealestateappraisershallhaveavalidCaliforniarealestatebrokerslicenseand1,000hoursofrealestateappraisalexperienceinoneormoreofthecategorieslistedinSection3542.

(1)Appraiserslicensedpursuanttosubsection(d)whohavenotprovidedtheBureauwithsubstantiationoftheminimum2,000hoursofexperiencearenotincompliancewithminimumAQBlicensingcriteria.Accordingly,suchappraisersdonotholdafederallyrecognizedcredential,arenotauthorizedtoperformfederallyrelatedrealestateappraisalactivityasdefinedinBusinessandProfessionsCodesection11302(i),andwillnotbereportedtoASCforinclusionontheNationalRegistry.

(e)Amaximumof400hoursofexperienceinreviewofappraisalsmaybecreditedtowardstheminimumexperiencehours,nomorethan50%ofwhichmayconsistofdeskreviews.Onlythosereviewsperformedafterobtaining1,600hoursofacceptableexperienceinothercategoriesmaybecreditedtowardsmeetingminimumexperiencerequirements.

(f)AllexperienceclaimedmustbeinconformancewithUSPAPandcompletedafterJanuary30,1989.

§3542.AcceptableCategoriesofExperienceandCriteriaforEachCategory.

(a)AcceptablecategoriesofexperiencetomeettheminimumrequirementsofSection3541andthecriteriaforeachcategoryareasfollows:

(1)Feeandstaffappraisal(arealpropertyappraisalpreparedbyapersonwhoisemployedbyanother,usuallyalendinginstitutionorgovernmentagency,orwhoispaidafeefortheappraisalassignmentsheorsheperforms):

(A)Shallbeawrittendocument;

(B)Shallhaveusedtheentireappraisalprocess;

(C)Shallhaveusedallappraisalmethods(market,cost,income)customarilyusedforaparticularpropertytype(i.e.,residential,commercial,industrial,etc.);

(D)ShallconformtoUSPAP,particularlyStandardsRules1and2;and

(E)Analysismustbecompletedbytheapplicant.

(2)Advaloremtaxappraisal(arealestateappraisalpreparedbyanappraiserwhichestimatesavaluethatisusedforpropertytaxpurposes):

(A)Appraisal:

1.Shallbeawrittendocument;

2.Shalluseappraisalmethods(salescomparison,cost,income)requiredforthepropertytypebeingappraised(i.e.residentialornon-residential);

3.Shalleffectivelyusetheappraisalprocess;and

4.ShallconformtoUSPAP,particularlyStandardsRules1and2.

(B)MassAppraisal:

1.ShallconformtoUSPAP,particularlyStandardsRules1and2,or6.

(3)Reviewofanappraisal(fieldordesk):

(A)Shallbeawrittendocumentseparatefromtheappraisalitself;

(B)Thereviewshallbeofanappraisalpreparedeitherbyemployees,associatesorothers;

(C)Theappraisalbeingreviewedshallnotbesignedbythereviewer;

(D)Shallbea“technicalreview”wherethereviewappraiserformsanopinionastowhethertheanalyses,opinions,andconclusionsintheappraisalreportunderreviewareappropriateandreasonable,asopposedtoan“administrativereview”,whichisworkperformedbyclientsandusersofappraisalservicesasaduediligencefunctioninthecontextofmakingabusinessdecision(e.g.,underwriting,buying,selling,etc.);and

(E)TheworkshallconformtoUSPAP,particularlyStandardRule3.

(4)Appraisalanalysis:

(A)Shallbeawrittendocument;and

(B)TheworkshallconformtoUSPAP.

(A)ShallbeexperienceasanemployeeofaCaliforniaCountyAssessor'sOfficeortheCaliforniaBoardofEqualizationinsettingforthopinionsofvalueofrealpropertyfortaxpurposes,and;

1.Shallbeawrittendocument;

2.Shalluseappraisalmethods(salescomparison,cost,income)requiredforthepropertytypebeingappraised(i.e.residentialornon-residential);

3.Shalleffectivelyusetheappraisalprocess;and

4.ShallconformtoUSPAP,particularlyStandardsRules1and2,or6.

(10)Assistinginthepreparationofappraisals:

(A)Shallbeawrittendocument;

(B)Shalleffectivelyusetheappraisalprocessperformingmarketresearch,dataanalysisandapplyingtheappropriateappraisaltechniques.Theworkexperiencemustgobeyondsuchtasksastakingphotographs,typingtheappraisalreport,measuringimprovements,orfindingsalesthatmayormaynotbeusedintheappraisal.Atleast75%oftheprofessionalworkshallhavebeenperformedbytheapplicant;

(C)TheworkshallconformtoalloftheapplicableUSPAPstandards,statelawsandBureauofRealEstateAppraisers(BREA)regulations;and

(D)Amaximumof400hoursofassistinginthepreparationofappraisalsmaybeacceptedforcredittowardsmeetingtheminimumexperiencerequirements.

(11)Realestatevaluationexperiencesuchasthatofarealestatelendingofficerorarealestatebroker:

(A)Appraisal:SamerequirementsasCategory1;

(B)ReviewofAppraisals:SamerequirementsasCategory3;and

(C)Consulting:

1.Shallbeawrittendocument;and

2.TheworkshallconformtoUSPAP.

(b)Onlyappraisalsperformedforabusinesspurpose(e.g.loans,litigation,etc.)maybecreditedforpurposesofmeetingtheminimumexperiencerequirementsexceptthatexperiencegainedthroughcasestudiesandpracticumcoursesthatareapprovedbytheAQBCourseApprovalProgramortheBureaumaybecreditedfornomorethan50percentofthetotalexperiencerequirement.

(c)EachapplicantshallmeetadditionalrequirementsasmaybeestablishedfromtimetotimebytheAppraiserQualificationsBoardofTheAppraisalFoundation.


§3543.MinimumBasicandContinuingEducationRequirements.

(a)Minimumbasicandcontinuingrequirementsshallbeasfollows:

(1)AllcoursesshallmeettheminimumAQBrequirements;

(2)Allclassroomattendedcoursesshallbetakenthroughschoolsthatareaccreditedbyeither:

(2)Appraisersapplyingforrenewalofalicenseshallaverageatleast14hoursofaccreditedcontinuingeducationperyear;and

(a)Instructorsofappraisalcoursesmayreceivecreditforuptoone-halfofthecontinuingeducationrequirement.Teachingofappraisalcoursesshallnotbeacceptabletomeetminimumexperiencerequirements.

(b)Instructorsmustsubmitwrittenverificationoftheirinstructorexperience,whichshallinclude:

(1)NameofSchool;

(2)NameofAppraisalCourse;

ARTICLE4.APPLICATIONPROCESS

§3561.ApplicationforLicensing.

(a)ApplicationsforlicensingshallbevalidforoneyearfromdateofreceiptbytheBureau,duringwhichtimetheapplicantmustqualifyforadmissiontotheexamination.Theoneyearperiodshallnotbeextended.Iftheapplicantwishestobeconsideredforlicensureafterexpirationoftheoneyearperiod,heorshemustreapply,includingsubmissionofallnecessarydocumentsandpaymentofallapplicablefeesinaccordancewiththenexistingrequirements.

(b)ApplicantsforlicensingshallhaveanappropriateknowledgeoftheEnglishlanguage,includingreading,writingandspelling,andofarithmeticalcomputationscommontorealestateandappraisalpractices.

§3568.TraineeLicensesandSupervisingAppraiserResponsibilities.

(a)ToobtainaTraineeLicense,applicantsshallsatisfythefollowingminimumrequirements:

(1)Education:

(A)CompletionofbasiceducationwhichcoverstheminimumnumberofhoursandspecifictopicsrequiredbyAQBforaresidentiallevellicenseandmeetstheminimumrequirementsofSection3543;and

(B)15hoursofUSPAPwhichconsistsofthe15-hourNationalUSPAPCourseoritsequivalent.

(C)CompletionofaBREAapprovedcoursethat,ataminimum,complieswiththespecificationsforcoursecontentestablishedbytheAQB,whichisspecificallyorientedtotherequirementsandresponsibilitiesofsupervisingappraisersandtraineeappraisers.Thecourseisnoteligibletowardsthequalifyingeducationrequiredtoobtainthelicense.

(D)Alleducationshallbecompletedwithinthefive-yearperiodimmediatelyprecedingthedatetheapplicationwasreceivedbytheBureau.

(b)Toaccrueacceptableexperience,traineelicenseesshall:

(1)AcquireexperiencepursuanttoSection3542.

(2)Workunderthedirecttechnicalsupervisionofanappraiserlicensedatthecertifiedlevelandingoodstanding.

(3)MaintainanappraisalloginconformancewiththerequirementsofSection3563.

(c)Traineesshallmaintaincopiesofappraisalreportswhichappearonthelog.

(d)TraineesshallcomplywiththecontinuingeducationrequirementsofSection3543.

(e)Thesupervisingappraisershall:

(1)PersonallyinspectthepropertywiththetraineeuntilthetraineeiscompetenttomakeunsupervisedinspectionsinaccordancewiththeCompetencyRuleofUSPAPforthetypeofpropertybeingappraised;

(2)Reviewthetrainee'sappraisalreport;

(3)AcceptresponsibilityfortheappraisalreportbysigningandcertifyingthatthereportisincompliancewithUSPAP;

(4)Reviewandinitialeachpageofthetrainee'sLogofAppraisalExperienceFormREA3004(Rev.4/7/08)andverifyunderpenaltyofperjurythattheworkwascompletedunderhis/hersupervision;and

(5)Maintainrecordsofthetrainee'sappraisalsinaccordancewithUSPAP.

(f)Supervisingappraisersshall:

(1)belicensedatthecertifiedlevelforaminimumofthreeyearswiththeBureaupriortobeingeligibletobecomeasupervisingappraiser;

(2)beingoodstandingwiththeBureauforaperiodofatleastthreeyears;

(3)notsupervisemorethanthreetraineesatonetime;

(4)notbesubjecttoanydisciplinaryactionwithinanyjurisdictionwithinthelastthreeyears,thataffectsthesupervisor’slegaleligibilitytoengageinappraisalpractice;and

(5)completeaBREAapprovedcoursethat,ataminimum,complieswiththespecificationsforcoursecontentestablishedbytheAQB,whichisspecificallyorientedtotherequirementsandresponsibilitiesofsupervisingappraisersandtraineeappraisers.Thecourseshallbecompletedbythesupervisingappraiserpriortosupervisingtraineeappraisers.


§3569.Reciprocity.

(a)AnapplicantforareciprocallicenseshallholdavalidcredentialfromastatethatisincompliancewithTitleXIoftheFinancialInstitutionsReform,Recovery,andEnforcementActof1989asdeterminedbytheAppraisalSubcommittee.Thecredentialingrequirementsoftheapplicant’scredentialingstate(astherequirementsexistatthetimeofapplicationforreciprocallicense)mustmeetorexceedthoseofBREA(astherequirementsexistatthetimeofapplicationforreciprocalcredential).

(b)Applicantsforareciprocallicenseshallcompleteandsubmitthefollowing:

(1)ApplicationforReciprocalLicenseFormREA3025(Rev.5/8/00)andformREA3006(Rev.5/8/00);and

(2)Evidencethattheapplicantholdsavalidcredentialfromanotherstate.

(f)(1)NoAppraisalManagementCompanyshallimproperlyinfluenceorattempttoimproperlyinfluencethedevelopmentofanappraisalreportorreviewbyengagingin,withoutlimitation,anyofthefollowingactions:

(A)WithholdingorthreateningtowithholdthetimelypaymentforacontractedappraisalassignmentthatiscompletedinaccordancewiththeUniformStandardsofProfessionalAppraisalPracticeandwithcontractualprovisionsasagreedtobytheAppraisalManagementCompanyandtheappraisalcontractor;

(B)Withholdingorthreateningtowithholdfuturebusinesswithanappraisalcontractorsolelybasedonanappraisalresult;

(C)Basingtheappraisalfeeforanappraisalassignmentonapre-determinedvalue;

(D)Attemptingtoinfluencethedevelopmentofanappraisalassignmentthroughcoercion,extortionorbribery;

(E)Expresslyorimpliedlypromisingfuturebusiness,promotions,orincreasedcompensationforacontractedappraiserbasedoncertainbusinesspracticesnotincompliancewiththeUniformStandardsofProfessionalAppraisalPractice;

(2)Subdivision(f)(1)ofthisSectiondoesnotprohibitanAppraisalManagementCompanyoranindividualwithaninterestinarealestatetransactionfromrequestinganappraiserto:

(A)Consideradditionalappropriatepropertyinformationincludingrelevantsalescomparablesnotconsideredintheinitialappraisalreport;

(h)TheappraisershallnotberequiredtoprovidetheAppraisalManagementCompanywiththeappraiser'sdigitalsignature.

ARTICLE5.FEES

§3581.Fees.

(a)FeespaidtotheBureaushallbesubmittedintheformofamoneyorder,certifiedcheck,cashiers'check,preprintedpersonalorcompanycheck,orgovernmentalpurchaseorderwhichshallclearlyindicatethenameoftheapplicantorlicenseetowhomitapplies.Notwithstandinganyothersection,theBureaumaydelayperformanceofanyserviceuntilthepersonalorcompanycheckclearsandthefundsaredepositedintheBureau'saccounts.

(b)Cashisnotacceptableforpaymentofanyfee.

(c)Paymentofanyfee,fineorpenaltysubmittedintheformofapreprintedpersonalorcompanycheckwhichwassubsequentlydishonoredbytheissuinginstitutionshallbesubmittedtotheBureauintheformofamoneyorder,certifiedcheck,cashiers'check,orgovernmentpurchaseorder.

§3622.Re-Examination.

(a)Applicantswhofailanexaminationmayapplyforre-examinationbysubmittingthefollowing:

(G)Identityandsignatureofverifierofcoursecompletion;and

(H)Thecoursesponsormayincludesuchadditionalinformationinthisdocumentasitdeemsnecessary.

(3)Participantsshallbephysicallypresentduringatleast90%oftheofferingtime(54minutesoutofeach60minutesofinstructiontime),exclusiveofthetimeallocatedtotheadministeringofabasiceducationfinalexamination;and

(4)Eachinstructorshallhaveatleastoneofthefollowing:

(A)Abachelor'sdegreeorhigherdegreeinafieldrelatedtorealestateappraisingfromaschoollistedasaninstitutionofhigherlearningbytheU.S.OfficeofEducation,orfromacomparableschoolofaforeigncountry;

(B)Avalidteachingcredentialorcertificateauthorizingtheholdertoteachinthefieldofknowledgecoveredintheoffering;

(C)Fiveyearsfull-timeexperienceinthefieldbeingtaught;or

(D)Acombinationoffull-timeexperienceandfulltimecollege-leveleducationtotalingatleastfiveyears.

(b)Inadditionto(a)above,requirementsforbasiceducationaccreditationshallbeasfollows:

(1)EachcourseshallhaveafinalexamperAQBestablishedappraiserqualificationcriteria;and

(2)Examinationquestionstobeincludedinthefinalexaminationshallnotbereviewedwithstudentsbefore,duringorafterthecourse.

(3)EachcourseshallmeettheminimumcourselengthrequirementsestablishedbyAQB.


§3662.AccreditationApplication.

(a)Courseprovidersdesiringtobeaccreditedand/ortohaveacourseaccreditedshallsubmitCourseProviderAccreditation,REAForm3013(Rev.5/8/00),CourseAccreditationandDescription,REAForm3014(Rev.5/8/00)andBREATopicMatrix,REAForm3015(Rev.5/8/00),whicharehereinincorporatedbyreference,asapplicable.

(b)Theapplicationshallbesignedbythecourseprovider'sChiefExecutiveOfficer.

(c)TheChiefExecutiveOfficerofthecourseprovidermaydelegateauthoritytosigntheCourseProviderAccreditation,REAForm3013(Rev.5/8/00),CourseAccreditationandDescription,REAForm3014(Rev.5/8/00)andBREATopicMatrix,REAForm3015(Rev.5/8/00),byfilingwithBREAawrittendelegationofauthoritytoactonbehalfofthecourseproviderforaccreditationmatters.

(d)Onlyonesuchdelegationofauthorityshallbevalidatanypointintimefortheeducationactivitiesofthecourseproviderwithinaparticularstate.

(e)Thedelegationofauthorityshallbevalidforamaximumoffouryears,andmayberevokedbytheChiefExecutiveOfficerbyfilingawrittenrevocationofthedelegationofauthoritywithBREA.Anewdelegationofauthority,inwriting,mustbesubmittedto,andreceivedby,BREAwithin30daysofachangeinthecourseprovider'sChiefExecutiveOfficer.


§3663.AdditionalApproval.

(a)ProposedcourseofferingsmayalsorequiretheapprovaloftheCouncilofPrivatePostSecondaryandVocationalEducationpursuanttothePrivatePostSecondaryandVocationalEducationReformActof1989(EducationCodeSections94300,etseq.)IfsuchapprovalisrequiredbytheCouncilofPrivatePostSecondaryandVocationalEducation,thecourseprovidershallforwardacopyofsaidapprovaltotheBureauaspartoftheirApplication.

(b)ItistheresponsibilityofthecourseprovidertoensurethatanysuchresponsibilitiesunderthatActaresatisfied,andthatBREAisprovidedsatisfactorynotification.


§3664.MaterialChangeinEducationCourseOffering,SchoolManagementorSchoolOperatingPolicies.

(a)Anyproposedmaterialchangetoanaccreditededucationoffering,schoolmanagementorschooloperatingpoliciesshallbesubmittedbytheprovidertotheBureauforconsiderationandapprovalpriortouse,togetherwithanewaccreditationapplicationandfee.

(b)“Materialchange”meansasignificantdeviationinoneormoreaspectsfromthecourseoffering,schoolownership,managementoroperatingpoliciesasapprovedbytheBureau,includingbutnotlimitedtoachangeincurriculum,courselength,formorsubstanceofthefinalexamination,workbooks,textsorsyllabi,butnotincludingchangesdesignedexclusivelytoreflectrecentchangesinstatutes,regulationsordecisionallaw;


§3665.RecordKeeping.

(a)Thecourseprovidershallmaintainastudentrecordforeachparticipantforaperiodofatleastfiveyearsfromcompletionofthecourse.Therecordshallinclude,ataminimum,thefollowinginformation:

(1)TheBureau'saccreditationnumberfortheoffering;

(2)Nameandaddressofeachparticipant;

(3)Coursetitleandhoursofcreditapproved;

(4)Date(s)ofcourseanddatecourseiscompleted;

(5)Nameandaddressofcourseprovider;

(6)Identityofverifierofattendance;and

(7)Coursegradeorotherevidenceofsatisfactorycompletion.

(b)Thecourseprovidershallmaintainbusinessrecordsforaperiodofatleastfiveyears.Therecordsshallinclude,ataminimum,thefollowinginformation:

(1)BusinessandmailingaddressofcourseproviderasonfilewiththeBureau;

(2)Writtenrecordsofattendanceandgradesforeachstudent;and

(3)Theprincipalplaceofbusinessorthemailingaddressatwhicheachoftheaccreditedbasiceducationandcontinuingeducationinstructorscanbecontacted.

(c)UponreceiptofarequestfromtheChief,therecordsspecifiedinthissectionshallbesubmittedtotheBureauwithin30days.

(d)Wheneverthereisachangeinthebusinessormailingaddressofthecourseprovider,thecourseprovidershallnotifytheChiefinwritingwithin10daysofthechange.


§3666.Advertising.

Anyadvertisingbyoronbehalfofacourseproviderforrealestateorrealestateappraisalrelatededucationalservicesshall:

(a)ClearlyidentifytheproviderasbeinganBREAapprovedrealestateappraisaleducationalcourseproviderandtheprovider'sBREAapprovalnumber;

(b)ClearlyidentifythosecourseswhichhavebeenaccreditedbyBREAandtheirBREAapprovalnumber,or,inthealternative,include:

(1)AclearstatementthatnotallcoursesofferedbythecourseproviderarenecessarilyBREAapproved;and

(2)AclearlylegibletelephonenumberandaddressforthecourseproviderwhichmaybeutilizedbythoseinterestedindeterminingifaspecificcourseofferedbytheproviderhasbeenapprovedbyBREA,anditsapprovalnumber.

(c)Clearlycontainthedateofinitialpublicationordistribution;

(d)NotstateorimplyanendorsementofthecourseprovideroranycoursesbyBREAortheStateofCaliforniaotherthanthefactofaccreditationasindicatedin(a)and(b)ofthissection;

(e)Notincludeanyfalse,misleadingordeceptiveinformation;

(f)Notcontainanyasteriskorotherreferencesymboltocontradictortochangetheordinarymeaningofthematerialinthebodyoftheadvertisement;and

(g)Notcontainanyoffersorinducementsprecludedbylaw.


§3667.Subcontractors,AgentsandFranchisees.

(a)Courseprovidersshallberesponsiblefortheactionsoftheirsubcontractors,agentsandfranchiseesforactivitiessubjecttothisarticleandshallensurethatsaidpersonsandentitiescomplywiththisarticle'sprovisions.

(b)ContractsenteredintobyoronbehalfofcourseprovidersforservicessubjecttothisarticleshallcontainarequirementthattheserviceprovidercomplywiththeprovisionsofthisArticle.


§3668.DenialorWithdrawalofEducationAccreditation.

(a)AcourseshallnotbeaccreditediftheChiefdeterminesthatthecourseorcourseproviderfailstosatisfytherequirementsofArticle9oftheseregulations.

(b)AccreditationshallbewithdrawniftheChiefdeterminesthatthecourseorcourseproviderfailstosatisfyorhasviolatedtherequirementsofArticle9oftheseregulations.

(c)Theprocessfordenialorwithdrawalshallbeasfollows:

(1)ThedeterminationbytheChiefshallbesubmittedtothecourseproviderinwritingsettingforththereasonsforthedetermination;

(2)Within30daysofreceiptoftheChief'swrittendetermination,thecourseprovidermaysubmitawrittenrequestforahearing;

(3)TheChiefshallholdahearingwithin90daysofreceiptofthewrittenrequestforahearingunlessanotherhearingdateisagreeduponbybothparties;

(4)TheChiefshallissueawrittendecisionwithin30daysofcompletionofthehearing;and

(5)Ifahearingisnotheldpursuantto(3)aboveoradecisionisnotissuedpursuantto(4)above,accreditationwillbedeemedtohavebeengivenbytheChief.

(d)Accreditationshallautomaticallyexpireafterfouryearsoranytimethecoursehasnotbeenofferedbythecourseproviderintwoconsecutiveyears.

(e)Inanyhearing,theburdenofprovingthatthecoursecomplieswiththerequirementsofArticle9oftheseregulationsisonthepartyseekingtheaccreditation.

(f)Noapplicantshallbegivencreditforanycourseworkcommencedaftertheeffectivedateofwithdrawalofaccreditation.


§3669.CourseCreditAfterRevocation.

Ifanofferingwasaccreditedatthetimeofregistrationbyanappraiser,creditfortheofferingshallbegiventotheappraiseratthetimeofinitiallicensureoruponrenewalnotwithstandingthefactthatapprovalmayhavebeenrevokedatthetimethattheapplicantsuccessfullycompletedtheofferingexceptintheeventofcollusion.


ARTICLE10.RENEWALPROCEDURES

§3681.RenewalApplication.

(a)AlicensemayberenewedbysubmittingthefollowingtotheBureau:

(1)AppropriatefeesincludingstateandfederalregistryfeespursuanttoSection3582;

(4)FormREA3012(Rev.5/8/00)RenewalApplicationwhichishereinincorporatedbyreference.

(b)Therenewedlicenseshallbevalidforamaximumoftwoyearsfromthedateofexpirationofthepriorlicense,providedtheRenewalApplicationisreceivedbytheBureaubeforemidnightofthelastdayoftheperiodforwhichthepreviouslicensewasissued,accompaniedbytheapplicablerenewalfeesandevidenceofgoodfaithcompliancewiththeprovisionsofthisArticle.

§3682.LateRenewals.

(a)Ifanappraiserfailstorenewhisorherlicensepriortoitsexpiration,theappraisermayrenewthelicensewithintwoyearsafterexpirationofthepreviouslyheldlicensebysatisfyingalloftherequirementsforrenewalofthelicenseandbythepaymentofallapplicablefees.

(b)Appraisalsinfederallyrelatedtransactionsmaynotbeperformedduringthetwoyeargraceperiodimmediatelyfollowingthedatetheappraiser'slicenseexpires,unlessanduntilarenewedlicenseisissued.

(c)Anappraiserapplyingforlaterenewalshall,priortothesubmissionofhisorherapplicationforlaterenewal,completeatleast10hours(proratedsemiannually)ofcontinuingeducationforeachyearsincetheexpirationofthelicensefortheperiodoccurringuptoandincludingDecember31,1997,andatleast14hours(proratedsemiannually)ofcontinuingeducationforeachyearsincetheexpirationofthelicensefortheperiodoccurringonorafterJanuary1,1998,inadditiontomeetingtherequirementsofSection3543.

§3701.StandardsofProfessionalAppraisalPractice.

§3705.ResponsibilityforAppraisalReports,Signatures.

(a)EveryappraisalreportsubjecttotheUniformStandardsofProfessionalAppraisalPracticeuponfinalcompletionshallbearthesignatureandlicensenumberoftheappraiserandofthesupervisingappraiser,ifappropriate.Theaffixingofsuchsignatureandnumberconstitutetheacceptancebytheappraiserandsupervisingappraiseroffullandpersonalresponsibilityfortheaccuracy,content,andintegrityoftheappraisalunderStandardsRules1and2ofUSPAP.

(a)TheChiefmayissueacitation,orderofabatement,assessafineorprivateorpublicreproval,suspendorrevokeanylicenseorCertificateofRegistration,and/ormaydenytheissuanceorrenewalofalicenseorCertificateofRegistrationofanypersonorentityactinginacapacityrequiringalicenseorCertificateofRegistrationwhohas:

(1)Beenconvictedofafelonyoranycrimewhichissubstantiallyrelatedtothequalifications,functions,ordutiesoftheprofessionofrealestateappraisal;

(3)Forging,counterfeitingoralteringanyinstrumentaffectingtherightsorobligationsofanother;

(4)Evasionofalawfuldebtorobligation,includingbutnotlimitedtotaxobligations;

(5)Trafficinanynarcoticorcontrolledsubstanceinviolationoflaw;

(6)Drivingundertheinfluenceofalcoholordrugs,whileconductingbusinessrelatedtorealestateappraisals;convictionoffelonydrivingundertheinfluenceofalcoholordrugs;or

(c)Theweighttobeaccordedtoasubstantiallyrelatedcrimeoractunder(a)or(b)shallbedeterminedbyapplicationofthefollowingstandards:

(1)Theextenttowhichtheparticularactsoromissionshaveadverselyaffectedotherpersons,includingbutnotlimitedtolenders,clients,employersorotherpersons;andtheprobabilitythatsuchadverseeffectswillcontinue;

§3730.SuspensionofLicenseAfterInformalConference.

§3732.RestrictedorConditionalLicense.

Arestrictedorconditionallicenseissuedpursuanttothischaptershallcontaintherestrictionorconditionuntilitislifted,inwriting,bytheChief.

(a)Inordertohavetheconditionorrestrictionremoved,thelicenseeshallsubmittotheBureaualetterrequestingtheconditionorrestrictionbelifted,alongwithappropriateevidenceofcompliancewithanyrestrictionorcondition,andtheappropriatefeeasprovidedinSection3582.

(b)TheChiefmay,withouthearing,issueanordersuspendingalicensee'srighttofurtherexerciseanyprivilegesgrantedunderarestrictedorconditionallicensependingfinaldeterminationmadeafterformalhearing,except,thatarestrictedorconditionallicenserequiringcompletionofeducationalrequirementsshallbeautomaticallysuspendeduponthelicensee'sfailuretocomplywiththeconditionorrestriction.ThesuspensionshallnotbelifteduntilthesuspendedlicenseehassubmittedtherequiredevidenceofcoursecompletionwiththeappropriatefeesasprovidedinSection3582,andtheChiefhasgivenwrittennoticetothelicenseeoftheliftingofthesuspension.

§3733.DisciplinaryGuidelines.

InreachingadecisiononadisciplinaryactionundertheAdministrativeProcedureAct(GovernmentCodeSection11400etseq.),theBureaushallconsiderthedisciplinaryguidelinesentitled“AManualofDisciplinaryGuidelinesandModelDisciplinaryOrders”[Rev.2015]whichareherebyincorporatedbyreference.Deviationfromtheseguidelinesandorders,includingthestandardtermsofprobation,isappropriatewheretheBureauand/oradministrativelawjudgesinits/hisorherdiscretiondeterminesthatthefactsoftheparticularcasewarrantsuchadeviation--forexample:thepresenceofmitigatingfactors;theageofthecase;evidentiaryproblems.

§3741.ConsentDeterminations.

(a)AtanytimeaftertheChiefhasservedaNoticeofConference,oraftertheChiefhasservedaStatementofIssuesoranAccusationagainstanapplicant,licensedappraiser,orRegistrantandaNoticeofDefensehasbeenfiled,theapplicant,licensee,orRegistrantandtheBureaumayenterintoasettlementupontermswhichincludeaplanforabatementoftheviolationorrehabilitationorre-qualificationoftheapplicant,licensedappraiser,orRegistrantwithinaspecifiedtime,consistentwithotherprovisionsoflawandregulations.

(b)IftheChiefdeterminesthatthepublicinterestwouldnotbeprejudicedbyasettlementofthedisputedfactsbytheissuanceofarestrictedlicenseorCertificateofRegistrationhe/shemayordersuchissuanceuponsuchlawfultermsandconditionsashe/shemaydeemappropriatetoimposeandwhichtheapplicant,licensedappraiser,orRegistrantmaydeemappropriatetoaccept.
