(a) Words shall have their usual meaning unless the context or a definition clearly indicates a different meaning. Words used in their present tense include the future tense and words in the singular form include the plural form. Use of the word “shall” or “must” denotes mandatory conduct; “may” denotes permissive conduct; and “should” denotes recommended conduct. (b) As used in these regulations, the following words and phrases shall have the following definitions: (1) “Applicant” means a natural person who has made application to be a State Licensed Real Estate Appraiser, a State Certified Real Estate Appraiser, a Course Provider or a person who has applied for a Trainee License, a Reciprocal License or a Temporary Practice Permit. Applicant also means an entity or Controlling Person that has applied for a Certificate of Registration as an Appraisal Management Company; (2)(A) “Appraisal Management Company” means any person or entity that satisfies all of the following conditions: 1. Maintains an approved list or lists, containing 11 or more independent contractor appraisers licensed or certified pursuant to Part 3 (commencing with section 11300), of Division 4 of the Business and Professions Code or employs 11 or more appraisers licensed or certified pursuant to that Part. 2. Receives requests for appraisals from one or more clients. 3. For a fee paid by one or more of its clients, delegates appraisal assignments for completion by its independent contractor or employee appraisers. (B) “Appraisal Management Company” does not include any of the following, when that person or entity directly contracts with an independent appraiser: 1. Any bank, credit union, trust company, savings and loan association, or industrial loan company doing business under the authority of, or in accordance with, a license,

ARTICLE1.DEFINITIONS

§3500.MeaningofWordsandGeneralDefinitions.

(a)Wordsshallhavetheirusualmeaningunlessthecontextoradefinitionclearlyindicatesadifferentmeaning.Wordsusedintheirpresenttenseincludethefuturetenseandwordsinthesingularformincludethepluralform.Useoftheword“shall”or“must”denotesmandatoryconduct;“may”denotespermissiveconduct;and“should”denotesrecommendedconduct.

(b)Asusedintheseregulations,thefollowingwordsandphrasesshallhavethefollowingdefinitions:

(1)“Applicant”meansanaturalpersonwhohasmadeapplicationtobeaStateLicensedRealEstateAppraiser,aStateCertifiedRealEstateAppraiser,aCourseProviderorapersonwhohasappliedforaTraineeLicense,aReciprocalLicenseoraTemporaryPracticePermit.ApplicantalsomeansanentityorControllingPersonthathasappliedforaCertificateofRegistrationasanAppraisalManagementCompany;

(2)(A)“AppraisalManagementCompany”meansanypersonorentitythatsatisfiesallofthefollowingconditions:

1.Maintainsanapprovedlistorlists,containing11ormoreindependentcontractorappraiserslicensedorcertifiedpursuanttoPart3(commencingwithsection11300),ofDivision4oftheBusinessandProfessionsCodeoremploys11ormoreappraiserslicensedorcertifiedpursuanttothatPart.

2.Receivesrequestsforappraisalsfromoneormoreclients.

3.Forafeepaidbyoneormoreofitsclients,delegatesappraisalassignmentsforcompletionbyitsindependentcontractororemployeeappraisers.

(B)“AppraisalManagementCompany”doesnotincludeanyofthefollowing,whenthatpersonorentitydirectlycontractswithanindependentappraiser:

1.Anybank,creditunion,trustcompany,savingsandloanassociation,orindustrialloancompanydoingbusinessundertheauthorityof,orinaccordancewith,alicense,

certificate,orcharterissuedbytheUnitedStatesoranystate,district,territory,orcommonwealthoftheUnitedStatesthatisauthorizedtotransactbusinessinthisstate.

2.AnyfinancelenderorfinancebrokerlicensedpursuanttoDivision9(commencingwithSection22000)oftheFinancialCode,whenactingundertheauthorityofthatlicense.

3.AnyresidentialmortgagelenderorresidentialmortgageservicerlicensedpursuanttoDivision20(commencingwithSection50000)oftheFinancialCode,whenactingundertheauthorityofthatlicense.

4.AnyrealestatebrokerlicensedpursuanttoPart1(commencingwithSection10000)ofDivision4oftheBusinessandProfessionsCode,whenactingundertheauthorityofthatlicense.

(C)“AppraisalManagementCompany”doesnotincludeanypersonlicensedtopracticelawinthisstatewhoisworkingwithoronbehalfofaclientofthatpersoninconnectionwithoneormoreappraisalsforthatclient;

(3)“AppraisalStandardsBoard(ASB)”meanstheboardofTheAppraisalFoundation;

(4)“AppraisalSubcommittee(ASC)”meanstheAppraisalSubcommitteeoftheFederalFinancialInstitutionsExaminationCouncil;

(5)“Appraiser”meansanindividualwhoholdsalicenseissuedbytheBureauofRealEstateAppraisers;

(6)“AppraiserQualificationsBoard(AQB)”meansthesubcommitteeofTheAppraisalFoundation.The“AppraiserQualificationsBoard”(AQB)istheboardofTheAppraisalFoundationwhichpromulgatestheminimumnationalrequirementsforlicensureforlicensedappraisers.Theminimumnationalrequirementsincludestheinterpretationsandclarification'softheappraiserqualificationscriteriaissuedbyAQB;

(7)“CertificateofRegistration”meansacertificateissuedbytheCaliforniaBureauofRealEstateAppraisersverifyingtheregistrationofapersonorentityasapprovedtoconductbusinessinCaliforniaasanAppraisalManagementCompany.

(8)“ControllingPerson”meansoneofmoreofthefollowing:

(A)AnofficerordirectorofanAppraisalManagementCompany,oranindividualthatholds10%orgreaterownershipinterestinanAppraisalManagementCompany.

(B)Anindividualemployed,appointedorauthorizedbyanAppraisalManagementCompanythathastheauthoritytoenterintoacontractualrelationshipwithclientsfortheperformanceofappraisalservicesandthathastheauthoritytoenterintoagreementswithindependentappraisersforthecompletionofappraisals.

(C)AnindividualwhopossessesthepowertodirectorcausethedirectionofthemanagementorpoliciesofanAppraisalManagementCompany.

(9)“CourseProvider”meansapersonororganizationthathasbeenapprovedbytheBureauofRealEstateAppraiserstoprovideeducationalcourseswithintheparameterssetforthherein.

(10)“DesignatedOfficer”meansaControllingPersonauthorizedbythegoverningstructureoftheAppraisalManagementCompanytoactonbehalfofthecompanyforpurposesofapplicationfor,andcompliancewith,aCertificateofRegistrationtooperateasanAppraisalManagementCompanypursuanttoCalifornialaw.TheDesignatedOfficershallberesponsibleforthesupervisionandcontrolofactivitiesconductedonbehalfoftheAppraisalManagementCompanybyitsofficersandemployeesasnecessarytosecurefullcompliancewiththeprovisionsofSB237(Chapter173,Statutesof2009),includingcontractservicesprovidedtotheAppraisalManagementCompanyfortheperformanceofappraisalactivitiesforwhichaCaliforniaRealEstateAppraisallicenseisrequired.

(11)“Chief”meanstheChiefofBREAorhisorherdesignee;

(12)“FIRREA”meanstheFinancialInstitutionsReform,RecoveryandEnforcementActof1989,PublicLaw101-73andanyamendmentsthereto;

(13)“Non-residentialproperty”meansallotherpropertyexceptonetofourunitresidentialstructuresandlandsuitableforonetofourunitresidentialuse;

(14)“Bureau”meanstheBureauofRealEstateAppraisers,and/ortheChief;

(15)“BREA”meanstheBureauofRealEstateAppraisers;

(16)“Registrant”meansapersonorentityauthorizedtoconductbusinessasanAppraisalManagementCompanyinCaliforniathroughissuanceofaCertificateofRegistrationbytheCaliforniaBureauofRealEstateAppraisers.

(17)“Registration”meanstheproceduresandrequirementswithwhichapersonorentityshallcomplyinordertoqualifytoconductbusinessasanAppraisalManagementCompany;

(18)“Residentialproperty”meansrealpropertycontaining,andlandsuitablefor,fourorfewerresidentialunits.

(19)“UniformStandardsofProfessionalAppraisalPractice;(USPAP)”meansthosestandardsasadoptedbytheAppraisalStandardsBoardoftheAppraisalFoundation.

ARTICLE2.GENERALREQUIREMENTS

§3521.ScopeofPractice.

ThetypesoffederallyrelatedtransactionswhichshallbeperformedbyeachclassoflicensedappraisersshallbeasprovidedinSection323.3ofPart323ofSubchapterBofChapterIIIofTitle12oftheCodeofFederalRegulations.

§3522.LicenseorCertificateofRegistration.

EachlicenseorCertificateofRegistrationshallshowonitsfaceinclearandconciselanguagethefollowinginformation:

(a)Thenameoftheholder;

(b)ThelicensenumberorCertificateofRegistrationnumber;

(c)Thescopeofauthorityconferredbythedocument;

(d)Whetherrestrictedorlimitedinanymanner,andifso,thenatureoftherestrictionorlimitation;and

(e)Thedatesofissuanceandexpirationofthedocument.

§3523.LicenseorCertificateofRegistrationPropertyoftheBureau.

EachlicenseorCertificateofRegistrationshallremainthepropertyoftheBureauandshallbesurrenderedtotheBureauoritsauthorizedrepresentativeuponorderoftheChief,unlessotherwiseorderedpursuanttotheseregulations.

§3524.TermofLicenseorCertificateofRegistration.

EveryoriginallicenseorCertificateofRegistrationshallbevalidforthetermsetforthinSections11341and11345.1oftheBusinessandProfessionsCodeunlessotherwiseorderedpursuanttotheseregulations.

§3525.TemporaryPracticePermit.

(a)Inlieuofobtainingalicense,appraiserswithcurrentlyvalidunrestrictedlicensesissuedbyanotherstatemaybeissuedaTemporaryPracticePermittoperformasingleappraisalassignment.

(b)ATemporaryPracticePermitisnotrequiredifanappraiserfromanotherstateassociateswithanappraiserlicensedinCaliforniaandtheworkislimitedtoassistinginthepreparationofanappraisalundertheconditionsspecifiedinBusinessandProfessionsCodeSection11324.

(c)TheapplicantshallhavesatisfiedtherequirementsforalicenseinastateorterritorywherethelicensingprovisionscomplywithTitleXIofFIRREAandwheretheAppraisalSubcommitteehasnotissuedafindingthatthepolicies,practices,orproceduresofthestateorterritoryareinconsistentwithTitleXI.

(d)Thelicenseheldshallbecurrentandingoodstandingwiththeissuingstateorterritory.

(e)ATemporaryPracticePermitisrequiredwhenanyappraiserentersCaliforniatoappraiseorprovidetechnicalreviewservicesinafederallyrelatedtransactionandtheappraiserisnotlicensedinCalifornia.

(f)ApplicationforaTemporaryPracticePermitshallbemadeonRequestforTemporaryPracticePermitFormREA3009(Rev.3/16/10)whichishereinincorporatedbyreference,oranyfederally-approvedequivalentformtotheBureauatitsprincipalofficeinSacramento,togetherwiththefeesspecifiedinSection3582andsuchinformationasmayberequestedbytheChief.

(g)AnappraisalassignmentundersuchtemporarypracticeshallbecompletedwithinoneyearafterissuanceoftheTemporaryPracticePermit,orwithintheperiodoftimethattheapplicantholdsavalid,currentlicenseinhisorherissuingstate,whicheverissooner.Shouldtheapplicant'slicensefromtheissuingstateexpirelessthanoneyearfromtheissuancedateoftheTemporaryPracticePermit,theBureaushallextendthetermoftheTemporaryPracticePermitforuptooneyearfromtheinitialdateofissuanceuponproofofrenewalofthelicensefromtheapplicant'sissuingstate.ThetermoftheTemporaryPracticePermitshallnotbeextendedbeyondoneyearfromtheinitialdateofissuance.

§3526.ConsenttoServiceofProcess.

(a)Eachapplicantforalicenseortemporarypracticepermitwhoisanon-residentofCaliforniashallcompletetheConsenttoServiceofProcessFormREA3006(Rev.5/8/00),whichishereinincorporatedbyreferenceoranyfederally-approvedequivalentform.

(b)AnyControllingPersonapplicantwhoisanon-residentofCaliforniashallcompletetheConsenttoServiceofProcessFormREA3006(Rev.5/8/00).

§3528.MinimumRequirements.

(a)Allapplicantsfor,andholdersof,anylicenseorpermitauthorizedbythischaptershallmeettheminimumrequirementssetforthinthischapterorthoseestablishedbytheAppraiserQualificationsBoard,whicheverisgreater.

(b)NotwithstandinganyotherprovisioninthisChapter,applicantsshallbeevaluatedbasedontheminimumrequirementsineffectonthedatebothacompleteapplicationisreceivedbytheBureauandtheapplicanthassuccessfullypassedtheexamination.

(1)“Completeapplication,”asusedinthissection,includes,butisnotlimitedto,completededucationandexperiencerequirements.

(2)“Applicant,”asusedinthissection,includes,butisnotlimitedto,existingBREAlicenseesapplyingforadifferentBREA-issuedlicense,includingappraiserslicensedpursuantto§3541(d)applyingforafederallyrecognizedlicense.

(c)AnyholderofaCertificateofRegistrationissuedbytheBureauofRealEstateAppraisersasauthorizedbythischapter,andanypersonorentityactinginacapacitythatrequiresaCertificateofRegistrationunderthischapter,shallmeettherequirementssetforthinArticle4forregistrationasanAppraisalManagementCompany.

§3529.Audits.

TheBureaumayreviewandaudittherecordsofapplicants,licensees,educationalproviders,registeredAppraisalManagementCompaniesandpersonsorentitiesactinginacapacitythatrequiresaCertificateofRegistration,todeterminecompliancewiththerequirementsofthischapterandstateandfederallaw.Applicants,licensees,educationalproviders,andregisteredAppraisalManagementCompaniesshallcooperatewiththeBureauintheconductofsuchauditsandprovideaccessduringnormalbusinesshourstorecordsandsuchinformationastheBureaudeemsreasonablynecessaryforthecompletionoftheaudit.

ARTICLE3.EXPERIENCEANDEDUCATIONREQUIREMENTS

§3541.MinimumExperienceRequirements.

(a)Tomeettheminimumexperiencerequirements,applicantsforcertifiedgeneralshallhaveaminimumof3,000hoursofrealpropertyappraisalexperienceobtainedcontinuouslyoveraperiodofnotlessthan30monthsinoneormoreofthecategorieslistedinSection3542.Ofthe3,000hours,

certifiedgeneralapplicantsmusthaveaminimum1,500hoursofnon-residentialappraisalexperienceinoneormoreofthecategorieslistedinSection3542.

(b)Tomeettheminimumexperiencerequirements,applicantsforcertifiedresidentialshallhaveaminimumof2,500hoursofrealpropertyappraisalexperienceobtainedcontinuouslyoveraperiodofnotlessthan30monthsinoneormoreofthecategorieslistedinSection3542.

(c)Tomeettheminimumexperiencerequirements,applicantsapplyingtobeastatelicensedrealestateappraisershallhave2,000hoursofrealestateappraisalexperienceobtainedoveraperiodofnotlessthan12monthsinoneormoreofthecategorieslistedinSection3542.

(d)Tomeettheminimumexperiencerequirements,realestatebrokersapplyingtobearesidentiallicensedrealestateappraisershallhaveavalidCaliforniarealestatebrokerslicenseand1,000hoursofrealestateappraisalexperienceinoneormoreofthecategorieslistedinSection3542.

(1)Appraiserslicensedpursuanttosubsection(d)whohavenotprovidedtheBureauwithsubstantiationoftheminimum2,000hoursofexperiencearenotincompliancewithminimumAQBlicensingcriteria.Accordingly,suchappraisersdonotholdafederallyrecognizedcredential,arenotauthorizedtoperformfederallyrelatedrealestateappraisalactivityasdefinedinBusinessandProfessionsCodesection11302(i),andwillnotbereportedtoASCforinclusionontheNationalRegistry.

(e)Amaximumof400hoursofexperienceinreviewofappraisalsmaybecreditedtowardstheminimumexperiencehours,nomorethan50%ofwhichmayconsistofdeskreviews.Onlythosereviewsperformedafterobtaining1,600hoursofacceptableexperienceinothercategoriesmaybecreditedtowardsmeetingminimumexperiencerequirements.

(f)AllexperienceclaimedmustbeinconformancewithUSPAPandcompletedafterJanuary30,1989.

§3542.AcceptableCategoriesofExperienceandCriteriaforEachCategory.

(a)AcceptablecategoriesofexperiencetomeettheminimumrequirementsofSection3541andthecriteriaforeachcategoryareasfollows:

(1)Feeandstaffappraisal(arealpropertyappraisalpreparedbyapersonwhoisemployedbyanother,usuallyalendinginstitutionorgovernmentagency,orwhoispaidafeefortheappraisalassignmentsheorsheperforms):

(A)Shallbeawrittendocument;

(B)Shallhaveusedtheentireappraisalprocess;

(C)Shallhaveusedallappraisalmethods(market,cost,income)customarilyusedforaparticularpropertytype(i.e.,residential,commercial,industrial,etc.);

(D)ShallconformtoUSPAP,particularlyStandardsRules1and2;and

(E)Analysismustbecompletedbytheapplicant.

(2)Advaloremtaxappraisal(arealestateappraisalpreparedbyanappraiserwhichestimatesavaluethatisusedforpropertytaxpurposes):

(A)Appraisal:

1.Shallbeawrittendocument;

2.Shalluseappraisalmethods(salescomparison,cost,income)requiredforthepropertytypebeingappraised(i.e.residentialornon-residential);

3.Shalleffectivelyusetheappraisalprocess;and

4.ShallconformtoUSPAP,particularlyStandardsRules1and2.

(B)MassAppraisal:

1.ShallconformtoUSPAP,particularlyStandardsRules1and2,or6.

(3)Reviewofanappraisal(fieldordesk):

(A)Shallbeawrittendocumentseparatefromtheappraisalitself;

(B)Thereviewshallbeofanappraisalpreparedeitherbyemployees,associatesorothers;

(C)Theappraisalbeingreviewedshallnotbesignedbythereviewer;

(D)Shallbea“technicalreview”wherethereviewappraiserformsanopinionastowhethertheanalyses,opinions,andconclusionsintheappraisalreportunderreviewareappropriateandreasonable,asopposedtoan“administrativereview”,whichisworkperformedbyclientsandusersofappraisalservicesasaduediligencefunctioninthecontextofmakingabusinessdecision(e.g.,underwriting,buying,selling,etc.);and

(E)TheworkshallconformtoUSPAP,particularlyStandardRule3.

(4)Appraisalanalysis:

(A)Shallbeawrittendocument;and

(B)TheworkshallconformtoUSPAP.

§3561.ApplicationforLicensing.

(1)ThedeterminationbytheChiefshallbesubmittedtothecourseproviderinwritingsettingforththereasonsforthedetermination;

(2)Within30daysofreceiptoftheChief'swrittendetermination,thecourseprovidermaysubmitawrittenrequestforahearing;

§3682.LateRenewals.

(a)Ifanappraiserfailstorenewhisorherlicensepriortoitsexpiration,theappraisermayrenewthelicensewithintwoyearsafterexpirationofthepreviouslyheldlicensebysatisfyingalloftherequirementsforrenewalofthelicenseandbythepaymentofallapplicablefees.

(b)Appraisalsinfederallyrelatedtransactionsmaynotbeperformedduringthetwoyeargraceperiodimmediatelyfollowingthedatetheappraiser'slicenseexpires,unlessanduntilarenewedlicenseisissued.

(a)Eachcomplaintshallresultinaconfidentialinvestigativereportshowingasummaryoftheactsand/oromissionsalleged,andasummaryofthesupportingevidencetogetherwitharecommendationforappropriateenforcementaction,ifany.

§3729.ConferencetoConsiderAllegations,Notice.

(a)Notlessthan30calendardaysafteraNoticeofConferencehasbeenissued,unlesstheapplicantorlicensedappraiserrequestsanearlierdate,aninformalconferencemay,atthediscretionoftheBureau,beheld,inwhichtheapplicantorlicensedappraisershallhaveanopportunitytoshowwhytheBureaushouldnotproceedwithadisciplinaryaction.

(b)Theconferenceshallbeclosedtoallexcepttheapplicantorlicensedappraiserandhisorherrepresentative,ifany,andthepersonorpersonsdesignatedbytheChief.TheBureaushallnotreleaseorgiveoutanyinformationreceivedintheconferenceorinconnectionwiththeconfidentialinvestigationreporttoanypersonnotauthorizedbylawtoreceivesuchinformation.

(c)Within60calendardaysaftertheconference,thelicensedappraisershallbegivenwrittennoticeeitherthat:

(1)TheBureauhasdeterminedthatfurtheractionorproceedingsarenotwarranted;

(2)Thematterhasbeenresolvedbystipulationoragreement,togetherwiththetermsandconditionsthereof;or

(3)Anaccusationorstatementofissueswillbefiledoracitationissuedagainsthimorher.

§3730.SuspensionofLicenseAfterInformalConference.

(a)TheChiefmay,afteraninformalconference,suspendthelicenseofanypersonwhoprocuredtheissuanceofalicenseforhimselforherselfbyfraud,misrepresentation,deceit,orbythemakingofanymaterialmisstatementoffactinhisorherapplicationforsuchlicense.

(1)TheauthorityoftheChieftoordersuchsuspensionofalicenseshallexpire180daysafterthedateofissuanceofsaidlicense.

(2)ThesuspensionitselfshallremainineffectonlyuntiltheeffectivedateofadecisionoftheChiefafterahearingconductedpursuanttotheseregulations.

(b)TheChiefmay,afteraninformalconference,suspendthelicenseofanypersonwhoisconvictedofacrimewhichis,orthatthereisprobablecausetobelievethatitis,substantiallyrelatedtothedutiesofanappraiserandcontinuationofthelicensedactivityposesaseriousthreatofharmtothehealth,safetyorwelfareofthepublic.

(c)TheChiefmay,afteraninformalconference,suspendthelicenseofanypersonwhoisallegedtohavecommittedanact,orthereisprobablecausetobelievethatanacthasbeencommittedthatissubstantiallyrelatedtothedutiesofanappraiserandcontinuationofthelicensedactivityposesaseriousthreatofharmtothehealth,safetyorwelfareofthepublic.

(d)NotwithstandingSection3729,aninformalconferenceregardingallegationssubjecttothissectionmaybeheldnotlessthan10calendardaysafteraNoticeofConferencehasbeenissued,unlesstheapplicantorlicensedappraiserrequestsanearlierdate.

(e)Uponissuanceofasuspensionunderthissection,theChiefshallproceedasprescribedbyChapter3(commencingwithSection490)ofDivision1.5oftheBusinessandProfessionsCodeandtheBureaushallhaveallthepowersgrantedtherein.

§3732.RestrictedorConditionalLicense.

Arestrictedorconditionallicenseissuedpursuanttothischaptershallcontaintherestrictionorconditionuntilitislifted,inwriting,bytheChief.

(a)Inordertohavetheconditionorrestrictionremoved,thelicenseeshallsubmittotheBureaualetterrequestingtheconditionorrestrictionbelifted,alongwithappropriateevidenceofcompliancewithanyrestrictionorcondition,andtheappropriatefeeasprovidedinSection3582.
