Texas and the oil industry are practically synonymous, and it just seemed kind of natural for Jim Henery to earn a PhD in chemistry and spend 20 years in R&D in the petrochemical industry. Then came a deviation in his
career as a result of family ties, and he hasn’t regretted it. Jim’s step-father was Cliff Wright, the original founder of the Wright Burial Vault Company in 1961. (When Wright received a Wilbert license in 1965, the company name changed to Wilbert Vaults of Houston.) In 1993 Cliff asked Jim to move his family from Mineral Wells (just to the west of Dallas-Ft. Worth) and join him in the business. Jim said “yes,” was placed in charge of op-erations and began calling on customers. He viewed this dramatic change as an opportunity and, as he says, “It gave me a good taste of what I really wanted to do. I can’t think of a more satisfying life than to own a manufacturing company and serve my custom-ers.” Cliff passed in April of 1994 and Jim continued to manage the company. He and his wife Darlene ultimately purchased the busi-ness in 1996. “That brought about a major change in our family life, too,” says Jim. “Up to that point, Darlene had been a home-maker. We had a blended family of four children, with one still in high school, and it sure tore apart our family lifestyle for awhile. But it was a good change. Darlene has welcomed her experiences in business and enjoys her work for the company as much as I do.” All three of their sons, representing the third generation of the family, are currently involved in the day-to-day operations. Jay is Operations Manager; Kevin does Inventory Control; and Brett is Director of Business Development.
When thinking of Texas, one usually expects operations based in that state to be big. That generalization holds true for Wilbert Vaults of Houston, which serves 29 counties, covering a territory roughly 200 miles long and 100 miles wide. The company distin-guishes itself by serving with a big heart and strong business acumen, guided by soft-spoken Jim Henery, president and owner, and his wife Darlene, vice president.

Business GrowthWhen the Henerys started out, Wilbert Vault’s production was ap-proximately 3,400 lined units per year. Through strategic acquisi-tions, such as the purchase of the Corpus Christi Wilbert license, the company is now approaching 5,000 units per year, and also provides Doric and Trigard vaults in addition to the Wilbert line. Making maximum use of plant facilities and equipment, such as its batch plant, figures into Jim’s growth strategy for the com-pany. Wilbert Vault manufactures vaults on an as-needed basis for some smaller companies, but also has a diversified product line that includes retaining wall blocks, concrete pads for air condi-tioners, parking lot stops, downspout drip blocks and other con-crete products. He spends a good portion of his workday scanning the horizon for other products—primarily non-funeral—to add to production, and for what to do next in terms of adding services. “If someone needs a specialty concrete product,” says Jim, “we are happy to do the concrete work for them if they furnish the custom mold.” Assisting him in finding and exploring new opportunities as well as possible acquisitions is an advisory board that consists of an accountant and an attorney who meet with him several times a year. Considering the large territory covered by Wilbert Vault, Jim estimates that the company has upwards of 250 funeral homes as customers, as well as numerous cemeteries—from small, family-owned cemeteries to large church-operated and private places of rest. As an improvement in services to the funeral homes and cemeteries, Wilbert Vaults offers the opening and closing of graves, doing as many as 1,000 of these a year. While he surmises that disinterments may be on the increase, Jim says he hasn’t really studied it to qualify it as a trend. Wilbert Vaults performs from 20 to 30 disinterments a year. Jim believes the need for family closeness is the major reason behind most dis-interments with which the company has been involved: “As they can afford it, people who have roots in a certain area try to get the entire family buried in one place.”
Texas-scale ServiceAt its North Houston location on Aldine Westfield Road, the company has easy access to all major freeways around Houston, and is also close to Bush Intercontinental Airport. Still, from that
location it’s quite a drive down the coast to Corpus Christi. Deliv-eries extend 90 miles southward from there. Wilbert Vault owns about 20 trucks, ranging from basic three-unit delivery trucks to tractor-trailers, to make deliveries. “We use a GPS system to help us manage our fleet,” says Jim. “We keep our trucks and equipment well-maintained, and strive to keep our diesel trucks for approximately seven years or 500,000 miles of service.” “Our production plant is in an area that is largely Hispanic,” says Jim, “and while many of our employees come from within a small radius of our plant, our labor force has diversified, and we now have staff members from all areas of Houston. We’re interested in hiring hard workers, and that’s what we pride our-selves on. Our style of management is very simple: Get people to understand their job responsibilities and requirements, then let them do their jobs. I don’t ever have to say, ‘It’s time to do this or that.’ We’ve got a good number of people to do a great job, and that’s what they do,” Jim stresses. Escalating Costs,Shortages in Materials Are Future ChallengesJim concedes that burial vault manufacturing concerns are fac-ing numerous challenges, such as changes in demographics and consumer preferences, and determining just what those new preferences may be. He is also concerned about the economy and all associated costs of manufacturing a product and delivering it to the customer. Those costs include the escalating cost of fuel, energy-associated costs, the costs of raw materials, such as rock and sand, and possible shortages of any necessary materials. Although Jim acknowledges that cremation is increasing nationwide, his business is supported by people who still prefer a traditional funeral and burial. “We’re fortunate to be located in what is often referred to as ‘the Bible Belt,’” he comments. “There are still people around who won’t choose cremation because of their traditional or reli-gious values.”

“Business is Fun”When asked what he does for recreation, Jim laughs: “My business is fun to me. I enjoy it. For many years I’ve belonged to the Rotary Club. One of its principles is that we have many vocations and should speak up about them. I like to talk about what I do for a liv-ing.” He and Darlene have been married for 35 years and are pleased that their immediate family is in the Houston area, so they can enjoy family time on a regular basis. Fam-ily includes three sons and a daughter, six granddaughters and one on the way, and two great-grandsons. The couple enjoys traveling and has a motor home that, according to Jim, they are getting used to. What they really prefer, however, is taking a cruise or a vacation in Europe. With a special interest in photography, Jim still talks about an 11-day safari he and Darlene took to Africa that gave him plenty of photo ops. “What an experience that was!” he exclaims. “We spent our days in different types of camps, from our own private camp on the Serengeti, to a treehouse, a few nights in a tent and some in a lodge. We were very close to real wildlife, and will never forget watching two cheetahs making a kill.” Recreational activities aside, the Henerys thrive on their business, providing caring service to families, their funeral home customers and their staff. There are more than 40 valued employees on the Wilbert Vault team. In the way of appreciation, the Henerys have food brought into the production plant at various times during the year. In just a few short weeks they plan on holding a Christmas open house in their home, as they have for the past two years. They are good role models for contemporary owners and managers of small businesses everywhere. Hospitality and giving back comprise the backbone of their successful business and lifestyle.

Watts Vault & Monument Company recently hosted a group of mortuary science stu-dents from Des Moines Area Community College in Ankeny, IA. Watts has been dedi-cated to helping educate aspiring funeral directors since the mortuary science program was first offered at the college in 2004. During their visit, the students learned about burial vaults, bronze and granite memorials and infant and child products. They also got a chance to tour the manufacturing facility and learn how burial vaults are made.
Wilkes-Barre Burial Vault recently held an open house and education seminar at their newly renovated facility in Wilkes-Barre, PA. Jeff Miller, Trigard Vice President of Busi-ness Development, spoke at the event. He discussed established vault principles and how to properly educate families and clients of the services and products that are offered. Guests were able to tour the facility, and staff members were on hand to answer any questions. Food, door prizes and other giveaways completed the event.

Your Business1. Continue the practice of hiring the best people you can and treat them like family. En-courage them and be sure to tell them when they are doing a good job. Take the time to train them to do the best job possible, whatever it may be in your company. They represent you and your business.
2. Make sure your employees and your facility are up to date in qualifications or certifica-tions (such as forklift operator, crane operator, etc.). Burial vault manufacturers have until November 14, 2014 to certify or qualify crane operators. Training requirements for riggers and signalers had an effective training date deadline of November 8, 2010. If your staff is not qualified for rigging or signaling, your company could be in jeopardy now because of non-compliance. A hefty fine as a result of an unexpected government inspection could put a huge dent in your profits.
3. Examine your business plan. If you don’t plan for growth or expansion, it likely won’t happen. Establish goals and try to incorporate some new strategies.
4. Do you know the actual here-and-now worth of your business? If not, get first-hand in-formation for getting an accurate picture by attending NCBVA’s Convention, when speaker Kathy Richardson-Mauro of Business Transitions Solutions will discuss “Valuing a Burial Vault Business for Acquisition or Selling” (see pages 12-13).
5. Make sure you have a disaster plan that helps you keep your business going in any likely—or unlikely—event, whether it’s a fire, an explosion, a technology issue or a natural disaster. Hurricane Sandy rendered an important lesson. She went against the grain of normal hurricane “profiling,” making an unwelcome arrival at the very tail-end of hurricane season. She devastated a large, heavily populated, out-of-the-ordinary target area, demonstrating that we should never be unprepared.
6. Get a check-up on your estate plan. If you don’t have one, make getting one a priority. J. Scott Calkins, NCBVA’s Legal Counsel, has regularly advised burial vault company owners to take the necessary, prudent steps to protect heirs and assets.
Your Personal Life1. Demonstrate your appreciation for your family and friends. They are your bulwark against the stresses of the world. Spend time with those you care about and be sure they know how you feel about them. Tell them often. Better yet, put it in writing on beautiful stationery or a special greeting card.
2. Practice your own business advice about pre-need by making sure your own funeral and burial are planned and paid for. It’s a way to insure that your wishes are met and that your dearest family members don’t have to make tough decisions, should you pass unex-pectedly.
3. Read widely (daily newspapers or newsfeeds, professional magazines, etc.). Reading expands your world and keeps you on top of what’s happening in your community, your nation and the world—a world that is getting smaller every day.
4. Take a vacation every year. They are an excellent prescription for new ideas. When it’s possible to combine business with pleasure in a top vacation spot (such as the NCBVA Convention location; see pages 12-13), you win all the way around.

What a period of intense national politics we have witnessed over the past few months. The Presidential campaigns captured the attention of the media, and to a large extent overshad-
owed coverage to important other matters, some of which we will touch on in this column.
TaxationAs year’s end approaches, we all face uncertainty about what will happen to the slate of federal personal and business tax breaks that are scheduled to expire on December 31. I will not cover personal tax issues here because there is a boat-load of information constantly being provided by the media regarding personal federal taxes and the so-called “fiscal cliff.” Hopefully, and I say that with crossed fingers, the administration and the Republican House leadership will come together and resolve that issue. As I was writing this article (November 11), I recalled reading in the morning paper that President Obama and John Boehner (R-OH 8th District), Speaker of the House, indicated that there is room for compromise.
But for our industry, the BUSINESS TAXES are front and center now, such as the 50 Percent First Year Bonus Depreciation. New assets that are placed in service by December 31, 2012, will allow business taxpayers to write off 50 percent of the cost in year one. Quali-fying assets include most software, certain heavy non-passenger vehicles and equipment. This 50 percent bonus depreciation deal is scheduled to expire at the end of 2012—unless it is continued by a new law.
Employer paid health-care benefits are the single biggest tax break in the U.S. Will that break be tampered with during the tax negotiations? What does all this mean? It means that employers (along with their CPAs and estate-planning counsels) should be studying the effect of the current tax breaks that may disappear, and to plan accordingly for the end of 2012 and 2013.
CremationReports from the Cremation Association of North America (CANA) indicate that the rise in U.S. consumer preference for cremation continues upward, with preliminary numbers showing that in 2011, cremation was chosen for 42 percent of deaths in the country—up from 40.6 percent in 2010. In addition, a key milestone was reached in 2011, with the country’s crematories handling more than one million cremations—the first time that mark has been hit.
Most southern states have the lowest number of cremations. The highest states for cremation percentage-wise are Hawaii and the Pacific Coast states of Oregon,Washington and the coast-states’ neighbor, Nevada. The greatest number of cremations are performed in the states of California, Texas, New York, and Pennsylvania.
An interesting case on the legal side of cremations is the recent decision made on September 21, 2012 by the Supreme Court of Tennessee: RONDAL AKERS ET AL. v. PRIME SUCCESSION OF TENNESSEE, INC. ET AL. The Tennessee case is an off-shoot of the litigation against Tri-State Crematory in Noble, GA that was settled years ago. The Georgia case has been reported on in many news media, including reporting by the well-known deathcare industry counsel, Harvey I. Lapin. In the Georgia litigation and decision, it was discovered that the owner of Tri-State Crematory was accepting bodies from funeral homes in Georgia and surrounding states, and was not cremating them but was instead burying them on the premises. The Akers Case involved the same crematory, but was tried in Tennessee and the Tri-State owner was found guilty of various offenses. It was the Tri-State decision that

influenced other states to enact laws to more thoroughly regulate crematories. NCBVA members who are also involved in cremations should be aware of the laws and regulations of their respective states regarding their responsibilities in offering cremation ser-vices.
The State of WisconsinMost of you have surely heard about the investigation of the Wisconsin Funeral Home Directors Association in its handling of the association’s pre-need fund program. The most recent news I have seen regarding their pre-need program is that it may be short by as much as $21 million. A court has decreed the association to stop offering the program and has appointed a Milwaukee at-torney, John Wirth, as receiver for the fund. According to a statement by Wirth that was published in the Wisconsin State Journal on September 15: “While these poli-cies were sold on a local basis by individual funeral homes, the questions that we need answered are association-related. A large number of Wisconsin’s funeral homes are small businesses oper-ated by families and I have no reason to question their conduct. What is in question is the association operation in Madison and how the funds from those policies were managed.” While one would expect the final resolution of this serious matter to be covered by the national news, I would appreciate it if NCBVA members in Wisconsin would provide me with any state or local media coverage they may see.
