M ost of the telephone calls and e-mail correspondence over the past several months from members throughout the country have dealt with the issue of cemeteries and the noncompetitive, discriminatory, and unreasonable policies and fees that they have instituted. I have published information and offered solutions to such problems over the years in previous issues of The Bulletin and have also spoken on the topic at our annual conventions and at state meetings. But it’s a good time to revisit this relationship between the vault manufacturer and the cemetery. Experts say that repetition is good for one’s memory! Therefore, the next couple of articles in The Bulletin will relate to your rights and obligations towards cemeteries and their rights and restrictions towards you. Let’s start with the consent decree entered into several years ago between the cemeteries and the Attorney General of Oregon and approved by the US District Court for Oregon. Although that consent decree was most effective in Oregon, it had an industry wide application since it expanded the Moore (remember the famous Mac Moore litigation?) and Rosebrough decisions which prohibited cemeteries from tying the sale of burial lots to the sale or installation of markers and memorials. Industry Calendar of Events

As I flew out of the airport at our nation’s capital after a recent meeting, I couldn’t help thinking about our great country, our heritage, and how blessed we are to live here.

I was in Washington with Jerry Brown to meet with Fred Watson, the Director ofVe t e r a n ’s A ffairs and several of his staff about the possibility of instituting a national concrete urn vault program, similar to the one for outer burial receptacles used in thenational cemeteries. His response was very positive. Fred has since advised me that he

presented the proposal to the advisory board to the Undersecretaryof State and that was also well received.

On a sad note for NCBVA, Fred Watson will be retiring at theend of this year after more than 30 years with the National C e m e t e r ySystem. We wish Fred and his family the very best and would liketo thank him for his help and guidance over the years.

The NCBVA Board of Directors met in San Antonio, Texas inOctober preceding the NFDA convention. The Board authorizedthe new scholarship program that you read a little about on page 1.The marketing committee reported that it has rolled out the nationa lrecognition campaign ads in the trade journals and also did a

presentation at the FAMIC meeting in November in Milwaukee. We are moving ahead with the strategic plan and you will be hearing some exciting information at the annualconvention in Orlando. I wish to express my personal thanks to Eagle and Doric for deciding to hold their meetings in conjunction with ours.

The Board is also sorry to announce that our Secretary/Tr e a s u r e r, Robert Hardy hasresigned his position due to added responsibilities of his company and family commitments. Rob has been a valuable member of the Board and will continue to beinvolved in NCBVA. Bob Donatelli has agreed to handle the duties as interim S e c r e t a r y /Tr e a s u r e r.

I hope to see a lot of members, both old and new, with their families in Orlando for ourannual meeting. Your board is enthusiastic about the upcoming convention and the futureof NCBVA. Come join the fun and “Find Your Hidden Pot of Gold!”

c e m e t e r y, the consent decree also p r o h i b i t s cemeteries from havinga regulation which: a . Permits only the use of certain manufacturers’vaults or liners,

either by name or specifications, b . Permits only the use of a certain style or design of vault/liner, c . Requires third-party liability insurance in excess of $500,000,

or a compliance bond in excess of $25,000, d . Imposes an inspection fee greater than the actual labor costs

incurred in conducting the inspection, e . Imposes any road use fee although planking or pontoon tires

can be required, f . Requires a third party to utilize cemetery equipment or

personnel, although the consent decree language states thatgrave openings and closings are ‘primarily the responsibilityof the cemetery’,

g . Requires that the installation occur more than 90 minutesbefore the burial service,

h . Requires a purchaser to use the cemetery’s vault/liner due tolack of delivery of the third-party product, provided the third-party product can be installed within a reasonable timefollowing the service, and

i . Imposes any fee that has the purpose or intent of raising thecosts to purchasers of competitors’products and services.”

In the article, A C A Counsel also pointed out that since actions bythe attorney general are circulated to attorneys general in otherstates, this Oregon consent decree may serve as the basis for simil a rinterpretations of industry practices elsewhere.

H o w e v e r, we all know that many cemeteries’ management donot read what their national association publishes nor do they agree with it. Thus we have seen many smaller, rural cemeterieswhich are unaware of the regulations and some larger “well managed” cemeteries including those owned by the conglomerateswhich don’t abide by the restrictions. As a third party vendor confronted by a cemetery that imposes any of these prohibitions, it is important that you first discuss such regulations with theappropriate cemetery officials. Then, if not successful (you don’twant to incur litigation costs), you or your attorney (along withyour State Senator or Representative) can bring the matter to theattention of your state’s attorney general. You would be surprisedwhat a state official can do if “influenced” sufficiently to becomeinvolved. In our current state of massive litigation within the deathi n d u s t r y, I am sure your official would take an interest. If not, youronly recourse is either intimidation or litigation.

Cirque du Soleil® is a theatrical experience unlike anything you have experienced

before. The concept behind Cirque du Soleil was conceived by a group of street performers in Quebec, Canada in the early ‘80s. This original vision has grown to eight different shows, three of which have permanent homes. One is at Downtown Disney, where the theater is the first stand-alone, permanent showroom for a Cirque du Soleil show. The other two are in Las Vegas.

Cirque du Soleil is not a traditional circus. At La Nouba (which means to party, to live it up), youwill not find any animals in the cast. There are no dancing bears, lions leaping through hoops or elephants doing tricks. Rather, Cirque du Soleil is a combination of circus and theatrical presentation combining elements of modern dance, staging, humor and acrobatic stunts. Dispersedthroughout the show are acts of hilarity, peculiarity, inspiration, excitement and amazement.

The experience of a Cirque du Soleil showalways ends with you wondering how it was possible for time to move so fast from theintriguing, attention grabbing pre-show, to thefinal standing ovation. World of Concrete will be held Feb. 4-7,2003 at the Las Vegas Convention Center. Ithas a commitment to hold the 2004 con-vention in Orlando but after that the showwill stay in Las Vegas, according to ownersH a n l e y - Wood Exhibitions of Addison, Ill.

World of Concrete and the concurrentWorld of Masonry is the industry’s larg e s tannual construction show. There will be 93seminars in eight interest areas.
