Judge M W Msimeki made a number of harsh comments in his verdict, especially regarding the GTM’s arguments for disqualifying the joint venture’s tender arguing that Mr Etienne Tolmay was not qualified to be the Site Agent. The GTM also argued that the joint venture did not have the necessary plant and equipment to build the roads. In this respect the Judge referred to the joint venture’s track record of doing work for the GTM in the past to the value of more than R356 million. He also criticised the GTM’s procurement policy, as well as its Supply Chain Management Policy. The GTM’s ability to evaluate a tender on functionality, and possible failure in ap- plying criteria even-handedly also featured prominently in the judge’s ruling. • We obtained a copy of the judgement, but it could only be trans- mied to our offices late on Wednesday. The Greater Tzaneen Municipality has lost yet another legal batt le. This time around the High Court in Pretoria ruled on Monday in urgent interdict applications that the tender pro-cess for the upgrading of two roads in the district was “un-lawful and unconstitutionally invalid”.

To add insult to injury, the GTM, Selby Construction CC, Matlala Nyapele Investment and Properties CC and Readira Refuge Services CC, the respondents in the matt ers, have to pay the costs — including costs of two counsel — of the ur-gent applications by Quality Plant Hire CC and Expectra 388 CC, the applicants.

Five advocates, two of whom are senior (SC) councel, have to be paid! Furthermore there are legal costs of the att orneys who acted for the parties (for the GTM it was Mahowa Inc of Tzaneen). The costs are likely to run into hundreds of thou-sands of rands.

The urgent applications were aimed at restraining the GTM and Selby from implementing the project to upgrade a grav-

el road between Mafarana and Burgersdorp to tar, as well as restraining the GTM, Matlala Nyapelle and Readira Refuge from implementing the project to upgrade a gravel road be-tween Moruji and Matswi/Kheshokwe to tar.

Selby’s tender for the Mafarana road amounted to R53 956 980,00, whilst the joint venture between Quality and Expec-tra submitt ed a tender for R46 904 298,83 — a diff erence of R7 052 681,17!

Judge M W Msimeki made a number of harsh comments in his verdict, especially regarding the GTM’s arguments for disqualifying the joint venture’s tender arguing that Mr Etienne Tolmay was not qualifi ed to be the Site Agent.

The GTM also argued that the joint venture did not have the necessary plant and equipment to build the roads. In this respect the Judge referred to the joint venture’s track record of doing work for the GTM in the past to the value of more than R356 million.

He also criticised the GTM’s procurement policy, as well as

its Supply Chain Management Policy. The GTM’s ability to evaluate a tender on functionality, and possible failure in ap-plying criteria even-handedly also featured prominently in the judge’s ruling.

• We obtained a copy of the judgement, but it could only be trans-mitt ed to our offi ces late on Wednesday. We will study it properly and publish more details about the judge’s fi ndings in next week’s edition of Bulletin.

We asked Mr Louis Erasmus of Thomas & Swanepoel At-torneys in Tzaneen, who acted for Quality and Expectra, for his comments on the judgement.

He said, “We are fi rmly of the view that the award by the GTM of these two tenders, cumulatively exceeding our cli-ent’s tenders in value by some R22 900 000 was Constitution-ally invalid and must be set aside by the High Court. Due to the interdicts now being granted, our client’s substantive review applications are being prepared and will be launched imminently.”

V.I. (Vlieg’s In-siens) fantasties!

So kom Vlieg doen dit:

As hy betyds terug is. berig hy spoedig weer. Indien nie… Happy Vliegmis!

In antwoord

Stanford Lake College pupils participated in the Junior Afri-kaans First language Olympiad held at Stanford Lake early in September.  Countrywide,  4 333 pupils participated in this event. Christian Schmidt, a Grade 9 pupil,  managed to ob-tain 95% during the Olympiad, putting him second in South Africa and fi rst in Limpopo. Malike Naude (89%) came third in Limpopo, Anya Robinson (88%) fourth and Elané Maritz (87%) fi fth.  Twelve of Stanford’s pupils received placing in the  Top 20 in Limpopo.

2. Vir my, as ‘n platt elandse, Afrikaans-, En-gels- en Selobedu-sprekende Suid-Afrikan-er, gebore en getoë in die Limpopo-provin-sie, in die Reënkoningin Modjadji se wêreld, is die eerbetoon oorweldigend.

4. Kategories kan ek aan u almal erken dat enige meriete vir die toekenning aan my, veranker lê of grondslag het of fonda-sie vind by die mense en gemeenskap wat my die idiome van Afrika geleer het, tesa-me met die antieke wyshede van die Wes-terse en Midde Oosterse invloed op ons. My voorreg, as Suid Afrikaner, is om hierdie

So is dit ook by Groen-vinger Tuindienste.

“Kon-tak my gerus by 076 493 1300 vir ‘n kwotasie,” nooi Liebenberg.

The paint brush is applied to buildings in the main street of Modjadjiskloof as part of an urban renewal project by the Greater Letaba Municipality, but it was done privately and without the R400 000 allocated for the project.

Good news for hundreds of residents in the upper class suburb of Panorama came on Wednesday, with the return of running water in their taps — af-ter they had been left without water for nine days because of pipe bursts, due to an obsolete network and lack of maintenance.

At the sports grounds in Botha Street an open air gymnasium was erected months ago with the help of fi nan-cial grants from the government and abroad, but the equipment is still wrapped in packaging foam and not

in use. The set of exercisers cost about R550 000 and are described by resi-dents as “an invasion from Mars”.

The unveiling of the gymnasium is set to be offi cially done by the Pre-mier of Limpopo, but no date has been scheduled for the occasion so far.

In the mean time residents are thank-ful for the face-lift that makes the main street look a lot bett er. “If the current program of cleaning up the town and the restoration of buildings can be maintained, our town could once again become the idyllic small town (village) it used to be, and att ract more tourists to the area again,” said a num-ber of residents we spoke to in the past week. — Louis Roux

Hogs help elderly have happy holidaysTzaneen’s Roadhogs motorcycle club paid a visit to Goue Jare Ouetehuis in Modjadjis Kloof, to spread some two-wheeled love and enjoy a lunch together.

Some of the older folks who mana-ged to pluck up enough courage, were treated to a ride on the back of some of the hogs, which was thoroughly enjoyed by all.

It was brought to the att ention of the Roadhogs that the retirement village was batt ling with a shortage of medical supplies, electronic equip-

ment, food and cutlery and so the club held a fundraiser to aid the elderly.

Through the help of their members, the Roadhogs were able to raise enough funds to purchase and supply Goue Jare with a number of much needed medical supplies, crockery and cutlery, a per-sonal computer and fuel for their generator. The fuel will be supplied by Roadhogs on a monthly basis.

The elderly and manage-ment were so thankful for the visit, the funds raised and the supplies generated through those funds.

“Despite this, there is still a major shortage of adult di-apers for both men and wo-men and we urge the com-munity to step in and help us help our elderly,” said Estelle

Venter of Roadhogs Tzaneen. “Any-one who is willing and able to help with donations can contact us on the numbers provided below or deliver the goods to Goue Jare directly.”

Roadhogs Tzaneen would like to extent a special thanks to each and everyone who chipped in and helped with the fund raiser, including the local business sponsors who opened their hearts and their pockets.

“We would like to invite the com-munity to join us for our next visit to Goue Jare on 10 December. We will once again have stalls available where you can sell your goods and help raise funds for the elderly.

“For bookings please contact us timeously as space is limited.”

For information and bookings please contact Estelle Venter on 079 982 9410, Jaco van Wyk on 082 459 1668 or Ryno Kunneke on 082 401 6013.

It is with sadness that we announce the passing of Mr Julius Heim who died peacefully on Monday morning in his room at Macadamia Retirement Village in Tzaneen. He was a resident of the area for the past 60 years and is survived by his wife Rita, children Margaret, Geoffrey and Patricia, four grandchildren and four great grandchildren. A funeral service will be held tomorrow at the Tzaneen Catholic Church (in the hall as the church fl oor is being renovated) and will start at 09:00.

Julius Heim

se onbeskeie opinie is dit pure snert.

Tzaneen’s newly upgraded public swimming bath has quickly become the epicentre of aqua-tainment in Mo-pani, and to a great extent even in Lim-popo. This past weekend it hosted the annual Limpopo Club Championships.

The championships saw swimmers from all corners of the province take their places on the local starting blocks. Some fantastic times were recorded in both the individual events and the team relays, especially in the younger age groups.

Eagar Aquatics proved to be the vic-tors in the women’s division, with some fi ne performances recorded on the day by Sulé van der Merwe and Ashleigh Hunter who logged a total of 283 and 267 points respectively. De-spite a good eff ort by their male coun-terparts, Eagar managed only a second spot on the ladder in the men’s divi-sion, where Limpopo Tuks Swimming

took the honours through the eff orts of Reghardt Grobler, Franco Botha and their fellow aqualungs.

It was a day of fervent competition and heart racing excitement as one af-ter the other the swimmers took to the water. For onlookers and timekeepers, predicting a winner would have been an impossible task — but it was Lim-popo Tuks Swimming who took it by a nose as they managed to maintain a lead of only 21,5 points to be crowned reigning champs.

“It was a resounding success and on behalf of the Limpopo Province Swim-ming Executive (LPSE), we would like to thank the Greater Tzaneen Munici-pality for their support before and aft er the event. It was a huge success and the new facilities proved impressive to our visiting clubs,” said Sheila Grobbelaar of the LPSE.
