CLOSING THE GAP

Alameda County Public Protection Departments were tasked with closing a funding gap of $13.6 million dollars for fiscal year 2017-18.

The District Attorney has contributed one-time revenue from its civil forfeitures and penalties trust account in the amount of

$1,713,600 to help close this funding gap.

1-2-3-Read empowers children exposed to trauma using talking, reading, and singing.

Natalie’s Nook Reading Center is a magical nook for children six and under where they listen to stories while surrounded by paintings of braveknights andprincesses and fairytale castles.


KIDZONE –

HELPING CHILDREN AND FAMILIES

KidZone provides a safe, nurturing and engaging environment for children visiting the ACFJC. It serves more than 2,500 kids annually.


ADDRESSING ABSENTEEISM –

‘EVERY DAY COUNTS’

• We created Truancy Court in 2004

• More than 1,000 parents and 1,700 elementary andmiddle school children have participated

• Work with the whole family

• Consistent outcome: 90% of children improve attendance

• Award-winning HEAL (Health Education and Learning for life) Program

• Work with community organizations e.g. Lincoln Families


ADDRESSING ABSENTEEISM –

‘EVERY DAY COUNTS’

• We created the DA Mediation Program in 2004 to address absenteeism of youth aged 13-16

• Work with schools throughout Alameda County, andwith teens and their families

• Nearly 1,000 teens have participated

• Consistent outcome: 60% of the teens improve their school attendance


JUVENILE JUSTICE

Over the last few years, we have reduced numbers of filings in juvenile court by two-thirds.

This is primarily due to programs that focus on keeping kids out of the juvenile justice system as an alternative to prosecution.


JUVENILE JUSTICE

Restorative Justice

An intervention model facilitating teens to grow their empathy and understanding of the impact of their crime, and allows the victim to resolve negative judgement toward the minor and other youth.

We refer on average 100-125 minors per year to this program.


JUVENILE JUSTICE

Know Your Rights: Helps build trust with law enforcement to engage and empower youth. Conducted in partnership with NAACP, Charles Houston Bar Association, and local law enforcement. ADA Terry Wiley leads a diverse team of attorneys conducted the seminars on Saturdays. More than 2,500 youth have participated.

Girls Court: established in 2011 as a gender-responsive approach to addressing the unique challenges faced by system involved girls. It is a model for the State.

Mental Health Collaborative Court: Provides specialized supervision and a multitude of services to seriously mentally ill juvenile probationers and their families.


DISTRICT ATTORNEY’S JUSTICE ACADEMY

WORKING WITH YOUTH

Recently a group of DDAs spent their weekend debating students from Frick Middle School in east Oakland. The debates were to provide the 8th Grade Debate Team with valuable preparation before they competed at the State Championships.

The team has never made it to State finals before and are the only predominantly African-American team competing, so this opportunity to debate seasoned professionals was well received.

• 8,948 Defendants Charged with Felonies

• 21,493 Defendants Charged with Misdemeanors

• 4,083 Felony Probation/Parole/PRCS Violations

• 8,306 Misdemeanor Probation Violations

Average: 433 cases per criminal DDA


WORKLOAD MEASURES

We have diverted more than 2,000 people from having charges filed.

Pre-prop 47, we were charging approx. 3,000 felony level cases as misdemeanors per year.


INNOVATIVE COURTS AND OFFENDER REHABILITATION

The DA’s Office staffs and supports numerous innovative court programs to better serve the citizens of Alameda County while providing opportunities for offender rehabilitation.

More than 8,000 cases were heard in these collaborative courts in 2016.


AB109 REALIGNMENT AND REDUCING RECIDIVISM

Leading the way

The DA was the first county department to convene and sponsor two Bidders Conferences to identify and educate community service providers about opportunities to serve 1170(h)/Realigned offenders.


SMART SOLUTIONS FOR SAFE COMMUNITIES

Community Corrections Partnership (CCP) -- Executive Committee

DA O’Malley is a leader on the CCP Executive Committee, and co-chair of the Fiscal Procurement Sub-Committee, working collaboratively to channel resources into the community for effective prevention.

SMART SOLUTIONS FOR SAFE COMMUNITIES

Pre-Filing Program

Our innovative DA pre-filing diversion model provides an opportunity for those with low-level, non-violent misdemeanors to participate in a program offered by Pacific Education Services (PES) in lieu of charges being filed.

We waive the administrative fee for those in need.

More than 2,000 people have completed the program.


DIVERSION PROGRAMS

The DA’s Office also participates in numerous other diversion programs, including:

• Early Intervention Court (EIC)

• Mentor Diversion Program

• Veterans’ Court

• Drug Court

• Girls Court


ALTERNATIVES TO INCARCERATION

The DA’s Office also participates in other programs that promote alternatives to incarceration, such as:

BSCC ‘PAY FOR SUCCESS’ GRANT

In FY15-16, the DA was part of the group that helped secure one of just 3 Board of State and Community Corrections (BSCC) ‘Pay for Success' grants awarded in California.

The aim of Pay For Success is to provide an enhanced level of service to formerly incarcerated individuals who have violated probation. They are offered wraparound services and peer mentors (themselves formerly incarcerated).

The DA’s Office also participates in other programs that promote alternatives to incarceration, such as:

VICTIMS OF CRIME


MAKING A DIFFERENCE FOR VICTIMS OF CRIME

The DA’s office also invests its resources in providing the highest quality service to victims of crime.

In 2016 alone, the DA’s Office provided 88,879 distinct services to 12,985 victims and their families.

We processed 2,458 applications to the State of California, Victims of Crime Fund, ultimately securing $2,347,039 in assistance (such as funeral/burial, relocation, and counseling) for victims in Alameda County.

We obtained 1,097 victim restitution orders totaling $9,449,096.

DAY OF REMEMBRANCE FOR VICTIMS OF DV

At the Day of Remembrance, the community comes together to honor those victims who have been murdered as a result of domestic violence, and to empower survivors.


DEPUTY DOG SERVICE UNIT

Our trained Deputy Dog Service Unit provides comfort and support to minors, sexual assault victims, as well as those who have suffered other trauma.

CONSUMER PROTECTION

People v Overstock.com

• Settled consumer case against Overstock.com for ripping off consumers by advertising deceptive online reference prices

• Decision upheld by the First District Court of Appeal

People v Wells Fargo

• Settlement against Wells Fargo Bank for violating California’s privacy laws


ENVIRONMENT

People v Comcast

• Settlement for unlawful disposal of hazardous waste and material and the incorrect disposal of private customer records

People v Big Lots

• Settlement for incorrect disposal of hazardous waste

The DA’s Office is also focusing on public benefit programs, such as testing for lead in our water, and looking to see if children in our community are suffering due to environmental pollution.


REAL ESTATE FRAUD

Postcard Initiative

• Pilot project where the DA’s Office sent postcards to homeowners facing foreclosure to alert them to possible fraudulent activity

• Through this outreach effort, we were alerted to a number of cases of fraud that were charged and resolved

The DA’s Office has seen overlap between real estate fraud and identity theft, with many criminals perpetrating ID Theft to take possession of a home.


INSURANCE FRAUD

We seek to level the playing field for local businesses and to protect workers.

We prosecute insurance fraud, including: • Dirty doctors• Prescription fraud• Insurance scams• Employers not paying workers compensation• Employers not paying full wage or paying at all


INSURANCE FRAUD AND WORKERS RIGHTS

We prosecuted the owner of Chinese restaurant for tax evasion, workers compensation fraud, and wage theft.

The defendant was ordered to pay thousands of dollars in restitution to the victims and he also served time in jail.

Claire’s House will be a therapeutic living community: a safe environment of genuine love, hope, and healing. It will offer opportunities to develop the skills needed for successful futures.

The SPA is a Safe Place Alternative, a space for formerly trafficked young women to meet at the ACFJC for the Young Women’s Saturday Program (YWSP).

YWSP is a 16-week educational, therapeutic, life skills, and empowerment program started in 2011.

• Blue Ribbon Commission with leaders from child welfare, education, criminal justice, health, and the nonprofit sector

• Six regional information summits throughout the state to learn how communities understand and are responding to CSEC

City of Oakland Training

Every City employee will be trained by the DA’s Office on human trafficking.

Motel/Hotel training

The DA’s Office hosted two hotel/moteltrainings in Alameda County since the beginning of 2016, training over 100 hotel/motel workers.


LABOR TRAFFICKING AND WORKERS RIGHTS

The Labor Task Force was initiated to bring varied agencies together to discuss the common issues, develop inter-agency trust, design best-practice protocols, and run collaborative outreach projects to prevent vulnerable workers from slipping through the cracks into exploitation and human rights abuses.


HUMAN TRAFFICKING PREVENTION

AC United is a multi-agency advisory council working to develop a collaborative response to human trafficking of all forms in Alameda County.

Drug Take Back Day

• collected over 1100 pounds of unused, unwanted and/or expired prescription or over-the-counter medication for free, confidential and safe disposal

• Collected more than any other disposal site

• Safe disposal is essential to prevent misuse of these substances, and to curb the environmental impacts of dumping them in our environment


GUN SAFETY

• Partnered with various organizations (e.g. Brady Center to Prevent Gun Violence) to help raise awareness in the community about gun safety

• Participated in public awareness campaigns, such as the ASK (Asking Saves Kids) Campaign


FIREARMS IN ALAMEDA COUNTY

The DA’s Office is currently conducting research to identify the path a gun takes from manufacture to being used in a crime in Alameda County.

The DA’s Office is looking to utilize cloud technology to assist us in providing discovery to the Defense.

DVRR

The Domestic Violence Report and Referral Program is testing a new electronic medical tutorial and record for victims of sexual assault. We are also hoping this program can be utilized for victims of human trafficking.

In Sacramento, legislative leaders recognize the Alameda County District Attorney’s Office as the model for progressive criminal justice and reform. We are also recognized for the effective balancing of public safety interests: victims, rehabilitation and reentry of offenders, and serious and violent crime affecting the community.

Today, we demonstrated that we closed the funding gap. We have also sourced grants to support our many successful initiatives.
