    This Charter Amendment would amend theFrederick County Charter to provide that theCounty Council shall fill a vacancy on theCouncil by choosing one of three personsfrom a list submitted by the central committeeof the same political party as the vacatingmember. If no list is submitted or the vacatingmember was not a member of a politicalparty, the Council shall appoint a person itdeems best qualified to hold office. If theCouncil fails to fill the vacancy within 45 days,the County Executive shall fill the vacancy byfollowing the same procedure. All personsconsidered for appointment shall bepresented to the public and shall beinterviewed by either the Council orExecutive, allowing for public comment, priorto appointment. If the vacancy occurs in thefirst year of the vacating member's term, aftera person is appointed to temporarily fill thevacancy, a special election will be held toelect and fill the vacancy for the balance ofthe term.

    This Charter Amendment would amend theFrederick County Charter to provide aprocess to fill a vacancy in the position ofCounty Executive. The County Council shallfill a vacancy of the Executive by choosingone of three persons from a list submitted bythe central committee of the same politicalparty as the vacating Executive. If no list issubmitted or the vacating Executive was not amember of a political party, the Council shallappoint a person it deems best qualified tohold office. If the Council fails to fill thevacancy within 45 days, the Council shallappoint the County's Chief AdministrativeOfficer. All persons considered forappointment shall be presented to the publicand shall be interviewed, allowing for publiccomment, prior to appointment. If the vacancyoccurs in the first year of the vacatingExecutive's term, after a person is appointedto temporarily fill the vacancy, a specialelection will be held to elect and fill thevacancy for the balance of the term.
