1.0 INTRODUCTION

1.1 This document sets out the processes and actions that have been identified and undertaken to date by Wakefield Metropolitan District Council to comply with the legal and policy requirements of the duty to cooperate as part of the production of the Wakefield District Local Plan (WDLP). It also provides some background to the legal basis and policy requirements of the duty to cooperate.

1.2 The document lays out the issues of strategic importance that have been

initially identified by the Local Planning Authority as part of the duty to cooperate process and sets out what actions have taken place to date with regards to the duty.

1.3 It should be noted that this statement is a 'living document' which will be used

to log progress and actions at each stage of the plan preparation process in order to demonstrate compliance with the duty where applicable.

2.0 NATIONAL CONTEXT AND THE REQUIREMENTS OF THE DUTY TO

COOPERATE

The Localism Act 2.1 Section 110 of the Localism Act 2011 makes a number of amendments to the

Planning and Compulsory Purchase Act 2004, the effect of which is to place a legal duty on Local Planning Authorities to cooperate with neighbouring authorities, county councils and other prescribed bodies to engage constructively, actively and on an ongoing basis to maximise the effectiveness of local plan preparation in the context of strategic cross boundary matters. The duty to cooperate is referenced in Section 33A of the Planning and Compulsory Purchase Act 2004, which defines the duty and sets out its general requirements, and sub-section (c) to Section 20(5) of that Act, which sets out the purposes of independent examination of development plan documents. Complying with the duty is now integral to that independent examination process.

2.2 The duty:

relates to sustainable development or use of land that would have a significant impact on at least two local planning areas or on a planning matter that falls within the remit of a county council

requires that councils set out planning policies to address such issues requires councils to consider joint approaches to plan making.

2.3 Other public bodies, in addition to local planning authorities, are subject to the

duty to cooperate by being prescribed in the Town and Country Planning (Local Planning) (England) Regulations 2012 as amended by the National Treatment Agency (Abolition) and the Health and Social Care Act 2012 (Consequential, Transitional and Saving Provisions) Order 2013. These bodies are: The Environment Agency

The Historic Buildings and Monuments Commission for England (known as Historic England))

Natural England The Mayor of London (where applicable) The Civil Aviation Authority The Homes and Communities Agency (now known as Homes England) each clinical commissioning group established under section 14D of the

National Health Service Act 2006; The Office of Rail Regulation (now known as The Office of Road and

Rail) Transport for London (where applicable) Integrated Transport Authorities Highway authorities within the meaning of section 1 of the Highways

Act 1980 (including the Secretary of State, where the Secretary of State is the highways authority)

The Marine Management Organisation.

2.4 Local Enterprise Partnerships and Local Nature Partnerships are not subject to the requirements of the duty, but local planning authorities and county councils in England, and prescribed public bodies must cooperate with them. Local planning authorities must have regard to their activities when they are preparing their local plans, so long as those activities are relevant to plan-making.

2.5 The Inspector must determine as part of his or her overall assessment of an emerging plan whether or not the duty to cooperate has been complied with. If it is determined that the duty has not been met, a plan will automatically fail as not legally compliant, and cannot go forward for examination of its overall soundness.

National Planning Policy Framework 2.6 Paragraph 20 of the revised Framework (published in July 2018) sets out the

issues that are considered to be strategic and which may need to be addressed through the duty to cooperate. These are: housing (including affordable housing), employment, retail, leisure and

other commercial development; infrastructure for transport, telecommunications, security, waste

management, water supply, wastewater, flood risk and coastal change management, and the provision of minerals and energy (including heat);

community facilities (such as health, education and cultural infrastructure);

conservation and enhancement of the natural, built and historic environment, including landscapes and green infrastructure, and planning measures to address climate change mitigation and adaptation.

2.7 Paragraphs 24 to 27 of the Framework set out national policy with regard to

maintaining effective cooperation. The Framework states that:

Effective and on-going joint working between strategic policy-making authorities and relevant bodies is integral to the production of a positively prepared and justified strategy

Joint working should help to determine where additional infrastructure is necessary, and whether development needs that cannot be met wholly within a particular plan area could be met elsewhere

one or more statements of common ground should be prepared and maintained, documenting the cross-boundary matters being addressed and progress in cooperating to address these. These should be produced using the approach set out in national planning practice guidance (NPPG)

National Planning Practice Guidance 2.8 NPPG contains guidance on the duty to cooperate and the preparation of

statements of common ground in the Plan-making section that was published in September 2018.

2.9 The guidance states that a statement of common ground is a written record of

the progress made by Local Planning Authorities during the process of planning for strategic cross-boundary matters. It documents where effective co-operation is and is not happening throughout the plan-making process, and is a way of demonstrating at examination that plans are deliverable over the plan period, and based on effective joint working across local authority boundaries. It also forms part of the evidence required by Local Planning Authorities to demonstrate that they have complied with the duty to cooperate. The guidance provides detailed advice with regard to what the statements should contain, about dealing with identified development needs, activities that should be documented, addressing strategic infrastructure needs and what geographical area should be covered. NPPG is clear that it may be necessary for some authorities to have more than one statement of common ground.

3.0 LEEDS CITY REGION APPROACH TO COLLABORATIVE WORK ON

PLANNING

2.1 Councils in Yorkshire have worked closely on strategic planning issues for many years. Following the Government’s decision to discontinue regional planning at a statutory level in 2010 collaboration has continued through both the Leeds City Region and one to one collaboration. The City Region has taken the lead on organising an agreed approach to the duty to cooperate. Additionally much joint working is undertaken on the production of evidence which can be used to inform local plans on issues such as strategic employment land supply and housing markets.

Leeds City Region Statement of Cooperation for Local Planning 2.2 In July 2014 the first iteration of the Leeds City Region Statement of

Cooperation for Local Planning was endorsed by the Leeds City Region Leaders Board and subsequently by the West Yorkshire Combined Authority in September 2014. The statement has now been revised six times and the

latest version was produced in June 2018. This is available as one of the supporting documents for the WDLP.

2.3 The statement sets out the processes and practical steps that Leeds City

Region authorities will undertake to meet the duty to cooperate. The statement confirms that city region authorities are committed to partnership working to ensure a joined up approach to spatial planning including tackling cross boundary issues and agreeing strategic priorities.

4.0 WAKEFIELD'S CONTEXT FOR THE DUTY TO COOPERATE

Statements of Common Ground Leeds City Region Statement of Common Ground 4.3 The Leeds City Region Statement of Common Ground was approved by the

West Yorkshire Combined Authority in December 2018. The statement is available as one of the supporting documents for the WDLP. Wakefield Council is a signatory to the statement alongside the other bodies set out in table 1 below which also describes their relationship with Wakefield.

4.4 The statement sets out the joint working that occurs in the city region on planning matters, the approach to planning for housing that will be adopted and details the matters on which the signatories agree with regard to: inclusive growth housing green belt employment transport minerals and waste green and blue infrastructure

Other Statements of Common Ground 4.5 The Council will need to prepare a statement of common ground with

Doncaster Council, who have an adjacent boundary with Wakefield but are not part of the Leeds City Region, and work on this will continue as the plan preparation process advances.

4.6 It is also possible that statements of common ground will be required with

other proscribed bodies and discussions regarding this will continue as the plan preparation process advances.

5.0 DUTY TO COOPERATE EVIDENCE AND OUTCOMES

Early Engagement Stage 5.1 The Council carried out an Early Engagement consultation on the Wakefield

District Local Plan from Thursday 26 October to Wednesday 6 December 2017. This focused on the scope of the new plan, highlighted key issues the Council needed to consider and set out a number of options for deciding where new development should take place. All duty to cooperate proscribed bodies and relevant local authorities were invited to comment on this document.

5.2 The procedure for identifying and addressing cross boundary strategic issues is set out in the Process Diagram in the Leeds City Region Statement of Cooperation for Local Planning. The Council are following this process. After the conclusion of the Early Engagement consultation the Council prepared a draft table of strategic issues. An early draft of the table was included as an agenda item and discussed at the Leeds City Region Strategic Planning Duty to Cooperate meeting on 27th September 2018 where informal comments on this draft were sought. Following these comments the table was revised and this final draft was formally circulated to adjacent and / or Leeds City Region Councils and proscribed bodies for comment. This final draft table can be viewed in Appendix 1. The comments received on this draft will be reviewed by the Council and, if necessary, a revised draft of the table will be produced and circulated for comment as part of duty to cooperate processes in advance of the next formal consultation on the Wakefield District Local Plan. This statement will be updated to reflect these continuing discussions and this revised version will be published as part of this future consultation.

APPENDIX 1: WAKEFIELD DISTRICT LOCAL PLAN: DUTY TO CO-OPERATE DRAFT STRATEGIC ISSUES TABLE – EARLY ENGAGEMENT

Section 110 of the Localism Act 2011, imposes a duty on councils to co-operate with other Local Planning Authorities (LPA’s) and proscribed bodies on planning issues that cross administrative boundaries. The duty is explained in the National Planning Policy Framework at paragraphs 24 to 27 with additional guidance in the plan making section of National Planning Practice Guidance. The intention of the legislation is that the duty is carried out before councils make formal decisions on plans, with those decisions taking account of the outcome of the co-operation process. The table below sets out the latest analysis of issues and proposed actions that the Council has identified to date which may impact on neighbouring LPA’s and the interests of proscribed bodies. This information will be central to demonstrating that the duty has been carried out appropriately.
