QUALITY CONTROLAt the end of each tour all travellers complete a comprehensive questionnaire which allows us to closely monitor any items that need attention and this feedback ensures we can act quickly so that any issue can be rectified immediately.

STAY A LITTLE LONGERExtra nights’ accommodation can be arranged either before or after your tour. As some flights arrive late at night and others depart early morning, extra nights are highly recommended to allow yourself time to relax before commencing your holiday.

LET US CARRY YOUR BAGSFrom the moment you arrive in New Zealand you will be assisted with your luggage. Each touring day your packed bags will be left at your hotel door for the porters to collect and then assist the Coach Captain to load safely onto the coach. On arrival at each new hotel luggage will be delivered to your hotel room in quick turnaround time.

A WARM WELCOMEOn arrival at each hotel a member of the management team will board the coach and provide a friendly welcome including a full brief on the hotels facilities and surrounds. When a two night stay is included, you will receive an official welcome letter called ‘Hotel Hints’ detailing the facilities including special Grand Pacific Tours arrangements

PERSONALISED SERVICEWhilst travelling with a group, it is still important that your holiday is a personal experience. One guide per 24 travellers has been confirmed for any guided tour inclusion.

ANYONE FOR A HELICOPTER RIDE?In certain locations you will have free time to participate in a range of Optional Activities from jet boating to helicopter rides. A colour Optional Tours Directory is provided so you can budget for any extra activities. NO MESSY MEAL SUPPLEMENTS!Our tours are inclusive of daily cooked breakfast and most dinners. An occasional night is free to dine at leisure and soak up the ambience of the local surrounds.

SPECIALTY MEALSEvery tour incorporates a number of specialty dinners including a traditional Haggis Ceremony in Dunedin, country fare at the Walter Peak Homestead in Queenstown and experience a colourful Maori Hangi and Concert in Rotorua.

THIS TABLE IS RESERVEDAt meal times you will never have to worry about finding a table to dine at. All Grand Pacific Tours travellers are provided with priority reserved dining at breakfast and dinner.

A FITTING FAREWELLA special farewell dinner on the last night of the tour offers the perfect opportunity to say goodbye to new found friends. Celebrate, have fun and share great memories of your time together.

SAFETY IS IMPORTANTOn the first morning of travel the Coach Captain will play a short introductory DVD providing some useful information that will ensure all travellers are fully briefed on a range of health and safety topics.

EXCLUSIVE TO US!Being a New Zealand specialist allows us to build solid relationships with our key suppliers and confirm arrangements exclusive to Grand Pacific Tours. A key example of this is on the Milford Sound Cruise where our travellers enjoy reserved seats on the Top Deck for premium viewing.

WE ARE HERE TO ASSISTOur qualified Operations Team in New Zealand ensure the smooth delivery of every tour. Located in the North and South Islands, our dedicated team provide personal assistance to both the travellers and Coach Captains whenever required. A Dinner Hostess is on site for your first nights dinner to assist with introductions.

TOUR POINTS TO NOTEChildren Children’s fares (i.e. 11 years and under) are available on application. Please note: unfortunately children under five are not suitable on these tours.

Luggage Limits Each traveller is entitled to take one suitcase, the sum of length, width and depth is not to exceed 140cm and weigh no more than 20 kilograms.

Single Travellers The option to twin share with another single traveller is not available on some tours. Please enquire with your Travel Consultant at time of booking.

Room & Dietary Requests Special room and dietary requests will be accepted and passed on to the hotels but cannot be guaranteed.

Triple Share Room Bookings Hotel rooms are generally sized to accommodate two travellers in comfort. When three travellers elect to share a room note that there will be restricted space. Please note that a rollaway bed may be used for triple share room bookings where three separate beds are required.

Special conditions apply on all tours that overnight on Ipipiri, the Overnight Boat in the Bay of Islands. Please enquire at time of booking.

Optional Tours Grand Pacific Tours does not operate these excursions. As such, no person employed or associated with Grand Pacific Tours has any connection with the operators of these excursions.

Variation Grand Pacific Tours reserves the right to cancel or to vary the content of its tours should the need arise.

Transfers Return airport transfers in New Zealand are not included if travellers have pre or post tour accommodation booked outside the Tour Hotels.

1 Making your bookingBookings can be made in person at our offices or by phone, letter, fax or email.When booking, you must pay a deposit of 20% of the total cost of your holidaytogether with the deposits specified in clause 19 where applicable (or fullpayment if booking within 10 weeks of departure). In addition, if you decide topurchase the insurance policy we offer, all applicable insurance premiums mustalso be paid at the time of booking. On receipt of these monies, we will, subjectto availability, issue a confirmation/invoice. The balance of the price due mustbe received by us not less than 10 weeks prior to departure. All arrangementsincluding airfares are subject to availability at the time you book.

2 Your contract Where you make your booking in person, a binding contract will come intoexistence when we despatch the confirmation/invoice. For postal, fax,telephone & email bookings, the contract will only come into existence at theend of five days from the date we despatch the confirmation invoice to give youtime to consider these booking conditions. If you do not contact us before thispoint to withdraw from the booking, you will be deemed to have accepted thesebooking conditions. The contract and all matters arising from it are governed byEnglish law and the jurisdiction of the Courts of England and Wales. You mayhowever choose the law and jurisdiction of Scotland or Northern Ireland if youwish to do so (unless referred to arbitration under clause 6).

3 PaymentAs soon as you receive the confirmation/invoice, please check the detailscarefully and inform us immediately if anything appears to be incorrect as itmay not be possible to make changes later. We regret we cannot accept anyliability if we are not notified of any inaccuracy in any document within 10days of our sending it out (or before issue date for tickets). Please note thedate by which the final payment is due. No further reminder will be sent. Notickets will be sent out until final payment is received in full. If payment is notreceived in full and on time, we/the principal to the contract have the right totreat your booking as cancelled by you. In this case, cancellation charges asset out in these booking conditions will be payable.

4 Changing your bookingIf, after we have issued the confirmation/invoice, you want to change yourbooking, we will endeavour to assist providing a written request signed bythe person who made the booking is received at our offices. It is not alwayspossible to make changes. We will charge an amendment fee of £10.00 to£50.00 (depending upon the amount of work involved) if a requestedchange can be made. In addition, you must pay any additional costsincurred by us and any costs or charges incurred or levied by any serviceprovider. Airlines also generally charge an amendment fee of at least£50.00 for changes to itineraries made prior to receipt of full payment.Once ticketed, any amendments often incur 100% cancellation charges. Inthis event, you will have to pay the full cost of the airline ticket again if youwish to make an amendment.

Where you book a “package”, you or a party member who is preventedfrom travelling (e.g. as a result of serious personal illness, death or serious illness of a close family relative, jury service, redundancy orunavoidable work commitments) may transfer their place on the bookingto someone else (introduced by you) providing they notify us not less than two weeks before departure. In this event, the above mentionedamendment fees, costs and charges will be payable before the transfercan be effected. This is entirely dependent on availability and where airline tickets are concerned an entirely new booking will be required asthese are always non-transferable.

5 Cancellation by youWe must receive any notice of cancellation in writing and the cancellation willtake effect from when this written confirmation is received. The followingsliding scale of charges will be applied depending on when the notification isreceived:

Please note that all insurance premiums paid for insurance arranged by uson your behalf and any amendment charges are non refundable in the eventof your cancellation. If the reason for your cancellation is covered by theterms of any insurance policy you have purchased, you may be able to re-claim any applicable cancellation charges (less any excess). Cancellationcharges must however be paid before they can be claimed from insurers.

6 ComplaintsIf you have a problem during your holiday, you must immediately notify bothour representative/agent (where there is one) and the service providerconcerned (e.g. airline, hotel, Tour Company etc). If it is not possible to do soor you remain dissatisfied, please telephone us or send a fax or email Bridge& Wickers. We aim to answer such messages by return but please bear inmind that, although our offices are open 6 days a week, time may passbefore a reply can be despatched.

If you remain dissatisfied after your return home, you must write to us givingyour original booking reference and all the relevant information within 28days of the end of the arrangements in question.

Problems can only be resolved if we and the service providers are madeaware of them as soon as they occur. For all complaints and claims which donot include personal injury, illness, or death, we regret we cannot acceptliability in relation to any complaint or claim which is not notified inaccordance with this clause.

Disputes arising out of, or in connection with, this contract which cannot beamicably settled may be referred to arbitration under a special Schemearranged by ABTA and administered independently by IDRS, part of theChartered Institute of Arbitrators.

The scheme provides for a simple and inexpensive method of arbitration ondocuments alone with restricted liability on the customer in respect of costs.Full details will be provided on request or can be obtained from the ABTAwebsite www.abta.com

The Scheme does not apply to claims for an amount greater than £5,000 perperson. There is also a limit of £25,000 per booking form. Neither does it apply to claims which are solely in respect of physical injury or illness or theirconsequences. The Scheme can however deal with compensation claimswhich include an element of minor injury or illness subject to a limit of £1,000on the amount the arbitrator can award per person in respect of this element.

The application for arbitration and Statement of Claim must be received bythe Chartered Institute of Arbitrators within nine months of the date of return

from the holiday. Outside this time limit arbitration under the Scheme maystill be available if the company agrees, but the ABTA Code does not requiresuch agreement.

7 Prices(a) We reserve the right to alter the prices of any of the holidays shown inour brochure. You will be advised of the current price of the holiday thatyou wish to book before your contract is confirmed.

When you make your booking you must pay a deposit of 20% of the holidaycost. The balance of the price of your travel arrangements must be paid atleast 10 weeks before your departure date. If the deposit and/or balance isnot paid in time, we shall cancel your travel arrangements. If the balance isnot paid in time we shall retain your deposit. All monies you pay to the travelagent are held by him on our behalf at all times. Please note that airfareshave different rules and some may require payment within 24 hours ofmaking a reservation to guarantee price and availability. We do not holdallocations at hotels; therefore all arrangements are subject to availabilityand can be requested and confirmed after receipt of your deposit.

(c) Changes in transportation costs, including the cost of fuel dues, taxesor fees chargeable for services such as landing taxes or embarkation ordisembarkation fees at ports and airports and exchange rates mean thatthe price of your travel arrangements may change after you have booked.However there will be no change within 30 days of your departure. We willabsorb and you will not be charged for any increase equivalent to 2% ofthe price of your travel arrangements, which excludes insurance premiumsand any amendment charges.

You will be charged for the amount over and above that, plus anadministration charge of £1.00 per person together with an amount tocover agents’ commission. If this means that you have to pay an increaseof more than 10% of the price of your travel arrangements, you will havethe option of accepting a change to another holiday if we are able to offerone (if this is of equivalent or higher quality you will not have to pay morebut if it is of lower quality you will be refunded the difference in price), orcancelling and receiving a full refund of all monies paid, except for anyamendment charges. We will consider an appropriate refund of insurancepremiums paid if you can show that you are unable to transfer or reuseyour policy. Should you decide to cancel for this reason, you mustexercise your right to do so within 14 days from the issue date printed onyour final invoice.

Should the price of your holiday go down due to the changes mentionedabove, by more than 2% of your holiday cost, then any refund due will bepaid to you. However, please note that travel arrangements are not alwayspurchased in local currency and some apparent changes have no impacton the price of your travel due to contractual and other protection in place.

8 Changes by usIt is unlikely we will have to make any changes to your booking but we do plan some arrangements many months in advance and we thereforereserve the right to make alterations to and correct errors in brochure or on the internet and other details both before and after bookings have beenconfirmed. Most changes will be minor ones. Occasionally, it may benecessary to make a significant change. A significant change is one madebefore departure which materially affects (on the basis of the informationyou have given us at the time of booking) the confirmed arrangements we have agreed to provide or arrange. Such changes will usually include a change of your departure or return by more than 12 hours, of yourdeparture airport (except as between London Airports) to one that is more inconvenient to you, a change of accommodation to that of a lowercategory or standard for the whole or a significant proportion of yourholiday, a change of accommodation area for the whole or significantproportion of your holiday, withdrawal of the only or all swimming pool(s) at your accommodation of an extended period and in the case of tours, a significant change of itinerary. Minor changes include a change of yourdeparture or return time by 12 hours or less, or your departure airportbetween Gatwick and Heathrow or the other London Airports (and viceversa), a change of accommodation to other accommodations of the samestandard or category in the same area that you have booked or a changeof accommodation to that of the same standard or category for any periodduring your holiday. If it is necessary to make a significant change beforedeparture, we will advise you as soon as practicable. If there is time beforedeparture we will then offer you the choice of:

accepting the changed arrangements as notified to you or

purchasing alternative arrangements, of a comparable standard if available(if the alternative arrangements are less expensive than the original one, wewill refund the difference, if they are more expensive, you will have to paythe difference) or cancelling your arrangements and receiving a full andprompt refund of all monies paid to us.

If it is necessary to notify you of a significant change 10 weeks or lessbefore departure, we will in addition pay you compensation as set outbelow subject to the following exception. Compensation will not bepayable where a change is made as a result of unusual and unforeseeablecircumstances beyond our control, the consequences of which could nothave been avoided even with all due care. For significant changes, anyliability we have is limited to offering the above choices and thecompensation payments (where applicable) set out below. Nocompensation is payable if we make any change more than 10 weeksbefore departure. We cannot be responsible for any costs or expenses youmay incur as a result of any change. No compensation is payable for minorchanges. Minor changes do not entitle you to cancel or change to otherarrangements without paying our normal charges.

In accordance with EU Regulation 2111/2005 we are required to advise you ofthe actual carrier operating your flight/connecting flight/transfer. We do this bylisting carriers to be used or likely to be used. Any changes to the actualairline after you have received your tickets will be notified to you as soon aspossible and in all cases at check-in or at the boarding gate. Such a changeis deemed to be a minor change. Other examples of minor changes includealteration of your outward/return flights by less than 12 hours, changes toaircraft type, change of accommodation to another of the same standard.

9 Cancellation by usOccasionally, it may be necessary to cancel confirmed arrangements. Wemust reserve the right to do so. However, we will not cancel less than 10weeks before departure unless you have failed to make payment in full andon time or we are forced to do so as a result of circumstances outside our

control. Where your arrangements are cancelled other than due to yourdefault in payment, we will offer you the choice of purchasing alternativearrangements from us of a comparable standard if available (if thealternative arrangements are less expensive than the original ones, we willrefund the difference, if they are more expensive, you will have to pay thedifference) or receiving a full and prompt refund of all monies you have paidto us. In addition, if we cancel 10 weeks or less before departure, we willpay you compensation as set out in clause 8 (a) above subject to thefollowing exceptions. Compensation will not be payable where we areforced to cancel as a result of unusual and unforeseeable circumstancesbeyond our control, the consequences of which we could not have avoidedeven with all due care or where we cancel because an insufficient numberof people have booked your chosen arrangements - in this case, you willbe notified not less than 10 weeks before departure. In all cases our liabilityis limited to offering the above choices and the compensation payments(where applicable) set out in clause 8(a). No compensation is payablewhere we cancel more than 10 weeks before departure. We cannot beresponsible for any costs or expenses you may have as a result of anycancellation. Very rarely, we may be forced to curtail your arrangementsafter the date of departure where circumstances amounting to “forcemajeure” as defined in clause 10 below occur. In this very unusualsituation, we regret we cannot make any refunds (except where refunds areobtained from any supplier), meet any costs or expenses you may incur asa result or pay any compensation.

10 Force majeure Except where otherwise expressly stated in these booking conditions weregret that we cannot accept liability or pay any compensation where theperformance of our contractual obligations is prevented or affected byreason of circumstances amounting to “force majeure”. In these bookingconditions, 'force majeure' means any event which we or the supplier ofthe service(s) in question could not, even with all due care, foresee oravoid. Such events may include war or threat of war, riots, civil strife,terrorist activity, industrial dispute, natural or nuclear disaster, adverseweather conditions, fire and all similar events outside our control.

11 Liability We make every effort to ensure that all arrangements booked with us aremade correctly and efficiently. We further accept responsibility for the actsand/or omissions of our employees, agents, suppliers and sub-contractors(providing they were at the time carrying out work authorised by us) exceptwhere these result in death, personal injury or illness (dealt with separatelybelow). We also accept responsibility if the services which we arecontractually obliged to provide prove deficient or not of a reasonablestandard. In all cases except where personal injury, illness, death, lossand/or damage to and/or of luggage or personal possessions results or alower limitation of liability applies, our liability (if we are found liable to youor any member of your party on any basis) is limited to twice the price ofthe contracted arrangements (excluding insurance premiums andamendment charges) of the person(s) affected in total. For loss and/ordamage of and/or to luggage or other personal possessions (includingmoney), our liability in all cases is limited to £25.00 per person as you areassumed to have taken out adequate insurance prior to travelling. Thisclause is subject to clause 10 'force majeure' and the other terms of thesebooking conditions.

Subject to these booking conditions, we accept responsibility should youor any member of your party suffer death, personal injury or illness as aresult of any failure to perform or improper performance of any part of ourcontract with you by any of our employees, agents, suppliers and/or sub-contractors (providing they were at the time carrying out work authorisedby us) except where the failure to perform or improper performance wasdue to:

The acts and or/omissions of the person affected or other party member(s)or those of a third party not connected with the provision of yourarrangements and which were unforeseeable or unavoidable or an eventwhich either ourselves or the supplier of the service(s) in question could nothave foreseen or avoided even with all due care.

It is a condition of the acceptance of liability set out in clauses 11a that younotify us of any claim in accordance with clause 6 'Complaints'. Where anypayment is made, you must also assign to ourselves or our insurers, anyrights you may have to pursue any third party.

Except where otherwise expressly stated in these booking conditions,where any claim or part of a claim is based on any travel arrangementsmade by us (including the process of getting on and off the transportconcerned) provided by any air, sea, rail or road carrier or any stay in ahotel, the maximum we will have to pay you in respect of that claim or thatpart of the claim if we are found liable to you on any basis, is the maximumthat would be payable by the carrier or the hotel keeper concerned underthe applicable international convention (e.g. Warsaw convention asamended for international travel by air and/ or for carriers with an operatinglicence granted by an EU country, the EU regulation on Air Carrier Liabilityfor international and national travel by air, Athens Convention forinternational travel by Sea) in that situation. You must give credit for allpayments due or received from any carrier or hotel keeper which will relateto the claim in question.

Should you or any member of your party be unlucky enough to sufferpersonal injury, illness or death by misadventure as a result of an activitywhich does not form part of your booked arrangements nor an excursionsold through us, we shall assist you. This assistance may, subject to ourprior approval and our reasonable discretion, include financial assistancewith legal expenses to enable you to take proceedings against the thirdparty responsible. All assistance is provided subject to a maximum totalcost to ourselves of £5,000.00 per booking form. In addition, if you shouldbe successful in obtaining a costs order against any third party or if you areable to claim under any insurance policy/ies you may have, we shall beentitled to recoup from you the costs actually incurred by us. Finally, allrequests for assistance must be received by us within 90 days of the dateof misadventure.

Please note that we cannot accept any liability for any damage, loss,expense or other sums of any description which a) on the basis of theinformation given to us by you concerning your booking prior to ouraccepting it, we could not have foreseen you would suffer or incur if webreached our contract with you or b) did not result in any breach ofcontract or other fault by ourselves or our employees or, where we areresponsible our suppliers. Additionally, we cannot accept liability for anybusiness losses.

12 Flights and other transport servicesPlease note that the timings of air, sea road and rail departures given inbooking are estimates only and are subject to change. Latest timings willbe shown on your confirmation/invoice. Timings may be affected by

operational difficulties, weather conditions, passengers failing to checkin on time and other factors outside our control. For flights, the actualflight times will be those shown on your tickets (unless otherwiseadvised) which will be despatched to you approximately 2 weeks beforedeparture. You must check all tickets very carefully to ensure you havethe latest timings. You must in addition ensure you read and observe anyinstructions sent with your tickets, for example reconfirming your flightsat least 3 days before departure where possible. Please note, even whenwe sell flights as principal (rather than agent), we do not enter into anagreement for carriage by air but rather only undertake to reserveaccommodation on board the airline advised at the time of booking orsuch other airline as may be substituted. Where we sell flights as part of a 'package' or as principal, we are not always in a position to confirmthe airline, aircraft type and airport of destination which will be used inconnection with that flight. Where this information is provided at the timeof booking, it is subject to change. Any such change will not entitle youto cancel or change to other arrangements without paying our normalcharges. Please also note that in relation to flights, an infant must beunder two years of age on the date of their return flight to be entitled to the infant fare level which is usually 10% of the IATA published fare.

13 InsuranceWe strongly recommend that you take out full, comprehensive travelinsurance both for protection against misfortune that can occasionallyoccur and for your own peace of mind.

14 Tickets and travel documentsTickets and travel documents, unless collected from us, are usuallydispatched by normal Royal Mail services. If you require the added speedand security of data post or courier delivery, this can be arranged and thenet cost of this bill be added to the final invoice. We cannot accept anyliability for late or lost tickets if normal post is used.

15 Passports, visas and health requirementsDetails of the passport, visa and health requirements as applicable toBritish citizens holding a full ten year British passport are shown on theconfirmation/invoice. Should you need to obtain a full 10 year BritishPassport you must allow a minimum of 6 weeks for processing with therelevant authorities. Non British citizens and British citizens not holding afull British Passport must consult their Embassy, Consulate or the BritishForeign Office to check the applicable requirements. Clients with anyexisting medical problems should consult their own doctor. Requirementsmay change and you should check the up to date position in good timebefore departure. It is your responsibility to obtain proper and detailedmedical advice and to ensure that you have the correct passport and visasto gain access to or pass through any country or region included in thetravel arrangements which you purchase. If you fail to do either, we haveno liability to you for any cost, loss or damage which you suffer as a resultand nor will we refund the cost of any unused portion of your travelarrangements.

16 RefundsIf you return any unused ticket(s) to us for refund, we will submit them tothe relevant airline for refund. Once we receive the refund from the airlinewe will forward it to you less any applicable cancellation or administrationcharges. You should note that the airline refunds for part used tickets andthe return half of the tickets are always less than the pro-rata proportion ofthe fare paid and, in some cases, may have no refund value at all. Refundsusually take 10 to 12 weeks, but in some cases, may take longer. Refundsin respect of all other unused services are not generally possible.

17 Special requests and medical problemsIf you have any special request, please inform your travel consultant at the time of booking. Although we will endeavour to pass any reasonablerequests on to the relevant supplier, we regret we cannot promise that anyrequest will be complied with unless we have specifically confirmed this inwriting. Confirmation that the special request has been noted or passed onto the supplier or the inclusion of the special request on your confirmationor any other documentation is not confirmation that the request had beenmet. Unless and until specifically confirmed, all special requests aresubject to availability. If you have any medical problem or disability whichmay affect your booked arrangements, you must advise us in writing at the time of booking giving full details. If we feel unable to properlyaccommodate your particular needs, we must reserve the right todecline/cancel your booking.

18 DelayWe regret we are not in a position to offer you any assistance in the eventof a delay at your outward or homeward point of departure. Any airlineconcerned may however provide refreshments etc.

19 Other depositsFor all land arrangements, a 20% deposit of the total value of non flightproduct charges must be paid at the time of confirmation of your booking.

20 Financial securityWhen you buy an ATOL protected air holiday package from us you willreceive a Confirmation Invoice from us (or via our authorised agent throughwhich you booked) confirming your arrangements and your protectionunder our Air Travel Organiser’s Licence number 6611. In the unlikely eventof our insolvency, the CAA will ensure that you are not stranded abroadand will arrange to refund any money you have paid to us for an advancebooking. For further information visit the ATOL website at www.atol.org.uk.

21 Data Protection StatementPlease be assured that we have measures in place to protect the personalbooking information held by us. This information will be passed on to theprincipal and to the relevant suppliers of your travel arrangements. Theinformation may also be provided to public authorities such as customs orimmigration if required by them, or as required by law. Certain informationmay also be passed on to security or credit checking companies.

If you travel outside the European Economic Area, controls on dataprotection may not be as strong as the legal requirements in this country.We will only pass your information on to persons responsible for yourtravel arrangements. This applies to any sensitive information that yougive to us such as details of any disabilities, or dietary/religiousrequirements. (If we cannot pass this information to the relevant suppliers,whether in the EEA or not, we will be unable to provide your booking. Inmaking this booking, you consent to this information being passed on tothe relevant persons.) Full details of our data protection policy areavailable upon request.

Your contract is with Bridge & Wickers World of Travel Ltd a member of ABTA.

1 Making your bookingBookings can be made in person at our offices or by phone, letter, fax or email.When booking, you must pay a deposit of 20% of the total cost of your holidaytogether with the deposits specified in clause 19 where applicable (or fullpayment if booking within 10 weeks of departure). In addition, if you decide topurchase the insurance policy we offer, all applicable insurance premiums mustalso be paid at the time of booking. On receipt of these monies, we will, subjectto availability, issue a confirmation/invoice. The balance of the price due mustbe received by us not less than 10 weeks prior to departure. All arrangementsincluding airfares are subject to availability at the time you book.

2 Your contract Where you make your booking in person, a binding contract will come intoexistence when we despatch the confirmation/invoice. For postal, fax,telephone & email bookings, the contract will only come into existence at theend of five days from the date we despatch the confirmation invoice to give youtime to consider these booking conditions. If you do not contact us before thispoint to withdraw from the booking, you will be deemed to have accepted thesebooking conditions. The contract and all matters arising from it are governed byEnglish law and the jurisdiction of the Courts of England and Wales. You mayhowever choose the law and jurisdiction of Scotland or Northern Ireland if youwish to do so (unless referred to arbitration under clause 6).

3 PaymentAs soon as you receive the confirmation/invoice, please check the detailscarefully and inform us immediately if anything appears to be incorrect as itmay not be possible to make changes later. We regret we cannot accept anyliability if we are not notified of any inaccuracy in any document within 10days of our sending it out (or before issue date for tickets). Please note thedate by which the final payment is due. No further reminder will be sent. Notickets will be sent out until final payment is received in full. If payment is notreceived in full and on time, we/the principal to the contract have the right totreat your booking as cancelled by you. In this case, cancellation charges asset out in these booking conditions will be payable.

4 Changing your bookingIf, after we have issued the confirmation/invoice, you want to change yourbooking, we will endeavour to assist providing a written request signed bythe person who made the booking is received at our offices. It is not alwayspossible to make changes. We will charge an amendment fee of £10.00 to£50.00 (depending upon the amount of work involved) if a requestedchange can be made. In addition, you must pay any additional costsincurred by us and any costs or charges incurred or levied by any serviceprovider. Airlines also generally charge an amendment fee of at least£50.00 for changes to itineraries made prior to receipt of full payment.Once ticketed, any amendments often incur 100% cancellation charges. Inthis event, you will have to pay the full cost of the airline ticket again if youwish to make an amendment.

Where you book a “package”, you or a party member who is preventedfrom travelling (e.g. as a result of serious personal illness, death or serious illness of a close family relative, jury service, redundancy orunavoidable work commitments) may transfer their place on the bookingto someone else (introduced by you) providing they notify us not less than two weeks before departure. In this event, the above mentionedamendment fees, costs and charges will be payable before the transfercan be effected. This is entirely dependent on availability and where airline tickets are concerned an entirely new booking will be required asthese are always non-transferable.

5 Cancellation by youWe must receive any notice of cancellation in writing and the cancellation willtake effect from when this written confirmation is received. The followingsliding scale of charges will be applied depending on when the notification isreceived:

Please note that all insurance premiums paid for insurance arranged by uson your behalf and any amendment charges are non refundable in the eventof your cancellation. If the reason for your cancellation is covered by theterms of any insurance policy you have purchased, you may be able to re-claim any applicable cancellation charges (less any excess). Cancellationcharges must however be paid before they can be claimed from insurers.

6 ComplaintsIf you have a problem during your holiday, you must immediately notify bothour representative/agent (where there is one) and the service providerconcerned (e.g. airline, hotel, Tour Company etc). If it is not possible to do soor you remain dissatisfied, please telephone us or send a fax or email Bridge& Wickers. We aim to answer such messages by return but please bear inmind that, although our offices are open 6 days a week, time may passbefore a reply can be despatched.

If you remain dissatisfied after your return home, you must write to us givingyour original booking reference and all the relevant information within 28days of the end of the arrangements in question.

Problems can only be resolved if we and the service providers are madeaware of them as soon as they occur. For all complaints and claims which donot include personal injury, illness, or death, we regret we cannot acceptliability in relation to any complaint or claim which is not notified inaccordance with this clause.

Disputes arising out of, or in connection with, this contract which cannot beamicably settled may be referred to arbitration under a special Schemearranged by ABTA and administered independently by IDRS, part of theChartered Institute of Arbitrators.

The scheme provides for a simple and inexpensive method of arbitration ondocuments alone with restricted liability on the customer in respect of costs.Full details will be provided on request or can be obtained from the ABTAwebsite www.abta.com

The Scheme does not apply to claims for an amount greater than £5,000 perperson. There is also a limit of £25,000 per booking form. Neither does it apply to claims which are solely in respect of physical injury or illness or theirconsequences. The Scheme can however deal with compensation claimswhich include an element of minor injury or illness subject to a limit of £1,000on the amount the arbitrator can award per person in respect of this element.

The application for arbitration and Statement of Claim must be received bythe Chartered Institute of Arbitrators within nine months of the date of return

from the holiday. Outside this time limit arbitration under the Scheme maystill be available if the company agrees, but the ABTA Code does not requiresuch agreement.

7 Prices(a) We reserve the right to alter the prices of any of the holidays shown inour brochure. You will be advised of the current price of the holiday thatyou wish to book before your contract is confirmed.

When you make your booking you must pay a deposit of 20% of the holidaycost. The balance of the price of your travel arrangements must be paid atleast 10 weeks before your departure date. If the deposit and/or balance isnot paid in time, we shall cancel your travel arrangements. If the balance isnot paid in time we shall retain your deposit. All monies you pay to the travelagent are held by him on our behalf at all times. Please note that airfareshave different rules and some may require payment within 24 hours ofmaking a reservation to guarantee price and availability. We do not holdallocations at hotels; therefore all arrangements are subject to availabilityand can be requested and confirmed after receipt of your deposit.

(c) Changes in transportation costs, including the cost of fuel dues, taxesor fees chargeable for services such as landing taxes or embarkation ordisembarkation fees at ports and airports and exchange rates mean thatthe price of your travel arrangements may change after you have booked.However there will be no change within 30 days of your departure. We willabsorb and you will not be charged for any increase equivalent to 2% ofthe price of your travel arrangements, which excludes insurance premiumsand any amendment charges.

You will be charged for the amount over and above that, plus anadministration charge of £1.00 per person together with an amount tocover agents’ commission. If this means that you have to pay an increaseof more than 10% of the price of your travel arrangements, you will havethe option of accepting a change to another holiday if we are able to offerone (if this is of equivalent or higher quality you will not have to pay morebut if it is of lower quality you will be refunded the difference in price), orcancelling and receiving a full refund of all monies paid, except for anyamendment charges. We will consider an appropriate refund of insurancepremiums paid if you can show that you are unable to transfer or reuseyour policy. Should you decide to cancel for this reason, you mustexercise your right to do so within 14 days from the issue date printed onyour final invoice.

Should the price of your holiday go down due to the changes mentionedabove, by more than 2% of your holiday cost, then any refund due will bepaid to you. However, please note that travel arrangements are not alwayspurchased in local currency and some apparent changes have no impacton the price of your travel due to contractual and other protection in place.

8 Changes by usIt is unlikely we will have to make any changes to your booking but we do plan some arrangements many months in advance and we thereforereserve the right to make alterations to and correct errors in brochure or on the internet and other details both before and after bookings have beenconfirmed. Most changes will be minor ones. Occasionally, it may benecessary to make a significant change. A significant change is one madebefore departure which materially affects (on the basis of the informationyou have given us at the time of booking) the confirmed arrangements we have agreed to provide or arrange. Such changes will usually include a change of your departure or return by more than 12 hours, of yourdeparture airport (except as between London Airports) to one that is more inconvenient to you, a change of accommodation to that of a lowercategory or standard for the whole or a significant proportion of yourholiday, a change of accommodation area for the whole or significantproportion of your holiday, withdrawal of the only or all swimming pool(s) at your accommodation of an extended period and in the case of tours, a significant change of itinerary. Minor changes include a change of yourdeparture or return time by 12 hours or less, or your departure airportbetween Gatwick and Heathrow or the other London Airports (and viceversa), a change of accommodation to other accommodations of the samestandard or category in the same area that you have booked or a changeof accommodation to that of the same standard or category for any periodduring your holiday. If it is necessary to make a significant change beforedeparture, we will advise you as soon as practicable. If there is time beforedeparture we will then offer you the choice of:

accepting the changed arrangements as notified to you or

purchasing alternative arrangements, of a comparable standard if available(if the alternative arrangements are less expensive than the original one, wewill refund the difference, if they are more expensive, you will have to paythe difference) or cancelling your arrangements and receiving a full andprompt refund of all monies paid to us.

If it is necessary to notify you of a significant change 10 weeks or lessbefore departure, we will in addition pay you compensation as set outbelow subject to the following exception. Compensation will not bepayable where a change is made as a result of unusual and unforeseeablecircumstances beyond our control, the consequences of which could nothave been avoided even with all due care. For significant changes, anyliability we have is limited to offering the above choices and thecompensation payments (where applicable) set out below. Nocompensation is payable if we make any change more than 10 weeksbefore departure. We cannot be responsible for any costs or expenses youmay incur as a result of any change. No compensation is payable for minorchanges. Minor changes do not entitle you to cancel or change to otherarrangements without paying our normal charges.

In accordance with EU Regulation 2111/2005 we are required to advise you ofthe actual carrier operating your flight/connecting flight/transfer. We do this bylisting carriers to be used or likely to be used. Any changes to the actualairline after you have received your tickets will be notified to you as soon aspossible and in all cases at check-in or at the boarding gate. Such a changeis deemed to be a minor change. Other examples of minor changes includealteration of your outward/return flights by less than 12 hours, changes toaircraft type, change of accommodation to another of the same standard.

Except where otherwise expressly stated in these booking conditions,where any claim or part of a claim is based on any travel arrangementsmade by us (including the process of getting on and off the transportconcerned) provided by any air, sea, rail or road carrier or any stay in ahotel, the maximum we will have to pay you in respect of that claim or thatpart of the claim if we are found liable to you on any basis, is the maximumthat would be payable by the carrier or the hotel keeper concerned underthe applicable international convention (e.g. Warsaw convention asamended for international travel by air and/ or for carriers with an operatinglicence granted by an EU country, the EU regulation on Air Carrier Liabilityfor international and national travel by air, Athens Convention forinternational travel by Sea) in that situation. You must give credit for allpayments due or received from any carrier or hotel keeper which will relateto the claim in question.

Should you or any member of your party be unlucky enough to sufferpersonal injury, illness or death by misadventure as a result of an activitywhich does not form part of your booked arrangements nor an excursionsold through us, we shall assist you. This assistance may, subject to ourprior approval and our reasonable discretion, include financial assistancewith legal expenses to enable you to take proceedings against the thirdparty responsible. All assistance is provided subject to a maximum totalcost to ourselves of £5,000.00 per booking form. In addition, if you shouldbe successful in obtaining a costs order against any third party or if you areable to claim under any insurance policy/ies you may have, we shall beentitled to recoup from you the costs actually incurred by us. Finally, allrequests for assistance must be received by us within 90 days of the dateof misadventure.

Please note that we cannot accept any liability for any damage, loss,expense or other sums of any description which a) on the basis of theinformation given to us by you concerning your booking prior to ouraccepting it, we could not have foreseen you would suffer or incur if webreached our contract with you or b) did not result in any breach ofcontract or other fault by ourselves or our employees or, where we areresponsible our suppliers. Additionally, we cannot accept liability for anybusiness losses.

12 Flights and other transport servicesPlease note that the timings of air, sea road and rail departures given inbooking are estimates only and are subject to change. Latest timings willbe shown on your confirmation/invoice. Timings may be affected by

operational difficulties, weather conditions, passengers failing to checkin on time and other factors outside our control. For flights, the actualflight times will be those shown on your tickets (unless otherwiseadvised) which will be despatched to you approximately 2 weeks beforedeparture. You must check all tickets very carefully to ensure you havethe latest timings. You must in addition ensure you read and observe anyinstructions sent with your tickets, for example reconfirming your flightsat least 3 days before departure where possible. Please note, even whenwe sell flights as principal (rather than agent), we do not enter into anagreement for carriage by air but rather only undertake to reserveaccommodation on board the airline advised at the time of booking orsuch other airline as may be substituted. Where we sell flights as part of a 'package' or as principal, we are not always in a position to confirmthe airline, aircraft type and airport of destination which will be used inconnection with that flight. Where this information is provided at the timeof booking, it is subject to change. Any such change will not entitle youto cancel or change to other arrangements without paying our normalcharges. Please also note that in relation to flights, an infant must beunder two years of age on the date of their return flight to be entitled to the infant fare level which is usually 10% of the IATA published fare.

13 InsuranceWe strongly recommend that you take out full, comprehensive travelinsurance both for protection against misfortune that can occasionallyoccur and for your own peace of mind.

14 Tickets and travel documentsTickets and travel documents, unless collected from us, are usuallydispatched by normal Royal Mail services. If you require the added speedand security of data post or courier delivery, this can be arranged and thenet cost of this bill be added to the final invoice. We cannot accept anyliability for late or lost tickets if normal post is used.

15 Passports, visas and health requirementsDetails of the passport, visa and health requirements as applicable toBritish citizens holding a full ten year British passport are shown on theconfirmation/invoice. Should you need to obtain a full 10 year BritishPassport you must allow a minimum of 6 weeks for processing with therelevant authorities. Non British citizens and British citizens not holding afull British Passport must consult their Embassy, Consulate or the BritishForeign Office to check the applicable requirements. Clients with anyexisting medical problems should consult their own doctor. Requirementsmay change and you should check the up to date position in good timebefore departure. It is your responsibility to obtain proper and detailedmedical advice and to ensure that you have the correct passport and visasto gain access to or pass through any country or region included in thetravel arrangements which you purchase. If you fail to do either, we haveno liability to you for any cost, loss or damage which you suffer as a resultand nor will we refund the cost of any unused portion of your travelarrangements.

16 RefundsIf you return any unused ticket(s) to us for refund, we will submit them tothe relevant airline for refund. Once we receive the refund from the airlinewe will forward it to you less any applicable cancellation or administrationcharges. You should note that the airline refunds for part used tickets andthe return half of the tickets are always less than the pro-rata proportion ofthe fare paid and, in some cases, may have no refund value at all. Refundsusually take 10 to 12 weeks, but in some cases, may take longer. Refundsin respect of all other unused services are not generally possible.

17 Special requests and medical problemsIf you have any special request, please inform your travel consultant at the time of booking. Although we will endeavour to pass any reasonablerequests on to the relevant supplier, we regret we cannot promise that anyrequest will be complied with unless we have specifically confirmed this inwriting. Confirmation that the special request has been noted or passed onto the supplier or the inclusion of the special request on your confirmationor any other documentation is not confirmation that the request had beenmet. Unless and until specifically confirmed, all special requests aresubject to availability. If you have any medical problem or disability whichmay affect your booked arrangements, you must advise us in writing at the time of booking giving full details. If we feel unable to properlyaccommodate your particular needs, we must reserve the right todecline/cancel your booking.

18 DelayWe regret we are not in a position to offer you any assistance in the eventof a delay at your outward or homeward point of departure. Any airlineconcerned may however provide refreshments etc.

19 Other depositsFor all land arrangements, a 20% deposit of the total value of non flightproduct charges must be paid at the time of confirmation of your booking.

20 Financial securityWhen you buy an ATOL protected air holiday package from us you willreceive a Confirmation Invoice from us (or via our authorised agent throughwhich you booked) confirming your arrangements and your protectionunder our Air Travel Organiser’s Licence number 6611. In the unlikely eventof our insolvency, the CAA will ensure that you are not stranded abroadand will arrange to refund any money you have paid to us for an advancebooking. 21 Data Protection StatementPlease be assured that we have measures in place to protect the personalbooking information held by us. This information will be passed on to theprincipal and to the relevant suppliers of your travel arrangements. Theinformation may also be provided to public authorities such as customs orimmigration if required by them, or as required by law. Certain informationmay also be passed on to security or credit checking companies.

If you travel outside the European Economic Area, controls on dataprotection may not be as strong as the legal requirements in this country.We will only pass your information on to persons responsible for yourtravel arrangements. This applies to any sensitive information that yougive to us such as details of any disabilities, or dietary/religiousrequirements. (If we cannot pass this information to the relevant suppliers,whether in the EEA or not, we will be unable to provide your booking. Inmaking this booking, you consent to this information being passed on tothe relevant persons.) Full details of our data protection policy areavailable upon request.
