Tender Forms for Assigning the Contract for Sale of Used Answer Books of the Exam held in Feb/March/April 2014 Name and Complete Address of the Tenderer

. (i)Conditions of Eligibility

1 The Firm/Agency must be registered with the competent authority under the appropriate Act/Rules for carrying on business relating tothe purchasing of waste papers/ used A/Books/ old books etc.

2 The agency/firm should submit a proof of having an annual turn –over of Rs.50 lac or above relating to trade in waste paper and/or paper board during each of the last three years. i.e. Financial year 2013-2014, 2012-2011 & 2011-2010. The self attested copies of Profit and Loss Account Statements and the Balance Sheets duly certified by a registered Chartered Accountant of the firm to be attached.

3 Proof of latest Income Tax Return filed. (duly attested by bidder to be attached).

4 Permanent Account Number (PAN) under Income Tax Act. (attested copy to be attached)

5 Proof of Registration for Sales Tex, State or Central Excise Duty etc.6 The Firm/Agency must enclose an Earnest Money of Rs.2,00,000/-

(Two lac)in the form/shape of Demand Draft in favour of Secretary, Board of School Education Haryana, Bhiwani drawn on any schedule Bank. Earnest Money in other mode will not be accepted. Similarly the Firm/Agency must enclose Tender Fee of Rs.500/- (Rs. Five Hundred) in the shape of D.D./Board’s Receipt along with the Tender in Technical Bid.

(ii)General Terms & Conditions

1 Tender Form is not transferable. 2 Two bid system shall be followed. Accordingly, the agency/firm shall

submit Technical Bid with Demand Draft of Rs.-2,00,000/-(Two lac) and Financial Bid in two separately sealed envelopes and both these envelopes shall then be sealed in the third envelope. The envelopes must be marked as (i) Technical Bid of Contract for Sale of Used Answer/Books,(ii)Financial Bid of Contract for Sale of Used Answer/Books,(iii) Tender for Contract for Sale of Used Answer/Books at Board of School Education Haryana, Bhiwani

3 All contents of each of the two envelopes shall be page-numbered and signed by the bidder/authorized signatory of firm/agency.

4 The successful bidder shall be required to deposit an amount of Rs-4,00,000/- (Rs. Four lac) as Performance Security in the form of demand draft in favour of Secretary, Board of School Education Haryana Bhiwani Payable at Bhiwani. No interest shall be payable on the amount of security and it will be released on request within one month after completing the contract period.

5 The Earnest Money of the unsuccessful agency/firm shall be returned on completion of the process.

6 The Firm/Agency shall be required to lift the raddi with in thirty days from the issue of the Work Allotment Order by the Board in writing. If the needful is not done within the stipulated period , a penalty @-5000/- per day will be imposed for a period of one week. If the needful is still not done within the extended period of one week, with penalty, the amount of Security Deposit shall be forfeited and this contract shall stand terminated.

7 In case of any dispute relating to this contract arising during the contract period, the matter shall be referred to the sole Arbitrator to be appointed by the Secretary/Chairman whose decision shall be binding upon both the parties.

8 The concerned agency/firm shall be bound to lift the raddi on “as is where is basis” with Cloth Bags and Ist page of answer books (OMR) in paper bags. No shifting or segregation of material shall be allowed. Depending on the quantity of material, estimated above money as intimated by the Board shall be deposited by the firm before lifting the

raddi. The amount/money shall be deposited through Demand draft or in cash with the Board Cashier and the original receipt should be submitted as proof.

9 The firm/ agency shall bear the weighing, lifting/ loading charges of raddi .

10 The weighing of the raddi shall be got done in the presence of a

Committee constituted by Board for the purpose at a ’Dharam Kanta’ approved by the Municipal Committee, Bhiwani.

11 Any other condition as may be deemed fit to the office shall be announced at the time of opening of tenders in the presence of bidders.

12 The contract for lifting raddi shall be for the sale of used A/Books ofexam held in Feb/March/April-2014 from the date of actual award of the contract.

13 The sealed Tenders, complete in all respects must reach in the office of the Secretary, Board of School Education Haryana, Bhiwani (Haryana)-127021, latest by 29.12.2014 upto 01.00 P.M which shall be opened at 29.12.2014 on 03.00 P.M the same day in the presence of bidders /their representative as who may wish to be present.

14 Rates should be carefully filled up without any cutting, erasure or overwriting, both in words and figures.

15 The Board reserve the right to accept or reject any or all the bids without assigning any reason.

16 There are also other terms and conditions as may be considered necessary for execution of this contract which shall be provided separately in an agreement to be signed/executed by the firm /agency in writing on a Non-Judicial Stamp Paper of Rs. 100/-.(Rs. Hundred Only) which shall execute and agreement with the Board on a Non Judicial.

17 The cost of the Tender Form shall be Rs.500/-. This amount shall be required to be deposited at the Board’s Cash Counter or by Bank Draft drawn in favour of “Secretary Board of School Education Haryana, Bhiwani. Tender form can be downloaded from Board web site www.bseh.org.in

18 The firm/agency should quote their rates against the following item:-Name of Item. (Rates are to quoted in the separate financial Used Answer Books/Sheets Bid as at annexure ‘A’ )

Rates per k.g. including weighing, lifting, loading and all other charges.

19 In case the firm/agency quoting the highest 2nd , 3 rd , 4th , highest and so on but declines to accept the offer, the earnest money of such firm(s) shall be forfeited and the firm (s) shall be black- listed by Board for any kind dealing in future.

20 Negotiation may be done with the bidders as per the revised Negotiation Policy of the Govt. of Haryana.

21 The firm/agency shall pay VAT charges separately as per the rules of Govt. of Haryana.

22 The commodity is 2300 quintals in weight approximately .

22 The agency shall append the following declaration with the tender :
