Draft  Fingal  County  Development  Plan  2017-­‐2023  

Within  the  Draft  County  Development  Plan  2017-­‐2023  the  subject  site   is  zoned  objective   ‘HA  ’  with  a  stated  objective  ‘to  protect  and  enhance  high  amenity  areas’.    The  location  of  the  subject  site   in  the  context  of  Map  13  –  Blanchardstown  South  of  the  Draft  Fingal  County  Development  Plan  2017-­‐2023  is  shown  below.

Burial  Grounds  is  a  use  ‘permitted  in  principle’  under  the  ‘High  Amenity’  Zoning  objective.  

Section  12.8  of  the  Draft  Fingal  County  Development  Plan  relates  to  “Burial  Grounds  and  Crematoria”,  stating  the  following  policy:  

“Local  Authorities  have  a  statutory  responsibility  to  provide  for  burial  facilities.  Many  of  the  existing   burial   grounds   within   the   County   have   reached   or   are   nearing   full   capacity.  Therefore,  it  will  be  necessary  to  provide  additional  burial  grounds  within  the  County  over  the  next  number  of  years.”  

Objective  DMS99  of  the  Development  Plan  states  as  follows:  

“Provide   and   facilitate   the   development   of   additional   burial   grounds,   including   green  graveyards  /  natural  burial  grounds  in  areas  across  Fingal  as  required  during  the  life  of  the  Development  Plan  and  which  preferably  have  good  public  transport  links,  taking  cognisance  of  the  needs  of  multi-­‐faith  and  non-­‐religious  communities.”

Map  based  Objective  130  is  located  on  lands  to  the  north  of  the  subject  site  and  reads  as  follows:  

“Provide  for  a  burial  ground  of  up  to  4  hectares  within  the  Kellystown  area.  This  site  is  to  be  identified  as  part  of,  or  in  advance  of,  the  adoption  of  Kellystown  LAP”.  

The  relevant  section  of  Draft  Development  Plan  Map  –  Sheet  13   illustrating  Objective  130  within  LAP  area  13.C  is  shown  below.

Our   client   is   seeking   to   have   a   similar  Map  based  objective   applied   to   their   land   at   Rugged   Land   –  outlined  in  Figure  1.    Specifically  our  client  is  seeking  to  have  an  additional  objective  added  to  Map  13  of   the   Draft   Fingal   County   Development   Plan   2017-­‐2023.   The   additional   objective   proposed   is   as  follows:  

“Provide  for  a  burial  ground  of  up  to  3  hectares  within  the  Rugged  Lane  area”  

Given  the  acknowledged  capacity   issues  at  existing  burial  ground  facilities   in   the  county   the  subject  site   could   suitably   accommodate   an   additional   facility   and   we   recommend   Council   to   include   this  additional   objective   to   strengthen   the   fact   that   Burial   Ground   is   “Permitted   in   Principle”   on   “HA   –  High  Amenity”  zoned  lands  at  this  location.    

Furthermore,   our   clients   have   undertaken   preliminary   site   investigation   works,   which   confirm   this  location  as  an  appropriate  site  for  a  burial  ground.
