    QUANTITY SURVEYORS ACT 1967

    QUANTITY SURVEYORS (AMENDMENT) RULES 2004

    In exercise of the powers under section 26 of the Quantity Surveyors Act1967 (Act 487), the Board with the approval of the Minister, makes thefollowing rules: -

    PART I

    PRELIMINARY

    1. (1) These rules may be cited as the Quantity Surveyors(Amendment) Rules 2004

    (2) These Rules come into operation on the 31 December 2004

    The Quantity Surveyors Rules 1973 [P.U.(A)366/73], which arereferred to as the principal Rules in these Rules, are amendedby substituting for the words provisionally registered QuantitySurveyor wherever appearing the words registered graduateQuantity Surveyor.

    2. Words and expressions used in these Rules shall, unless thecontext otherwise expressly provides, have the same meaningassigned to them in the Act insofar as they are used or applicableto or referred to in these Rules and are not defined in theseRules.

    CPD programmes means Continuing Professional Developmentprogrammes or other activities relating to the quantity surveyingprofession for registered, registered graduate or temporaryregistered Quantity Surveyors as approved by the Board.

    credit points means the number of credit points accumulated bya registered, registered graduate or temporary registeredQuantity Surveyor through participation in the CPD programmes.

    Forms means any Form as set out in Part One of the FirstSchedule:

    " Joint Test of Professional Competence Panel" means the panelappointed by the Board under rule 23D;

    "President" means the President of the Board of QuantitySurveyors appointed under section 3 of the Act;

    Registrar means the Registrar of Quantity Surveyors appointedunder section 6 of the Act;.

    "Secretary" means the person or firm of professional secretariesappointed by the Board under rule 10.

    PART II

    ADMINISTRATION

    3. The Registrar shall convene a meeting of the Board wheneverrequested to do so by the President or in writing by not less thaneight members of the Board.

    4. (1) Not less than fourteen days' notice in writing shall be givenspecifying the place, date and time of a meeting and the

    business to be conducted at the meeting.

    (2) The accidental omission to give notice of a meeting under thisrule to one or more members of the Board or the non-receiptthereof shall not in any manner affect the validity of orprejudice anything done or agreed to at the meeting.

    5. A resolution shall be proposed and seconded before being put tothe vote. Voting shall be by show of hands or by secret ballot asmay be decided by the President or the member presiding. Adeclaration by the President or the member presiding that aresolution has been carried by a particular majority or not carriedby a particular majority shall be conclusive, and an entry to that

    effect in the minutes of the meeting shall be conclusive evidencethereof without proof of the number or proportion of votesrecorded in favour of or against resolution.

    6. Votes shall only be given by members present and voting.

    7. Minutes of every meeting shall be kept by the Secretary and theminutes, if purporting to be signed by the President or themember presiding at the next succeeding meeting, shall beconclusive evidence of the facts stated therein.

    8. (1) The Board may from time to time by resolution appointcommittees from amongst its members and the Board mayby resolution at any time dissolve any committee soappointed.

    (2) A committee appointed under paragraph (1) may invite anyperson to attend its meetings and to take part in itsdeliberations but such person shall have no vote.

    (3) The President and the Registrar shall be ex-officio membersof all committees.

    9. (1) The Registrar shall consult the President on any businessother than of a routine nature requiring attention before eachmeeting of the Board.

    (2) Deleted.

    10. (1) The Board may appoint a person or a firm of professionalsecretaries to act as a Secretary for the Board.

    (2) The Secretary shall keep the minutes of all meetings or theBoard and its committees and shall send notices of meetingsand perform such other functions as may be determined bythe Board.

    (3) The Secretary shall receive and be responsible for allmonies payable to the Board and shall present:-

    Meetings of the Board.

    Notice of meetings.

    Votes.

    Proxies not admitted.

    Minutes.

    Committees.

    Registrar.

    Secretaries.

    (a) at each meeting of the Board a statement of accountshowing receipts and expenditure as on the last day ofthe previous month; and

    (b) not later than the 30 June in each year the auditedaccounts for the previous financial year.

    (4) Deleted.

    11. All payments received shall be deposited to the credit of theaccount of the Board with a bank or banks approved by theBoard; Provided that the Secretary may keep as petty cash a sumnot exceeding five hundred ringgit or such sum as may bedetermined by the Board.

    12. All cheques on the bank account of the Board shall be signed byany two of the members of the Board appointed by the Board.

    12A. All payments to the Board shall be in the form of money order,

    bank draft or cheque made to the Board.

    13. (1) The Board shall cause to be kept and maintained properaccounts and records relating to:-

    (a) the assets and liabilities of the Board;

    (b) the sum of money received and expended by or underthe authority of the Board.

    (2) The books of accounts and records shall be kept in thecustody of the Secretary or at such place as the Board maydetermine.

    14. The Board may determine reasonable remunerations andallowances to be paid to the President, Registrar, Secretary ormembers of the Board, or members of any committee, council orpanel appointed by the Board.

    15. The accounts of the Board shall at least once every year beaudited by a firm of professional auditors to be appointed by theBoard,

    16. The financial year of the Board shall end on the 31December.

    16A. Pursuant to section 4(ea) of the Act, the Board may act asstakeholder in respect of a contract for consulting quantitysurveying services subject to the guidelines as may bedetermined by the Board, where such guidelines may includetherein the payment of a fee to the Board when it acts as astakeholder.

    PART III

    REGISTRATION

    17. Every (a) citizen or permanent resident of Malaysia desirous of

    being registered as a registered graduate or registeredQuantity Surveyor under section 10(1) or 10(2) of the Act,respectively; or

    Bank account.

    (b) foreign quantity surveyor desirous of being registered as a

    temporary registered Quantity Surveyor under section 10Aof the Act,

    shall make an application to the Board in Form A or B or B1, as

    the case may be.

    (2) Deleted.

    18. Every application for registration shall be decided upon by theBoard within four months from the date of receipt of theapplication by the Board, provided that such application is in fullcompliance with the requirements of the Board.

    19. Every applicant shall be notified of the decision of the Board bythe Registrar within one month of the date of the decision.

    20. Every application for registration as a registered, registeredgraduate or temporary registered Quantity Surveyor under rule17 shall be accompanied with

    (a) the processing fee as prescribed in Part Two of the FirstSchedule, which is not refundable; and

    (b) the registration fee as prescribed in Part Two of the FirstSchedule, which shall be refunded to the applicant who isunsuccessful in his application.

    21. Upon an application for registration being approved by the Board,the Registrar shall issue a certificate of registration in Form C orD or D1, as the case may be, and the certificate of registrationshall be sealed with the common seal of the Board in accordancewith subparagraph (3) of paragraph 3 of the Schedule to the Act.

    22. (1) Every registered, registered graduate or temporary registeredQuantity Surveyor desirous of renewing his registrationunder section 13(2) of the Act shall, on or before 31January of the year following the year of expiration of hisregistration, submit an application for renewal, and theapplication shall be accompanied with-

    (a) the renewal fee as prescribed in Part-Two of the FirstSchedule; and

    (b) a record of the credit points accumulated in the yearimmediately preceding the year of renewal ofregistration.

    (2) Subject to rule 22A, the application for renewal may be

    rejected by the Board if the applicant does not accumulatethe requisite credit points as determined by the Board in theyear immediately preceding the year of renewal ofregistration.

    22A. Unless otherwise exempted by the Board, every registered,registered graduate or temporary registered Quantity Surveyordesirous of renewing his registration with the Board shallaccumulate the requisite credit points as determined by theBoard, through participation in the CPD programmes during theyear immediately preceding the year of renewal of registration.

    23. The fee for the renewal of registration of a registered, registeredgraduate or temporary registered Quantity Surveyor shall be asprescribed in Part Two of the First Schedule.

    23A. Upon the renewal of registration, the Registrar shall issue to the

    applicant a certificate of registration in Form C or D or D1, as thecase may be.

    23B. The fees for the reinstatement of a registered, registered graduateor temporary registered Quantity Surveyor under section 17of the

    Act shall be

    (a) the total amount of arrears of yearly renewal fees payable ifregistration is renewed;

    (b) a re-registration fee of the same amount as that underparagraph (a); and

    (c) an administrative fee as prescribed in Part Two of the FirstSchedule.

    23C. Upon reinstatement, the Registrar shall issue to the registered,registered graduate or temporary registered Quantity Surveyorconcerned a certificate of reinstatement in Form E or F or F1, asthe case may be.

    23D. (1) The Board may appoint a Joint Test of ProfessionalCompetence Panel comprising of such members as it maydetermine to conduct examinations for admission to thequantity surveying profession.

    (2) The functions of the Joint Test of Professional CompetencePanel shall be in accordance with the guidelines asdetermined by the Board.

    24. (1) The practical experience that a registered graduate QuantitySurveyor is required to obtain under section 10(1)(b) of the

    Act in order to be entitled to apply for registration as aregistered Quantity Surveyor shall be as follows:

    (a) employment as a quantity surveyor to the satisfaction ofthe employer for a minimum period of two years afterregistration with the Board as a registered graduateQuantity Surveyor in any of the departments, authorities,

    institutions, firms or bodies corporate approved by theBoard;

    (b) in the case of a registered graduate Quantity Surveyornot in employment of any of the departments, authorities,institutions, firms or bodies corporate approved by the

    Board, employment as a quantity surveyor performingquantity surveying services to the satisfaction of theemployer, for a minimum period of two years afterregistration with the Board as a registered graduateQuantity Surveyor in any firm, body corporate ororganisation having either a partner, director, principal ora supervisor who is a registered Quantity Surveyor; or

    (c) in the case of a registered graduate Quantity Surveyorunder the employment of an organisation that is notspecified in paragraph (a) or (b), the registered graduateQuantity Surveyor shall obtain the written approval of theBoard to have an external supervisor, who shall be a

    registered Quantity Surveyor, to supervise his practicalexperience in respect of performing quantity surveyingservices to the satisfaction of the external supervisor fora minimum period of three years after registration withthe Board as a registered graduate Quantity Surveyor.

    (2) Deleted.

    (3) In order that a registered graduate Quantity Surveyor may beentitled to apply for registration as a registered QuantitySurveyor, he shall pass the Test of Professional Competenceor other tests or professional assessment as conducted orsanctioned by the Board.

    3A.The Test of Professional Competence shall be in accordancewith the guidelines as determined by the Board.

    (4) A registered graduate Quantity Surveyor applying forregistration as a registered Quantity Surveyor shall submittogether with his application documentary proof that he hascomplied with the requirements of paragraphs (1), (3) and(3A).

    24A (1) The Board may appoint a Quantity Surveying AccreditationCouncil for the purpose of accrediting qualifications for thequantity surveying profession.

    (2) The Quantity Surveying Accreditation Council shall compriseof the following members:

    (a) a Chairman who shall be a registered Quantity Surveyorand a member of the Board;

    (b) a Deputy Chairman who shall be a registered QuantitySurveyor;

    (c) two members of the Board who shall be registeredQuantity Surveyors;

    (d) two representatives from the Institution of Surveyors,

    Quantity Surveying Accreditation Council.

    Malaysia who shall be registered Quantity Surveyors;

    (e) two representatives from public universities or institutionsof higher learning who shall be registered QuantitySurveyors and faculty members;

    (f) one representative from the National AccreditationCouncil;

    (g) one representative from the Ministry of Higher Education;

    (h) one representative from the Public Services Department;and

    (i) any other persons as the Board considers fit and proper tobe members of the Quantity Surveying AccreditationCouncil.

    (3) The Board may appoint members of the Quantity Surveying

    Accreditation Council for such term as may be determined bythe Board.

    (4) The functions of the Quantity Surveying Accreditation Councilshall be in accordance with the guidelines as determined bythe Board.

    PART IV

    CODE OF PROFESSIONAL CONDUCT

    25. Unless the context otherwise requires, "registered QuantitySurveyor" shall, for the purposes of this Part, include registeredQuantity Surveyor, registered graduate Quantity Surveyor,temporary registered Quantity Surveyor and a firm or bodycorporate approved in writing and issued with a valid permit topractise as consulting Quantity Surveyors by the Board.

    26. (1) A registered Quantity Surveyor shall at all times uphold thedignity, standing and reputation of the quantity surveyingprofession.

    (1A) A registered Quantity Surveyor shall at all times exercise thestandard of reasonable care, skill and diligence normallyexpected and accepted by the quantity surveying profession.

    (2) A registered Quantity Surveyor shall not conduct himself insuch manner or commit any act which in the opinion of theBoard is undesirable or disgraceful.

    (3) A registered Quantity Surveyor shall not conduct himself insuch a manner or commit any act that has or will put theBoard in disrepute or by his conduct or act question or injurethe integrity or reputation of the Board.

    (4) Without prejudice to the generality of this rule, a registeredQuantity Surveyor shall in the exercise of his duties observeand be guided by the provisions of the Code of ProfessionalConduct as set out in these Rules or guidelines as

    determined by the Board.

    26A. A registered Quantity Surveyor in carrying out his responsibility tohis employer, client or the quantity surveying profession shallhave full regard to the public interest.

    27. (1) A registered Quantity Surveyor shall discharge his duties tohis employer or client, as the case may be, with completehonesty.

    (2) Except with the permission of his employer or client, as thecase may be, a registered Quantity Surveyor shall not acceptnor allow any member of his staff to accept remuneration forservices rendered other than from his employer or client, asthe case may be.

    (3) A registered Quantity Surveyor shall not offer or acceptcommission which in the opinion of the Board is an illicitcommission.

    (4) Except with the prior written approval of the Board, aregistered Quantity Surveyor practicing as a consultingQuantity Surveyor shall not be a director or substantialshareholder in or an agent for any construction firm orcompany.

    (5) Where a registered Quantity Surveyor has obtained the priorapproval of the Board in accordance with paragraph (4) heshall not, whilst practising as a consulting Quantity Surveyor,at the same time without disclosing the fact in writing to hisclient, be a director or substantial shareholder in or agent forany construction firm or company with which he deals onbehalf of his employer or client.

    28. (1) Before accepting an appointment, a registered QuantitySurveyor shall notify his client in writing of the prevailingterms and conditions contained in the Memorandum of

    Agreement Between The Client And The ConsultingQuantity Surveyor For Professional Quantity SurveyingServices (hereinafter referred to as the Memorandum of

    Agreement) as determined by the Board.

    (2) Within thirty days of the receipt of the written confirmation ofthe appointment of the registered Quantity Surveyor as aconsulting Quantity Surveyor, the registered QuantitySurveyor shall notify the Board of such appointment bysubmitting to the Board a copy of the letter of appointment orMemorandum of Agreement duly signed between him and hisclient.

    29. A registered Quantity Surveyor shall not maliciously injure orattempt to injure, whether directly or indirectly, the professionalreputation, prospects or business of another registered QuantitySurveyor.

    30. A registered Quantity Surveyor shall not:

    (a) canvass or solicit professional employment;

    Public interest.

    Discharge of duties.

    Conditions ofengagement and scaleof charges.

    Reputation, etc. of aregistered person notto be injured.

    (b) give or offer remuneration or other consideration for theintroduction of his professional employment; or

    (c) advertise in connection with his profession in any mannerunless it is in accordance with the guidelines as determinedby the Board.

    31. Deleted.

    32. A registered Quantity Surveyor shall at all times construe andadminister with fairness the provisions of a contract for theperformance of work for which the registered Quantity Surveyor isappointed or employed, as the case may be, and in all questionsarising from the contract he shall act in an impartial manner.

    33. A registered Quantity Surveyor shall not-

    (a) procure or assist in procuring, or knowingly be a party toprocure by fraud or misrepresentation, the approval of the

    Board for a firm or body corporate to practise as consultingQuantity Surveyor;

    (b) conceal or assist in concealing from the Board the existenceof any fact or circumstance which, if known, would entitle theBoard to withdraw the approval granted under section 7A(3)of the Act from any firm in which he is the sole proprietor or apartner, or a body corporate in which he is a director orshareholder;

    (c) contravene or fail to perform, or assist in the contravention of,or knowingly be a party to the contravention of or failure toperform, any of the restrictions or conditions imposed by theBoard when granting approval to a firm or body corporateunder section 7A(3) of the Act;

    (d) cause or permit or suffer any firm in which he is the soleproprietor or a partner, or body corporate in which he is adirector or shareholder, to practise as consulting QuantitySurveyors prior to the approval of the Board beingobtained;,and

    (e) cause or permit or suffer any firm in which he is the soleproprietor or a partner, or body corporate in which he is adirector or shareholder, to practise as consulting QuantitySurveyors after the Board.

    34. A registered Quantity Surveyor practising as a consulting QuantitySurveyor shall not directly or indirectly-

    (a) supplant or attempt to supplant another registered QuantitySurveyor practising as a consulting Quantity Surveyor whohas already been appointed by an employer or client andwhose appointment has not been terminated or discharged;

    (aa) secure an appointment by undercutting or reduction of fees orby any other means;

    (b) intervene or attempt to intervene in, quantity surveying workof any kind which to his knowledge has already beenentrusted to another registered Quantity Surveyor practising

    Advertising andsoliciting prohibited.

    Fairness in construingand administeringcontracts.

    A registered QuantitySurveyor practising asconsulting QuantitySurveyor not tointervene in or takeover the practice ofanother.

    as consulting Quantity Surveyor; or

    (c) take over the work of another registered Quantity Surveyorpractising as a consulting Quantity Surveyor acting for thesame employer or client, on the same project, unless he has:-

    (i) obtained the consent of that other registered QuantitySurveyor; or

    (ii) been formally notified by the employer or client that theengagement of that other registered Quantity Surveyorhas been terminated or discharged in accordance withthe provisions of any contract entered into between thatother registered Quantity Surveyor and the employer orclient.

    35. A registered Quantity Surveyor practising as a consulting QuantitySurveyor shall not act in a professional capacity for an employeror client and a contractor on the same project except on the

    specific instructions of the employer.

    35A. (1) Any person may lodge a complaint against a registeredQuantity Surveyor, where such complaint shall be made inwriting by the complainant.

    (2) The complaint shall contain the following particulars:

    (a) the full name, identity card or passport number andaddress of the complainant;

    (b) the facts of the complaint;

    (c) copies of any supporting documents in relation to thecomplainant;

    (d) the signature of the complainant; and

    (e) the name and address of the complainants counsel, ifany.

    35B. (1) A complaint shall be lodged with the Registrar.

    (2) Upon receipt of the complaint, the Registrar shall:-

    (a) stamp the date of its receipt on the document ofcomplaint;

    (b) satisfy himself that the requirements of rule 35A inrespect of the complaint have been complied with; and

    (c) if so satisfied, register the complaint in a registermaintained by the Registrar.

    (3) Where a complaint is not made in accordance with therequirements of rule 35A, the Registrar shall reject thecomplaint and shall enter the fact of the rejection in theregister maintained by him.

    (4) Upon the rejection of a complaint and if the name and

    address of the complainant is available, the Registrar shallinform the complainant in writing of the rejection of thecomplaint.

    (5) Where the complaint has been entered in the registermaintained by the Registrar, the Registrar shall forward thecomplaint to the Board for its action.

    35C. (1) A complainant may at any time withdraw his complaint by aletter addressed to the Registrar.

    (2) Upon receipt of the letter of withdrawal of the complaint underparagraph (1), the Registrar shall immediately inform theBoard in writing of the withdrawal of the complaint and shallenclose such letter for the Boards attention.

    (3) The Registrar shall enter the fact of the withdrawal of the

    complaint by the complainant in the register maintained byhim.

    35D. (1) The Board shall appoint an Investigating Committee for thepurposes of sections 7A(6) and 15(2) of the Act toinvestigate any complaint lodged against any registeredQuantity Surveyor that has been forwarded to the Boardunder rule 35B(5).

    (2) The Investigating Committee shall meet at the premises ofthe Board or at such other place, and on such date and timeas the Chairman of the Investigating Committee maydetermine.

    (3) Where an investigation in respect of any matter is to be heldby the Investigating Committee, the Investigating Committeeshall send a notice in respect of the investigation to thecomplainant and to the registered Quantity Surveyor byregistered post or prepaid post to his or its last knownaddress.

    (4) The notice under paragraph (3) shall specify the date, timeand place of the investigation of the complaint by theInvestigating Committee.

    (5) The Investigating Committee may adjourn the investigationfrom time to time, and no written notice of an adjournment isrequired to be served upon any party when the adjournmentis made in the presence of that party.

    (6) Subject to the provisions of the Act and these Rules, theInvestigating Committee may regulate its own investigationprocedures in such manner as it deems fit, and theInvestigating Committee shall make a record of theproceedings conducted before it.

    (7) At the investigation before the Investigating Committee, the

    registered Quantity Surveyor shall be given an opportunity tobe heard, where-

    35E. (1) Where on the date fixed for investigation of the complaint-

    (a) both the complainant and the registered QuantitySurveyor fail to attend before the InvestigatingCommittee, the Investigating Committee may, upon beingsatisfied that the notice in respect of the investigation hasbeen duly served on the complainant and the registeredQuantity Surveyor under rule 35D(3), recommend to theBoard that the complaint be dismissed;

    (b) the complainant fails to attend before the InvestigatingCommittee, the Investigating Committee may, upon beingsatisfied that the notice in respect of the investigation hasbeen duly served on the complainant under rule 35D(3)-

    (i) recommend to the Board that the complaint bedismissed; or

    (ii) proceed to investigate the complaint in the absenceof the complainant without further notice to him , andmake its recommendations to the Board; or

    (c) the registered Quantity Surveyor fails to attend before theInvestigating Committee, the Investigating Committeemay, upon being satisfied that the notice in respect of theinvestigation has been duly served on the registeredQuantity Surveyor under rule 35D(3), proceed toinvestigate the complaint in the absence of the registeredQuantity Surveyor and without further notice to him or it,and make its recommendations to the Board.

    (2) The report of the Investigating Committee shall state the factsand the recommendations of the Investigating Committee andshall be signed by the Chairman of the Investigating

    Committee.

    (3) The report of the Investigating Committee together with therecord of the investigation proceedings shall be sent to theBoard.

    (4) Where the Investigating Committee is not unanimous on anyquestion or matter to be determined before it, the decision ofthe majority of the members of the Investigating Committeeshall be deemed to be the decision of the InvestigatingCommittee.

    (5) Where on any question or matter to be determined by theInvestigating Committee there is an equality of votes, theChairman shall have a casting vote.

    35F. (1) Subject to section 7A(6) or 15(2) of the Act, the Board upon

    receipt of the report of the Investigating Committee and itsrecommendations, shall, where it is satisfied that there aregrounds for the complaint against the registered QuantitySurveyor, conduct a hearing of the complaint.

    (2) The Board shall meet at the premises of the Board or at suchother place, and on such date and time as the President ofthe Board may determine.

    (3) Where a hearing is to be held by the Board, the Registrarshall send a notice in respect of the complaint to thecomplainant and the registered Quantity Surveyor, and theirrespective counsels, if any, by registered post or prepaidpost to his or its last known address.

    (4) The notice under paragraph (3) shall specify the date, timeand place of the hearing of the complaint by the Board.

    (5) The Board may adjourn the hearing of the complaint fromtime to time, and no written notice of an adjournment isrequired to be served on any party when the adjournment ismade in the presence of that party.

    (6) Subject to the provisions of the Act and these Rules, theBoard may regulate its own procedures for the hearing of thecomplaint in such manner as it deems fit, and the Board shallmake a record of the proceedings conducted before it.

    (7) At the hearing before the Board, the registered QuantitySurveyor shall be given an opportunity to be heard, where-

    (a) in the case of a registered, registered graduate ortemporary registered Quantity Surveyor, in person or bycounsel;

    (b) in the case of a sole proprietorship, by the soleproprietor or by its counsel; or-

    (c) in the case of a partnership or body corporate, by apartner, director, representative appointed in writing or byits counsel.

    (8) Where the Board is not unanimous on any question or matterto be determined before it, the decision of the majority of themembers of the Board shall be deemed to be the decision ofthe Board.

    (9) Where on any question or matter to be determined by theBoard there is an equality of votes, the President shall have acasting vote.

    35G. (1) Where on the date fixed for the hearing of the complaint, theregistered Quantity Surveyor and/or the complainant fail toattend the hearing before the Board, the Board may, uponbeing satisfied that the notice of the hearing has been duly

    served on the registered Quantity Surveyor or thecomplainant under rule 35F(3), proceed to investigate thecomplaint in the absence of the registered Quantity Surveyorand/or the complainant, as the case may be, without furthernotice to him or it and make its determination and order.

    (2) The Registrar shall inform the complainant and the registeredQuantity Surveyor of the order of the Board in respect of thecomplaint..

    PART V

    REGISTRATION OF FIRMS AND BODIES CORPORATE

    36. (1) A firm or body corporate desirous of practising as consultingQuantity Surveyors shall make an application for approval topractise under section 7A of the Act to the Board in Form G.

    (2) (deleted)

    (3) Where a firm is desirous of practising as consulting QuantitySurveyors under rule 36(1), the sole proprietor or all thepartners , as the case may be, shall be registered QuantitySurveyors and

    (a) the sole proprietor; or

    (b) the majority of the partners, in terms of number ofpartners and equity,

    shall have a minimum of 5 years of experience to thesatisfaction of the Board after registration as registeredQuantity Surveyors under section 10(2) of the Act;and

    (4) Where a body corporate is desirous of practising asconsulting Quantity Surveyors under rule 36(1), the directorsshall be registered Quantity Surveyors, and the majority ofthe directors, in terms of number of directors and equity, shall have a minimum of 5 years of experience to thesatisfaction of the Board after registration as registeredQuantity Surveyors under section 10(2) of the Act.

    36A. (1) A body corporate providing quantity surveying services,professional engineering services and/or architecturalconsultancy services that is desirous of practising asconsulting Quantity Surveyors, shall make an application forapproval to practise under section 7B of the Act to the Boardin Form G1.

    (2) The body corporate that applies for approval to practiseunder paragraph (1) shall comply with the following, namely:

    (a) all the requirements as set out in section 7B of the Act;and

    (b) the directors of the body corporate responsible for theprovision of consulting quantity surveying services shallbe registered Quantity Surveyors, and the majority of thedirectors shall have a minimum of 5 years of experienceto the satisfaction of the Board after registration as

    36A shall be accompanied with

    (a) the processing fee as prescribed in Part Two of the FirstSchedule, which is not refundable; and

    (b) the registration fee as prescribed in Part Two of the FirstSchedule, which shall be refunded to the applicant who isunsuccessful in its application.

    43. (1) The permit to practise to be issued to a firm or body corporatewhose application for approval to practise as consultingQuantity Surveyors has been approved by the Board undersection 7A(12) of the Act shall be in Form H.

    (IA) The permit to practise to be issued to a body corporateproviding quantity surveying services, professionalengineering services and/or architectural consultancyservices whose application for approval to practise has beenapproved by the Board under section 7B of the Act shall be inthe Form H1.

    (2) All permit to practise issued under section 7A(12) of the Actshall be signed by the Registrar and sealed with the commonseal of the Board in accordance with subparagraph (3) ofparagraph 3 of the Schedule to the Act.

    44. An application by -

    (a) a firm or body corporate practising as consulting QuantitySurveyors; or

    (b) a body corporate providing quantity surveying services,professional engineering services and/or architecturalconsultancy services that is approved to practise asconsulting Quantity Surveyors by the Board,

    for renewal of approval to practise shall be made to the Board.

    45. The renewal fee for a firm or body corporate to practise asconsulting Quantity Surveyors under section 7A(13) of the Actshall be as prescribed in Part Two of the First Schedule.

    45A. The fees for the reinstatement of a firm or body corporatepractising as consulting Quantity Surveyors under section 17 of

    the Act shall be as prescribed in Part Two of the First Schedule.46. (1) Upon the renewal of approval for a firm or body corporate to

    practise as consulting Quantity Surveyors, the Registrar shallissue to the firm or body corporate a permit to practice inForm H.

    (2) Upon the renewal of approval for a body corporate providingquantity surveying services, professional engineeringservices and/or architectural consultancy services to practiseas consulting Quantity Surveyors, the Registrar shall issue tothe body corporate a permit to practise in Form H1.

    (3) Upon the reinstatement of a firm or body corporate to practiseas consulting Quantity Surveyors, the Registrar shall issue tothe firm or body corporate a permit of reinstatement to

    (4) Upon the reinstatement of a body corporate providing quantitysurveying services, professional engineering services and/orarchitectural consultancy services to practise as consultingQuantity Surveyors, the Registrar shall issue to the body

    corporate a permit of reinstatement to practise in Form I(1).

    47. Where the Board approves an application by a firm or bodycorporate whose permit to practise as consulting QuantitySurveyors has been previously cancelled pursuant to section7A(5)(dd) of the Act, the application by the firm or body corporateshall be deemed to be a new application and the fee prescribed inrule 42 shall apply.

    48. (1) A firm or body corporate which has been approved by the Boardand desirous of changing its name shall apply to the Registrarin writing for approval of the Board and, in the case of a bodycorporate, after ascertaining from the Registrar of Companies

    the acceptability of the proposed name.

    (2) Upon the approval by the Board of the proposed change inname a fee of three hundred ringgit shall be paid within onemonth from the date of notification by the Registrar of suchapproval.

    PART VI

    AUTHORISATION BY PRESIDENT

    49. (1) Any person who is not a registered Quantity Surveyor, or anyfirm or body corporate which is not practising as consultingQuantity Surveyors, is desirous of doing any act or thing thatthe person, firm or body corporate would, but for theauthorisation under section 26A of the Act, be prohibited ornot entitled to do, shall make an application for authorisationto the Board in Form J or J1, as the case may be.

    (2) (delete)

    (3) Subject to the requirements specified in rule 50 the Presidentshall make a decision within ninety days of the date of receiptof the application, provided that such application is in fullcompliance with the requirements of the Board.

    50. (1) The President may grant his authorisation to the applicantunder rule 49 subject to the following conditions:

    (a) that the applicant possesses qualification in QuantitySurveying recognised by the Board;

    (b) that the applicant has obtained ten years post qualificationexperience to the satisfaction of the Board as a QuantitySurveyor;

    (c) that the applicant's employment in Malaysia is, in the

    opinion of the Board, necessary and that he shall be fullysponsored by an organisation or a firm that requires hisservices and shall be fully supported by a letter ofsponsorship from the organisation or firm;

    (ca) that where the applicant is a firm or body corporate, itsapplication shall be fully supported by the client whorequires its services; and

    (d) in deciding to grant his authorisation to the applicant, thePresident shall have regard to any policy as the Boardmay from time to time adopt.

    51. (1) Every applicant shall be notified of the decision of thePresident by the Registrar within thirty days of the date of thedecision.

    (2) The notification under paragraph (1) must state the date ofthe decision.

    52. (1) Any authorisation granted by the President under rule 50 shallbe substantially in a Letter of Authorisation in Form K together with the conditions or restrictions (if any) as hethinks fit to impose.

    (2) The Letter of Authorisation shall, subject to paragraph (5), bevalid for one calendar year only.

    (3) (deleted).

    (4) The authorised person, firm or body corporate shall bepermitted or entitled to do or act as if he is a registeredQuantity Surveyor, or it is a firm or body corporate practicingas consulting Quantity Surveyors, and shall be subject to the

    Act, rules made thereunder and the conditions or restrictionsspecified in the authorisation granted under this rule.

    (5) The authorised person, firm or body corporate shall not act ordo things as permitted for more than a total period of 180

    days in any one calendar year.53. (1) Every application for an authorisation under rule 49 shall be

    accompanied with -

    (a) the processing fee as prescribed in Part Two of the FirstSchedule, which is not refundable; and

    (b) the registration fee as prescribed in Part Two of the FirstSchedule, which shall be refunded to the applicant whois unsuccessful in his or its application.; and

    (2) Upon or before expiry of the Letter of Authorisation, the

    authorised person may apply for a new Letter of Authorisationand if approved, shall pay the fees as prescribed in Part Twoof the First Schedule.
