Private Schools-Immigrant
Private schools in the jurisdiction of Title III-Immigrant eligible LEAs will be asked to submit a request to participate in the Title III Immigrant program via online reporting, due June 30, 2010.
A letter detailing the process will be mailed to private school administrators in early May.

Private Schools-Limited English Proficient (LEP)
Each year on ConApp I, page 4, LEAs are asked to indicate which private schools they will serve with Title III Limited English Proficient (LEP) funds.
The following year, the LEA reports the number of private school students it served and is reimbursed on the following fiscal year apportionment.

Private Schools-Limited English Proficient (LEP)
For the first time this year on ConApp I, LEAs will be asked to report two things on the private school page:
the private schools they will serve with Title III LEP funds in 2010-11; and
the private schools students they served with Title III LEP funds in 2009-10
LEAs will be reimbursed in 2010-11 based on the private school students served in 2009-10 as reported by the LEA on ConApp I.

LEAs generating $10,000.00 or more apply via the ConApp I, due June 30, 2010, page 2.
LEAs generating less than $10,000.00 apply via the online consortia application process by June 30, 2010. A letter detailing application information is anticipated to be mailed in early May to consortia eligible LEAs.

Community-Based English Tutoring Program
Community-Based English Tutoring Program
Pursuant to Senate Bill x3 4 (SB x3 4), Community-Based English Tutoring (CBET) Program funding for 2008-09 through 2012-13 may be used for any educational purpose.
All program requirements are suspended during this flexibility period.
Funding for 2009-10 through 2012-13 will be based on 2008-09 allocations, rather than on EL counts.

In addition to flexibility for 2008-09 through 2012-13 funding, SBx3 4 provides that CBET balances as of June 30, 2008 may be used for other purposes. The time period to do so ends June 30, 2010.
The CDE sent a payment request to the State Controller’s Office on November 16, 2009 for 100 percent of the allocation for 2009-10.

The Governor’s Budget released on 1/8/10 includes $40,095,000 for CBET for fiscal year 2010-11.
Each LEA that received CBET funding for 2008-09 will automatically receive funding for 2010-11, without having to apply for it.

English Language Acquisition Program
English Language Acquisition program (ELAP) funding for 2008-09 through 2012-13 is NOT granted flexibility.
ELAP funding must still be used to provide supplemental services to ELs in grades four through eight.
However, ELAP balances as of June 30, 2008 may be used for other purposes. The time period to do so ends June 30, 2010.

Apportionment notices for 2009-10 were mailed in early September, 2009.
The CDE sent a payment request to the State Controller’s Office on December 23, 2009 for 100 percent of the allocation for 2009-10.

The Governor’s Budget released on 1/8/10 includes $50,376,000 for ELAP for fiscal year 2010-11.
For budgeting purposes, each LEA can estimate its allocation for 2010-11 by multiplying its number of English learners in grades four through eight on the March 1, 2010 Language Census (R30-LC) by $109.
With few exceptions, do not include English learners enrolled in charter schools in the student count for funding.

Title III Accountability Update

Title III Year 2 and Year 4 Local Educational Agencies in Improvement Status
The California Department of Education (CDE) and the County Office of Education Regional Leads, in partnership with the California Comprehensive Center (CA CC) at WestEd, have co-planned and delivered in the last two years, technical assistance to local educational agencies (LEAs) failing to meet the Annual Measurable Achievement Objectives, per the agreement of services with the California County Superintendents Educational Services Association (CCSESA).

Title III Year 2 and Year 4 Local Educational Agencies in Improvement Status
CDE and CA CC personnel have convened and facilitated monthly meetings of the County Regional Leads.
Coordinated technical assistance efforts, discussed and developed solutions to emerging technical assistance and policy implementation issues, and maintained consistent effort in assisting these LEAs.

COE Regional Leads
In fiscal year 2009–10 the CDE will disburse $1.8 million in Title III local assistance funds.
Eleven selected COEs to continue providing technical support to LEAs in the development, implementation, and monitoring of Title III Year 2 Improvement Plan Addendum and Year 4 Online Action Plans required of identified LEAs in need of improvement.

COE Regional Leads
The COE Regional Leads have been working with the LEAs that were identified as in need of improvement based on the results of the 2008-09 Title III Accountability Reports released on December 4, 2009.
They are also assisting the LEAs that went into improvement status as the result of subsequent updates (February 3, 2010) to the Adequate Yearly Progress (AYP).
