I. INTRODUCTION

A. Introduction to Project

1. The Masalli to Astara Motorway is a new 62 km motorway section of the M-3 highway corridor that links the capital city, Baku, to the south of the country and the town of Astara, which straddles the Azeri/Iranian border. The project is split into three sections; A (0 - 22.15 km), B (22.15 - 45.00 km), and C (45.00 – 62.14 km).

2. The Executing Agency for the project is the Azeravtoyol Open Joint Stock Company1 (abbreviated to AAY in the present report).

3. Following screening2, an Environmental Impact Assessment (EIA) was carried out for the project in 2007. The EIA report was approved by AAY and ADB, and has served as a basis for the development of the specification and contract documents, and for the preparation and pricing of the Contractor Environmental Management Plan (EMP).

4. The Engineer appointed by AAY is Nippon Koei UK Ltd. The construction contract for Section B was awarded to Özgün Construction Industry and Trading Co. Inc. Section C was awarded to Polat LLC in November 2013.

5. The first bi-annual environmental monitoring report covered the period 1st March to 31st August 2011 (Section A only). Subsequent bi-annual environmental monitoring reports covered the following periods:

• Second: 1st September 2011 to 31st May 20123.

• Third: 1st June 2011 to 31st December 2012.

• Fourth: 1st January 2013 to 30th June 2013.

• Fifth: 1st July 2013 to 31st December 2013.

• Sixth: 1st January 2014 to 30th June 2014.

• Seventh: 1st July 2014 to 31st December 2014.

• Eighth: 1st January to 30th June 2015.

• Ninth: 1st July 2015 to 31st December 2015.

• Tenth: 1st January 2016 to June 2016.

• Eleventh: 1st July 2016 to 31st December 2016.

• Twelfth: 1st January 2017 to 30th June 2017.

6. From the Fifth issue onwards, the report has been split according to loan source into two; Part I, covering Section A and Lenkaran Bridge (Loan 2354 AZE), and Part II, covering Sections B & C (Loan 2831 AZE).

7. Key milestones relating to mobilisation are summarised below:

• Overall Contract agreement: 15th Dec 2010.

• The Engineer mobilised on 21st February 2011.

• Section B Contract Agreement: 29th March 2013.

• Notice to Commence for Section B was issued on 18th June 2013.

• Earthworks began on Section B in August 2013.

• Section C Contract Agreement: 31st October 2013.

• Notice to Commence for Section C was issued on 27th January 2014.

B. Objectives of Biannual Environmental Reporting

8. The purpose of the Biannual Environmental Monitoring Reports is to provide a summary of the key issues relating to environmental management over the past six months. The summary includes an update on overall project progress, the status of SSEMP implementation, any progress made with environmental management, environmental monitoring results, and other relevant issues such as non-compliance and corrective actions, and monitoring of the Grievance Redress Mechanism (GRM).

9. The Reports are prepared by AAY and are intended to inform ADB and any other interested parties of the status of environmental management of the project. The Reports are summaries; more detailed information is included in the monthly and quarterly reports prepared by the Contractors and the Engineer.

C. Methodology

10. The Biannual Environmental Monitoring Reports are prepared by reviewing and extracting key information from a number of sources, as follows:

• Contractors’ Quarterly Environmental Management Reports;

• Contractors’ Grievance Registers;

• Engineer’s Quarterly and Monthly Progress Reports;

• Engineer’s Environmental Specialist’s Field Reports;

• Monthly instrumented monitoring results;

• Ad Hoc reports from the Contractors on training and public consultation; and

• Correspondence between AAY, Engineer and Contractors relating to environmental and social issues.

11. In addition, some information and opinion in the reports results from site visits, technical meetings and public meetings and interviews over the preceding six months.

D. Construction Activities and Project Progress dur ing previous six months

12. Key milestones and construction activities relating to the past six months’ work are summarised below:

• Table 1 below shows the Contractor's monthly progress throughout the current reporting period.

• The Contractor made substantial progress during the reporting period and major works accomplished are: (i) embankment and pavement works of main road (100% complete), (ii) access roads of 4 flyover bridges including asphalt pavement (100% complete), (iii) embankment works of access roads and ramps of two interchanges (80% complete), (iv) Remaining culvert construction, (iv) embankment slope protection works (80% complete), (v) bridge construction works (98% complete).

• New Jersey Barrier along central median (90% complete), other road furniture materials procurement in progress.

• Utility relocations (100% complete).

• A total of 23 Interim Payment Certificates (IPC) have been issued.

Section C

• Table 2 below shows the Contractor's monthly progress throughout the current reporting period.

• During the first 3 months of the reporting period there were limited activities due to the wet condition of materials and standing water within the working areas.

• Since April all activities resumed and major works accomplished during the reporting period are: (i) Rockfilling (100% complete), (ii) Embankment construction (75% complete), (iii) Granular and asphalt pavement works (70% complete), (iv) Embankment slope protection works (75% complete), and (v) Median drainage works (85% complete).

• Construction works for minor elements of bridges and approach slabs are ongoing (overall 95% complete)

• Utility relocation works are complete except two steel truss tower additionally required at access of the bridge no.3.

• New Jersey Barrier along central median (70% complete).

• A total of 21 Interim Payment Certificates (IPC) has been issued.

E. Project organization and environmental managemen t team

13. There has been no change to the organization of the environmental management team within the Contractors, Engineer or the Owner (AAY) over the past six months. For completeness, the Contractors’ organisational structures are shown below.

F. Relationships with Contractors, owner, lender, e tc.

14. The relationships between contractors, Engineer, Owner, and Lender are considered normal working relationships.

15. At the working level, communication with regards to environmental issues remains good.

II. ENVIRONMENTAL MONITORING

A. Status

Section B

16. Regular monthly monitoring has been carried out in accordance with the SSEMP throughout the current reporting period, with the exception of at the Hirkan Forest, where only sampling set was taken (June 2017) during the reporting period.

17. The sampling has been carried out by Platan Group, who then send the samples for analysis at the Central Laboratory of the Ministry of Ecology and National Resources of Azerbaijan.

Section C

18. Regular monthly monitoring has been carried out in accordance with the SSEMP throughout the current reporting period.

B. Results

Section B

20. Most water quality monitoring results met the Azeri national standards during the present reporting period, however several results contravened the standards. The contraventions as well as some further observations on the results are discussed below: The full results are provided in Appendix 1.

• pH readings were within the limits at all locations for most of the reporting period, with the following exceptions:

o The Lakar and Ogru Rivers were rather acidic during January; and

o The Gamishli River was rather acidic during May.

o As has been the case in the past, the downstream readings generally show a slightly higher pH than upstream readings, indicating that the acidic conditions are not as a result of the project works.

• DO was below the permitted lower threshold of the Azeri standards for the majority of the reporting period. This has occurred often on all sections and is not considered a significant issue due to the high variability of DO within aquatic environments, and the multiple factors that influence levels, even on a daily basis.

• Turbidity was lower at most locations and at most times in comparison to both the pre-construction monitoring and to previous reporting periods, and were well below the applicable limits. Strangely, TSS levels, whilst often low, have sometimes been fairly high at the same time that turbidity has been low (e.g. May 2017). Whilst a strong linear correlation between turbidity and TSS usually exists, and could point to sampling/analysis errors, certain conditions can lead to a reduction in the strength of the correlation.

• Nitrates / Nitrites and other major ions are well below the standards at all locations, and oil and grease levels are constant throughout the reporting period at a very low level, well below the limits.

• As is usual for the project area due to the prevailing lack of sewage treatment, the faecal coliform levels at all stations are generally high (but below the standards). The project is not thought to be responsible for the continued elevated levels.

21. The water monitoring results for the stream bordering the Hirkan Forest Area continue to be of concern, with very high faecal coliform levels. It remains clear that these results are due to the use of the boundary stream by the adjacent village as both a sewer and a waste dumping area.

22. All air quality monitoring results for all determinants and all monitoring stations were well below Azeri national standards during the present reporting period. As would be expected, dust levels rose slightly throughout the monitoring period, in sync with the changing seasons, however they remained below the limits even in June. Air quality at Hirkan Forest remained very good during the single monitoring event.

23. Noise and vibration monitoring results were all below the permitted limits during the reporting period. Noise levels were approaching the limits at Yuxari Nuvadi at times, but, as has been discussed in previous reports, the principal noise sources in this area are not project-related.

Section C

24. Most water quality monitoring results met the Azeri national standards during the present reporting period, however several results contravened the standards. The contraventions as well as some further observations on the results are discussed below: The full results are provided in Appendix 1.

• pH fluctuated considerably between the sampling months, but not much between stations. This suggests that factors such as temperature and rainfall may have been the major influence in variation of pH.

• As with the previous reporting period, BOD, turbidity and TSS were generally low though one reading at one location (Penser 1, downstream in April) was ever so slightly over the limit for TSS.

• Sulphates, Nitrates / Nitrites and oil and grease results are all well below the standards at all locations.

• Faecal coliform levels remain generally rather high at all stations, as they have been on all sections of the project throughout.

25. All air quality monitoring results for all determinants and all monitoring stations were below Azeri national standards during the present reporting period, and as with Section B, dust levels rose slightly during the latter months.

26. Noise and vibration monitoring results were all below the permitted limits during the reporting period. In common with Section B, noise levels were approaching the limits at Yuxari Nuvadi on occasion, but, as has been discussed in previous reports, the principal noise sources in this area are not project-related.

C. Action

27. No action on site is required on either Section B or Section C in response to the monitoring results from the present reporting period.

III. ENVIRONMENTAL MANAGEMENT

A. Status

28. Environmental management of the project for the Section B is described in two parts; one covers general project activities and the second is dedicated to works around Hirkan forest area. This is due to the sensitivity and importance of the area requiring special attention.

Section B

29. With occasional exceptions, environmental management on Section B has continued to be of an acceptable standard during the present reporting period, and has improved somewhat since the previous reporting period. Any non-compliances noted during site audits are usually resolved quickly (see Part D below) however, repetitions of similar non-compliances have continued during the present reporting period.

30. The physical mitigation measures set out in the SSEMP are generally all constructed and functioning as designed (with the exception of the asphalt plant – see Part D below). General cleanliness and waste management has improved since the previous reporting period.

31. On the alignment environmental management was compliant with the SSEMP, and the site was clean, tidy, and well maintained. The situation was improved over previous reporting periods, and there were no isolated problems of waste management as have been frequently observed in the past. Unusually, no Health and Safety problems were observed, despite significant works being carried out.

32. The local road crossings along Section B have still not been completed and asphalted, however the situation is improved compared to the previous reporting period, during which several of the local roads and crossing points were observed to be non-compliant. During the present reporting period, all local roads crossing the alignment, whilst not tarred, were well graded and compacted, and were therefore passable.

33. The road through Haftoni village has been improved via filling of the potholes, but still requires a more permanent fix; this will presumably be included within the overall surfacing work for the local road crossing, which now passes over the new bridge (Figure 3). The fact that the Section B camp can now be accessed directly from the project road should now mean that traffic through Haftoni will be minimal from hereon in.

34. There have been no accidents during the reporting period involving the public, and none involving project workers. HIV and other on the job training has continued regularly throughout the reporting period.

35. The sole borrow pit operated by the Section B Contractor is Qrunba, situated just to the west of the project alignment to the south of Haftoni village. The borrow pit is no longer being exploited by the Contractor, however the current status with respect to ownership/licencing is unclear; it is understood that the local executive powers wish to continue to operate the site as a borrow pit for other projects/requirements, and have therefore prevented the Contractor from carrying out reinstatement activities.

36. No topsoil has been stripped during the present reporting period. Most of the material previously stockpiled at locations along the RoW is now being used for final reshaping and reinstatement alongside the road shoulder.

37. The issue of stockpiles and reinstatement will be closely examined during the next, final report.

Hirkan Forest area

38. During the previous audit, it was observed that the embankment and asphalting was complete at the “Hirkan Forest” area, with only installation of road furniture and the installation of permanent noise barriers remaining to be carried out. During the present reporting period, there has been little further progress. Likewise, previous audits reported that the forest was recovering well from the clearance and drainage works, and that ecological recovery continues, and again, the situation remains unchanged (Figure 4). Regretfully, the local population continues to use the SE corner of the forest as a rubbish dump, and has dammed the stream.

Section C

40. The Section C Contractor’s site performance remains good, and is largely compliant with the provisions of the SSEMP. As usual, the Contractor has made some efforts over the past months to address the non-compliances that were observed during the previous site audits, and in general, environmental management was of a comparatively good standard.

41. As with Section B, the works on the alignment have advanced well over the past six months, and all works observed on site during audits were being carried out in adherence to the SSEMP.

42. In common with Section B, the diversion/local road crossings remain generally unpaved, but were found to be in passable condition.

43. There have been no accidents during the reporting period involving the public, and none involving project workers. HIV and other on the job training has continued regularly throughout the reporting period.

44. The Contractor’s “office camp” (in Burjali village) is generally very well managed. The camp area is clean and tidy, senior staff accommodation is of a good standard, and the welding area is well equipped. Health and safety standards are also good.

45. At the Contractor’s “plant camp” (at km 33+000 / Yuxari Nuvadi village), the facilities are of a good standard in general, and most non-compliances previously observed have been satisfactorily solved, though one new non-compliance arose, and this is discussed further in Part D below. As with the “office camp”, the Contractor generally resolved any problems raised by the Engineer within an acceptable timeframe.

46. The sole borrow pit operated by the Section C Contractor is Rvo, situated around 10 km west of Lenkaran, alongside the Lenkaran River and close to the Lerik highway. The borrow pit is no longer being exploited by the Contractor, however as is common in the area, the local executive powers have granted use of the site to more than one contractor/company. Reinstatement of the site is therefore challenging, due to its ongoing use by third parties.

47. It should be noted that all required local and national level permits were obtained prior to the opening/operation of each borrow pit in Sections B and C, and furthermore, stand-alone borrow pit management plans were developed to ensure adequate environmental management during opening, operation and closure of the sites.

48. The reinstatement status described above and for Section B, whilst not satisfactory from a best practice standpoint, are entirely within the bounds of the national environmental management and legal systems, which devolve most management and decision-making to the local executive powers.

49. No topsoil has been stripped during the present reporting period. Most of the material previously stockpiled at locations along the RoW is now being used for final reshaping and reinstatement alongside the road shoulder.

50. The issue of stockpiles and reinstatement will be closely examined during the next, final report.

B. Documents

Section B

51. Reporting for Section B is compliant, with the Quarterly Environmental Reports and weekly audits being carried out/submitted correctly and on time. An inspection of site documentation in May 2017 showed that all relevant paperwork, including the Grievance Register, was present at the site office, and maintained up to date.

C. Inspections and Audits

53. There were no inspections or audits from the ADB’s international staff during the present reporting period, however ADB national specialists visited the site on several occasions.

54. The Section B & C contractor’s EPMs conduct ad hoc site visits on a daily basis, with a full audit of all sites once a week.

55. The Engineer’s National Environmental Specialist is based at the Section C camp area and he visits all sites on a twice-weekly basis, with additional ad hoc visits as required. The Engineer’s National Environmental Specialist also accompanies the Section B & C contractor’s EPMs on their site audits.

56. During the present reporting period The Engineer’s International Environmental Specialist visited construction sites between the 12th-14th May 2017.

57. The Executing Agency has made a number of ad hoc visits to site as required.

D. Non-Compliance and Corrective Actions

Section B

58. The Contractor has again significantly advanced the construction works on site over the past six months, and has mainly done so within the bounds of the SSEMP; works on the alignment were generally compliant, and the site was for the most part kept clean, tidy, and well maintained. As has been discussed in the preceding sections, the overall level of management has been improved over the past six months when compared to the previous reporting period.

59. The general situation at the construction camp was improved since the previous audit, with equipment stored in a good fashion and most of the previous non-compliances addressed satisfactorily. These efforts include:

• Closing up and reinstating the area in the eastern corner of the camp where the septic tanks were previously leaking;

• The cleaning of the oil storage area, which was observed to be in a better condition than previously (Figure 7);

• Bunding repairs (Figure 8); and

• Removal of large quantities of equipment and waste previously reported at the site.

60. Nevertheless, some non-compliances did arise during the reporting period:

• The prime coat asphalt plant located adjacent to the vehicle wash station was observed to have breaches in the bund where pipes pass through it, and a bitumen tank was located both outside the bund, and below ground level, where the opportunity for ground and water contamination is present (Figure 9);

• The bund wall at the main asphalt plant that was previously observed to have significant breaches was repaired, however a new breach appeared; and

• Fire extinguisher checks again revealed failures (Figure 9).

61. The above issues were addressed with varying levels of satisfaction, and follow up in some areas is ongoing.

Hirkan Forest Area

62. There were no non-compliances observed at the Hirkan Forest area during the present reporting period. As described in preceding sections, the embankment and road works are now completed in the area, and the temporary noise barriers have been removed. Ecological recovery appears to be progressing well.

Section C

63. The Section C Contractor’s site performance remains good, and is largely compliant with the provisions of the SSEMP. As always, the Contractor has made an effort over the past months to address the non-compliances that were observed during the previous reporting period, and only a few new minor non-compliances were noted.

64. No significant problems were noted on the alignment during the present reporting period.

65. The outstanding non-compliances at the two construction camps from the previous visit were inspected; some were found to have been resolved (for example the labourer accommodation had been somewhat improved) and only one notable non-compliance was observed during the present reporting period; whilst the previously observed breaches in the asphalt plant bund wall had been repaired (Figure 11), elsewhere in the bund, pipes had been passed through the bund wall at low-level (Figure 12). This clearly negates the purpose of the bund and required immediate attention.

66. The concrete plant, workshop, crushing area and oil change area were all in good condition and operating very well. Overall, both the “office camp” and the “plant camp” were in good condition and substantially compliant with the provisions of the SSEMP.

E. Consultations and Complaints

Section B

67. Previous reports discussed changes to the public consultation meeting format and frequency, which were aimed at making them more meaningful. Despite sustained pressure from the Engineer on the Contractor, the quality of the public consultations has not been significantly improved. This is entirely attributable to a lax attitude from the EPM, and the situation is a disappointment.

68. Despite the above disappointment, consultation meetings were held on the 2nd March (Dasdaligjar village) and 11th June 2017 (Haftoni and Laj villages), and they offered a chance to update local community leaders on the progress of the works and the expected finishing dates, and to remind them of the grievance redress mechanism.

70. One new grievance was lodged during the present reporting period. The complaint related to deterioration of local roads, and the grievance was addressed by the Contractor. A summary of all grievances to date and how they were resolved is provided in Table 5 below.

72. Two consultation meetings were held during the present reporting period – on the 7th March and 12th June 2017, both with Yuxari Nuvadi village.

G. Conclusions

77. The past six months have been a period of intense construction activity for both Section B and C contractors. During this period, both contractors maintained a generally good level of environmental management, have maintained their documentation in good order, and have avoided accidents and incidents.

78. Only a handful of non-compliances observed, and these were all restricted to the camp areas. The gradual completion of the road sections, and in particular the diversion/crossing roads, will reduce negative impacts such as airborne dust and traffic noise affecting local populations.

79. The Hirkan Forest area has been in a good condition during the present monitoring period, during which there has been little change from the previous six months.

80. The requested improvements to public consultations for both Sections have not been made, despite repeated attempts.

81. The focus in the coming months will be on ensuring that the required permanent environmental mitigation measures are correctly installed by the contractors, and that site reinstatement is correctly carried out.

Rashad Karimov – Environmental Protection Manager of Section B firstly welcomed all participants and informed that “Ozgun” is committed to integration with the society and the environment. He said that, we would like to bring into your attention that, under the offer of Azer Road Service OJC, the construction of Masalli – Astara project (Section B) is being carried out by “Ozgün Construction Industry and Trade Co” Inc, and work are currently scheduled to be completed by 2017. According to ecological and environmental policy of the company, we are constantly monitoring ecology and safety requirements at international level. However it is impossible to avoid of some negative impacts during construction (e.g. dust-mist, noise, vibration etc.) We do apologize to the owners of land, houses and etc. on behalf of our company administration for the temporary inconvenience that will be generated during the process of construction.

He said that Public Information Leaflets outlines the Masalli – Astara Motorway (Section B) project and describes the construction process. The leaflets also provide information on how to register complaints during the construction so that your concerns are dealt with swiftly and to your satisfaction. As a responsible contractor, “Ozgün Construction Industry and Trade Co” Inc is working with the Engineer

The GRM system consists of following steps below:

• People should contact with Grievances Focal Point (GFP). For Haftoni – Laj area the GFP is Rovshen Zeynalov (050-546-86-20), for Luveser – Lenkaran area the GFP is Aflatun Askerov (050-365-89-65), for Sovu – Lenkaran area the GFP is Kamal Huseynov (050-346-31-21) and for Dasdaligjar – Lenkaran area the GFP is Nazim Emenullayev (050-343-00-45);

• Your local GFP will meet with ÖZGÜN (the Contractor), register the complaint and will try to find a satisfactory solution;

• If your local GFP is not able to reach agreement with the Contractor, or if the Contractor does not solve the problem within one week, your GFP should contact the Project Supervision Consultant (assistant team leader) Farrux Mutallimov (055-450-69-79) and report the problem;

• If the complaint has not been dealt within a further 2 weeks the GFP will present the complaint to the Grievances Redress Committee (composed of representatives from the Contractor, Supervision Consultants, AAY and local government);

• The Grievance Redress Committee will decide a final resolution on the complaint within 2 weeks.

Even though he mentioned about waste problem near the Moscow Forest area. He said that it is very pity that the local village people still continuing to litter different kind of domestic waste close to Moscow Forest area. Please help us for solution this problem and protect the local environment.

The leaflets also provide information on how to register complaints during the construction so that your concerns are dealt with swiftly and to your satisfaction. As a responsible contractor, Polat is working with the Engineer and Owner. Therefore Polat was already established a Grievance Redress Mechanism to ensure swift and satisfactory resolution of local public issues arising from the construction activities.

Alieva Sevda – Burjali village representative said that during the road construction process contractor was solved all problems raised by local villages people we are very happy that the construction process for Masalli – Astara Motorway (Section C) is finishing. It is a big project and will have a positive impact on regional development. Even though he said that it is good that the contractor company as Polat wants to share all information with the local community helps to the local people by providing them with different jobs according to their ability.
