BENDIGO AIRPORT REDEVELOPMENT PROJECT
INCORPORATED DOCUMENT, MAY 2015
1. INTRODUCTION
This document is an Incorporated Document in the Schedule to Clause 52.03 and the Schedule to Clause 81.01of the Greater Bendigo Planning Scheme.
Despite any provisions to the contrary in the scheme, pursuant to Clause 52.03 of the Greater Bendigo PlanningScheme, the land identified in this document may be used and developed in accordance with the specific controlscontained in this document.
In the event of any inconsistency between the specific controls contained in this document and any otherprovision of the scheme, the specific control contained in this document will prevail.
2. PURPOSE
The purpose of the specific control in this Incorporated Document is to ensure that the removal, destruction orlopping of native vegetation associated with the development of the Bendigo Airport and the Bendigo AirportBusiness Park is offset in the manner provided for in this document to the satisfaction of the Department ofEnvironment, Land, Water & Planning and the responsible authority.
3. ADDRESS OF THE LAND
This document applies to approximately 180 hectares of land as shown in Appendix 1 of this document (“theLand”). The Land comprises:
Lots 1-4 on PS422204F, 35 Victa Road, East Bendigo, commonly known as Bendigo Airport.
Lot 1 on LP34746, 149 Heinz Street East Bendigo.
Lot 3 on LP34746, 179 Heinz Street East Bendigo.
Lot 2 on LP34746, 199 Heinz Street East Bendigo.
Crown Allotments 92P, 92Q, 92S, 92S1, 191A, 191K, Parish of Sandhurst, known as the Bendigo AirportReserve.
Parts of the reservation of the main airport access road (part government road and road on PS422204).
Part of Crown Allotments 323C and 326M, Parish of Sandhurst, being parts of the Bendigo Regional Park inthe vicinity of the Airport.
Part of Crown Allotment 92R, Parish of Sandhurst, being reserved Crown land and containing theEllesmere-Goornong Channel.
Part of Heinz Street road reserve, East Bendigo.
Part of Andrew Lane road reserve, Ascot.
Part of Crown Allotment 326A, Racecourse Road, Ascot.
4. APPLICATION OF PLANNING SCHEME PROVISIONS
The following provision does not apply to the removal, destruction or lopping of native vegetation on the Land asallowed by the control in this document:

5. CONTROL
Despite the above provision of the Greater Bendigo Planning Scheme, no permit is required to remove, destroyor lop native vegetation, including dead native vegetation, as shown and described in Appendix 2 and subject tothe conditions in Clause 6 of this document.
The offset requirements must be provided in accordance with the summary table provided in Appendix 3.
6. CONDITIONS
1. Before works commence, an Environmental Management Plan to the satisfaction of the Department ofEnvironment, Land, Water & Planning must be submitted and approved by the responsible authority. Whenapproved, the plan will be endorsed and form part of this Incorporated Document.
The plan must include, where appropriate:
Construction
a) Measures to identify the native vegetation to be removed;
b) Measures to identify and protect the native vegetation to be retained during works;
c) Erosion and sediment control measures to ensure that no polluted and/or sediment laden run-off isdischarged directly or indirectly into drains or watercourses (no straw or hay are to be used for thesemeasures unless approved by the North Central Catchment Management Authority);
d) Vehicle and equipment hygiene measures to prevent the spread of weeds and pathogens to and fromthe site;
e) A site plan or plans identifying the above measures; and
f) The persons responsible for implementing the above measures.
Native Vegetation Management
The identification of the native vegetation within the Bendigo Regional Park to be managed as the ObstacleLimitation Surface and appropriate methodology for managing that native vegetation, including:
a) A schedule of maintenance activities including time of year for works;
b) The method of removal of native vegetation;
c) The management of cut material;
d) The rehabilitation and revegetation of any areas damaged by machinery;
e) The specify responsibility for activities and reporting on works and/or incidents; and
f) A requirement to notify the public land manager of any works at least seven days prior to thecommencement of works.
2. Prior to commencement of native vegetation clearing, an Offset Strategy for the development and to thesatisfaction of the Department of Environment, Land, Water & Planning must be submitted to and approvedby the responsible authority. When approved, the plan will be endorsed and form part of this IncorporatedDocument. The plan should be generally in accordance with the Ecological Assessment of Vegetation thatwill be affected by the Bendigo Airport Upgrade, (as amended on 20 November 2013), but must showoffsets matching clearing for each stage of development. It must achieve no net loss in the contributionmade by native vegetation to Victoria’s biodiversity.
3. Prior to the commencement of native vegetation clearing works for each stage, offsets for each stage of thedevelopment must be secured to the satisfaction of the Department of Environment, Land, Water &Planning.
7. EXPIRY:
The control in this document will expire if one of the following circumstances applies:
The removal, destruction or lopping of native vegetation is not started by 31 December 2017.
The removal, destruction or lopping of native vegetation is not completed by 31 December 2020.
The responsible authority may extend the periods referred to if a request is made in writing before the controlsexpire or within six months afterwards.
