(“Imerys”) respectfully submits this response to the Motion For Transfer filed by movant Tanashiska Lumas. Imerys joins in, adopts, and incorporates the Response of Johnson & Johnson and Johnson & Johnson Consumer Companies To Motion For Transfer And Coordination Of Pretrial Proceedings Pursuant To 28 U.S.C. § 1407. Imerys agrees that there is a group of overlapping cases involving talcum powder products that should be transferred by the Panel to a single district court for coordinated pretrial proceedings. Imerys is not named as a party in all the federal actions. 1 Imerys is a mining company, which did not design, package, label, distribute, market, or sell the talcum powder products used by consumers. Instead, Imerys sold a raw material (talc) in bulk to Johnson & Johnson Consumer Companies (JJCC) that JJCC incorporated into the finished products it sold to consumers. Presumably, however, an MDL judge can fashion procedures to avoid unnecessarily burdening a party who is not a defendant in every case. 1 Of the 11 actions Movant identified in her motion, Imerys was named as a defendant in only three, and subsequently was dismissed from one of those actions. Defendant Imerys Talc America, Inc. (“Imerys”) respectfully submits this response to the

Motion For Transfer filed by movant Tanashiska Lumas.

Imerys joins in, adopts, and incorporates the Response of Johnson & Johnson and

Johnson & Johnson Consumer Companies To Motion For Transfer And Coordination Of Pretrial

Proceedings Pursuant To 28 U.S.C. § 1407.

Imerys agrees that there is a group of overlapping cases involving talcum powder

products that should be transferred by the Panel to a single district court for coordinated pretrial

proceedings. Imerys is not named as a party in all the federal actions.1 Imerys is a mining

company, which did not design, package, label, distribute, market, or sell the talcum powder

products used by consumers. Instead, Imerys sold a raw material (talc) in bulk to Johnson &

Johnson Consumer Companies (JJCC) that JJCC incorporated into the finished products it sold

to consumers. Presumably, however, an MDL judge can fashion procedures to avoid

unnecessarily burdening a party who is not a defendant in every case.
