NOTICE OF HEARING

THE STATE OF UTAH TO ALL PERSONS INTERESTED IN THE FOLLOWING

MATTER.

Notice is hereby given that the Board of Oil, Gas and Mining ("Board"), State ofUtah, will

conduct a hearing on WEDNESDAY, May 24, 2017, at 10:00 AM, or as soon thereafter as

possible, in the Council Chambers ofthe Vernal City Offices, 374 East Main Street, Vernal, Utah.

The hearing will be conducted as a formal administrative adjudication in accordance with

the rules of the Board as set forth in Utah Administrative Code R641 et seq., and as provided for

in Utah Code Ann. § 40-6-1 et seq., and Utah Code Ann.§ 63G-4-101 through 601.

The purpose of the hearing will be for the Board to receive testimony and evidence

regarding a Request for Agency Action filed by Wesco Operating, Inc. ("Wesco") that the Board

enter an Order:

1. Establishing a special drilling unit for the Threemile Unit 12-2-29-21 horizontal well

(the "Subject Well") for the production of oil and associated gas and hydrocarbons from

the Cane Creek Shales, defined for the purpose of this cause as follows:

the stratigraphic equivalent of the interval from 7,548 feet to 7,63 8 feet MD as identified on the Gamma Ray Log run on November 15, 2010 for the Three Mile 12-7 Well with a surface location in the NWY4SEY4 of Section 12, T29S, R21E, SLM,

(the "Subject Formation"), comprised of the following San Juan County, Utah lands:

Township 29 South, Range 21 East, SLM

Section 1: EY:!SEY4 Section 12: NEY4 and NY:!SEY4

Township 29 South, Range 22 East, SLM

Section 6: Lots 6 (38.10) and 7 (38.14) [WY:!SW'/4]

(containing 396.24 acres)

(the "Subject Lands"), retroactive to October 15, 2016, the date of first production from

the Subject Well;

2. Providing that no well (whether vertical or horizontal) producing from the Cane

Creek Shales (as defined above) may be located closer than 400 feet from any portion of

the Subject Well's lateral located within the Cane Creek Shales (as defined above) without

an exception location approval by the Division or Board in accordance with Utah Admin.

Code Rule R649-3-3;

3. Providing said Order shall be suspended without further order of the Board if and

as of the effective date of the determination by the BLM that all of the Subject Lands be

included within a Unit participating area. In such event, Wesco, or its successor Unit

Operator, shall provide to the Board's secretary a copy of the BLM Decision Letter

reflecting such determination so the Board's records may be properly noted to reflect such

suspension becoming effective;

4. Making such findings and orders m connection with this Request as it deems

necessary; and

5. Providing for such other and further relief as may be just and equitable under the

circumstances.

Objections to the Request for Agency Action must be filed with the Secretary of the Board

at the address listed below no later than May 10, 2017. A party must file a timely written objection

or other response in order to participate as a party at the Board hearing. Failure to participate can

result in a default judgment.

Natural persons may appear and represent themselves before the Board. All other

representation of parties before the Board will be by attorneys licensed to practice law in the State

of Utah, or attorneys licensed to practice law in another jurisdiction which meet the rules of the

Utah State Bar for practicing law before the Utah Courts.

Persons interested in this matter may participate pursuant to the procedural rules of the

Board. The Request for Agency Action, and any subsequent pleadings, may be inspected at the

office of the undersigned, and inspected online at the Utah Board of Oil, Gas and Mining's website

at http://ogm.utah.gov/amr/boardtemp/redesign/books.html.
