Draft Technical Guidelines on Transboundary Movements of e-wasteand Used Electrical and Electronic Equipment, in Particular Regardingthe Distinction between Waste and Non-waste under the BaselConvention (Version 27 September 20121

I would like to refer to the above matter.

2. Malaysia is please to put forward our comments on the draft documentUNEP/CHW/OEWG.8/lNF/9/Rev.1 on Technical Guidelines on TransboundaryMovements of Electronic and Electrical Waste (e-Waste), in Particular Regarding theDistinction between Waste and Non-Waste (Version 27 September 2012)UNEP/CHW/OEWG.8/lNF/g/Rev.1. Our kev comments are summarized as follows:

(i) Referring to Section lll of the document on Guidance on distinctionbetween waste and non waste, in relation to paragraph 26(b)(ii), Malaysiado not support the approach of classifying the distinction between wasteand non-waste of used equipment based on Annex Vll and non Annex Vlldesignation of receiving countries.

(ii) As a developing and economies in transition country, Malaysia ispromoting development of manufacturing and services sectors as part ofour economic development plan. These include development of electricaland electronic sectors including the establishment of refurbishment andrepair center of electrical and electronic products and parts, which seryes

as refurbishment and repair hubs for the region for some brands products.Capabilities and availability of formal recycling facilities in somedeveloping countries and economies in transition that are repairing,refurbishing and recycling used equipment and e-waste in anenvironmentally sound manner should be recognized and further enhance.Putting geographical limitations on the distinction between waste and non-waste of used equipment would restrict further development of thesesectors.

Malaysia is of the opinion that classification of the distinction betweenwaste and non-waste of used equipment should not be limited bygeographical limitation, and what is describe as non waste to the AnnexVll countries should apply the same to those described in the non AnnexVll countries for the purposed used in this draft document.

Specific comment on the draft document is listed in table as perAttachment 1.
