Re: Enbrjdge Northern Gateway Project — Hearing Order OH-4-201 IFile No. OF-Fac-OiI-N304-2010-O1 01Request for Permission to provide Oral Evidence at Community Hearlnq
As indicated in our fax of this morning (copy attached, enclosures omitted), we represent Alberta Lands Ltd.with respect to the proposed Enbridge Northern Gateway Pipeline project on their lands. Our earlier letterwas a formal request for the permission of the Joint Review Panel to allow our client to make an oralstatement at the Community Hearing scheduled in Grande Prairie on March 26 to 28, 2012. In clarificationof this request, as a registered intervener in this matter, our request is to provide oral evidence at theCommunity Hearing scheduled in Graride Prairie. As previously indicated, when we filed our application forintervenor status with the panel we were unaware that such community hearings would be held in GrandePrairie. Now that we are aware of this fact, we would very much appreciate the opportunity to speak directlywith the panel regarding the lack of consultation that our client has experienced.
Please advise whether the panel is prepared to provide us with an opportunity to provide oral evidencebefore the panel at the upcoming Grande Prairie Community Hearing. I look forward to hearing from you.
Yøur truly,

Re: Enbridge Northern Gateway Project — Hearing Order OH-4-201 IFile No. OF-Fac-Oil-N304-201O-0f 01Request for Permission to provide Oral Statement at Community Hearing
We represent Alberta Lands Ltd. with respect to the proposed Enbridge Northern cateway Pipelineproject on their lands. We registered for Intervenor Status on June 13, 2011, filing ID number A29640.Please consider this letter our formal request for the permission of the Joint Review Panel to allow ourclient to make an oral statement at the Community Hearing scheduled in Grande Prairie on March 26to 28,2012.
When we liled our application for intervenor status with the panel we were unaware that suchcommunity hearings would be held in Grande Prairie. Now that we are aware of this fact, we wouldvery much appreciate the opportunity to spek directly with the panel regarding the lack of consultationthat our client has experienced. We expect that the oral statement would not exceed fifteen minutesand would be in English.
Our client’s situation is unique in the sense that they are the only registered owners of privately heldlands in that area affected by the proposed pipeline. Our client would like to make the panel awarethat early in the negotiation process Enbridge agreed to undertake a review of re-routing possibilitiesthat could avoid our clients lands. From that point in time, we received no response from Enbridgeuntil the summer of 2011. In a letter dated June 24, 2011, notably almost one year after Enbridge filedtheir application. Enbridge essentially dismissed all re-routing options that they claimed to haveconsidered. There was no discussion with our client of these alternative routes or the advantages anddisadvantages of each prior to Enbridge’s decision and ultimate selection of the preferred route. Acopy of some of the pertinent correspondence with Enbridge between June 1, 2006 and the present isattached hereto and may be referred to in our client’s oral statement, should our client be permitted tomake one.

In addition to the opportunity to speak directly to the panel regarding these concerns, it would beadvantageous for our client with respect to costs should the panel grant this opportunity in GrandePrairie. It is our hope, that in being allowed to make an oral statement at the Grande Prairiecommunity hearing, our client could potentially avoid having to incur the costs of attending the fomalhearing.
Please advise whether the panel is prepared to provide us with an opportunity to provide an oralstatement before the panel at the upcoming Grande Praine Community Hearing. I look forward tohearing from you.
Yours truly,
DARRYL C ER&COMP NY
