For 2000 setbacks, I would like to see no "off-ramps" allowed as they are allowed in COGCC rules, just a firm 2000 ft setback. Also setbacks for trails and trailheads. I would like all communications from operators including flaring/venting, spills/releases, upset/hazardous conditions, etc. to be required in electronic form and posted on the Larimer County oil & gas website. I would like to see the County set up continuous air emissions monitoring along the Fort Hills for VOCs, ozone, NOX etc. See system at Boulder Reservoir. https://www.bouldair.com/boulder.htm because we are one of 4 highest sites for ozone in the State. Also frequent emissions detection and rapid repair by operators. All air quality emissions mitigations from oil and gas should be retroactive to current oil and gas facilities. The land use code should include reverse setback regulations to protect the families who will live in new developments. Larimer County has 2 major rivers, wetlands, irrigation canals that need special protections and no oil and gas facilities in the flood plains. Northern Larimer County also needs protections, i.e. Soapstone, ranches, etc. with protections for wildlife and the viewshed.

We need to have air quality monitors that check for VOCs and other pollutants. What is our baseline? What are we already breathing? We should have full disclosure of any and all chemicals being used in Larimer County for Oil and Gas. How many abandon wells do we have in Larimer County and are they all closed and sealed properly? Are all flow lines, transfer lines and gathering lines clearly marked now and will they be in the future. There are thousands of technical requirements that should be included in any oil and gas regs and the average citizen won't know what all these are but Larimer County has an obligation to insure the safety of its residents. I highly recommend a moratorium so that we can have sufficient time to understand everything. Why are we not just saying NO like other municipalities have to oil and gas. Clearly, this industry cannot be trusted. They pollute the air, our water and then they go bankrupt leaving the people who live here to pay for the damage they cause. We are suffering already with Oil and Gas from Weld County. Please say no!

Frankly, the ranking of concerns is a distorted way of approaching this issue. All of the listed topics are inter-related, and trying to say any one is more important than another begs the question that this is a complex problem that requires a holistic and comprehensive approach.

But there is also a need for comprehensive, 24/7 real time monitoring of regional air quality, because the effects don't just hover over a particular site. Water Quality and Water Bodies: The amount of water used in the processes may impact both surface water sources and and below ground aquifers. I have concerns as well about spills of waste products from O&G sites that can find their way into critically sensitive water resources. Maintenance of machinery: Ties into all issues. It is clear that many operators do not put the time, effort, and funds into making sure everything is tight, secure, and safe. Elementary tightening of joints with wrenches could eliminate a great deal of our surface and atmospheric emissions from these sites.Other: Again, there is no one issue that really transcends the others in importance. One thing frequently leads to another, and there has to be an awareness of all aspects at all times.

Setbacks – The language in Section 17.3.B.3 permits the County to approve setbacks that are less than those required by the COGCC(contrary to the intent of these regulations). This section should be revised to ensure that a reduced setback will not be approved if it would be less than the setback required by the COGCC.

Flow Lines, Transfer Lines, and Gathering Lines – Flow lines may present hazards to the public health and safety. The language in Section 17.3.N.1.d and Section 17.3.T.3 should be modified to require that the coordinates of flow lines be provided upon their installation and activation.

Chemical Handling – Prompt removal of chemicals from the site will provide more protection to the public health and safety. Section 17.3.K.3 should be modified to require the removal of chemicals within 30 days (instead of 60 days).

Application Process – The application submittal requirements identified in Section 17.2.B should include proof that a surface use agreement has been executed with the property owner, or evidence that the applicant has made a good faith effort to negotiate a surface use agreement. This evidence may include a copy of the proposed agreement that was last submitted to the property owner (with confidential information redacted).

Noise – Section 17.3.H.5 should be changed to identify what possible actions may be taken by the County to mitigate low frequency noise impacts.

The regulations adopted last year – incorporated as Section 17 in the County’s land use code – are woefully inadequate to protect public health, safety, and the environment, and as such, conflict with state law SB-181: in intent and purpose, in specific proposed regulations, and in failure to address many substantial issues necessary to protect public health, safety, and the environment.

The regulations are thoroughly flawed because the policy-making process was deeply flawed by blatant bias toward oil & gas development interests in the Oil & Gas Task Force, undisclosed conflicts of interest in the Task Force, the County's record in steering and managing the policy-making process, and the County's refusal to address many substantive concerns and issues raised by the public during the policy-making process.

The existing regulations need substantial revise throughout, to address and rectify many weaknesses and many more gaps, so the regulations will protect public health, safety, and the environment in accord with the intent of state law as well as recently adopted state rules.

Revision should start with 17.1 Intent and Purpose, to ensure that the Intent and Purpose statement(s) are consistent with state law that provides local governments with authority to regulate oil and gas in a manner consistent with protection of public health, safety, welfare, the environment, and wildlife.

All of Section 17 needs to be reviewed and revised to uphold intent of SB19-181. The County received extensive recommendations during the process of developing the existing regulations (in public record), many of which are highly specific, regarding methods and standards for adequate protection of public health, safety, welfare, environment and wildlife.

Local regulations adopted by other local governments known to be serious about protecting public health, safety, and environment should be considered and serve as a model for Larimer County’s regulations. Regulations adopted by Boulder County, Longmont, and Broomfield should be considered. If Larimer County chooses not to adopt protections for public health, safety, and environment such as other local governments have done, then the County should provide clear explanation about why such protections are not needed or not in the best interest of the County’s residents and environment.

This survey is a hopelessly inadequate method for public participation in the County’s revision of its oil and gas regulations. The survey has major design flaws that bias and limit responses; these flaws render survey results with little or no real value to public policy-making for local regulations that will adequately protect public health, safety, and environment in matters pf oil and gas development in Larimer County.

Many topics pertaining to oil and gas development are important and require substantive attention, analysis, and consideration in properly managing and regulating oil and gas development. It is misguided and misinformative to use ranked choice voting as a method for public input.

Why should people be told to choose five topics – and rank them? Should County residents need to choose whether its worse to be endangered by toxins in the air, or to suffer noise, or lights all night from oil & gas operations? Or whether to worry more about chemical handling or flammable materials? Or whether water pollution, or financial risk from abandoned wells, or living dangerously close to oil & gas operations, are worse than, say, an explosion from a leaking unmapped flow line, or the noise, dust, and danger of heavy truck traffic?

Such choices are unreasonable, this is not about a popularity contest.

What about topics not listed in the survey instrument – such as reverse setbacks; threats to wildlife, to open space and natural areas; and methane leaks, venting, and flaring that cause climate damage. These and other unmentioned topics are also very important and require substantive attention, analysis, and consideration in properly managing and regulating oil and gas development.

The main utility of the survey is to fulfill a checkbox requirement for public participation the in the County’s revision of its oil and gas regulations. But no one should think that this survey contributes to or achieves useful and effective public input and participation.

With a world-class university located in Larimer County, it would benefit the County to seek advice regarding survey design and effective public participation methods. CSU has respected social science professionals like Dr. Stephanie Malin. Dr. Malin has conducted extensive research locally that would be informative to the County’s efforts to communicate effectively with the public regarding concerns, views, issues and priorities related to oil and gas development.

I feel more than just the 5 areas need to be addressed and updated. I'd like to see the operators held responsible for the true costs, including fees to cover the administrative costs to county, air, water and road impact fees, bonding to adequately cover costs to plug and abandon a well if operator goes under(state requirements are currently inadequate). I'd also like to see details in our regulations to address transfer of ownership issues when an operator sells.

I want these regulations to updated to consider equity and the urgency of climate change. Toxic waste should not be disposed of in low-income neighborhoods or shipped abroad to less wealthy countries with fewer regulations. Relatedly, regulations should make sure that low-income communities are not disproportionately affected by inadequate air quality and water quality. There must be adequate space between housing and any Oil & Gas facilities and any leaks must be reported immediately and accurately; Oil & Gas facilities must be responsible for cleaning up and paying residents for any pollution that occurs due to these leaks. These regulations must be enforceable to keep O&G companies responsible for ethical and safe waste disposal, maintenance of equipment, and any failure of their systems which impact air and water quality.
