over your sales tax processing in other EU countries.

You have to comply with the new German § 17a UStDV
Thus in case of an EU delivery every company has to prove that the delivery item was transported or shipped to another EU member state by the company or the customer. This evidence is provided by the Confirmation of Arrival. The documents have to be unambiguous and easily verifiable.

Motivation / Requirement
On January 1, 2012, legislators revised the legal obligations for providing evidence of intra-
community deliveries that are exempt from sales tax.
As of October 1, 2013, the new German sales tax law §17a UStDV applies, which now
includes an implementing decree with details on implementation in practice. It requires every
trader to provide documentary evidence (Confirmation of Arrival) that he or the purchaser has
transported or dispatched the item being supplied to another EU member state. This
information must be stated clearly and in an easily verifiable form in the documentation.
For intra-community deliveries carried out up to December 31, 2013, the documentary and
accounting evidence according to the tax exemption regulations valid until December 31, 2011
can still be used.
Besides the actual Confirmation of Arrival, alternative forms of evidence will also be
considered equally valid. These can be submitted in electronic form and can comprise
multiple documents.
The legal regulation in sales tax law distinguishes between transporting and dispatching.

Requirement & Definition
The Confirmation of Arrival is a declaration
made by the purchaser that the delivery item
has arrived in the other EU member state.
The purchaser of the items being supplied
creates the Confirmation of Arrival either at the
end of the transport phase or upon receipt of the
goods – so chronologically after transfer of the
delivery.
The supplying company bears the risk for a
sales tax deficit if it does not receive a
verification document that the goods actually
arrived at the destination.
If the items are dispatched, meaning that a third
party, i.e. a freight forwarder, is involved in the
transportation process, equal alternative
documents are acknowledged.

Requirement & Definition
The Confirmation of Arrival does not have to be provided in any particular form. Nevertheless
the following details have to be included in the document:
Name and address of the purchaser
Amount of items delivered and the commercial designation including the vehicle
identification number if the delivery item is a vehicle
Declaration of end date (year and month) of transportation or shipment, meaning the
receipt of the item in the EU. This is also valid if the purchaser collects and ships the
goods himself. In this case the purchaser has to submit the confirmation afterwards and
not on collection, as it is currently done.

Signature of the purchaser respectively of an appointed representative
The electronical transmission is permitted. When it is transparent that the electronic
transmission started in the purchaser’s or representative’s area of disposition, i.e. by
using the purchasers mail account, a written signature is not required.
