Rates of assistance• Eligible entities with turnover under $20 million:
– 45 per cent refundable tax offset: if a company has atax liability of zero it may be entitled to a refund of anyunused offset amount , e.g. $10m R&D expenditure,offset refund $4.5m
– Quarterly credits system from 1 January 2014 for companies eligible for the refundable tax offset
• Eligible entities with turnover over $20 million:
– 40 per cent non-refundable tax offset

Eligible R&D entities• corporations incorporated in Australia
• foreign corporations resident in Australia
• foreign corporations resident of a country with a double tax
treaty arrangement with Australia, carrying on business througha permanent establishment in Australia
• public trading trust with a corporate trustee
Excluded entities:
• corporate limited partnerships
• exempt entities
• sole traders and trusts

Expanded program access
• Allowing foreign companies with offshore IP access to theprogram
• Increase in allowable overseas R&D activities – requires anoverseas finding
• If a company is owned 50% or more by a university, thecompany may still be eligible for a 40% non-refundable offset
Access to R&D expertise
• Research Service Providers (RSP) who have met certaineligibility criteria
• Companies using services of a RSP do not need to meet the$20,000 expenditure threshold

Core R&D activities require that an experiment isconducted using the scientific method in order to addressa significant knowledge gap
Supporting R&D activities must be either directly related to core R&D activities or in a production environment,undertaken for the dominant purpose of supporting coreR&D activities
