August Ludie Article: I was on my way to work the other day and got rear ended at a stop light. I got out of the car and asked the lady that hit me what she was thinking. She said “Oh I’m sorry, I thought you were moving”. I said “no, it was a red light, I was stopped.” Don’t worry, I didn’t get hurt in the accident, the only pain I experienced took place following the acci-dent. I had to rent a car and place my car in the shop for repair for a week. In the whole scheme of things, my pain wasn’t that bad actually, it was just a little inconvenience. You just wouldn’t believe how many people drove by and waved or honked as I stood there on the side of the road waiting for the police to arrive. I swear the lady that hit me must of thought everyone was honking at her because I noticed she was waving every time some-one honked. While I stood there, I received calls from people I haven’t heard from in months, all of them were asking me if I was alright. It just goes to show you that even under the worst circumstances, you can find something good. Well, it is now time to get on with the story.

Conrad Birdie operated Sweet Apple Realty, a residential brokerage firm in a highly competitive market area. He frequently used information from the Association’s MLS as the basis for comparative ads and to keep close track of his listing and sales activity, as well as that of his competitors. One day, while reviewing MLS data and comparing it to a competitor’s ad in the hometown newspaper, Conrad no-ticed that Rod McKuen with DPS Real Estate had used a diagram to demonstrate his market share in comparison to several brokerages in town. Rod’s ad showed that Conrad’s company, Sweet Apple Realty, had listed 10% of the properties in the MLS over the past three months. Conrad thought Rod’s marketing statistics were done incorrectly and that he intentionally made the statistics look like he held a larger market share than he does, which did not present a true picture to the public. Conrad stated that when he ran the statistics from the MLS data, they showed his market share was 10.2% , not 10% as Rod had stated in his ad. Conrad filed an ethics complaint against Rod, citing Article 15 of the Code of Ethics, and said that Rod “obviously overstated his market share” which was a “misleading statement about his competitors.” Conrad’s com-plaint was reviewed by the Grievance Committee and forwarded to Professional Standards for an ethics hearing. At the hearing, Rod McKuen testified he is always truthful in his advertising and that all his claims were based on fact. He provided the committee with the statistics that he had used and the criteria he used to pull them from the MLS data base. He stated that he had not accidentally or intentionally published statistics to make his competitors look bad. He told the committee that his office statistics show that he holds 40% of the market, and even, if for some reason, the .2% was not included in the statistics he published for Conrad’s real estate firm, the next highest brokerage in the ad showed 15% of the market. The MLS statistics indicated that Conrad’s firm is in the bottom three brokerages in the market area. Rod went on to state that it all depends on when and where you run your statis-tics as to the end result. “I’ve, in fact, heard from every brokerage that was listed in the advertisement and they are all angry with me. If the tables were turned, I’m sure they would have run an ad similar to mine, especially if they held 40% or more of the market. My ad is accurate and is not misleading, my advertisement does not make disparag-ing comments or statements about my competitors. My ad states that the information comes from the MLS system, I would ask that the panel dismiss the charges Conrad has bought against me.” Well what do you think about this one? Would you argue over the .2% that Rod left out of his statistics? It doesn’t sound like he intentionally left it off. We all know you can make statistics say whatever you want them to say, it would all depend on when you run them and what criteria you set to pull the information. It sounds like Rod got ver-bally beat up from his fellow Realtors® for running the ad in the first place. Do you think he will run it again it the future? Do you think the ad might have cost him cooperation with the brokers in his market area? After all was said and done, was the ad value worth all the trouble it caused? Now, what do you think the panel should do in this case? The Hearing Panel agreed with the Respondent, Rod McKuen, noting that a Realtor® should be able to rely on gener-ally accurate information from reliable sources such as the MLS. The Panel concluded that the Respondent, Rod McKuen’s comparison with his competitors, was based on usually accurate and reliable information and had been made in good faith. Rod was found not to have violated Article 15 of the Code of Ethics.

He is a Senior GRI Instructor in Florida, Georgia, New Hampshire and Illinois, and is qualified as a GRI Speaker for the National & various State Realtor® Conventions. Tony teaches internationally in several countries in Western Europe, Eastern Europe, Asia, the Caribbean, and South Africa. Mr. Macaluso was proud to represent the National Association of Realtors® regarding Homeland Security issues following the World Trade Center bombing on September 11. He introduced a “Silver-Visa” classification concept which has gained attention from the national news media. Real Estate fraud is not always intentional and some agents and brokers have found themselves behind bars for doing what they thought was legal and in the best interest of their clients. On

February 25 alone, 14 people were indicted in a $47 million real estate fl ipping and mortgage fraud conspiracy, and the agents and brokers are going down with them. They ARE prosecuting!

To kick off Realtor Safety Month, Florida Realtors will attempt to break a Guinness World Record for the “Largest Business Lesson held in Multiple Venues.” On September 9, 2011, Andrew Wooten, Florida Realtors safety expert, will present “Florida’s Safety and Security,” a 3-hour program designed to provide education, tools and resources necessary to create safe workplace environments while instilling awareness and empowerment in individuals.

This record attempt will connect more than 30 of Florida’s local associations as satellite venues, with participants across the state interacting with each other simultaneously over a live broadcast. Students will be able to participate in the program with fellow Realtor members in the convenience of their local association office while building strong community relationships with their friends and neighbors who are also invited to participate in the program.
