IT IS, ACCORDINGLY, ORDERED, ADJUDGED AND DECREED?
Dismissal with Prejudice:
1. The Court’s Order of November 28, 2017, dissolving the lien lis pendens, having become
a final order pursuant to Rule 54.02 of the Tenn.R.Civ.P., is unaffected by this Agreed
Order of Dismissal with Prejudice.
2. All monies paid into and held by the Court shall be distributed to defendant Brookside
Properties, Inc.
The Court’s Order of January 11, 2018, ordering, with respect to the sale of property held
by any party, that tbQfihe seller shall file a notice with the Court no later than fifteen (15)
days prior to the proposed closing identifying the property to be sold and expected closing
date” as well that portion of the same order requiring the “seller shall separately furnish
counsel for the parties to this litigation, (Without filing) the terms of the proposed sale,
including the parties and sales price,” is hereby vacated and dissolved.

4. All other matters in controversy between the parties hereto, including all matters that are
the subject of orders that are not yet final orders, be, and hereby are dismissed with
prejudice.
The unpaid court costs of this matter shall be taxed to the defendant, Brookside Properties, Inc.
