Independent from any insurance company,Havelet is able to offer avarietyofcarefullydesignedanddynamicallyinvestedproducts.

THEPLAN

TheHaveletPlanallowsanattorneytodeferreceiptoftheirfeesuntilsuchtimeas theyare required. The feesare invested throughaportfolioof investmentsprofessionallymanagedby leadingmoneymanagersbasedupon theattorney'sdesignatedinvestmentobjective.This is achievedbyutilizinganassignment contractunderwhich thedefendant(or a qualified settlement fund) pays a sum representing some or all of theattorney'sfeestoHavelet,andHaveletagreestomakeperiodicpaymentstotheattorney in the future. The precise value of the periodic payments will bedetermined by the performance of the selected portfolio.As the fees areinvested on a pre-tax basis and the investments can grow tax-free, there is amuch largercapitalbase thanwouldotherwisebe thecase.Thenet result isahigherafter-taxsumtobereceivedbytheattorney. Importantly,Havelet’sclientsareabletoparticipateinmarketratesofreturns,customize deferral and payment terms, select beneficiaries and contingentbeneficiariesandreceivemonthlyinvestmentstatements.

WHOISTHEPLANAPPROPRIATEFOR?

ThePlanmaybeappropriateforanyattorneywhoreceivescontingentfees,providedthat:

• Thefeesarenotimmediatelyrequired;• Theattorneyhasnotalreadyenteredintoacourtapprovedsettlement

agreementinrespectofthatfee,unlessaqualifiedsettlementfundisbeingutilized.

TAXMATTERS

Havelet has obtained tax advice from a leadingUS Law Firm regarding the taxposition of Havelet and the attorney. A full opinion is available to ourprospectiveclients.Insummary,theattorneyshouldnotbesubjecttocurrentU.S.incometaxonthefullamountoftheir feepaidtoHaveletnorshouldanyothertaxconsequencesapply to the structure.Upon receiving distributions fromHavelet, the attorneywillbesubjecttotaxonsuchdistributionsatordinaryrates.Regarding the3.8%AffordableCareAct taxonnet investment income,HavelethasbeenadvisedthatthattheentireamountofeachpaymentfromHavelettothe attorney represents deferred legal fees and not net investment incomesubjecttotaxunderCodeSection1411.

INVESTMENTOPPORTUNITIES

The attorney’s fee will be invested by Havelet in one of several portfoliosdesigned andmanaged by leading investment firms. Additionally, the attorneymay select to work with their existing investment advisor provided certaincriteriacanbemet.The attorneywill select themost appropriateportfolio for their circumstances,withthehelpofalicensedadviser.Theportfoliosrunthespectrumofriskandrangefromconservative,traditionalstrategiestomoreaggressivealternativearrangements.Pleasenotethatonceaninvestmentobjectivehasbeenselected,itcannotbealtered.A monthly statement will be provided to each attorney whereby portfoliocompositionandperformancecanbeviewed.Haveletdoesnotofferclientspecifictax,legalorinvestmentadvicebutisabletoliaisewithyouradvisorsinthisregard.
