This agreement is made this day of , 20 , by and between Flying Monkey Productions, Sacramento, California, hereinafter called FMP and Julia Soto , hereinafter called Artistic Director. 1. The Artistic Director shall be responsible for the duties which are enumerate in the attached instrument entitled “Duties of the Artistic Director”. 2. This agreement covers the period from 9/01/2011 through 09/01/2012 , inclusive. 3. The Artistic Director agrees to attend any meetings as required by FMP. 4. The Artistic Director understands that there is an agreement between FMP and the Central United Methodist Church regarding the use of the CUMC facilities, and agrees to abide by the regulations set forth in these guidelines (see President for guidelines). 5. The Artistic Director agrees to provide the FMP President his or her social security number as required for the Federal Tax 1099 form.* 6. FMP agrees to pay the Artistic Director the sum of $150.00 , two increments of $69.87 (taxes withheld), payable on the fifteenth (15th) and thirtieth (30th) of each month. 7. The Artistic Director agrees to attend all FMP performances, fundraisers, and events. 8. Any portion of this agreement may be modified by written agreement of both parties, (Artistic Director and FMP). DUTIES OF THE ARTISTIC DIRECTORIn accordance with the By-Laws of Flying Monkey Productions, the duties of the Artistic Director are as follows:

A. The compensation, duties, and powers of the Artistic Director shall be prescribed by agreement between the Board of Director and the persons involved. Such action shall be taken upon a 2/3 vote of the Board.

B. The Artistic Director shall be responsible to the Executive Producer, Technical Director, and Director of Design for the artistic success of the production, including preparation and direction of the cast and the design of the technical requirement for the production such as lighting, sound, properties, set construction, costumes, etc.

C. The Artistic Director shall be responsible for hiring, supervising, and evaluating artistic personnel, including Directors, Performers, and Designers.

D. The Artistic Director shall be responsible for scheduling and attending all Artistic Planning and Production Meetings. He or she must notify all attendees by phone or email one (1) week prior to the scheduled meeting.

E. The Artistic Director shall be responsible for the finding and development of plays and musicals that fit with FMPʼs mission statement and furthers the artistic goals of the company.

F. The Artistic Director shall act as spokesperson for the organizationʼs artistic purpose via speaking engagements, public and social appearances, and fundraising events and solicitations.

G. The Artistic Director shall foster the development of good relations with other cultural organizations by participating in meetings and joint activities where appropriate.

H. The Artistic Director shall report to the Board of Directors on a regular basis as to update on artistic activity.

I. The Artistic Director shall supervise the maintenance of written procedure manuals for technical and production staff.

J. The Board may re-assign duties for this position as may fit the needs of the production.

Both the Artistic Director and the FMP Board also agree upon the following:

! 1. The Board will provide an Executive Producer who shall be responsible for obtaining a Production Manager, Stage Manager, and general help to the production staff. ! The Executive Producer shall be responsible for the payment of Production Staff, Performers, ! and Independent Contractors.

! 2. The Board will provide a Technical Director who shall be responsible for the ! set construction and general technical direction (lights, sound, etc.)

! 3. The Board will provide a Director of Design who shall be responsible for the set design, ! ! costume design, and make up design.

! 4. The Board will be responsible for publicity, house management, and box office.

Be it known also that the Artistic Director and the Executive Producer together have the responsibility to maintain discipline among the cast and the crew. The Director is responsible for bringing the actors and the playwrightʼs words and ideas together under one artistic vision. Whatever interpretive approach the director takes, it involves research, collaboration with designers, leadership, an ability to match actors with suitable roles and an understanding of the actorsʼ craft.

The Director oversees auditions and casting. The Director must have excellent communication skills, strong organizational skills, strong intuition, a clear artistic vision, and a willingness to work with many people with a range of experience and abilities in a nurturing and supportive manner. The Director is responsible to the Executive Producer for the delivery and interpretation of the showʼs artistic elements by opening night in a responsible manner. He or she is responsible for rehearsing and preparing actors, and communicating the artistic vision to the designers and other creative, technical, and administrative staff / volunteers. Any decision taken by the Director has a ripple effect on the whole company, he or she should be knowledgable or have a vision in all aspects of theatre, including design, lighting, sound, costume, and acting technique.

Both the Artistic Director and Executive Producer have the right to dismiss cast and crew at any time based upon the above, and agreements between the Artistic Supervisors and the Cast and Crew, but must contact the Board before taking such action.
