Arizona Department of Public Safety Arizona Attorney General's Office e Arizona Crime Victims' Rights AUTOMATIC RIGHTS Many of the rights provided to victims through legislation and rules of court are automatic. If you are a victim, these include the right: 1. To be advised of all victim rights and how to assert them; 2. To infonnation on the availability of crisis intervention, medical and emergency services, information on victim assistance programs and domestit: violence resources; 3. To be advised of the date, time and location of the initial appearance or arraignment if a suspect is arrested or cited; 4. To be provided the police report number, if available, and if the case has been submitted to a prosecutor's office, information on how to c0ntact that office; 5. To be notified ifthe prosecutor declines to file charges, and notice of what charges are filed; 6. To have your home address, and employer's name and address withheld from the defendant and his representatives; 7. To refuse an interview with the defendant and anyone working on the defendant's behalf. This also applies to the parent or legal guardian of a minor child who exercises victims' rights on behalf of the minor child; 8. To be present at any court proceeding at which the defendant has the right to be present; 9. To name an appropriate support person, who is not a witness, to accompany you to any interview, deposition or court proceeding; . 10. To have the Court provide appropriate safeguards to minimize contact between you and the defendant; · 11. To be heard at any proceeding concerning release of the accused person, a plea agreement, and the sentencing (with some limitations ifthe defendant is facing the death penalty); 12. To speak with the presentence investigator before the sentencing, to give a sentencing recommendation, and to read the presentence report when it is available to the defendant; · 13. To have the court order restitution, and to receive tb.at restitution promptly; 14. To leave work (if eligible) to attend scheduled legal proceedings, or obtain or attempt to obtain an order of protection or injunction against harassment (in accordance with A.R.S 13-4439). To request the prosecutor assert any right to which you are entitled; 3. To receive a free copy of the police report and/or court transcripts (in accordance with A.R.S. 39-127); 4. To receive a copy of the conditions of the suspect's release from custody; 5. To be given notice of the release on bond of the suspect; 6. To receive notice of all court proceedings at which the defendant has the right to be present; 7. To the return of your personal property taken during the investigation, and if the property cannot be returned, be advised of the reason; 8. To be advised of the sentence imposed upon the defendant; 9. To be given notice of any post-conviction release or appeals proceedings; 10. To be given notice of any hearing in which release from prison is being considered, the right to be present and heard at that hearing, and to be advised of the result; 11. To be advised of the earliest possible release date of a prisoner sentenced to the Department of Corrections (if the sentence exceeds six months), and notice before the·release of the prisoner or, ifthe prisoner has died, notice of the death; 12. To receive notice of any probation revocation disposition or probation tennination proceeding. You also have the right to be notified of any modification of probation which will substantially affect your safety or the probationer's contact with you, or which will affect restitution or the probationer's incarceration status; 13. To be notified, upon request, of the escape and re-arrest of the accused or convicted person (this includes a person placed by court order in a mental health treatment agency). If there is any conflict of interest or disagreement between you and the prosecutor, you have the right to: 1. Be directed to the appropriate legal assistance, and 2. DERECHOS AUTOMATICOS

A traves de legislacion y reg/as del tribunal, muchos de los derechos proveer a victimas son automaticos. Si usted es victima, estos derechos incluyera:

I. Ser aconsejado de todos los derechos como victima, y como asertar los; 2. Sobre Ia informaci6n disponible de crisis intervencion, los servicios de medico y

emergencia, informaci6n sobre programas de asistencia para victimas', y recursos sobre la violencia domestica;

3. Ser aconsejado de la fecha, la hora, y el lugar de la apariencia inicial, ode la citacion, si el sospechoso es detenido o es citado;

4. Proveer con el n<unero del reportaje de policia en caso que este disponiblc, y si el caso fue sometido a la oficina del defensor, la informaci6n de como ponerse en contacto con esa oficina;

5. Aviso si el dcfensor se niega hacer las acusaci6nes, o algun aviso de cufiles son las acusaci6nes;

6. De retener su domicilio, y el nombre y la direcci6n de su empleador, del acusado o sus representantes;

7. Negarse a una entrevista con el acusado o con cualquier persona que esta trabajando a favor del acusado. Esto aplica tambien al padre o el guardian .legal de un niiio menor · de edad que ejercita los derechos de victimas a favor del niflo menor de edad;

8. De estar presente en cualquier procedimiento en corte, de cual el ac~ado tiene derecho a estar presente;

9. Nombrar una persona para apoyo adecuado, quien no es testigo, para que lo acompaiie a cualquier entrevista, deposici6n o procedimiento en corte;

10. De que la corte proveer un salva guarda apropiado para minimizar contacto entre usted y el acusado;

11. De que lo escuchen en cualquier procedimiento referente la libertad de la persona acusada, una suplica pacto, y la sentencia (con algunas limitaci6nes, si el acusado esta enfrentado con la condena de muerte);

12. Hablar con el investigador antes de la sentencia, para hacer una recomendaci6n, y para leer el informe de la presentencia, cuando este disponible al acusado;

13. Tener la restituci6n por orden de la corte, y recibir la restituci6n puntualmente; 14. Salir del trabajo (si es elegible) para atender anticipado procedimientos legales, o

obtener, o intentar obtener una orden de protecci6n o orden contra hostigamiento (de acuerdo con A.R.S. 13-4439). ·

DERECHOS QUE USTED TIBNE QUE SOLICITAR Si usted es victima, usted tambien tiene derecho solidtar sobre: I. Conferir con el abogado de alguna decision de no proceder con el procesamiento

destituci6n de las acusaci6nes, programas diversi6n antes del juicio, alguna suplica o sentencia negociaci6nes, y en cualquier tribunal con respecto sobre al poner en libertad al acusado. Usted tambien tiene derecho a conferir con el abogado antes del proceso (estos derechos no incluyen la autoridad de dirigir el procesamiento del caso);

2. Solicitar que el abogado aserta cualquier derecho, a cual usted tenga derecho; 3. Recibir una copia gratis del reporte de policia, y/o la transcripci6n del tribunal (de

acuerdo con A.R.S. 39-127); 4. Recibir una copia de las condici6nes al liberar de detenci6n, al sospechoso; 5. Notificaci6n sobre la fianza de la libertad del sospechoso; 6. Notificaci6n de todos los procedimientos de la corte, a cual el acusado tienc derecho a

estar presente; 7. El regreso de su propiedad personal que fue detenida durante la investigaci6n, o si la

propiedad no se le puede regresar, qu~ se le aconseje las raz6nes; 8. Ser aconsejad_o de la sentencia sobre imponer al acusado; 9. Aviso de cualquier libertad despues de convicci6n, o procedimiento de apelaci6nes; 10. Aviso de algun tribunal en que existe la consideraci6n de poner en libertad de prisi6n,

el derecho de estar presente y ser escuchado en el tribunal, y ser aconsejado del resultado;

1 l. Ser aconsdejado de la fecha a lo mas pronto posible en que el prisionero sentenciado a la agencia del Departamento de Correcci6nes podra ponerse en libertad (si la sentencia es en exceso de seis meses), y aviso antes de liberar al prisionero, o aviso de muerte, si el prisionero muere;

12. Para recibir aviso de cualquier disposicion de revocar la libertad condicional, o el procedimiento de la terminaci6n de libertad condicional, Usted tambien tiene derecho al aviso de alguna modificaci6n de libertad condicional cual le afectara a su seguridad considerablemente o el contacto de la persona en libertad condicional, con usted, o cua.J. le afectara restituci6n o el estado de encarcelamiento de la persona en libertad condici6nal;

13. A viso, al solicitar sobre algun escape y que se vuelva arrestar al acusado, o a la persona condenada (esto incluyera a una persona que por orden de la corte, este en una agencia para tratamiento de salud mental).

Si hay algun conjlicto de interes o desacuerdo entre usted y el abogado, usted tiene derechoa: 1. Ser dirigido a apropiado asistencia legal, y 2. Ser representado por su propio abogado, con gasto propio. Revisado 0212008
