Lusaka Agreement The African Regional Intellectual Property Organization (ARIPO) was established by the Agreement on the Creation of the African Regional Intellectual Property Organization (ARIPO) (Lusaka Agree-ment) adopted on 9th December, 1976. The Objectives of the Or-ganization are, inter alia, to promote, harmonize and develop the intellectual property system of the region.

Membership of the Organization is open to states members of the United Nations Economic Commission for Africa or of the African Union. States become members by depositing an instrument of accession to either the Lusaka Agreement or the Harare Protocol or the Swakopmund Protocol. The number of Member States of ARIPO is as reflected in the table on the right of this page.

The Harare Protocol Within the framework of ARIPO, a Protocol on Patents and Indus-trial Designs was adopted on 10th December 1982 (the Harare Protocol) and entered into force on 25th April, 1984. It has since been amended multiple times.

The Protocol empowers ARIPO to grant patents and register indus-trial designs and utility models on behalf of the Harare Protocol contracting states. All ARIPO Member States are signatory to this Protocol except Somalia.

The Banjul Protocol The Banjul Protocol on Marks was adopted on 19th November, 1993. This protocol, as well, has been amended several times. The Protocol empowers the Organization to register marks centrally for those ARIPO Member States which are its signatories (see table on this page).

The Swakopmund Protocol On 9th August 2010, ARIPO Member States held a diplomatic con-ference in Swakopmund, Namibia, at which they adopted a third ARIPO protocol called the Swakopmund Protocol on the Protection of Traditional Knowledge and Expressions of Folklore.

This protocol will come into force three months after six ARIPO Member States have deposited their instruments of ratification or accession, as the case may be.

Every member state of the African Union or of the Economic Com-mission for Africa is eligible for ARIPO membership. To join ARIPO, any such state may accede to the protocol. The accession will en-tail acceptance by that state of provisions of the Lusaka Agree-ment.

Patent Cooperation Treaty The Patent Cooperation Treaty (PCT) is administered by the World Intellectual Property Organization (WIPO). Since the Harare Proto-col was linked to the PCT, the PCT has become important to the development of the patent system of all ARIPO Member States.

Besides benefits of membership in the PCT Union available from WIPO, ARIPO Member States become open to the flow of interna-tional patent applications filed through the PCT process. This has increased the number of patent applications filed in ARIPO Member States using the PCT-Harare Protocol route beyond those applica-ble under the traditional national route.

This increase means more income earned by the national offices. Consequently, some Member States no longer pay ARIPO member-ship contributions as income from the PCT-Harare Protocol route fully settles this.
