Approve the exercise of a one-year option and funding for the following consultantsfor geotechnical and tunneling consulting services for the period of May 1, 1998through April 30, 1999:

a) Dr. Z~D. Eisenstein for an amount not-to-exceed $174,000;

b) Dr. G.R. Martin for an amount not-to-exceed $48,000; and

¢) Shannon & Wilson, Inc. (Dr. H.W. Parker) for an amount not-to-exceed$54,000.

MERIT

Each contract contains options to extend the period of performance. The MTA mayexercise the options at its own discretion. Legal Counsel and ProcurementManagement have reviewed this action and determined that the exercise of an optionto extend the period of performance is not a change subject to Public Utilities Code§ 130243.

BACKGROUND

The Tunnel Advisory Panel convened in August, 1995 in response to questions posedby Mayor Riordan and the MTA Board regarding the feasibility of tunneling in LosAngeles ground conditions.

The MTA Board awarded a 2-year Time and Expense contract with two one-yearoptions to Drs. Eisenstein, Martin and Parker at its April 24, 1996 meeting. At theApril 23, 1997 meeting, the Board approved funding for 30 days which commenced

May 1, 1997. The balance of the funding for the second year, June 1, 1997 through May 31,1998, was approved by the Construction Committee in May, 1997.

Staff is now seeking approval to exercise a one-year option and fund the period of May 1, 1998through April 30, 1999. The total amount requested in this report represents a $54,000 (16%)reduction over funds allocated for the Tunnel Advisory Panel in each previous contract year.Staffwill also be reviewing and approving work prior to its performance in an effort to furtherreduce costs.

Over the past year, the Tunnel Advisory Panel provided advice and guidance on a variety of issuesaffecting the Metro Red Line East Side Extension and North Hollywood Corridor Projects. ThePanel addressed issues dealing with: design; design changes; contractual strategies; criteria forenvironmental protection and ground control; technical aspects and impact of project suspension,and dispute resolution. (A more detailed report of the Tunnel Advisory Panel’s activities for the1997-1998 year can be found in Attachment 1.)

During the 1998-1999 contract term, the Tunnel Advisory Panel will continue to advise the MTABoard and staff on environmental, technical, and legal issues concerning the Santa MonicaMountain tunnels and the successful construction ofthe North Hollywood Corridor. They willalso provide advise on design issues related to the demobilization of the East Side ExtensionProject. (Please see Attachment 2 for an outline of the Tunnel Advisory Panel’s activities for theupcoming year.)

BUDGET IMPACT

The funds for this action will be apportioned from the contracts with the General EngineeringConsultant and Construction Management Consultants as directed by the Board.

ALTERNATIVES CONSIDERED

a) The Board has the alternative to issue a new Request For Proposal (RFP) for geotechnicaland technical consulting services. However, Drs. Eisenstein, Martin and Parker were selectedin August, 1995 after an extensive search based on their technical expertise. They have sinceacquired specific knowledge of the Metro Rail construction process and could continueworking without the interruption an issuance of a new RFP would cause.

b) The Board could choose not to retain geotechnical and tunneling consultants. This alternativeis not recommended since these consultants’ recommendations have provided a valuablecontribution to the Metro Rail design and construction process.

SECOND YEAR ANNUAL REPORTMAY 1, 1997-APRIL 30, 1998

The MTA Tunnel Advisory Panel (TAP) was established by the MTA Board in April, 1996. establishing the Panel the MTA Board followed a practice adopted by many owners of large andcomplex projects of the caliber of the Los Angeles Metro Rail System Independent review andadvisory boards or panels are commonly set up on important projects to provide an objective,balanced and impartial view of the planning, design and construction progress. Such a view isoften needed when several large design, management and construction companies are involved inthe project. The boards or panels are normally not a substitute for routine consulting orconstruction management services, but are responsible for advising on technical concepts andreviewing their implementation in planning, design and construction. Their responsibility liessolely with the owner, to whom they report directly.

Unlike many traditional boards, the TAP is in a unique position to assist the MTA at all levelswhere and when the MTA needs such assistance~ The TAP is structured so that it can providedetailed design or construction assistance working directly with the MTA staff/and or itsconsultants as well as providing overall planning and overview functions. Thus, the TAP not onlyprovides quality control and supervisory functions but also acts as an in-house source of expertisefor the MTA staff.

In line with their role as outlined above, and with their contractual scope of work, the TAPmembers continued during their second contract year to be engaged in two principal forms ofadvisory service:

Providing ongoing, proactive advice on tasks of a conceptual nature, such as: designissues; contractual strategies; criteria for environmental protection and ground control,and technical aspects of project suspension and their impact; and

b) Providing ad hoe, reactive advice on issues developed during the process of design andconstruction, such as: systematic reviews; design changes; and disputes.

During the second year of their contract, the TAP members have been directly involved with thefollowing specific activities:

Advising on and reviewing environmentally sensitive and publicly acceptable constructioncriteria for the Santa Monlca Mountains tunnels (preparation for, and implementation of,blasting, ground water control monitoring and analysis, compliance with Consent Decree).

Advising on, and reviewing, critical construction issues at the Santa Monica Mountainstunnels (seismic section excavation by the shotcrete method, grouting at the seismicsection and elsewhere, quality control of the shotcrete).

3. Conduction routine site inspections at the Santa Monica Mountains tunnels includingquality control reviews and ad-hoc construction advice.

4. Advising on MTA’s response to the Dispute Review Board decision related to Claim No.6 (both in merit and quantum aspects).

5. Supporting and assisting the MTA defense in a dispute about differing site conditions atthe Santa Monica Mountains tunnels (Claim No. 14), including extensive review geological, geotechnieal and performance data and their processing for presentation to theDispute Review Board.

Participating as an independent party (apart from EMC and JMA) in defense of MTA the above dispute concerning differing site conditions.

7. Participating in media briefings (tunnel breakthrough, beginning of blasting, and otheroccasions).

8. Advising on, and reviewing, critical design issues on the East Side Extension Project(ground control methods and criteria, pre-cast segmented lining design and testing andcontaminated ground hazards and protection against them).

9. Reviewing contract specifications for the East Side Extension Project.

10. Reviewing the Geotechnical Design Summary Report for the East Side Extension Project.

11. Providing conceptual input and setting criteria for seismic design for the East SideExtension Project.

12. Reviewing design of compaction grouting at the East Side Extension Project.

13. Advising the CEO on technical aspects of design completion and construction delays(suspension) for the East Side Extension Project.

14. Advising the CEO on potential cost reduction measures for the East Side ExtensionProject.

15. Advising on technical and contractual aspects of the cut-and-cover section of the PasadenaBlue Line.

16. Organizing and conducting the Orientation Workshop on Tunneling for new MTAConstruction Committee members and other interested members of the MTA Board ofDirectors.

17. Regular reporting to the CEO and other executive officers.

18. Proactively and systematically improving the image of the MTA and its tunnelconstruction program in the eyes of the MTA Board, the media, and the public throughthe activities cited above.

In fulfilling their role the TAP members have interacted closely with the MTA Construction staffas well as with outside parties such as EMC, JMA and Fluor Daniel. However, in order to beeffective in their review and advisory roles they maintained strict independence with respect to theoutside parties and did not perform services which duplicated the efforts of other MTAconsultants.

OUTLINE OF ACTIVITIES FOR THE THIRD YEARMAY 1, 1998-APRIL 30, 1999

During the third year of their activities the TAP members expect to be involved with the followingnew and ongoing issues:

Advise on, and review, current technical issues and measures such as: ground watercontrol; permanent liner installation and performance, and grouting, as needed, forsuccessful construction and completion of the North Hollywood Corridor Project - SantaMoniea Mountains tunnels,

Advise on, and review, measures to comply with the Consent Decree at the Santa MonicaMountains tunnels, namely the monitoring and evaluation of grouting and lining effects.

Continue to monitor adherence to environmental criteria related to blasting in the SantaMonica Mountains tunnels.

Advise on, and assist the MTA in defense against, ongoing and future claims due toallegedly differing site conditions at the Santa Monica Mountains tunnels. The level ofpotential exposure to the MTA is in the order of $24 million.

Advise on, and assist the MTA with, litigation related to contractor claims and settlementdamages along Lankershim Boulevard. The level of potential exposure to the MTA is inthe order of $30 million.

Advise on, and assist the MTA in completion of, negotiations related to settlementdamages along Hollywood Boulevard.

4Participate in the review and quality control of the signed and sealed design documents(drawings, specifications and Geotechnical Design Summary Report) for at least sixmonths as part of the demobilization process on the East Side Extension Project.
