Rationale
Risk of leaching organic substances and/or heavy metals
from materials into water for a continuous and long-lasting
period.
Article 10 of DWD 98/83/EC: MS should ensure safety of
products in contact with drinking water from catchment to
tap.
Article 21 of DL 306/2007: ERSAR should promote the
creation of an approval scheme for products.

Methodology 4 MS (NL, FR, UK and DE) implement approval schemes.
Portugal followed a product certification scheme, similar to
the NL.
Regulation ERSAR:
Current legal, scientific and technical knowledge (EN standards,…);
NL experience (Ministry of Infrastructure and Environment and KIWA);
National technical commission (Central government entities, Industry
associations, Certification bodies, Laboratories and Technical
centres);
JMC – 4(5)MS (Common Approach for Hygienic approval of PDW).

Comprises 29 articles and 5 annexes : • Article 1 to 9: General provisions (Scope, Definitions, Competences and duties:
ERSAR, certification bodies, economic operators, water suppliers, technical
commission);
• Article 10 to 13: Technical specifications;
• Article 14 to 18: Product certification process;
• Article 19 to 21: Product approval process (recognition and list of approved products);
• Article 22 to 29 : Transitional and final provisions;
• Annex A: Organic materials;
• Annex B: Cementitious materials;
• Annex C: Metallic materials;
• Annex D: Chemical products for water treatment;
• Annex E: Positive lists (accepted substances).
SCOPE
Approval scheme for products in contact
with drinking water in Portugal
Regulation ERSAR
Public consultation from 22nd of May to 3rd of July 2014.
EC notification process (under preparation).
Come into force in Portugal in the first semester of 2015.
Three year transitional period for the mandatory use of
approved products by the water suppliers.
An updated list of approved products will be available at
ERSAR’s website (www.ersar.pt).

Product certification vs. Product approval (low-risk products).
Low-risk products: physical and chemical characteristics
and/or conditions of use are considered to have a low
potential to change water quality (e.g. products with surface
contact < 10%).
Product assessment:
Toxicological assessment of the chemical formulation (positive lists).
Migration tests assessing the effects on water quality (acceptance
criteria).

Harmonisation of national approval criteria to the 4MS.
