2. Site and Surrounds The proposed development comprises an extension of the existing MA Room on existing Certificate of Title 31881/3. Drawing 8409-152 attached below indicates a plan layout of the property details and the adjacent properties. The Costa Group currently have a conditional agreement for the purchase of the existing CT 31881/3. The Costa Group also have a Conditional Contract for the purchase of the subdivision Lot 1 indicated by the hatched area on the drawing. The site is located on the western boundary of the recently approved allotment subdivision and development for EMS Packaging. The EMS Packaging development is for the construction of a packaging storage warehouse and injection moulding machines for packaging forming. The EMS facility will service the agriculture sector and, in particular, the Costa Group berry packing and distribution centre. Consequently, this development will expand and consolidate the existing distribution centre and hence improve the viability of the local berry industry. 4. Proposed Development This proposal involves the construction of an extension to the existing MA Room which is used to store packed fruit at a reduced temperature. This room is one component of the berry packing and distribution centre and the room extension is required to service the current growth of berry production in the agricultural hinterland serviced by the distribution centre. The Distribution Centre services the rural sector berry industry as the main facility for the receival, cooling, packing and distribution (to customers) of fresh berries. The proposed expansion of the MA Room is for an increase by approximately 70% of the floor area of the existing MA Room in order to meet the projected growth to 2020. Drawings 8409-151 and 153 below show the plan of the existing site and the plan of the proposed extension. The function of the MA Room is to permit the medium term storage of packaged and palletized berries. The pallets are stored in a drive-in racking system to optimize the storage space. The racking system modules are installed to suit the pallet size and this, together with the air circulation requirements, has dictated the proposed building height as detailed in this application. The increased height, compared to the existing MA Room, results in a reduced size plan area footprint. As this building is used for medium term storage, the forklift movements are minimized. The operation involves the transfer of pallets of berries from the main distribution centre into the storage racks. When required by customers, the pallets are transferred back to the main distribution centre for dispatch.

5. of the existing MA Room, parallel to the Brooke St frontage and hence is consistent with the existing streetscape Satisfies – the building extension can only be positioned on the western end of the existing room due to the configuration and design of the existing MA Room. As detailed on the attached drawing 8409-153, the northern boundary setback is complying with the scheme. However, the western boundary offset for Title Reference CT 31881/3 is, at the narrowest location, nominally 8.6m and hence is non-complying. The 8.6m has been investigated with respect to

• shading – assessed as not having a negative impact on the adjacent western property

• future building compliance – assessed as complying with BCA requirements for fire separation, access and fire fighting activities.

Additionally, after the short term, the western boundary setback will be complying. Drawing 8409-152, in Section 2 above, details a 3.5Ha allotment which has a current planning permit. The Costa Group has a purchase contract for this allotment and once this subdivision is finalized and the allotment purchased, and the purchase of CT 31881/3 is completed, both Titles will be adhered. a) Minimize likelihood for overshadowing of a habitable room or a required minimum area of private open space in any adjacent dwelling;

b) Minimize apparent scale, bulk, massing and proportion in relation to any adjacent building;

c) Be consistent with the streetscape and rural landscape;

d) Respond to the effect of the

slope and orientation of the site; and

e) Take into account the effect and durability of screening other than vegetation to attenuate impact

Satisfies – the natural ground generally slopes down from Brooke Street to the north. The proposed extension is nominally 10m high at the apex, but is located in the lower part of the allotment. Satisfies – the main vantage point for viewing of the buildings is via the western approach which is more elevated than the site, hence minimizing the visual impact.

iii)Shows hazard management areas between bushfire-prone vegetation and each building area that have dimensions equal to, or greater than, the separation distances required for BAL 19 in Table 2.4.4 of AS3959-2009 Construction of Buildings in Bushfire Prone Areas. The proposed plan of subdivision must be accompanied by a bushfire hazard management plan certified by the TFS or accredited person demonstrating that hazard management areas can be provided

In accordance with AS3959 the critical vegetation classification is ‘G’ Grassland. The allotment site is less than 5 degrees slope. The clear distance around the development building, including the existing buildings, is 18m and includes a 6m wide fire access road. AS3959 – Table 2.4.4 provides a BAL of 12.5 for the above conditions. (Minimum distance on the north side > 16m and on all other sides > 14m). Management plan for the development requires that 16m width adjacent to the building be maintained as gravel, pavements or mowed grass

E1.6.2.2 Approved Lots: Private access Objective Private access on approved lots:

(a) Allows safe access to and from the road network for occupants, fire fighters, and emergency service personnel;
