Executive Summary

The ACT Rugby Union is undertaking a planning study to support a Variation to the Territory Plan.

As part of the Plan Variation process, community consultation is required to inform the surrounding residents of the proposed development and to gather comments and views from the local community.

This report outlines the consultation activities undertaken, the observations made, the community feedback and conclusions prior to submitting a Planning Report to the ACT Planning and Land Authority.

1 Consultation Activities The following consultation activities have been undertaken to date to inform the community and stakeholder groups about the proposed development prior to submitting a planning report to the ACT Planning and Land Authority (ACTPLA):

• Newspaper Notification • Local Resident Notification • Notification of the public information sessions on the ACT

sessions to general membership and supporters • Community Information Sessions

1.1 Newspaper Notification

Newspaper Notifications were placed in the Canberra Times on 7, 14, 18 and 21 November 2009. The notices informed the general public of the project and invited attendance at the public information sessions (see below). A copy of the newspaper notice is included at Appendix A

1.2 Local Resident Notification

An information flyer was distributed to approximately 600 residents in the immediate vicinity of the Canberra South Bowling Club and the Griffith Oval. The fliers were distributed the week of the 9th of November, as a follow up to the advertisement in the Canberra Times on Saturday 7 November 2009.

The extent of the residents’ notification via a letterbox drop was assessed based on the possible impact the proposal may have. Appendix B shows the areas included in the letterbox drop notification process.

1.3 Notification on the ACT Brumbies Web Page

The ACT Brumbies issued a media release on 7 November (Appendix C) regarding the two public information and consultation sessions. The notice included details of the process of preparation of a supporting planning study for the proposed variation to the Territory Plan. Details of the location and dates of the information and consultation sessions were included in the notification.

1.4 Email circulation

In conjunction with the 7 November media release, the general membership and supporter base of the ACT Brumbies were advised of the information and consultation sessions via email and associated links to the appropriate web page of the ACT Brumbies web site.

1.5 Community Information Session

Two information sessions were hosted at the Canberra South Bowling Club in Griffith on Monday 23 November 2009 and Tuesday 24 November 2009 between the hours of 4 and 7 pm.

The information sessions were structured as “Drop In” sessions – an informal way in which to present information. Key project team members and representatives from the Brumbies were in attendance to explain project information and answer any questions that the community had. A registration desk and four information posts were set up at the venue with information posters displayed.

The 3 hour time frame of the information sessions permitted the community to arrive and depart at various times throughout the evening and also facilitated the opportunity to discuss issues raised with smaller groups of people or on a one on one basis with the project team.

2 Observations

The information session format as discussed in Section 1 worked well. Those who attended the session took time to view the information on display and spoke with the project team as well as representatives from the Brumbies.

The first session had a positive turnout with 75 signatures collected. The majority of those who attended visited the session between 4 and 6 pm, with people staying an average of 15 to 20 minutes. The second evening had a smaller attendance rate with 36 additional names collected (refer to Appendix 2 for the Registration of Attendance).

3 Community Feedback Attendees at the information session were invited to provide feedback verbally or in writing. A feedback form was made available for those who wished to write in their comments.

A total of 47 written responses have been received as of 4th December 2009. The responses have all been recorded and the comments noted. The four main reoccurring comments have been listed below with the complete set of responses and the comments schedule attached at Appendix 3. Reoccurring Comments from respondents:

• Concerned about the amount of public access to the oval and/or the loss of open space. Do not agree with rezoning Block 17.

• Concern about scale of residential development on Block 15.

• Concern about loss of trees.

• Request illuminated pathway between Wells Gardens and Flinders way for increased safety and amenity.

4 Conclusion The two information session evenings have formed part of a pre-consultation phase of the project and the feedback from the community has been invaluable in assessing the communities concerns and needs. The Territory Plan Variation process will incorporate further opportunities for the community to provide comment.

The conservation themes for this assessment cycle:

• heathlands and mallee woodlands, and

• terrestrial, estuarine and near-shore environments of Australia’s coasts.

Nominations consistent with these conservation themes are encouraged, but nominations outside the themes will also be considered for priority assessment.

Public nominations will be considered for the priority assessment list for the assessment period starting 1 October 2010 by the Threatened Species Scientific Committee.

TERMS AND CONDITIONS OF ADVERTISING1. Federal Capital Press Publishers of The Canberra

Times and The Sunday Canberra Times (ABN 47 000 010 382) and its subsidiaries (‘FCP’) reserves the right, at its absolute discretion, to decline or reject any advertisement for any reason whatsoever, including, but not limited to, that the advertising is unlawful, defamatory, offensive, or otherwise unsuitable.

Where the advertiser, its advertising agent or representative (in these terms and conditions jointly referred to as the ‘Advertiser’) lodges an advertisement for a job (a ‘Job Advertisement’) in a FCP publication, that has a prime circulation area that covers the location of the job, and it is accepted by FCP, FCP may at its absolute discretion publish the Job Advertisement in My Career and in any other FCP publication it so chooses.

3. Where FCP accepts an advertisement for publication from the Advertiser, FCP may, at its absolute discretion, publish the advertisement on any or all of the FCP web-sites.

4. Where FCP accepts an advertisement for publication from the Advertiser, it may, at its absolute discretion, place or position the advertisement anywhere it so chooses unless the Advertiser has paid for and FCP has accepted payment and agreed to the placement of the advertisement at a particular place or position.

5. These terms and conditions do not exclude or limit the application of any provision of any statute (including the Trade Practices Act 1974) where to do so would: (a) contravene that statute; or(b) cause any part of these terms and conditions to

be void.The liability of FCP, and the Advertiser’s sole remedy for breach of statute, will be limited to re-supplying, or paying for the re-supply, of the advertisement at the discretion of FCP.

6. Except to the extent that clause 5 applies, FCP will not be liable for any:(a) statutory liability;(b) tortuous liability (including, but not limited to,

liability for negligence);(c) conditions and warranties implied by custom,

the general law or statute; and(d) liability for any direct, indirect, economic

or consequential losses (including, without limitation, loss of anticipated savings, loss of profi ts, or any other business costs), expenses, damages and costs incurred by the Advertiser, arising out of or in connection with the publication of the advertisement or any failure to supply or delay in supplying the advertisement.

7. The Advertiser must indemnify FCP against all losses, expenses, damages and costs (on a solicitor and own client basis) incurred by or awarded against FCP arising out of or in connection with any breach of these terms and conditions which is wholly or partly attributable to or arising out of the acceptance and publication of any advertisement.

8. The Advertiser warrants to FCP that any advertisement that is accepted for publication contains information that is true and correct in all respects, is in no way misleading or deceptive such that it may contravene section 52 of the Trade Practices Act 1974, Section 53c of the Trade Practices Act 1974 or any other provision of any law of the State or Commonwealth, and is otherwise lawful.

9. Without limiting FCPs’ rights under clause 1 of these terms and conditions, advertisements must comply with FCPs’ standards of presentation, style and classifi cation in respect of advertisements placed with FCP.

10. Where complete material is supplied electronically it must be provided in PDF format with fonts embedded. For all other supplied material FCP reserve the right to amend fonts to those licensed to FCP.

11. Where any advertisement has the appearance of editorial matter, the Advertiser must include a border of a minimum of ‘two point’ thickness and the word “Advertisement” must be displayed on the advertisement in at least size eight-point font.

12. All run of press, classifi ed display and classifi ed semi-display advertising sold by FCP will be sold in whole centimetre and column units. All classifi ed line advertising sold by FCP will be sold by the total number of lines used and FCP may, at its absolute discretion, require the Advertiser to place a minimum number of lines in any advertisement before it is accepted.

13. All quoted rates for advertisements and other related services by FCP are quoted inclusive of the Goods and Services Tax (‘GST’). 09-07175/3

Brumbies Rugby seeks community input Saturday, 7 November 2009 Brumbies Media Unit

Brumbies Rugby has announced two public information and consultation sessions to seek the views of the community on a possible improvement to its Griffith headquarters.

Brumbies Rugby is undertaking a planning study which will support an application to the ACT Government to vary the Territory Plan.

If the variation is approved it would to allow for medium density housing and a new training and administration facility to be built at Griffith.

“It’s clear that we have to do something”, Brumbies Rugby CEO Andrew Fagan said. “Our training facilities are poor and they have to be improved in order to remain competitive and viable in the future.

“We also have to address building a more sustainable financial future for the CA Brumbies in Canberra. Under the current zoning for the site we could develop a more substantial licensed premises at the Bowling Club but we believe that’s a use incompatible with the needs of the local residents.

“On the other hand, we think that medium density housing on the site is a sound option. It’s compatible with a lot of the other development that’s going on in the area and we know it will be popular with many of the locals who are looking to downsize from their larger family homes but who want to stay in the area.

“We’re at the very beginning of a process so what we’re doing is taking the opportunity to hold some information sessions that will allow us to hear the views of the locals. We want to know their thoughts about our idea”.

The public information and consultation sessions will be held at the former Canberra South Bowling Club (Austin Street, Griffith) between 4pm and 7pm on Monday, 23 November and Tuesday, 24 November. All those interested are invited to attend.

The financial arrangements of the Brumbies organisation are commercially confidential. The Brumbies is a not for profit community based organisation.

What is the planning process/timing 1 2%

Following the pre-consultation process that is occurring in late 2009 the intent is that, subject to the agreement of the ACT Planning Authority, a draft variations to the territory plan will be advertised for formal public comment in early 2010, a proposed plan variation will then be finalised by the Planning Authority for consideration by the Minister, the Legislative Assembly Standing Committee on planning and ultimately by the legislative assembly in late 2010. Applications for development of the two site could then proceed, these would also be publicly notified.

The establishment of a training facility which is reflective of the professionalism required to be competitive in Super Rugby, a facility which can be the home of ACT and Southern NSW Rugby for years to come and a focal point for the sport in ACT

The proposed design will retain the open treed character of the precinct, detailed design proposals will be publicly advertised as part of the development application process.

The necessary technical studies are under way and will be made publicly available when the draft plan variation is advertised as part of the supporting documentation.

Development will be as expeditious as possible. An overall construction timeframe of 12 - 18 months is anticipated.

The oval site will remain in the ownership of the ACT Government (under the control of the Sport and Recreation section of the Department of Territory and Municipal Services) It will be sub-let to the Brumbies. If the Brumbies were to depart at some time in the future then the government would determine an appropriate use for the land.

In addition the large open space area across la Perouse St, the oval at the corner of Flinders Way and Monaro Cres and the open spaces along Monaro Cres are an off-leash area.

Consideration of a range of urban planning and environmental objectives lead to the conclusion that denser development in inner area is preferred. major Government policy documents including the Spatial plan and the Sustainable Transport Plan support this position.
