Subject: Appointment to explain about charge sheet issued on marketing regarding..Sir,Kindly refer to the charge sheets issued by the Haryana Khadi and Village Industries Board to Naresh

Kadyan, TS (L) and Departmental Inquiry officers was appointed by the Board with out properexamination of the facts submitted by Naresh Kadyan, where as no opportunity was provided,

explanation was called before issuing charge sheet, where as Naresh Kadyan performed his official

duties in good faith and trust with the approval of then Chief Executive of the Board, in the interest of

Haryana Khadi and Village Industries Board, to generate funds and income for Board not for personnel

gain and profit.Hence you are humbly requested to please allow the deputation of the National Khadi and Village

Industries Board Employees Federation (Apex Body of all state KVIB Employees Unions) to explain the

truth behind, for natural justice to Naresh Kadyan because performance of duties assigned to the post

of DKVIO can not be treated as violation.

Please direct Chief Executive of the Board to:1. Direct concerned branch to examine all facts properly and scrutiny the papers submitted by Naresh

Kadyan with his replies, because at this stage no loss to the Government involved.2. Drop the charge sheets because marketing orders were executed on February 27, 2007 and how it could

be possible to obey the instructions issued on November 16, 2007? 3. Proper goods receipt, payment from the purchaser along with the bill of the supplier, who was

authorised by the Board, as per agreement signed between Chief Executive and the supplier was

obtained, 5% service charges was sent to the Board and balance amount was disbursed to the supplier

through Bank transactions.4. As per information obtained under RTI cleared that no objections were received from the purchaser

and it is responsibility of the purchaser, to satisfy about cost, quantity and quality of the materials

supplied by the supplier before releasing payments and goods receipt, where as supplier is duty

bound to replace the objectionable materials and reimburse the excess payment. It would be

pertinent to mention here that the purchaser Department hold guilty the DEEO concerned, excess

payment was recovered from her and at this stage, no financial loss to the Government is involved,

hence charge sheet stands infractuas now, not maintainable as well.4. Zero FIR has been lodged by Naresh Kadyan with the Faridabad Police against supplier for the breach of

trust, terms and conditions mutually decided in agreement, which was signed amongst CE and

supplier, where as this action was required at the level of Head office, instead of issuing charge sheets

to Naresh Kadyan.5. In a similar items supplied by the same party to the DEEO, Jhajjar, at same price through Super Bazaar

and this matter was examined by the State Vigilance Bureau, Rohtak, FIR was lodged but billing

Authority Super Bazaar was exempted from the charges, findings attached here with for ready

references, where as same procedure was applied in the supply order executed in question, by Naresh

Kadyan then where are the irregularities?It is humbly requested to please consider our above said request sympathetically in the interest of

public with positive thoughts and broad minded, as Naresh Kadyan; man of many distinctions wants

to serve with honesty and dignity under your kind control, where as he is most efficient, well qualified
