AGENCY ROLE, PERFORMANCE AND GOVERNANCE Legislation and Structure A system of registration for all teachers employed in both government and non-government schools was established under Part IV of the Education Act 1972 and came into operation in 1976. The purpose of the legislation was to regulate the teaching profession. After a comprehensive public consultation process during 2004, the Teachers Registration and Standards Act 2004 (the Act) and the Teachers Registration and Standards Regulations 2005 (Regulations) were proclaimed on 31 March 2005. The legislation significantly enhanced the power, functions and responsibilities of the Board to better meet the expectation of the community and the professional standards required on a state and national level in relation to the regulation of the teaching profession. The object of the Act is to establish and maintain in the public interest, a teacher registration system and professional standards for teachers to ensure members are competent educators and fit and proper persons to have the care of children. In undertaking its functions the Board has the welfare and best interests of children as the primary consideration. The Board is a body corporate, has perpetual succession and a common seal and has the powers of a natural person and the functions and powers assigned or conferred under the Teachers Registration and Standards Act 2004 and any other Act.

The functions of the Board are:

- to administer the provisions of this Act for the regulation of the teaching profession;

- to promote the teaching profession and

professional standards for teachers; - to confer and collaborate with teacher

education institutions with respect to the appropriateness for registration purposes of teacher education courses;

- to confer and collaborate with teacher employers, the teaching profession, teacher unions and other organisations and other bodies and persons with respect to requirements for teacher registration and professional and other standards for teachers;

- to confer and collaborate with other teacher regulatory authorities to ensure effective national exchange of information and promote uniformity and consistency in the regulation of the teaching profession within Australia and New Zealand;

- to keep the teaching profession, professional standards for teachers and other measures for the regulation of the profession under review and to introduce change or provide advice to the Minister as appropriate.

Members of the Board include an independent Chairperson, a person representing the community, a legal practitioner, employers from the government and non-government sectors, teacher unions and the teacher education sector of the universities of the State. The composition of the Board reflects the key stakeholders in relation to the regulation of the teaching profession.

The Board meets on a monthly basis. The Board delegates the determination of matters pursuant to Part 5 (admissions to the register) and Part 7 (whether conduct constitutes proper cause for disciplinary action or whether a teacher’s capacity to teach is seriously impaired by an illness or disability affecting the person’s behaviour or competence as a teacher) to a sub-committee. This sub-committee is comprised of not less than three members of the Board including a member who is a legal practitioner and a member who is a practising teacher. During the reporting period the Board determined there would be five members on a sub-committee formed for this purpose. A decision is made on behalf of the Board and is binding on the Board. Standing Committees To enable specific matters to be dealt with in an efficient and effective manner, the Board has established four standing committees. Members may be co-opted to these Committees as appropriate. A range of matters are referred to these committees for discussion and to develop proposals and recommendations for resolution by the Board. Executive support to all standing committees is provided by the staff of the Board.

Teacher Education and Professional Issues (TEPI) - considers a broad range of educational and professional issues including the development of professional teaching standards. Delegations Section 19 of the Act requires the Board to include details in the Annual Report of any delegation of a function or power of the Board that was in operation during the relevant financial year. In addition to those previously reported, the Board delegated the following powers and functions to the Registrar.

With respect to the delegation of the powers and functions to grant registration, the Registrar may determine that the term of registration commence from the end of a preceding term of registration in accordance with Section 26(2) of the Act.

With respect to assessing applications for registration and renewal of registration the Registrar has been delegated all powers conferred to the Board under Section 22(2)(b) and (c) of the Act.

Statutory Review of the Teachers Registration Board of South Australia In 2008 the Statutory Authorities Review Committee received a motion from the Legislative Council to inquire into the Teacher Registration Board.

The Terms of Reference:

1. The welfare and best interests of children as its primary consideration in the performance of its functions;

2. The manner and process by which it ensures that a teacher registration system and professional standards are maintained to safeguard the public interest in there being a teaching profession whose members are competent educators and fit and proper persons to have the care of children;

3. The composition of the Board; 4. The manner and process by which

evidence is gathered and presented to the Board, including the representation of parties to proceedings;

5. The relationship between the Department of Education and Children’s Services and the Board; and

6. Any other relevant matters.

The Review Committee advertised the Inquiry in the Advertiser and Weekend Australian newspapers on Saturday 30 May 2009 and the Sunday Mail on Sunday 31 May 2009. The invitation for written submissions close on Friday 31 July 2009.

Strategic Framework 2009-2012 The Board regulates the teaching profession within Government, Catholic and Independent schools. As with other professions requiring specialist knowledge and occupying positions of trust and responsibility, teachers are required to be registered in order to practise their profession and to have the care of children.

In March 2009 a Strategic Planning Workshop session was conducted with all Board members and senior staff to review key achievements and identify key directions for the next 3 years.

The Strategic Framework 2009-2012 articulates the Board’s vision, purpose, values and strategic goals in relation to fulfilling its legislative functions.

Purpose The Board, in the public interest, regulates and promotes the teaching profession in South Australia.

Meet regulatory and compliance responsibilities as an accredited CrimTrac third party

agency the Teachers Registration Board conducts criminal history record checks on all new applicants and those renewing their registration. In October 2008 the Teachers Registration Board received the highest compliance rating as a result of a CrimTrac Audit undertaken in June 2008.

reviewed a range of policies and procedures relating to the registration of teachers, the granting of Special Authorities to Teach, and the imposition of conditions on registration.

implemented evaluated professional teaching standards and program guidelines for the accreditation of pre-service teacher education.

commenced the design and development of an electronic records management system in line with requirements of the State Records Act 1997. It is expected that full implementation will occur early 2010.

held 6 Inquiries and 16 Hearings (refer to separate section in Annual Report).

Influence the agenda for the regulation of teachers at state, national and international level the Teachers Registration Board is an

active member of the Australasian Teacher Regulatory Authorities (ATRA). ATRA membership consists of the teacher registration and accreditation authorities in all Australian states and territories. New Zealand is an associate member. The Presiding Member and Registrar of the Teachers Registration Board hold the positions of Chair and Deputy Chair until September 2009.

ATRA members attended the Third International Teaching Councils Meeting in Wales in June 2009. One outcome of this meeting was a commitment by the Teachers Registration Board to co-ordinate the collection of information relating to teacher registration requirements, including prescribed qualifications and the disciplinary functions undertaken in all jurisdictions. This information will be published on a website established for the International Forum of Teacher Registration Authorities (IFTRA).

the Registrar was nominated by the Chief Executive Officer, Department of Education and Children’s Services to represent South Australia on a working group established in mid 2008 by the Australian Education Officials Committee (AESOC) in relation to developing a set of agreed standards for national accreditation of pre-service teacher education.

ATRA worked closely with the Australian Council of Deans of Education to develop a set of program standards to apply to higher education institutions providing teacher education programs and a set of national teaching standards for pre-service teacher education graduates.

officers of the Teachers Registration Board participated in workshops at a state and national level to progress work on national consistency and in promoting the role of the Teachers Registration Board, in particular, in relation to the assessment of qualifications and legal procedures including the exchange of information between jurisdictions.

Accreditation and Approval of Pre-Service Teacher Education Programs Pre-service Teacher Education Program Approval Guidelines (the Guidelines 2007) form the basis for the accreditation and approval of pre-service teacher education programs for South Australian higher education institutions. The Guidelines provide a framework for the development of programs that meet Board requirements and were developed after consultation with the teaching profession and key education stakeholders. Graduates who successfully complete a program accredited by the Board (as well as meeting other statutory requirements) are eligible to apply for provisional registration.

Higher education institutions must satisfy the Board that graduates will meet the professional teaching standards and that all other program requirements are met. The institution is required to provide comprehensive documentation that demonstrates how intended outcomes, content, teaching practices and assessment of the program will enable graduates to meet the professional standards.

A panel consisting of the Presiding Member (or delegate), two nominated Board members (one of whom must be a practising teacher), up to two Deans of Education or their nominees and one member nominated by the Secretariat to provide executive support. The panel may co-opt additional outside expertise if required. After consideration of all documentation a recommendation is forwarded to the Board for approval.

In August 2008 a full day induction session was held for 35 prospective panel members. During November and December 2008, 13 pre-service teacher education programs were considered by a panel and recommendations submitted for Board approval. Inquiries The Board may, on Complaint of the Registrar, or of its own motion, hold an inquiry in order to determine whether the conduct of a registered teacher (or formerly registered teacher) is unprofessional and whether such conduct may constitute proper cause for disciplinary action. registration cancelled and was disqualified from being registered as a teacher on a permanent basis as a result of unprofessional conduct (being disgraceful and improper conduct) following convictions in the Adelaide District Court

for indecent assault upon the person of a male adolescent then aged 14 years.

one registered male teacher had his registration cancelled and was disqualified from being registered as a teacher on a permanent basis as a result of unprofessional conduct (being disgraceful and improper conduct) involving the development of an improper sexual relationship with a male adolescent between the ages of 14-18 years.

one registered male teacher was reprimanded and had his registration suspended until further order for unprofessional conduct (being improper conduct) in not maintaining proper boundaries in relation to the teacher/student relationship to the detriment of particular students. The suspension was also subject to a condition that during the suspension the respondent complete a course of study addressing ethical and protective practices in relation to sexual harassment and appropriate boundaries in the teacher/student relationship.

one registered female teacher had her registration as a teacher cancelled for unprofessional conduct (being incompetence) and as a result of the suspension of her registration by another teacher regulation authority (Victorian Institute of Teaching).

one registered female teacher was reprimanded for unprofessional conduct (being improper conduct) in failing to maintain appropriate boundaries in the teacher/student relationship and had a condition placed upon her registration that she completes further studies addressing ethics in education with particular reference to the maintaining of proper boundaries in the teacher/student relationship.

one registered male teacher was reprimanded, fined one thousand dollars ($1,000.00) and suspended from the Register of Teachers for one month for unprofessional conduct (being improper conduct) in relation to the falsification of mandatory notification documents presented to the Board.

Hearings – Admission to the Register The Board held sixteen Hearings in relation to the Admission to the Register of new or formerly registered applicants, who did not hold the requisite prescribed qualifications and/or experience as described in the Teachers Registration and Standards Act 2004 or Regulations 2005 or meet the Board’s policy on recency of practice. In exercising the discretionary power vested in the Board the following determinations were made: ten applicants were granted provisional registration subject to a condition that they upgrade their

qualifications to meet the prescribed minimum standard in the legislation.

four applicants were refused registration for reasons related to the relevance or adequacy of their qualifications or failure to comply with the recency of practice requirements.

two applicants who previously had restricted registration but had allowed this to lapse were granted a special authority to teach for a limited period.

Appeals There were no appeals from decisions of the Board to the District Court in this reporting period.

Four appointments resulted from separations. Of these, two persons were appointed on an ongoing basis (Administration Officer and Legal Clerk) and two persons on long term (3 year) contracts (Project Officer Registration and Standards). In addition one person was appointed to a newly created position (Business Manager) and one person was recruited on a short term contract (Executive Support Officer). Workforce Diversity – Disability There are no employees with a disability restricting their employment or requiring workplace adaptation.

Voluntary, Flexible Working Arrangements Four males and eight females use flexi-time as part of their working arrangements. There have been no requests from employees to access other flexible working arrangements.

Performance Development As of 30 June 2009 all staff have a documented performance management plan negotiated or reviewed within the last 12 months.

Leadership and Management Training Expenditure

Total training and development expenditure was $51 788 being 3.21% of total salary expenditure. There was a commitment by the agency during 2008-09 to implement a records management system which required a significant investment in staff training and development, both internal and external. Total leadership and management development expenditure was $16 245 being 1.01% of total salary expenditure.

Commitment to Customer Service All staff members undertook customer service training during 2008-09 as part of a continued commitment to the provision of quality customer service. Additional personnel were employed on a casual basis to assist with

timely service provision during the peak renewal period.

All job and person specifications reflect a commitment to the provision of customer service.

Occupational Health, Safety and Injury Management / Risk Management The Board continues to move toward a resilient safety culture consistent with the Premier’s Zero Harm Vision and South Australia’s Strategic Plan Objective 2: Improving Wellbeing, Target 2.11: Greater Safety at Work. During 2008-09 all agency staff undertook training in client relationships and safety management to reduce the risk of psychological harm particularly in peak work periods. In addition training sessions were held in relation to the initial detection of fraudulent documents and measures to reduce the risk of identity fraud.

Policies and procedures relating to occupational health and safety were reviewed during 2008-09 and continue to be reported through the Business Management System and monitored on an ongoing basis via the OHS&W Committee. The Committee, which is the principle forum for consultation and support for staff regarding OHS&W issues, continued to meet at two monthly intervals throughout the year. A representative from the Committee attends a Level 2 OHS&W meeting with another government agency on a regular basis. Staff members have been appointed as First Aid Officers and as the Chief Fire Warden. The Committee reviewed and updated the induction manual for new and casual staff appointed to the agency.

As safety is a high priority the site is inspected on a regular basis and staff members are asked to report any hazards to

the appropriate officer. A formal hazard inspection occurs each year and any findings are acted on promptly.

There were no notifiable occurrences pursuant to OHS&W Regulations Division 6.6, no notifiable injuries pursuant to OHS&W Regulations Division 6.6 and no notices served pursuant to OHS&W Act s35, s39 or s40 (default, improvement or prohibition notices). A Level 3 rating is held by the Agency.

Risk management and assessment of policies and procedures based on the South Australian Government Risk Management Policy 2003 and the Risk Management Standard AS/NZ54360, 2004 and relevant legislative instruments as determined by the South Australian Insurance Corporation and

Department of Treasury and Finance, South Australia. The Risk Management Register is updated on an annual basis.

Accommodation The Teachers Registration Board is an Independent Statutory Authority. Since 2000 the offices of the Board have been located at level 6, 70 Pirie Street, Adelaide. The current lease expires October 2010. The current leasehold needs to be increased to cater for existing and future needs. The Teachers Registration Board is working with the Department for Transport, Energy and Infrastructure in relation to renewing the lease and securing additional space as there are considerable benefits and cost savings in remaining at the same location.

The increase in energy consumption (GJ) and green house gas (GHG) Emissions in 2008-2009 reflected the first complete twelve month period with the increased leasehold and persons employed within the agency.

In some cases invoices were received later than the due date as a result of supplier invoicing processes but all were paid within 30 days e.g. one account for $120 000. Fraud There were no instances detected in the agency during the reporting period. The Teachers Registration Board complies with the existing Accounting Policy Standards and issued Accounting Policy Frameworks in line with the Australian Equivalence to International Reporting Standards (AIFRS).

Overseas Travel The summary includes salary and on costs, travel, accommodation and conference fees.

One employee attended on invitation from the British Columbia College of Teachers, an International Conference in Vancouver, Canada relating to Standards, Self-Regulation and the Public Interest - $8 900.

One employee by invitation and on nomination by the Commonwealth of Australia, attended a meeting of the British Commonwealth Teacher Qualifications and Professional Registration Steering Group in the United Kingdom - $2 751 (salary only).

One employee attended the Third Meeting of the International Teaching Councils in Wales - $7 900. The employee provided a key note address at the meeting.

Disability Action Plan There is appropriate access for persons with disabilities or mobility impairment both in the client service areas and within office work areas. Services and programmes undertaken by the agency are documented and published on the website, as well as the Register of Teachers as prescribed in Section 28 b (b) of

the Teachers Registration and Standards Act 2004. Feedback/comments can be submitted in person, telephone or through the Board’s info line email ([email protected]).

Employment practices are based on merit and do not discriminate against people with disabilities. In accordance with legislative requirements, applicants for registration as a teacher need to satisfy the Board they are fit and proper to teach. Applicants are required to declare whether their capacity to teach is seriously impaired by an illness or disability affecting their behaviour or competence as a teacher. Depending on the circumstances, an applicant may be required to submit to a medical examination by a medical practitioner selected by the applicant from a panel of medical practitioners nominated by the Board. All matters are considered on a case by case basis observing the principles of natural justice and appropriate legislation e.g. Disability Discrimination Act and the Equal Opportunity Act.

Freedom of Information

The structure and functions of the Board are stated in Part 3, Section 6 of the Teachers Registration and Standards Act 2004 and published in the Annual Report and on the Board’s website. The Teachers Registration Board is a Statutory Authority regulating the teaching profession in South Australia. The primary participation is through members of the Board who are nominated by the Minister for Education and Children’s Services, employers, unions and the university sector

Members of the public can seek advice or express their views by email ([email protected]), facsimile, telephone or in person (by mutual arrangement). The Agency holds documents relating to the general registration of teachers, assessment of qualifications and on fitness and propriety matters including consent forms for national criminal history record checks.

Authorities to Teach granted from 1994 – 30 June 2009 Authorities to Teach may be granted by the Board after a teaching position has been advertised in the media and no registered teacher is available to fill the position. In these circumstances an Authority to Teach may be granted for a maximum of one year. Other Special Authorities 2009 During the reporting period the Board granted 5 Special Authorities to Teach Instrumental Music, 5 Special Authorities as a Spiritual/Religious Leader and 1 Special Authority to Teach Anangu Education. These were all granted for a period of 3 years.

Assessment of Overseas Qualifications Applicants who hold teaching qualifications from overseas are required to have their qualifications assessed to determine comparability, in general academic terms, to the educational level of an Australian (three-year or four-year) Bachelor degree or Diploma. The next phase is to determine whether the award is a recognised teaching qualification. This is undertaken by assessing the academic transcript from the tertiary institution, in relation to the professional teacher education (i.e. pedagogy) subjects, which includes the theory studies in pedagogy and the practice student teaching component. For the qualifications to be recognised by the Board the following criteria must be met:

• the qualification or combination of qualifications is comparable to the educational level of at least four years of full-time (or part-time equivalent) tertiary level study in Australia, leading to the award of a recognised Bachelor degree or Diploma; and

• as part of those tertiary studies, there is at least one year (full-time or part-time equivalent) of professional teacher education, including a minimum of 45 days of student teaching practice; and

• the professional teacher education studies must be in the area of either pre-primary, primary or secondary teacher education.

During the period 1 July 2008 to 30 June 2009 there were a total of 233 applications for assessment of overseas qualifications. Of these, 193 were assessed as meeting the qualification requirements for registration as a teacher and 40 were refused. Those assessed as meeting the qualification requirements included applicants from India (54), United Kingdom (53), South Africa (26), United States of America (11), Zimbabwe (8), Fiji (7), three from each of the following countries, Malaysia, Philippines, Russia and Singapore, two applicants from China, Germany, Ireland, New Zealand and Pakistan respectively and one applicant each from 12 other countries. Note: Applicants who are assessed as meeting the qualification requirements may not necessarily proceed to apply for registration

as a teacher.
