The President and members of the Arab Society for Intellectual Property (ASIP) Board of Directors are pleased to present the nineteenth annual report for the Society describing its activities and programs during 2005. We express our great indebtness and gratitude to the honorable members who supported and contributed ASIP’s progress and advancement, either by providing it with recent information and articles, attending courses and seminars, or by supporting its objective of keeping pace with the accelerating global development.

The main objective of ASIP, promoting and enhancing intellectual property (IP) protection in the Arab world, has been at the forefront of its activities since its establishment in 1987. ASIP has continuously endeavored to increase public awareness, the development and modernization of IP systems, and capacity building among IP professionals and practitioners. The year 2005 continued that tradition with the development of new seminars and training programs on IP topics. ASIP expanded on many strides and accomplishments made in past years. ASIP would like to express its greatest indebtness and gratitude to the honorable members and supporters who contributed to our accomplishments during 2005.

This report discusses the accomplishments achieved and activities conducted by ASIP during 2005, such as developing IP programs, building capacities and expertise among professionals and practitioners in the field through continuous training programs and seminars, and raising public awareness on the IP system. Throughout the years, the Society’s accomplishments have been geared towards advancing the greater mission of promoting Arab creativity and enforcing cultural, social, and economic development in the society.

Additionally, this report contains attachments pertaining to general membership statistics during 2005. It presents analytical data of membership per country and academic qualifications, as well as the names and addresses of current and new members during 2005.

This report includes the financial statements and auditors’ report for the year ending on 31/12/2005, the budget and action plan for the year 2006, a list of names, addresses and offices of ASIP representatives, in addition to ASIP’s membership brochure and application form.

INTRODUCTION

The past period since the establishment of ASIP in 1987 in Munich has witnessed various stages and important developments during which ASIP achieved many accomplishments in more than one field, all of which aimed at enhancing ASIP progress and enforcing its role in protecting IP in the interest of both private and public sectors. All this has been accomplished either by developing IP laws, holding seminars and lectures or by the active attendance of conferences, seeking to expand the IP concept at the various levels; and ultimately to realize ASIP’s objectives aimed at enhancing economic, social, and cultural progress of the society.

During the year 2005, ASIP held many seminars and training courses. It also attended many activities, seminars, and conferences aiming at and contributing to spreading IP concept, directly or through coordination and cooperation with international and Arab bodies.

It is to be noticed that ASIP has achieved a lot in the past years for some Arab countries by offering assistance in fulfilling the requirements of accession to the WTO by up-dating and amending their IP laws and providing consultation and guidance to enact or amend such laws, in order to meet WTO’s conditions through ASIP’s understanding of the nature of such conditions.

ASIP held many programs and promoted activities throughout 2005 towards the development of IP in the Arab World. It up-dated, redesigned, and enriched its website www.aspip.org. It developed and launched the first Arab qualification program for the “Arab Certified Intellectual Property Practitioner” Award, which began on November 12, 2005. The course of the first paper, “Introduction to Intellectual Property,” was held at Jordan University under an initial agreement signed between ASIP and the University of Jordan Center for Consultations, Technical Services, and Studies.

Additionally, ASIP hosted the first annual Moot Court Competition at the College of Law of Jordan University during the period of February 20th and June 11th. ASIP also co-sponsored with the United States Patent and Trademark Office the first ever symposium on Geographical Indications in the Arab World in Abu Dhabi. In addition, ASIP organized the World Intellectual Property Day with Jordan University, the Royal Film Commission, and Goethe-Institute, including an event highlighting “The Legal Part of the Arts.”

The above-mentioned accomplishments and others could not have been achieved without the support, assistance, and continuous efforts of ASIP loyal colleagues, members of the Board of Directors, in addition to the support and assistance of many interested institutions, organizations, bodies, and experts of Intellectual Property Rights (IPRs) in the Arab world.

Teaching and Training:

The Teaching and Training Committee is in charge of managing and supervising ASIP activities in the area of capacity building, awareness and education, including related training courses, seminars, workshops, etc.

IP Master’s Program Committee :

The Masters Program Committee’s primary responsibility is to prepare masters programs sponsored by the Arab Society for Intellectual Property. The committee works to match program standards with the regulations of the Ministry of Higher Education. It sets requirements for admittance to the program, and for obtaining the degree, and prepares courses offered, references used in courses, and professors to teach the course.

Arab Center for Mediation & Arbitration in Intellectual Property Committee:

Arab Center for Mediation & Arbitration in Intellectual Property Committee is responsible for formulating and organizing the Arab Center for Mediation and Arbitration in Intellectual Property. This includes systemizing the mediation and arbitration rules, compiling a list of arbitrators and mediators, and proposing arbitration and mediation fees.

FOUNDATION

ASIP’s foundation was initiated by IP professional practitioners led by Mr. Talal Abu-Ghazaleh who extensively used his network of contacts and held several meetings with the officials in the WIPO, International Union for Intellectual Property Protection, and the German Patent Office (taking into consideration that Germany is the world leading country in protecting the IP profession). ASIP was established on February 23, 1987 in Munich, Germany as a non-profit organization aimed towards putting together the IP professionals and practitioners in the Arab region and to help build awareness and understanding of IP issues and their dynamics. It is internationally recognized in the field of IP, and has a long, successful tradition as a private Arab regional society.

The growing field of IP, concerning the development and protection of intangible ideas, is at the forefront of business development. IP has developed and continues to develop at a rapid speed matching the scientific and economic advancements to which it is a contributing factor, and underlining the new “economy of globalization” and the continued liberalization of trade in goods and services. As Arab economies continue to integrate into the world economy impacting the domestic legal, economic, and social systems, the need for a strong IP system and its continuous re-evaluation becomes even more vital. There is a crucial and ever-growing need for local IP professionals to manage and meet the changes of society with the continued advancements in creations of human ingenuity, such as technology and pharmaceuticals. Thus, it is vital that the Arab world reaches a level of awareness and development parallel to that of developed countries.

ASIP seeks to enhance and develop the system of IP protection and clarify its influential role on globalization. ASIP is highly committed to developing the IP system in the Arab world by using appropriate means to increase awareness and knowledge in this domain. One of the main objectives of ASIP is enforcing IP protection in the Arab world and providing a free arena to discuss laws pertinent to IP within the local and international scope. It strives to develop, strengthen, and harmonize procedures concerning intellectual property rights on the regional and international levels.

To adapt to the ever-developing business world and meet market needs, society needs to be aware of the importance of IP and professionals should be equipped with the necessary knowledge and experience to cope with constant changes in the field. ASIP conducts activities and provides services geared towards training qualified IP professionals in the interest of society’s advancement and the development of IP issues nationally and regionally. ASIP organizes conferences, workshops, and training courses on IP issues independently, as well as jointly sponsored by regional and international bodies hosted in the Arab region. ASIP through its efforts contributes to the protection of the consumer and the IPR holder. Additionally, it builds an environment encouraging Arab creativity and innovation in an economically developing world.

ASIP works to achieve the following objectives:

Enhancing and developing the system of IP protection through various means of public awareness and education clarifying IP and its influential role in globalization.

Developing and setting effective mechanisms to support Intellectual Property Rights (IPRS) Protection globally using appropriate methods to create harmonization between regional and international laws.

Cooperating with international organizations, such as ECOSOC and WIPO, and government offices in developing and enforcing IPRs in the Arab World in alignment with the international standards.

Developing and raising the scientific status and importance of IP protection profession through awareness activities and continuous professional training related to international developments.

Organizing, hosting, and monitoring IP educational courses, conferences, seminars and other events.

Collaborating with universities and professional organizations specialized in intellectual property and/or law to organize educational and professional programs on IPRS.

Presenting, deliberating, and processing the issues of IP in committees, conferences, and meetings on the regional and international levels.

Publishing educational books and encouraging scientific research in the IP field.

Providing ASIP members with a free forum to express their views, exchange experiences, and unite their efforts in helping modernize and develop IP laws and systems.

OBJECTIVES

ASIP’s working languages are Arabic and English in a majority of it activities. However, there are plans to intrude French as a working language in 2006 to aid ASIP’s objective of serving the North African region of the Arab world in a fully inclusive and specific manner.

The IP profession has obtained a high position in the professional quarters on the Arabic and International levels. Pursuant to ASIP’s interest in developing the profession in Arab countries in order to keep pace with other countries according to the highest technical and ethical levels, ASIP has started studying the related legislations of the profession, expanding the role the profession plays economically in the Arab region and in international IP forums. ASIP’s objectives were accomplished by keeping pace with events in the field, disseminating Arab concepts and ideas among Arab practitioners, providing its members and associates with the advantage to enable them to keep pace with professional development, knowledge in the field, and creation, and clearly understanding the laws that govern intellectual property regionally and internationally. ASIP is on the international front with several organizations. It has a consultative status with the United Nations Economic and Social Council (ECOSOC) and an observer status with the World Intellectual Property Organization (WIPO). ASIP holds membership in the Intellectual Property Constituency (IPC) of the Internet Corporation for Assigned Names and Numbers (ICANN).

INTERNATIONAL AMBITIONS AND MEMBERSHIPS

AMBITIONS

ASIP holds the immense responsibility of conveying the views of IP professionals to decision makers at the Arabic and international levels due to its wide-spread base of IP practitioners’ membership in the Arab World and its participation in laying down IP principles through its presence in international arenas.

Pursuant to the ASIP’s interest in developing the IP profession in the Arab region to keep pace with developed countries, it is essential that the Society continuously extends its goals to meet international developments. As ASIP develops advanced training programs and activities, it becomes more aware of the needs in the IP field regionally and internationally. Thus, ASIP’s ambitions develop as the Society makes new advancements.

ASIP’s Ambitions for the future include:

Enhancing and developing the system of IP protection through various means of public awareness and education clarifying IP and its influential role in globalization.

Establishing effective strategies to harmonize and support IPRs procedures on a regional and global level, including reformulating laws according to regional and international development in IP.

Promoting the Society and its objectives through effective marketing strategies and maintaining increased membership.

Developing strategies to increase financial capabilities from different regional and international sources for meeting ASIP’s needs.

Developing ASIP’s website to reflect its importance and accomplishments and further promote the Society.

Increasing awareness of the IP protection profession and its importance regionally and globally through development of the profession, raising its scientific position, and increasing its activities through training and specialization.

Developing the Arab Certified Intellectual Property Practitioner (ACIPP) program to increase the number of professionals specializing in IP in the Arab World. Expanding the ACIPP program to universities and organizations in other countries of the Arab region. Formulating an agreement with Cambridge University to provide accredited certification for the program, thus increasing the value of IP Practitioners in the Arab region.

Collaborating with more universities and professional organizations specializing in IP and/or law to organize educational and professional programs on IPRS.

Establishing and developing an IP library at the Talal Abu-Ghazaleh College of Business.

Graduating qualified Arab students to keep pace with world economic development in the IP field.

Promoting and protecting the intellectual rights of creative artists and innovative assets and the rights of actors/actresses, singers and composers. This includes ensuring that such artists are aware of their rights in copyrights, audio-visual rights, heritage rights, conventional knowledge, and literary rights.

Developing and supporting Intellectual Property Rights in the fields of pharmaceuticals, biotechnology, and medicine.

Assessing the effect of geographical indicators on the global level, as well as developing and supporting policies enforcing the implementation of a balanced protection for IP rights relating to geographical indicators.

Developing and supporting policies and attitudes related to internet IPRs, including domain names and domain names management.

Developing and supporting policies and attitudes to enforce and implement protection against piracy, trademarks imitation, and taking measures to increase government procedures with regard to such matters.

EXPANSION SINCE 2004

ASIP presented many programs and activities in 2004 upon which it expanded in 2005. This includes the monthly roundtables held in conjunction with many organizations and offices, continuous conferences and training programs on aspects of the IP field, and the meetings of the Board of Directors. In 2004, ASIP started planning and developing the IP Expert Program. In 2005, it completed the program curriculum, translated the WIPO Handbook, which is to be the main reference for the program, into Arabic, and held the first course of the program “Introduction to Intellectual Property” in November. ASIP continued with its work in 2005 by expanding old programs and establishing some new programs, including the first annual Geographical Indications Symposium and Moot Court Competition.

The First Moot Court Competition Hosted at the College of Law at the University of Jordan

The first annual Moot Court Competition was held at the College of Law at the University of Jordan organized upon an initiative by the Arab Intellectual Property Mediation and Arbitration Society (AIPMAS) in cooperation with the Faculty of Law in the University. It was held between February 20th and May 20th, 2005. The competition was designed to promote the spirit of excellence and creativity among students, and provide the community with qualified professionals in the field of intellectual property.The first advertisement for the competition began on February 20th. It included several stages focused on litigation proceedings of a case related to trademarks. On Monday, May 20, 2005 Jordan University witnessed the final stage of the Simulated (Replica) Tribunal Competition for the students of the School of Law. The final hearings were held at Sameer Shamma Theater in the presence of the faculty and a large number of students from the School of Law. The pleadings were presented by the participating students before a magistrate panel consisting of five (5) members, presided by Judge Tha’er Al-Adwan. The participating students displayed a high professional level in litigation, as well as consciousness and knowledge in intellectual property lawsuits.

Senior lawyers attending the competition highly valued this pioneering experiment that AIPMAS will annually organize in cooperation with the School of Law. The winners were rewarded during the AIPMAS inauguration ceremony, held under the patronage of Dr. Adnan Badran, the Prime Minister of Jordan on July 11, 2005.

ASIP holds the Annual Meeting of the Board of Directors

On June 11th ASIP held its annual meeting of the Board of Directors headed by Mr. Talal Abu-Ghazaleh, President of the Board, to discuss ASIP activities and accomplishments. There was a reshuffle of the administrative board with the appointment of HE Mr. Mohammad Asfour as ASIP Vice-President. Newly-appointed members of the board were Mr. Saleh Al-Shu’aibi, Mr. Suifyan Obeidat, and Mr. Hazem Al-Simadi. The Board Chairman also discussed financial and administrative issues and agreed to cover ASIP’s budget deficit. The Board discussed the Arab Center for Mediation and Arbitration, the first Center of its kind in the Arab world. Furthermore, the Board learned that the curriculum of the ACIPP program is now ready with the completed translation of the WIPO Handbook into Arabic. The translation will be copyrighted to both WIPO and ASIP. The formation of an ACIPP Board under the chairmanship of and in consultation with Dr. Heinz Goddar was discussed. It will be composed of qualified international experts with IP experience of no less than ten years.

Additionally, the Board recommended the formation of a committee to review ASIP’s five-year plan (2005-2009) with special focus on Arab states and materializing it into a working plan for achieving the suggested recommendations.

Arab Center for Mediation and Arbitration in Intellectual Property Launched

On June 11th ASIP celebrated the launching of the Arab Center for Mediation and Arbitration in Intellectual Property of AIPMAS. The Center is entrusted with the protection of intellectual property and the implementation of mediation and arbitration to guarantee a practical materialization of intellectual property observance and protection. The Center will also seek cooperation with and benefit from the expertise and support of regional and international universities and organizations.

During a meeting of the Board of Directors of the Association of the Arab Society Mediation and Arbitration in Intellectual Property on June 11, 2005 in Amman, President Talal Abu-Ghazaleh appointed Adv. Omar Al-Jazi as Vice-President of AIPMAS. Adv. Omar Al-Jazi will be responsible for the re-formulation of the strategic plan which shall focus on enforcing the role of mediation and arbitration in intellectual property matters to address goals sought through mediation in intellectual property and achieving them. The executive committee of the Center will be responsible for carrying out activities in accordance with the re-formulated strategic plan. Furthermore, the administrative board also set recommendations concerning the terms and conditions for selecting mediators and arbitrators in intellectual property as members of the Arab Society for Mediation and Arbitration in Intellectual Property.

The annual General Assembly meeting of AIPMAS followed the Board of Director’s meeting. Members discussed the strategic plan as presented by the Board of Directors in the annual report and endorsed the recommendation to reformulate the plan. Additionally, the General Assembly approved the Board of Director’s recommendations for new members and approved terms and conditions for selecting mediators and arbitrators for the Center.

Round Table Dialogue

-The Round-Table Series is aimed at spreading awareness on intellectual property with discussions on various topics of IP practice taken from current events and the latest rulings on IP matters. Roundtable discussions are held on a monthly basis, and each roundtable is led by an IP expert on the selected topic.

Seminar on “Contemporary Issues in Trademarks”

-ASIP co-sponsored a seminar on “Contemporary Issues in Trademarks” with the Consultation Centre at the University of Jordan between February 26th and 27th, 2005. The aim of the seminar was to enhance the knowledge and efficiency of Arab IP practitioners. Fourteen parties participated in the event, including Talal Abu-Ghazaleh Group, the Faculty of Law, University of Jordan Centre for Consultation, Technical Service and Studies, the Ministry of Industry and Trade, Jordan Kuwait Bank, the Bank of Jordan, the Islamic Bank, Specialized Furniture Co., Al-Sayegh Group, the Tobacco Company, Al-Ittihad Factories Co., Saba Co., JWAICO, the Department of Real Estate, and the Aqaba Special Economic Zone.

This seminar emphasized the importance of IP in our technologically advanced globalized world, developing issues in trademarks law and registration such as the use of color as a trademark, unfair competition, and the Madrid system which will soon be implemented in the Arab region. Syrian practitioner, Dr. Kana’an Al-Ahmar tackled topics such as: an overview of trademarks, unconventional trademarks, renowned trademarks, assignment licensing, acquittal, and an overview of the Madrid Agreement and Madrid Protocol concerning international registration. Furthermore, two German lawyers, Mr. Folker Zimch and Mr. Christian Kzishoski, presented papers on trademarks. Mr. Kzishoski’s presentation was titled “Two Important Principles for the TM Protection: the National File and International Registration,” while Mr. Zimich presented on the merits users can gain from the Madrid system and the international registration system.

Trademarks Training Seminar in Dubai co-sponsored with OHIM

-On March 22nd ASIP held a seminar, under the patronage of Sheikha Lubna Al Gassimy, the Minister of Economy and Planning, on Evaluation Methods and the Economic Benefits co-sponsored with Abu Ghazaleh for Intellectual Property and OHIM, in the Chamber of Commerce in Dubai. This seminar was held under the economic ministry of the UAE. Ms. Fatima Al-Hussny, Director of the Commercial Registration Department and Head of the Trademarks Section in the Ministry of Economy and Planning presented a speech on behalf of Sheikha Lubna Al-Gassimy. She emphasized in the speech that the UAE, over a period of three decades of development, have been able to establish an example model for other countries in the region to continue gaining a pioneering position in the IP field.

The seminar addressed a number of vital issues affecting subject maters related to IP and the value of Trademarks as an asset of a company. Mr. Waleed Hashim, Director of “Abu Ghazaleh International and Co,” Abu Dhabi, discussed Trademarks as an asset of a company and the concept of “added market value,” a rise in the equivalent value of the net assets of the establishment from the assets invested. Trademarks are the emblem of commercial fame and the value of this fame is increasing with the increase of sales and commercials. Evaluating Trademark methods include the method of tracking the historical cost, the method of the cost of redeveloping the Trademark, market evaluation, and the methods of depending on income.

Participated in the Workshop “Let’s all Have the Slogan Made in Palestine”

-On March 23rd ASIP, along with a work team from Abu-Ghazaleh for Intellectual Property (AGIP), participated in a workshop titled “Let’s all have the Slogan Made in Palestine” held by the Ministry of the National Economy. The seminar resulted in a recommendation to establish a joint committee from the Ministry of the National Economy and Abu-Ghazaleh Group for Intellectual Property (AGIP) to hold seminars and workshops regarding IP for industrial unions, establishments, and universities.

First Geographical Indications Symposium

-Between April 12th and 13 th ASIP and the United States Office of Patents and Trademarks co-sponsored the first symposium on Geographical Indications (GI) in the Arab Region in Abu-Dhabi. It was held under the patronage of Her Highness Sheikha Lubna Al-Qasimi, UAE Minister of Economy and Planning. The general trend of conference organizers was to provide full technical support to the entrepreneurs of Arab local industries in the field of goods, services, or geographically indicated ones. Mr. Talal Abu-Ghazaleh emphasized during the conference the need to build “bridges of cooperation” with advanced countries in all fields, including IP. The symposium tackled issues of the possibility of recording and investing geographical indications taking into consideration local legislation and international conventions effective in the Arab World. Furthermore, it examined the investment by entrepreneurs of Arab local industries of GI in the Arab world.

Mr. Richard Albright, US diplomatic mission Vice-Chair, voiced the interest of his country to hold this dialogue to further promote US commitment to sign trade agreements with Arab states in order to enhance investment and

businesses. ASIP President, Mr. Talal Abu-Ghazaleh, announced the launching of the first Arab initiative to hold a series of conferences in Arab capital cities with an aim to reach the fully fledged picture about the position of Arab investments and industries using GI and to get as much views on the matter as possible from the various sector in order to set up the first Arab regional plan and mobilize support from the international competent bodies.

Sessions of the conference, which included constructive dialogue with interventions and presentations, tackled a number of issues on the possibility of recording and investing geographical indications in the light of local legislation and intervention conventions effective in the Arab World.

World Intellectual Property Day Event: “The Legal Part of the Arts”

- ASIP promoted one of its main objectives, the protection of intellectual rights of creative artists, and innovative assets, in its co-sponsorship of the event “The Legal Part of the Arts.” During the period of April 26-28, ASIP participated in marking and organizing the World Intellectual Property Day event with the University of Jordan, the Royal Film Commission, and Goethe-Institute. The event included Copyright seminars and symposiums on the theme “Legal Part of the Arts.” Most importantly it discussed the rights that actors/actresses, singers, and composers should be aware of, including: copyright rights, audio-visual rights, heritage rights, conventional knowledge, and literary rights. ASIP Executive Director, Mr. Mohammad Jameel Al-Shalabi, stated that knowledge of their legal rights in the Arts is essential to protecting their rights and put an end to piracy acts that might infringe on their works, innovations, and ideas.

Adjudication in Intellectual Property Training Course Held at Talal Abu-Ghazaleh International

-During the period of May 21-25, ASIP held a training course on Adjudication in Intellectual Property in cooperation with Abu-Ghazaleh Group for Professional Training at TAGI Headquarters in Amman. It was a fifteen hour course held over the course of five days. The main objectives of the course included: enhancing participants’ understanding of the nature of adjucation in the field of intellectual property, types and procedures of appeal, the concept and types of evidence, acts of infringement, and fair compensation. The course addressed issues, such as the decisions of the Industrial Property Office, appeal (concept, types, and procedures), types of evidence, acts and types of infringement, criminal actions in case of forfeiting and forgery, infringements on patents, copyrights, trademarks, and industrial designs, arrogation, fair compensation, and arbitration in IP.

Arab Certif ied Intellectual Property Practitioner Program (ACIPP)

On June 11th AIPMAS signed a scientific cooperation agreement with the University of Jordan Center for Consultations, Technical Services, and Studies to hold the ACIPP Program at the University.

On November 12th ASIP held the first lecture of the Arab Certified Intellectual Property Practitioner Program of Paper One “Introduction to Intellectual Property.” The first course had a total of 17 students in the class including lawyers, patent and trademark registrants, and professionals of the IP field.

Through a combination of teaching and training tools, including real work experience, the ACIPP Program is designed to give participants a solid base and real understanding of IP principles, tools and their applications, focusing on the four main disciplines, with an option of advanced learning of other selected IP subjects, including practical legal and business knowledge. The program offers four papers, each pertains to a discipline of Intellectual Property:

Paper One: Introduction to Intellectual Property (IP)Paper Two: Trademarks and Unfair CompetitionPaper Three: Copyright and Related RightsPaper Four: Patents of Inventions and Trade Secrets

An ACIPP Guide was prepared and distributed with a description of the entire program, course outlines, and an extensive list of references. This was distributed to all students in the program and ACIPP Board Members.

The main reference for all four papers of the program is the WIPO Intellectual Property Handbook: Policy, Law and Use. The guide was translated into Arabic since the program is taught in Arabic.

Upon completion of each taught course, a Certificate of Attendance is issued to each participant. Upon completion of Papers 2, 3, and 4, participants who successfully pass the final exam will be granted one of the ACIPP Certificates:

ACTIVITIES AND GOALS For 2006

In 2006 ASIP will focus on extending activities to various parts of the Arab region, and developing activities on aspects of IP, such as the Arts, pharmaceuticals, and licensing, that are not usually discussed.

ASIP is currently developing and organizing programs and events for 2006. The ASIP plans to co-sponsor the Second Annual Geographical Indications Symposium in Jordan. Furthermore, ASIP plans to expand the ACIPP program to other countries in the Arab region in several phases. The first phase will begin in mid 2006.

ASIP will also hold the second annual Moot Court Competition in 2006 at University of Jordan. Law students will participate in a mock tribunal arguing an IP issue in front of a judge. Students will present their final arguments to an audience of their peers and members of the College of Law faculty. Winners of the competition will be awarded training contracts with Talal Abu-Ghazaleh International.

In 2006 ASIP will continue to possibly develop training programs in regard to IP for example, arbitration of IP, licensing, trademarks, and patents of inventions. It wishes to expand them to other parts of the Arab region, including Kuwait, the United Arab Emirates, and Saudi Arabia.

Additionally, ASIP will host the annual Board of Directors and General Assembly meetings in Amman in September to further develop the Society. ASIP hopes to present a re-formulated strategic plan to the Board of Directors to advance the Society’s goals and objectives.

ASIP training programs and activities will develop the Society, as well as promote its objectives and action plan for 2006. The Society will hopefully expand its work and work towards higher ambitions in the future. Through its work ASIP will contribute globally to the field of intellectual property by developing the field within its region.

HOW TO PROMOTE ASIP ACTIVITIES

ASIP will promote its services using many tools, including print media, the Internet, and cooperation with various businesses, organizations, and universities all over the Arab region. The proposed plan for promoting ASIP’s activities and programs, maintaining its progress, and increasing membership, comprises the following methods:

Highlighting the role of ASIP, its objectives, the purpose of its establishment, membership, and affiliation to businesses and organizations pertaining to the IP field.

Advertising ASIP’s events, activities and progress regularly and promptly to those interested in topics pertinent to IP, as well as organizations and businesses working on such issues.

Promoting ASIP through a distribution of a monthly bulletin and providing continuous updates on activities and progress via printed materials and word-of-mouth.

Continually drafting and publishing articles and scientific research as members or associates of ASIP jointly with the Society detailing Intellectual Property and its application.

Working together to create a network of contacts in universities and academic institutions, businesses, and organizations concerned with IP, so as to develop joint activities, such as seminars and educational programs.

Promoting and raising awareness of ASIP and its activities at the regional and international level through organizing and attending seminars, workshops, and awareness campaigns on IP matters and issues.

The Arab Certified Intellectual Property Practitioner (ACIPP) Program Guide

The Arab Certified Intellectual Property Practitioner (ACIPP) program is the only Intellectual Property certification program in the Arab World. The program guide contains information related to the ACIPP program curriculum consisting of four papers (Introduction, Trademarks and Unfair Competition, Copyrights and Related Rights, and Patents of Inventions and Trade Secrets), examinations, study materials, and registration information.

ASIP provides a complimentary monthly bulletin to all its members in Arab countries. It contains regional and international developments related to IP protection, specialized articles and research papers on IP topics written by ASIP members and experts, and ASIP activities and accomplishments throughout the month.

Abu-Ghazaleh Intellectual Property Dictionary

The dictionary consists of 6000 terms and expressions covering all term of IP (trademarks, patents, copyright, industrial designs, and models), in addition to the terms of IT, basic communications and E-Commerce, world trading system, globalization, and international treaties and agreements. The dictionary is a result of an integrated team of professionals and expert’s efforts supervised and directed by ASIP’s chairman Mr. Talal Abu-Ghazaleh. It is a new addition to improve the performance level in providing services related to the IP field in the Arab world.

Training Courses Guide

The training courses guide contains all training courses’ materials and programs related to IP Protection. ASIP conducts these courses and programs through continued courses all year amending the courses and guide annually according to its Training and Continued Education plan.

statements based on our audit.

We have conducted our audit in accordance with the International Standards on

ASIP was established on February 23, 1987 to enhance and develop the protection of IP in the Arab World, and in order to organize, activate and promote this profession in the best way that serves practicing members all over the Arab World. ASIP was registered as an Arab regional institution in Munich - Bavaria, Federal Republic of Germany.

2. Major Accounting Policies: a. The Society adopts the cash basis in recording its revenues, and the

accrual basis in accounting for its expenses. b. The Society adopts the straight-line method for the depreciation of its

ACTION PLAN FOR 2006 The Arab Society for Intellectual Property (ASIP) always works towards the advancement of its mission and objectives, which aim at the promotion of Intellectual Property (IP) within the Arab region and internationally. The following is a strategy set forth by ASIP for 2006 that follows its objectives and ambitions in developing the Society and its role in the IP field. ASIP will focus on promoting three main goals:

Goal 1: Spreading awareness of the IP field in the Arab region through activities and programs. Goal 2: Raising the scientific position of the IP profession by equipping IP professionals and practitioners with knowledge and training them according to international developments. Goal 3: Developing ASIP through marketing and awareness activities regionally and globally.

Expanding Membership and Member Involvement

Increasing ASIP’s membership pool and updates all corresponding

communication lists through: Creating a profile of all ASIP members Extensive communication with current members regarding ASIP’s activities Studying means of attracting new members of foreign expertise in IP issues

residing in the Middle East. Working towards creating an appropriate environment for member’s

cooperation in all activities. Implementing this goal encourages ASIP’s daily activities to focus on the implementation of policies concerning promotion, communication, modernization, and strengthening Arab-international relations concerning IP.

Development and Implementation of ASIP’s Strategic Goals through

Educational and Training Programs

Monitoring the activities of and implement strategies through ASIP’s working committees. It also establishes specified goals and strategies for each working committee on an annual basis.

Building capacities through continuous training courses and teaching sessions to Arab IP professionals and students. Moreover, ASIP will expand these programs to several countries in the Arab region.

Developing the Arab Certified Intellectual Property Practitioner program (ACIPP) through changes in its curriculum, outside training, and references. Furthermore, ASIP will expand the ACIPP program to other universities and educational institutions in the Arab region.

Establishing a library specializing in Intellectual Property sources under the management of ASIP that serves members, IP students, and the general public.

ASIP’s Website as an Information and Marketing Tool

Continually developing ASIP’s website and updating it with information on scientific and cultural developments indicating ASIP’s activities and achievements, as well as international changes in the field.

o Presenting information on the website in a manner and that appeals to site visitors. o Focusing website information on continuous training course information, programs, and IP events. o Inviting IP experts through the website to submit research papers, articles, and other publications on topics of IP and to deliver lectures in training courses, seminars, and meetings conducted by ASIP. o Publishing abstracts of the Chairman’s lectures, speeches, and scientific interviews broadcasted on TV channels on the website, and highlighting their importance. o Disseminating information on the membership, and collects information from members. o Providing site visitors with educational and informational sources on all topics pertinent to IP, such as related legal sources, scientific research, regional and international developments in the field, and links to other organizations concerned with IP.

Raising Public Awareness on Intellectual Property By:

Holding seminars, conferences, and discussion forums that tackle

intellectual property issues. Continuing to organize monthly round table discussions during

which experts and practitioners can exchange views, opinions, and experiences on IP issues.

Holding discussion forums that tackle IP issues whether through seminars, interviews, or publications.

Studying current events and topics related to the protection of Intellectual Property Rights (IPRs) and legislations in an effort to improve and harmonize international legislations with new global developments.

Supporting and Enforcing Intellectual Property Rights

Drafting new intellectual property laws to keep pace with international

developments. Promoting the concept of intellectual property rights protection in the Arab

world through awareness activities encouraging the issuance of IP laws and their development.

Intellectual Property Outreach to Intellectual Property Organizations and

Corporations

Holding regular meetings with regional patent and trademark offices, as well as other Arab IP organizations in the region to encourage continued collaboration with ASIP in achieving mutual goals.

Developing and Distributing Publications under ASIP’s Name

Promoting and elaborating on ASIP’s publications, books, and bulletins to reflect objectives, strategies, and activities. All guides, brochures, and other publications serve as an essential tool for promoting and explaining the role and achievements of ASIP. These publications should cover all aspects of IP and be disseminated to all ASIP members, professionals and practitioners in the field, and parties interested in Intellectual Property.

Moot Court Competition

Further developing the annual Moot Court Competition by:

o Expanding the competition to other universities by contacting

universities and faculty members to encourage participation o Promoting it to lawyers, IP professionals, businesses, and the general

public.

Arab Center for Mediation and Arbitration of Intellectual Property

Creating and building on existing networks with attorneys and IP professionals of the Arab region to develop the Arab Center for Mediation and Arbitration of Intellectual Property.

Promoting Intellectual Property and Business Strategy

Fostering better working knowledge of firms, institutions, universities, and

non-government organizations on proper business strategies involved in intellectual property. Promoting business strategy in IP to students and professionals through programs and workshops.

Associate Membership

• Member should be a citizen of an Arab country.• Member should be a holder of a university degree acceptable to the Board from one of its specializations (ex. Commerce, law, engineering, science, or business).• Member should have work experience not less than five years. IF the applicant proves to have an appropriate distinctive background acceptable to the Board of Directors, then the Board will consider reducing the period of acceptable experience in the field of intellectual property to two years.• Applicant should have membership in one of the international professional societies recognized by ASIP’s Board of Directors, or hold a university degree acceptable to the Board in one of the above specialization, and be an Arab citizen. Non-Arabs should have work experience of not less than 2 years in an Arab country within the five years prior to their submission of the application for ASIP membership.• Or the applicant is a holder of a Ph.D. in one of the above specializations which are recognized by the Board, and have lectured in these specializations for a period of not less than five years as an associate professor at minimum.

Membership Fees

The annual membership fee of $50 shall be paid at the beginning of each calendar year.

ASIP encourages Arab creativity and innovation in an economically developing world. It aims to develop the IP system in the Arab World by using appropriate means to increase awareness and knowledge in this domain, and clarify its influential role on globalization.

• Programs organized by ASIP and co-sponsors share information on all aspects of IP attracting participants from the Arab region and globally.

Past programs include:• The First Geographical Indications Symposium held in Abu Dhabi (April 2005).• “Contemporary Issues in Trademarks” Seminar co-sponsored by Jordan University (February 2005).

EDUCATIONAL DEVELOPMENT

Helping Professionals Stay Pace with International Developments

ASIP promotes continuing professional development and associations through conferences and programs. ASIP prepares training programs to students who work in the public and private sectors, universities, and scientific institutes. These programs, prepared by IP experts, place participants in the proper atmosphere to improve their professional efficiency.

• The Arab Certified Intellectual Property Practitioner (ACIPP) program was created under the belief that intellectual property protection depends on the efforts of experts working to provide constancy services, trademarks, and patents registration services and legal services, such as litigation and arbitration, in addition to managing legal rights related to intellectual property, and due to the importance of the role of registrar’s of trademarks, engineers, scientists, and lawyers. This qualification program, designed to encourage the development of the IP profession and a distinctive Arab intellectual property system, is the one of many initiatives undertaken by ASIP. The four papers covered in the program and on examinations include:

-Paper 1: Introduction to Intellectual Property-Paper 2: Trademarks and Unfair Competition-Paper 3: Copyrights and Related Rights-Paper 4: Patents of Inventions and Trade Secrets

• ASIP’s working committees organize and present programs on topics of IP through conferences, seminars, and symposiums.

• ASIP hosts a monthly round-table on current topics of Intellectual Property.

ASIP works to enforce and develop IP laws on an international scale. ASIP is on the international front with several organizations. It has a consultative status with the United Nations Economic and Social Council (ECOSOC) and an observer status with the World Intellectual Property Organization (WIPO). ASIP holds membership in the Intellectual Property Constituency (IPC) of the Internet Corporation for Assigned Names and Numbers (ICANN). Members are able to participate in international IP activities by networking with professionals worldwide. ASIP events and programs are often co-sponsored with global organizations.
