1. STRATEGIC OVERVIEW

1.1 Chairperson’s Statement of Policy and Commitment

Throughout 2004 South Africans from all walks of life celebrated ten years of democracy in discussion forums, art exhibits and musical events. Through various activities we acknowledged the continued affirmation of the basic tenets of our collective existence and welcomed ten more decades of mutual development.

One of the most significant events of 2004 was the establishment of the Commission for the Promotion and Protection of the rights of Cultural, Religious and Linguistic Communities (CRLC), the last Chapter 9 institution to be promulgated. As a body, the Chapter 9 state institutions, including the Public Protector, The South African human Rights Commission, The Commission for Gender Equality, The Auditor-General and the Independent Electoral Commission, are responsible for strengthening democracy in South Africa. As a Commission, we are specifically expected to ensure that the rights of cultural, religious and linguistic communities are respected through the promotion of peace, friendship, humanity and tolerance on the basis of equality, non-discrimination and free association. This is accomplished through cooperation with local communities and community councils.

South Africa has endeavoured to improve social conditions and eliminate inequality between cultural groups, genders, classes and races, which are a result of historical and political factors. While the appropriate ministries address the basic needs of South Africans such as housing, water and education, the vision of the CRLC is “To contribute meaningfully and constructively to social transformation and nation building for the attainment of a truly united South African nation.” This means that addressing the systemic erosion of African cultural practices and the marginalization of certain linguistic and religious communities is our specific charge. Previously disempowered cultures needed institutional support but have not received it. Racial discrimination, cultural intolerance and lack of respect based on stereotypes and prejudices have characterised interactions between citizens throughout South Africa. Poverty, or a lesser standard of living, often characterizes vulnerable groups, which contributes to the perpetuation of certain stereotypes. Western culture, which brings with it both positive and negative aspects, has been a specific threat to

African culture. Traditional social roles, such as held by indigenous leaders and parents, have been undermined, leaving no clear direction.

Our main priority therefore was to hear from fellow South Africans how best to ensure the protection and promotion of the respective communities. Regional assemblies of key representatives were held throughout the provinces which culminated in the first National Consultative Conference.

This Consultative Conference was an opportunity to hear from communities who to some extent had felt voiceless. Three main challenges were identified, namely, how to redefine ourselves first as individuals, second as communities and third as a nation. This includes how we should look at each other; and secondly, that we need to invent new ways of describing ourselves and each other. This process must occur in a context of building unity in diversity.

The charge of the Commission is very clear.

Religion is a key aspect of life in South Africa, an agent for nation-building and a source of moral authority. However, more dialogue is needed both within and between the various religious bodies and institutions. More acknowledgment must be given by the state institutions, especially the media, on the role and content of religion in daily life. And faith-based nation building must address the contemporary as well as the spiritual needs of their adherents. To ensure that all this occurs in a manner consistent with the other obligations of the state, the CRLC must ensure a more active role for the other organs of state, while maintaining the voice of the community.

Language is a medium by which to convey thoughts and aspirations as well as a tool by which to interact with others. It therefore requires a clear national policy. This policy should assist in promoting all the official languages to restore their dignity and encourage daily usage within the community, educational institutions and government. This requires dedicated resources, both intellectual and financial, and the cooperation of all relevant organisations.

Culture in many ways is the most encompassing and the most fluid. African culture in all its aspects is specifically in both a reciprocal and an oppressed relationship with Western culture. And South Africa’s first decade of democracy insufficiently addressed the creation of a culture of tolerance, a balance between traditional and contemporary culture, rural and urban experiences, individual and collective rights and obligations. South Africa’s unique history requires a re-evaluation of

traditional leadership and indigenous culture. And this also requires dedicated resources, both intellectual and financial.

In order for the national ministries to succeed in their charge, we must succeed in ours. Successful nation building can only occur with a people who are strong in their beliefs and can translate their beliefs into effective day to day policies and practices.

Over the next decade the CRL Commission has a very clear mandate from the people of South Africa through the mechanism of the first National Consultative Conference.

There will be structured consultation through the community councils, task teams and other Commission processes

There will be the systemic involvement of all marginalized voices

There will be basic and applied research There will be policy development There will be partnerships with key institutions There will be effective conflict mediation and resolution There will be a process of feedback on a regular basis

This then is how we plan to contribute to social transformation and nation building, by listening to our fellow South Africans, developing appropriate policies and ensuring that they are implemented through the appropriate institutions. We recognise that one can belong to a cultural community and be a loyal citizen of the state. We recognise that multiple identities can be complementary and that people should not have to choose or rank identities. It is therefore our task to ensure that these identities can exist side by side, without conflict or competition. It will mean mediating between cultural practices as culture is not static and different communities will need to understand how practices can or can not function in today’s environment.

We recognise that a truly united South African nation is possible when we abide by the dictates of the Constitution. The CRL Commission will be instrumental over the next ten years in contributing to a democracy that is culturally relevant for both individuals and groups. The Strategic task to make the intangible tangible, visible to promote and protect the rights, religiously and linguistically impoverished communities, is a daunting task. It requires a clear understanding of the environments of cultural, religious and linguistic communities of South Africa including those communities that may not be listed in the Constitution of the Republic of South Africa such as Swahili communities. It takes extensive consultation and fact finding to understanding the rights of these communities. It also demands in-depth participative research that facilitates not only information gathering but dissemination of knowledge that in turn promotes awareness and national education on the cultural, religious and linguistic sectors of the nation. Out of the information gathered, the Commission will formulate policies to guide and establish a system of promoting and protecting the rights of all communities.

The Commission held the first of the mandatory activities, a National Consultative Conference in December 2004. This activity was fully participatory and it produced the well of information, ideas, needs and aspirations of the various communities. Thus it achieved the main objective to provide an opportunity to the people to express concerns and ideas on how to best promote and protects their cultural, religious and linguistic rights. The NCC also provided the Commission with a list of organisations and individuals with whom the Commission must interact and consult on matters of its mandate.

This strategic plan attempts to implement the needs of various communities as expressed at the NCC to promote and protect their right while creating respect, tolerance and unity in diversity.

1.3 Legislative Mandate

The Mandate of the Commission is provided for in section 185 (1) of the Constitution and section 4 of the CRL Commission Act which set out the CRL Commission’s primary objects as follows:

Functions of the Commission

The primary objects of the Commission for the Promotion and Protection of the Rights of Cultural, Religious and Linguistic Communities are to-

a) Promote respect for the rights of cultural, religious and linguistic communities;

b) Promote and develop peace, friendship, humanity, tolerance and national unity among cultural, religious and linguistic communities, on the basis of equality, non-discrimination and free association;

c) Recommend the establishment or recognition, in accordance with national legislation, of a cultural or other council or councils for a community or communities in South Africa;

d) Foster mutual respect among cultural, religious and linguistic communities; and

(e) Promote the right of communities to develop their historically diminished heritage.

1.4 Service Delivery Environment

The cultural, religious and linguistic landscape of the South African Nation is communities diversified. While is characteristic of richness, it poses a number of challenges. One major challenge is the fact that many communities are victims of legal discrimination to a point of almost extinction. As a result myths and stereotypes developed that some cultural, religious or linguistic communities are more equal than others. Women were driven to the back stage in the name of African culture that they are minors. The struggle for gender equality rather than complimentary relationships between women and men deprived children and youth of their prime opportunity for socialisation and nurturing into their cultures, religions and languages. The various communities have high expectations. In an attempt to fulfil these expectations there is bound to be a high competition for the limited resources of the Commission.

1.5 Organisational Environment

The Commission for the Promotion and Protection of the Rights of Cultural, Religious and Linguistic communities is new institution and the youngest of the institutions established to strengthen democracy in South Africa. It starts on a clean slate and at the end of the first decade of democracy. Although lags behind all other institutions, it has the advantage that it can learn from others that have had a longer period of existence and experience. It has the opportunity to set up both the environmental and human resource infrastructure on the basis of expressed needs of the various communities. The major test of its contribution to a stronger democracy is the effectiveness of this strategic plan which will be influenced by the efficient distribution and use of resources.

1.6 Vision

The Commission adopted the Preamble to the enabling legislation, Act No. 19 of 2002, as its vision to:

1.7 Mission

In order to achieve its Vision, the Commission will:

Promote and develop peace, friendship, humanity, tolerance and national unity among cultural, religious and linguistic communities. To achieve this mission, the CRL Commission shall:

Monitor compliance by the state and civil Society with its mandate.

Be the channel of communication between the state and communities.

Monitor compliance by the state and civil Society with its mandate.

Mediate in inter-community conflict situations and facilitate harmonious co-existence.

Facilitate the development of programmes that foster sensitivity, respect and understanding for cultural, religious and linguistic diversity.

Lobby government departments and legislative authorities on issues concerning the rights of cultural, religious and linguistic communities.

1.8 Objectives

The objectives of the Commission are:

(i) Improve the quality of human and financial management by ensuring that appropriate policies and procedures are developed and implemented

(ii) Promote respect for the rights of cultural, religious and linguistic communities and develop peace, friendship, humanity, tolerance and national unity on the basis of equality, non-discrimination and free association

1.9 Values

In line with section 195 (1) of the Constitution (Chapter 10), section 15 of the CRL Commission Act and provisions of the King 2 Report, the Commission will be governed by the democratic Values and Principles enshrined in the Constitution including the following principles:
