ORDINANCE NO. 83

AN ORDINANCE OF NORTH MA"E1M TOWNSHIP, SCHUYLKILL COUNTY, COMMONWEALTH OF PENNSYLVANIA, AMENDING THE "NORTH MANHEIM TOWNSHIP SUBDIVISION REGULATIONS" OF 1979, BY DELETING EXISTING SECTION 6.23 AND CREATING NEW SECTION 6.23 AND SUBSECTION 6.231, REQUIRING THE PROVISION OF VERTICAL CONCRETE CURBS ON ALL NEW ROADS PROPOSED AS PART OF A SUBDIVISION OR LANE DEVELOPMENT AND ALONG ALL EXISTING ROADS IN WHICH A SUBDIVISION OR LAND DEVELOPMENT ADJOINS, INCLUDING REFERENCE TO CONSTRUCTION STANDARDS, AND BY DZLETING REFERENCE TO CURBS AND GUTTERS AND TO ADD REFERENCE TO CONSTRUCTION STANDARDS IN SECTION 6.242.

BE IT ORDAINED AND ENACTED by the Board of Supervisors

of North Manheim Township, Schuylkill County, Pennsylvania, and

it is hereby ordained and enacted by authority of the same as

follows:

SECTION 1: The North Manheim Township Subdivision

Regulations of 1979, as amended, shall be revised, and the same

is hereby amended to delete existing Section 6.23 and to create

new Section 6.23 and Subsection 6.231 to read as follows:

1. Section 6.23 to read: "Curbs: Curbs shall be

required on all roads proposed as part of a

subdivision and/or land development within the

Township as well as when development takes place

on existing Township roads adjoining the proposed

subdivision or land development.”

2. Subsection 6.231 to read: “Only concrete vertical

curbs will be permitted in the Township. Plain

Concrete Curb shall be constructed in accord with

PennDOT Publication 408, latest edition, and

PennDOT Pubiication 12.“

And to delete reference to ‘curbs and gutters“ and to reference

construction standards in Subsection 6.242 to read:

1. Subsection 6.242 to read: “All sidewalks shall be

installed in accordance with PennDOT Publication

408, latest edition, and PennDOT Publication 7 2 . ”

SECTION 2. All other provisions and regulations as

contained in the North Manheim Township Subdivision Regulations

of 1 9 7 9 , as amended, which have not been revised or amended by

this ordinance, shall remain in full force and effect.

SECTION 3. All ordinances and parts of ordinances

inconsistent with this ordinance and hereby repealed, insofar,

but only insofar, as the same are inconsistent herewith.

SECTION 4 . The provisions of this ordinance are

severable, and if any provision or part thereof shall be held

invalid, unconstitutional or inapplicable to any person or

circumstances such invalidity, unconstitutionality OL

inapplicability shall not effect or impair the remaining

provisions, or parts thereof of this ordinance.

SECTION 5 . This ordinance shall take effect

immediately upon its passage.
