THIS AGREEMENT MADE THIS 6th DAY OF JUNE, 2011.

BETWEEN

McKenzie Towne Care Centre (hereinafter called the "Employer")

PARTY OF THE FIRST PART

- and-

Canadian Union of Public Employees, Local 8 (hereinafter called the "Union") PARTY OF THE SECOND PART

ARTICLE 1 - PREAMBLE

1.01 Recognizing and agreeing that the primary purpose of the employer is to provide the community with efficient, competent, continuing care services, it is the intent of the parties to:

a) ensure the provision of the best possible services and care; b) protect the interest of residents, employees and the community, and encourage efficiency of

operations;

c) maintain harmonious relations between Employer and the Union; d) recognize the mutual value of jOint discussions and negotiations in all matters of mutual

concern to the parties.

1.02 It is the desire of the parties to proVide compassionate care for the residents to meet their physical and emotional needs in a safe, comfortable environment, treating residents and their families with respect and dignity.

1.03 It is desirable that methods of bargaining and certain matters relating to the working conditions of the employees be drawn into a Collective Agreement between the parties.

ARTICLE2-iTERM OF AGREEMENT

2.01 Duration

This Agreement shall remain in effect and binding from May 1, 2010 to and including October 31,2012, and shall continue from year to year thereafter unless either party gives notice in writing to the other party, not less than sixty (60) days and not more than one hundred and twenty (120) days before the Agreement is specified to terminate, that the party desires its termination or amendment.

2.02 Notice of Changes

Either party desiring to propose changes to this Agreement, shall, within the period of neither less than sixty (60) nor more than one hundred and twenty (120) days prior to the termination date, give notice in writing to the other party. The negotiating committees for both parties shall exchange proposals at the commencement of negotiations.

2.03 During the period of negotiations resulting from any of the provisions above, this Agreement shall remain in full force and effect until a new collective agreement has been executed.

2.04 During the term of this Collective Agreement the parties agree that there will be no strike or lockout, and there shall be no strike or lockout contrary to the provisions of the Alberta Labour Relations Code.

ARTICLE 3 - DEFINITIONS

3.01 Definitions

The word "employee" or "employees" as used in this Agreement shall mean the employees referred to in this Agreement, who are within the scope of the bargaining unit for whom the Union has attained the status of bargaining agent recognized pursuant to Certificate Numbers 98-2010 and 97-2010 issued by the Alberta Labour Relations Board.

3.02 A "regular employee" is one who works on a full-time or part-time scheduled basis.

3.03 A "permanent full-time employee" shall mean a person covered by this Agreement who is scheduled to and regularly and recurrently works the full work period of seventy-five (75) hours bi-weekly, exclusive of overtime.

For Licensed Practical Nurses, a "permanent full-time employee" shall mean a person covered by this Agreement who is scheduled to and regularly and recurrently works the full work period of (seventy seven and one half (77.5) hours bi-weekly, exclusive of overtime.

3.04 A "permanent part-time employee" is one who is scheduled to and regularly works less than the full prescribed bi-weekly hours of work as outlined in Article 3.03

3.05 A "casual employee" is one who is called in to work occasionally, usually on a "call" basis for relief purposes, but who does not work a regular schedule or does so only for a specified period, but not for the purpose of depriving another employee of full-time employment. The terms of this Agreement shall not apply to a casual employee, unless provided in Article 31 of this Collective Agreement. However, a record will be kept of the hours worked by a casual employee and in the event that such person is accepted for full­time or part-time employment the casual employee shall be credited with seniority equivalent to the hours worked within the two (2) years prior to acceptance for full-time or part-time employment. Further, the Employer agrees to pay to casual employees not less than the starting rate at hire and subsequent seniority hours increments as specified in Schedule "A," and agrees to deduct Union dues from casual employees as requested by the Union.

3.06 A "temporary employee" is a person who is employed in a temporary full-time or part­time position for a specific time period or until completion of a particular project, for a maximum duration of one year. The terms of this Agreement, including Schedule 'A' -Wages and Schedule 'B' - Benefits, will apply to the temporary employee for the duration of the specified time period or completion of the project.

3.07 The terms "regular pay" and "straight pay" when used in this Agreement shall mean the amounts indicated in the Wage Classifications contained in Schedule "N.

The words "bi-weekly period" shall mean the two calendar weeks constituting a pay period.

The term "seniority" is the accumulated lifetime hours worked with the Employer since the last date of hire, and in accordance with the accumulation proviSions at Articles 1 0.01 and 10.04.

The term "length of service" is the time interval since the last date of hire with the Employer.

In the event of any legislation now in force, or hereinafter enacted, invalidating the application of any section or article of this Agreement, such section or article shall be amended or deleted as the case may be, and the remainder of this Agreement shall remain in full force and effect.

Whenever the singular, masculine or feminine is used in this Agreement, it shall be considered as if the plural, masculine or feminine has been used where the context of the party or parties hereto so require.

ARTICLE 4 - RECOGNITION

4.01 Bargaining Unit

The Employer recognizes the Canadian Union of Public Employees, Local 8 as the sole and exclusive collective bargaining agent at McKenzie Towne Care Centre in Calgary, Alberta.

4.02 a) For the Continuing Care Centre mentioned in paragraph 4.01 above, the bargaining unit represented by the Union shall be: employees of the Care Centre engaged in the occupations of Nursing Aide, Therapy Aide, Licensed Practical Nurse, Hospitality Aide, Cook, Head Cook and Unit Clerk and any other occupational classifications that may be brought into the bargaining unit by future mutual agreement between the Parties.

b) This agreement shall apply to full time and part time employees unless otherwise stated and shall not apply to casual employees unless specified.

4.03 No Other Agreements

No employees shall be required or permitted to make a written or verbal agreement with the Employer or its representatives, which may conflict with the terms of this Collective Agreement.

4.04 Correspondence

All correspondence between the Employer and the Union arising out of this agreement or incidental thereto shall pass between the Executive Director or Director of Care Services and the Secretary of the Union with a copy to the staff representative of the Union.

ARTICLE 5 - BULLETIN BOARDS

5.01 The Employer shall provide a bulletin board, which shall be placed so that all employees shall have access to it and upon which the Union shall have the right to post notices of meetings, education conferences, and Union conventions.

No other notices will be posted without the prior written or initialed approval of the Employer.

ARTICLE 6 - MANAGEMENT RIGHTS

6.01 The Union acknowledges that it is the exclusive function of the Employer to exercise the regular and customary functions of management, and to;

a) conduct its business in every respect in accordance with its commitments and responsibilities in order to comply with all governmental requirements;

b) direct the working force and to create new classifications, work units, schedules, and to make rules and regulations, maintain discipline, effiCiency and the number of employees required;

c) hire, promote, transfer, layoff, recall and to demote discipline, suspend or discharge for just cause.

These rights shall not be exercised in a manner inconsistent with this Agreement.

ARTICLE 7 - DUES DEDUCTION AND UNION BUSINESS

7.01 Union Membership

All employees shall, as a condition of continued employment, become and remain members of the Union, in good standing, within thirty (30) days of employment. All employees whose work for the Employer is governed by this Collective Agreement are required to complete and sign a union membership application form and a dues authorization form, in the manner and on the form(s) prescribed by and in accordance with the Constitution and By-Laws of the Union. Membership application forms and dues authorization forms are supplied to the Employer by the Union.

7.02 Check-Off Payments

The Employer shall deduct from every employee any dues, initiation fees, or assessments levied in accordance with the Constitution and By-Laws of the Union.

7.03 Deductions

Deductions shall be made from each bi-weekly payroll effective the first full pay after receipt of notice of ratification of this Agreement, and shall be forwarded to the CUPE National Secretary-Treasurer and to the Local 8 Secretary-Treasurer not later than the fifteenth (15th) day of the month following the month in which the deductions are made and accompanied by a list of the names of the employees from whose wages the deductions have been made and in what amount. The Union will advise the Employer by letter of the amount of the dues, initiation fees or other assessments one month in advance of the end of the pay period in which the deductions are to be made. The Employer will indicate union dues deductions on the individual employee's annual T 4 issued for income tax purposes.

7.04 The Union will save the Employer harmless from any claims that may arise either from any deduction from wages at the request of the Union in accordance with Article 7.01,7.02 and 7.03.

7.05 The Employer agrees that the Union Representative shall be given the opportunity during the orientation period of newly hired employees to make a presentation of up to 30 minutes during the paid orientation of the Employee, for the purpose of advising the employee of the employee's rights and obligations under this Agreement.

7.06 Union Bargaining Committee

A Union Bargaining Committee shall be elected and consist of two (2) members of the Bargaining Unit, plus an alternate at the Care Centre, and who are members of the Union, and who have achieved at least six (6) months length of service. The Union will advise the Employer of the Union nominees to the Committee. The Union will advise the Employer with the name of its officer and members of the Union Bargaining Committee. The list will be revised as changes occur.

7.07 Representative of Canadian Union of Public Employees

The Union shall have the right at any time to have the assistance of representatives of the Canadian Union of Public Employees when dealing or negotiating with the Employer. Such-representative(s) shall have access to the Employer's premises in order to investigate and assist in the settlement of a grievance. The Employer agrees that the chief steward of the local will be recognized in the same manner as a CU PE Representative. The CU PE Representative will give reasonable notice to the Executive Director or deSignate prior to attending at the Continuing Care Centre.

7.08 No individual employee or group of employees shall undertake to represent the Union at meetings with the Employer without proper authorization of the Union

7.09 Time Off for Meeting

The Employer will continue normal straight-time wages for no more than two (2) employee members of the Bargaining Committee from the Continuing Care Centre for all days in attendance at negotiations of this Agreement or its successor with the Employer, including all mediation proceedings but excluding any arbitration proceedings, up to a maximum of five (5) working shifts per employee member. Where employee attendance at collective bargaining exceeds five (5) working shifts, the Employer shall continue to pay the employees directly, and the Union shall reimburse the Employer for the costs of wages and benefits in excess of those five (5) shifts.

7.10 Employee information

It shall be the responsibility of the employee to keep the Employer informed of the employee's current address, in case it is necessary to notify any employee of any matter under this Agreement. Any Employer notice to an employee may be given personally or by prepaid certified post addressed to the employee at the employee's last address shown on the payrolls of the Employer. Such notice shall be deemed to have been given when mailed.

7.11 Upon a written request of at least seven (7) ~alendar days from the CUPE National Staff Representative, the Employer will provide a list of the names of the employees, with addresses and phone numbers semi-annually.

ARTICLE 8 - NO DISCRIMINATION OR HARASSMENT

8.01 There shall be no discrimination, restriction or coercion exercised on the part of the Employer or the Union by reason of race, creed, color, marital status, sex, sexual orientation, nationality, ancestry, place of origin, residence, age, political affiliation as provided by the Alberta Human Rights Code, or by reason of membership or non­membership or participation or non-participation in lawful activities on behalf of the Union.

Article 8.01 does not apply with respect to a refusal, limitation, specification or preference based on bona-fide occupational requirements.

8.02 The Parties are jOintly committed to a workplace free from discrimination in the form of harassment, including sexual harassment, in accordance with the Alberta Human Rights Code. Any harassment complaints and investigations are to be treated in a confidential manner by the Employer and the Union. Where, as a result of investigation into a complaint there is a finding of harassment, the offender is subject to discipline, up to and including forfeiture of seniority and discharge from employment, without recourse to the grievance procedure.

ARTICLE 9 - SENIORITY

9.01 Seniority Defined

Seniority is defined as the cumulative lifetime hours worked for the Employer within the bargaining unit since the date oflast hire (in accordance with Article 9.04), and shall be used in determining preference or priority for promotions, transfers, demotions, layoffs, permanent reduction of the workforce and recall. Seniority shall operate on a bargaining­unit-wide basis within the facility.

9.02 Unless otherwise specified in this Agreement, all part time employees shall receive benefits under the Agreement on a basis proportionate to full time employees. The

proportion shall be governed by the time worked by a part time employee in any given period compared to the time worked by a full time employee during the same period.

9.03 Seniority List

The Employer shall maintain a seniority list showing the date upon which each employee's service commenced, the lifetime accumulated seniority hours worked for this Employer, and showing each employee's seniority accrual as set out in Article 10.04. An up-to-date seniority list shall be posted twice annually on employee bulletin boards, each January 15th and July 15th, and a copy shall be sent to the Union. An employee shall notify the Employer of any error in the seniority list within ten (10) working days of the posting of such list.

9.04 Seniority Accrual

Employees will accumulate seniority on the basis of one (1) seniority hour for each hour worked and in accordance with those conditions outlined in subsections (a) to (h) below. Seniority takes effect when an employee has completed the probationary period and is retroactive to the date of last hiring. Casual employees will not accrue seniority, except as specified in Article 3.05.

Employees will accumulate seniority during:

a) periods of sick leave paid by the Employer b) leaves of absence with pay c) bereavement leave d) employer paid JuryIWitness duty e) paid vacations f) when in receipt of Workers' Compensation as a result of injury or illness incurred while

in the employ of the Employer g) while on approved Union leave of absence h) while on pregnancy, maternity and adoption leave

9.05 Transfer to Full Time Employment

All seniority, vacation and other credits obtained under this Agreement shall be retained and transferred with the employee when the employee is reclassified from full time employment to part time employment and from part time employment to full time employment, between positions within the bargaining unit under the jurisdiction of this Collective Agreement.

9.06 Loss of Seniority

An employee shall not lose accrued seniority if the employee is absent from work because of sickness, temporary layoff subject to recall, or leave of absence if approved by the Employer.

An employee shall lose seniority and shall be deemed terminated in the event of in the event of:

a) discharge for just cause without reinstatement b) resignation c) absence from work in excess of three (3) working days without sufficient cause or

without notifying the Employer, unless reasonable proof is provided d) failure to return to work within three (3) calendar days follOwing a layoff and after

being notified by certified mail to do so, unless through sickness or other just cause. It shall be the responsibility of the employee to keep the Employer informed of the employee's current address. An employee recalled for casual work or employment of short duration at a time when the employee is employed elsewhere shall not lose the employee's recall rights for refusal to return to work

e) expiry of recall rights following layoff for a period of twelve (12) months

ARTICLE 10- HOURS OF WORK AND WORK SCHEDULES

10.01 This Article defines the normal hours of work for a full-time employee and is not a guarantee of work per day or per week, or a guarantee of days of work per week.

10.02 Regular Daily Hours

For an employee working the standard scheduled shift, regular daily hours of work shall be seven and one-half (7.5) hours per day, exclusive of meal periods.

For an employee working the extended scheduled shift, regular daily hours of work shall be twelve (12.0) hours per day, exclusive of meal periods.

For an LPN, the standard scheduled shift, regular daily hours of work shall be seven and three quarter (7.75) hours per day, exclusive of meal periods.

10.03 Regular Bi-weekly Hours

For an employee working the standard scheduled shift, the work period shall consist of seventy-five (75.0) hours in a bi-weekly pay period.

For an employee working the extended scheduled shift, the work period shall consist of an average of seventy-two (72.0) hours in a bi-weekly pay period.

10.04 This article shall not preclude the implementation of modified daily or bi-weekly hours of work by mutual agreement between the Union and the Employer.

10.05 Meal Period

The meal period shall be a half hour to be scheduled by the Employer during the employee's shift whether day, evening or night.

10.06 Rest Breaks

All employees shall be permitted one (1) rest period offifteen (15) minutes during each period of four (4) hours of work to be scheduled by the Employer during the employee's shift whether day, evening or night. It is understood that hours of work shall be defined for the purposes of this clause to exclude a half hour meal period as described in Article 10.05.

10.07 Commitmentre Part-Time Employees

Part-time employees who are covered by this Agreement may be requested by the Employer to work more than regularly scheduled hours, for example for relief during vacation periods, at Christmas/New Year's season, and on alternate paid holidays, and to replace an employee who is absent for a scheduled shift, if requested at any of these times. It is understood that the Employer will recognize the integrity of the part-time position and will not make unreasonable requests for additional work by part-time employees.

10.08 Shift Schedules

The shift schedules will be posted on the notice board, written in either ink or typed at least two (2) weeks prior to the effective date of the schedule. When the Employer makes a change in the shift schedule for a full-time or part-time employee, other than those changes contemplated by Article 10.04 and 10.11 of this Agreement, the employee shall be informed and when the change is made with less than three (3) calendar days notice the employee shall be paid at time and one-half times (1.5X) their regular rate of pay for the first shift of the changed shift schedule.

10.09 Requests for specific days off shall be submitted in writing to the supervisor one (1) week prior to the schedule posting. Where possible, paid holidays will be scheduled in conjunction with the employee's regular scheduled rest days.

10.10 Requests to exchange shifts within posted work schedules must be submitted in writing and co-signed by the employee willing to exchange days off or workings shifts, and are subject to the discretion of the Executive Director. In any event it is understood that such change initiated by the employee and approved by the Employer shall not result in overtime compensation or payment, or any other claims on the Employer by an employee under the terms of this Agreement.

10.11 For an employee who works the standard shift of seven and one-half (7.5) hours, the employee may be required to work for more than five (5) consecutive days to provide for days off on a consecutive rotation basis offour (4) days offbi-weekly and shall be taken on such days as shall be specified by the Employer. The Employer shall arrange shift schedules such that an employee is not scheduled to work for more than six (6) consecutive days. The Employer may switch scheduled days off to accommodate an emergency situation provided the switch is mutually agreed with the employees affected and any such change will be submitted to the Union.

10.11 For an LPN who works the standard shift of seven and three-quarters (7.75) hours, the employee may be required to work for more than five (5) consecutive days to provide for days off on a consecutive rotation basis offour (4) days offbi-weekly and shall be taken on such days as shall be specified by the Employer. The Employer shall arrange shift schedules such that an employee is not scheduled to work for more than six (6) consecutive days. The Employer may switch scheduled days off to accommodate an emergency situation provided the switch is mutually agreed with the employees affected and any such change will be submitted to the Union.

For an employee who works the extended shift of twelve (12.0) hours, the employee may be required to work for more than three (3) consecutive days to provide for days off on a consecutive rotation basis of eight (8) days off bi-weekly and shall be taken on such days as shall be specified by the Employer. The Employer shall arrange shift scheduled such that an employee is not scheduled to work for more than four (4) consecutive days. The Employer may switch scheduled days off to accommodate an emergency situation provided the switch is mutually agreed with the employees affected and any such change will be submitted to the Union.

10.12 The shift commencing at or about midnight shall be considered the first shift of each working day.

A shift shall be entirely within the calendar day in which the majority of worked hours fall regardless of what calendar day any part of such shift was actually worked.

10.13 There shall be no split shifts.

10.14 For an employee who works the standard shift of seven and one-half (7.5) hours, there shall be at least two (2) successive periods of seven and one-half (7.5) hours off duty scheduled between work shifts or changeover of shifts. An employee who is required to work within such sixteen (16) hour period between scheduled work shifts or a change­over of shifts, shall receive overtime rates of pay for all hours worked within such sixteen (16) hour period. A shorter period of time between work shifts or changeover of shifts may be scheduled by mutual consent between the Employer, the Union and the employees.

For an LPN who works the standard shift of seven and three quarters (7.75) hours, there shall be at least two (2) successive periods of seven and three quarters (7.75) hours off duty scheduled between work shifts or change-over of shifts. An employee who is required to work within such fifteen and seven point seven five (15.75) hour period between scheduled work shifts or a change-over of shifts, shall receive overtime rates of pay for all hours worked within such fifteen and three quarters (15.75) hour period. A shorter period of time between work shifts or changeover of shifts may be scheduled by mutual consent between the Employer, the Union and the employees.

For an employee who works the extended shift of twelve (12) hours, there shall be at least one (1) period of twelve (12) hours off duty scheduled between work shifts, and there shall be at least two (2) successive periods of twelve (12) hours off duty for changeover of shifts. An employee who is required to work within such twelve (12) hour period between scheduled work shifts, or within twenty-four (24) hours for a change-over of shifts, shall receive overtime rates of pay for all hours worked within either the twelve (12) hour period or twenty-four (24) period, respectively. A shorter period of time between work shifts or changeover of shifts may be scheduled by mutual consent between the Employer, the Union and the employees.

10.15 The Employer shall arrange shifts so that Saturdays and Sundays (weekends off) are distributed as equally as possible.

10.16 Part-time employees who wish to be considered for work over and above their scheduled hours of work shall notify their supervisor, in writing, as to their availability for additional hours of work. Part-time employees shall, in order of seniority, have preference for additional work, provided that care and efficiency are not compromised. When a part­time employee designates availability for additional hours, with suitable advance written notice, the employee's schedule shall not be considered to have changed and Articles 11.01, 11.08 and 12.07 do not apply.

ARTICLE 11 - OVERTIME

11.01 Overtime

Where an employee works the standard shift of seven and one-half (7.5) hours, overtime shall be paid for all hours worked in excess of seven and one-half (7.5) hours in a shift and for all hours worked in excess of seventy-five (75.0) hours in a biweekly pay period, at the rate of time and one-half (1.5X) the employee's regular rate of pay, provided that all such overtime is authorized by the Supervisor or Executive Director.

Where an LPN works the standard shift of seven and three-quarters (7.75) hours, overtime shall be paid for all hours worked in excess of seven and one-half (7.75) hours in a shift and for all hours worked in excess of seventy-five (75.0) hours in a biweekly pay period, at the rate of time and one-half (1.5X) the employee's regular rate of pay, provided that all such overtime is authorized by the Supervisor or Executive Director.

Where an employee works the extended shift of twelve (12.0) hours, overtime shall be paid for all hours worked in excess of twelve (12) hours in a shift and for all hours worked in excess of seventy-two (72) hours in a bi-weekly pay period, at the rate of time and one­half (1.5X) the employee's regular rate of pay, provided that all such overtime is authorized by the Supervisor or Executive Director.

11.02 Part-Time Employees

Part-time employees who are scheduled to work less than seventy-five (75) hours in a bi­weekly pay period qualiJY for overtime after first completing seventy-five (75) hours of work in the scheduled biweekly work period, or after completing seven and one-half (7.5) hours of work in the standard 7.5 hour shift, or after completing twelve (12) hours of work in the extended 12.0 hour shift, provided that all such overtime is authorized by the Supervisor or Executive Director.

Part-time LPNs who are scheduled to work less than seventy-seven and one-half (77.5) hours in a bi-weekly pay period qualiJY for overtime after first completing seventy-seven and one-half (77.5) hours of work in the scheduled biweekly work period, or after completing seven and three-quarters (7.75) hours of work in the standard 7.75 hour shift, or after completing twelve (12) hours of work in the extended 12.0 hour shift, provided that all such overtime is authorized by the Supervisor or the Executive Director.

11.03 No Pyramiding

There shall be no pyramiding of any premium pay (overtime and paid holiday pay, etc.).

11.04 No Layoff to Compensate for Overtime

An employee shall not be required to be laid off during regular hours to equalize any overtime worked. Time off in lieu of overtime pay may be arranged, by mutual consent between the employee and the Employer.

11.05 An employee who is absent on paid time during the employee's scheduled work week because of sickness, bereavement, holidays or vacation shall, for the purpose of computing overtime pay, be considered as if the employee had worked during the employee's regular hours during such absence.

11.06 Sharing of Overtime

Overtime shall be voluntary in descending seniority order except that the Employer shall have the right to assign overtime should there be no volunteers available. Overtime and callback time shall be divided as equally as possible among employees normally doing the work who are willing and qualified to perform the available overtime work.

11.07 Callback Guarantee

When an employee working the standard shift of seven and one-half (7.5) hours is called back to work within sixteen (16) hours after working the employee's regular shift, the employee shall receive overtime rates of pay for all hours worked during the callback.

When an employee working the extended shift of twelve (12) hours is called back to work within either twelve (12) hours after working the employee's regular shift, or within twenty-four (24) hours between shift change-overs, the employee shall receive overtime rates of pay for all hours worked during the callback.

11.08 Overtime for Work on Scheduled Day Off

Employees required to work by the Employer on their scheduled days off shall be paid for time worked on the first day off at the rate of time and one-half (1.5X) and for time worked on the second and subsequent days off at double time (2.0X), unless the employee is given seven (7) calendar days notice of the change of shift schedule.

11.09 Time Off in Lieu of Overtime

Where mutually agreed by the Employer and the employee, the employee may receive time off in lieu of overtime. Such time off shall be the equivalent of the actual time worked, adjusted by the applicable overtime rate and taken at a time mutually agreed by the Employer and the employee. In no case shall time off in lieu of overtime be taken later than thirty (30) days from the date the overtime was worked.

ARTICLE 12 - JOB POSTING, PROMOTIONS, TRANSFERS, VACANCIES

12.01 A vacancy in a bargaining unit position shall be posted within three (3) days and remain posted for five (5) working days (i.e. exclusive of Saturday, Sunday, and Paid Holidays). The posting shall indicate the date of the posting, the closing date for applications, the department in which the vacancy is to be filled and the classification, qualifications, hours of work and rate of pay for the posted position.

12.02 If no internal applications are received by completion of the posting period the Employer may fill the vacancy at its discretion.

12.03 Until the vacancy is filled, the Employer may fill the vacancy at its discretion on a temporary basis.

12.04 Both parties recognize:

a) the principle of promotion within the service of the Employer b) that job opportunity should increase in proportion to seniority

Therefore, in a case where bargaining unit employees apply (which applications shall be in writing) for a posted position, and who possess the required qualifications and a satisfactory employment record, the Employer shall select the employee with the greatest seniority.

An employee who is successful in a job posting will not be considered for the same position within six (6) months of the successful posting, unless the posting is for a higher FTE or change in the shift hours of work.

12.05 The Employer, if requested by the employee, will discuss with the unsuccessful applicant ways in which they can improve their qualifications for future postings.

12.06 Within seven (7) days of closure of the posting period for a vacant position, the name of the successful applicant and the date the appointment takes effect will be posted on the applicable bulletin boards. The Union shall be notified in writing of all hires, transfers, appointments and terminations of employment.

12.07 Trial Period for Transfers, Promotions and Change of Classification Within the Bargaining Unit

Upon promotion to a higher classification or transfer to a different classification, the successful applicant or appointee shall be placed on a trial basis for a period of two (2) months. Conditional on satisfactory service, such trial promotion or transfer shall become permanent after the two (2) month trial. In the event the successful applicant or appointee proves unsatisfactory in the position during the aforementioned trial period, or if the employee is unable to perform the duties of the new job classification, the employee shall be returned to the employee's former position and salary without loss of seniority. Any other employee promoted or transferred because of the rearrangement of positions shall also be returned to the employee's former position and salary without loss of seniority.

12.08 Transfers and Seniority Outside Bargaining Unit

No employee shall be transferred to a position outside the bargaining unit without the employee's consent. If an employee is transferred to a position outside the bargaining unit, the employee shall retain the employee's seniority accumulated up to the date of leaving the unit, but will not accumulate any further seniority. An employee shall have the right to return to a position in the bargaining unit during the employee's trial period, which shall be up to a maximum of sixty (60) calendar days, with no loss of seniority or benefits. If an employee returns to the bargaining unit, the employee shall be placed in a job consistent with the employee's seniority. Such return shall not result in the layoff or bumping of an employee holding greater seniority. This clause will not apply to temporary transfers.

ARTICLE 13 - LAYOFFS AND RECALLS

13.01 Role of Seniority in Layoffs

When a layoff occurs in a classification, the following procedure shall prevail provided that the remaining employees are willing, able and qualified to satisfactorily perform the available work:

1) the least senior in the classification shall be the first laid off; 2) if the employee so affected by 1) is willing and able and qualified to satisfactorily

perform the available work the employee shall have the right to exercise seniority and bump the next lower seniority employee in the bargaining unit in another classification within five (5) calendar days of notice of layoff.

For the purpose of this above procedure, a regular employee affected by layoff shall be accorded the opportunity to bump into a regular position of similar employment status (i.e. full-time to full-time, part-time to part-time).

13.02 Recall Procedure

Employees shall be recalled in the order of their seniority (i.e. the most senior employee on layoff status is recalled first) provided that the recalled employees are willing and able and qualified to perform the available work.

13.03 No New Employees

No new employees shall be hired for a position while there are laid off employees with recall rights and who are willing and able and qualified to satisfactorily perform the available work.

13.04 Advance Notice of Layoff

Unless legislation is more favorable to the employees, the Employer shall notify employees who are to be laid off at least four (4) calendar weeks prior to the effective date of layoff, except in the case of probationary employees for whom the Employer shall not be required to give notice. If an employee has not had the opportunity to work their normal scheduled shifts within the four (4) week period as provided in this article, the employee shall be paid for the shifts for which work was not made available. These provisions shall not be. effective in the event of an emergency such as a fire, flood, epidemic etc. that disrupts or curtails the operation of the Continuing Care Centre.

13.05 Advise Union

Prior to implementation of the layoff provisions of this Article, the Employer will meet with the Union to advise the Union of the Employer's intentions.

13.06 Communication to Confirm Available After recall

A laid off employee must communicate with the Employer within ninety-six (96) hours of notice of recall service by certified mail to the person's recorded address, and must be prepared to begin work at a time designated by the Employer, provided that if the employee is required to give notice to another employer then the employee shall not be required to report for work any sooner than fourteen (14) days after receipt of notice of recall.

13.07 Grievances on Layoffs and Recalls

Grievances concerning layoffs and recalls shall be initiated at Step II of the Grievance Procedure.

ARTICLE 14 - GRIEVANCE PROCEDURE

14.01 Recognition of Union Stewards and Grievance Committee

In order to provide an orderly and speedy procedure for the settling of grievances, the Employer acknowledges the rights of the Union and the Union Stewards. The Steward will assist any employee, whom the Union represents, in preparing the employee's grievance in accordance with the grievance procedure.

14.02 Names of Stewards

The Union shall notify the Employer in writing of the name of each steward and the department(s) the employee represents, and the name of the Chief Steward, before the Employer shall be reqUired to recognize stewards.

14.03 Grievance Definitions

A grievance shall be defined as any difference arising out of interpretation, application, administration, or alleged violation of this Collective Agreement. A grievance shall be categorized as follows:

a) an individual grievance is a dispute affecting one (1) employee. Such grievances shall be initiated at Step 1 of the grievance procedure as outlined in Article 15.07 (a) except in cases of suspension or dismissal which will commence at Step 2; or

b) a group grievance is a dispute affecting two (2) or more employees. Such grievances shall be initiated at Step 2 and processed there from in the same manner as an individual grievance as outlined in Article 15.07 (b). A group grievance shall list all employees affected by the grievance and the results of such grievance shall apply, proportionately if applicable, to all employees listed on the original grievance; or

c) a policy grievance is a dispute between the parties, which, due to its nature is not properly the subject of an individual or a group grievance. Such grievance shall be initiated, in writing, within ten (10) days of the date the aggrieved party first became aware of or reasonably should have become aware of the event leading to the grievance. If the policy grievance is a Union grievance, it shall commence at Step 2. If the policy grievance is an Employer grievance, it shall be directed to the National Representative of the Union and the National Representative shall render a written reply within seven (7) days of receipt. Upon receipt of response or failure to reply, the Employer may advance the grievance to Arbitration.

14.04 Authorized Representatives

a) An employee may be assisted and represented by the National Representative or the Shop Steward when representing a grievance.

b) The employer agrees that Shop Steward shall not be hindered, coerced, or interfered with in any way in the performance of their functions while investigating disputes and presenting adjustments as provided in this Article. However, no representative shall leave the employee's work without obtaining consent from the employee's supervisor, which shall not be unreasonably withheld. The Shop Steward shall not suffer any loss of pay for time spent in the performance of duties involving a grievance, provided that the steward does not leave the employer's premises while on duty.

14.05 Time Limits

For the purpose of this Article, periods of time referred to in days shall be consecutive calendar days exclusive of Saturdays, Sundays, and Named Holidays.

14.06 Mandatory Conditions

a) Should the employee or the Union fail to comply with any time limit in this Article, the grievance will be considered abandoned, unless the parties have mutually agreed in writing to extend the time limits.

b) Should the Employer fail to comply with any time limits in this Article, the grievance shall automatically advance to the next step on the day following the expiry of the particular time limit unless the parties have mutually agreed in writing to extend the time limits.

c) During any and all grievance proceedings, the employee shall continue to perform the employee's duties, except in cases of suspension or dismissal.

d) A suspension or dismissal grievance shall commence at Step 2.

14.07 Steps in the Grievance Procedure

a) Step 1

An employee who has a grievance shall, within seven (7) days of the date the employee becomes aware of or reasonably should have become aware of, the occurrence which led to the grievance, first discuss the matter with the employee's immediate supervisor and attempt to resolve the grievance at this stage. In the event that it is not resolved satisfactorily to the employee, it may be advanced in accordance with the following steps.

b) Step 2

If:

i) an individual grievance within ten (10) days of discussing the grievance with the employee's immediate supervisor in Step 1; or

ii) a group grievance within ten (10) days of the date any oftheaggrieved parties became aware of the event or reasonably should have become aware of the event leading to the grievance,

then the grievance shall be submitted, in writing, stating the article claimed to have been Violated, the nature of the grievance and the remedy sought, to the Executive Director or deSignated representative who shall conduct a meeting to hear the grievance and reply in writing within ten (10) days of receiving the grievance.

If the grievance is not settled at this stage, it may be advanced to Step 3.

c) Step 3

Within seven (7) days of the reply from the Executive Director or designated representative, the employee shall submit the grievance in writing to the Provincial Director or the deSignated representative. The Provincial Director or alternate representative shall hold a meeting within seven (7) days of receipt of the grievance. The employee shall be entitled to have a representative of the Union present during the meeting. The Provincial Director or alternate representative shall render a written decision within seven (7) days of the date of the meeting. If the grievance is not settled at this stage the Union may decide to proceed to a Grievance Panel or Arbitration.

14.08 Grievance Mediation Panel

Prior to proceeding to Arbitration, the grieving party may request that, and if mutually agreed between the Parties, the grievance be referred to a Grievance Mediation Panel established for this purpose by the Employer and the Union. The grieving party will advise the other party in writing of its intent to proceed to the Grievance Panel within fourteen (14) days after completion of Step 3. of the Grievance Procedure above.

a) The Grievance Panel shall consist oHour (4) persons, two (2) of whom shall be selected by the Employer and two (2) by the Union. In the event that four (4) persons are not available then the Grievance Panel shall be composed of two (2) persons, one (1) of whom shall be selected from the Employer and one (1) from the Union. The Employer's selection shall not be from the Employer and the Union's representative shall not be from the Local Union involved in the dispute.

b) The Grievance Panel shall meet to hear and determine the grievance, and render a decision after hearing the matter.

c) The majority decision of the Grievance Panel on the disposition of a grievance shall be final and binding upon the Parties, and shall have the same effect as a decision rendered by an Arbitrator.

d) Decisions of a Grievance Mediation Panel shall not be used as precedents in future employee grievances or disputes between the Parties.

e) If the Grievance Mediation Panel is unable to reach a majority decision, the grieving party may proceed to Arbitration by informing the other Party in writing within fourteen (14) days after the Grievance Panel advises the Parties that it is unable to reach a majority decision.

ARTICLE 15 -ARBITRATION

15.01 Composition of Board of Arbitration

Failing a satisfactory settlement being reached in Step 3 or by the Grievance Panel, either party may refer the grievance to arbitration within ten (10) working days by giving notice to the other party in writing in accordance with Step 3. Unless both parties agree to the appointment of a sole arbitrator to constitute the Board of Arbitration within seven (7) working days, the other party shall give notice in writing naming their nominee to the Arbitration Board. The two named members of the Board shall within five (5) working days name a third member of the Board who shall be the Chairperson. In the event of failure to agree upon a third person, the Minister of Labour for the Province of Alberta shall be requested to appoint a third member.

15.02 The Board shall determine its own procedure, but shall give full opportunity to all parties to present evidence and make representations. In its attempt at justice, the Board shall, as much as possible, follow a layman's procedure.

15.03 Decision of the Board

The decision of the majority shall be the decision of the Board. Where there is no majority decision, the decision of the chairman shall be the decision of the Board. The decision of the Board of Arbitration shall be final, binding and enforceable upon all parties and may not be changed. The Board of Arbitration shall have authority only to settle grievances under this Agreement and to apply this Agreement to the facts of the grievance involved. The Board of Arbitration shall have no power to change this Agreement or to alter, modify or amend any of its provisions, or give any decision inconsistent with it, nor shall any practices or customs become binding unless reduced to writing by the Employer and the Union. However, the Board shall have the power to dispose of a grievance by any arrangement that it deems just and equitable.

15.04 Disagreement on Decision

Should the parties disagree as to the meaning of the Board's decision, either party may apply to the Chairman of the Board of Arbitration to reconvene the Board to clarify the decision, which it shall do within thirty (30) calendar days.

15.05 Expenses of the Board

Each party shall pay: a) the fees and expenses of its nominee to the Board; b) one-half of the fees and expenses of a sole arbitrator, or in the event of a Board, the

Chairman; c) its own expenses including any pay due to be paid to witnesses.

No costs shall be awarded to or against any party.

15.06 Amending of Time Limits

The time limits in this Agreement are mandatory. The time limits fixed in both the grievance and arbitration procedure may be extended only by consent of the parties, confirmed in writing.

15.07 Where it appears that two or more employees have the same grievance or the same type of grievance that is proceeding to arbitration, the grievances shall be submitted to one Board of Arbitration. It is understood that each grievor shall have the right to make a submission.

15.08 Witnesses

At any stage of the grievance or arbitration procedure, the parties shall have the assistance of any employee(s) concerned as witnesses and any other witnesses.

All reasonable arrangements will be made to permit the conferring parties or the arbitration Board to have access to the Employer's premises to view any working conditions, which may be relevant to the settlement of the grievance.

ARTICLE 16 - DISCIPLINE DISMISSAL AND RESIGNATION

16.01 Except for the dismissal of an employee serving a probation period, there shall be no discipline or dismissal except for just cause.

16.02 Whenever the Employer deems it necessary to reprimand an employee in a manner indicating that dismissal or diScipline may follow any further infractions, or may follow if such employee fails to bring the employee's work up to the required work performance by a given date, the employee shall be notified in writing of the speCifics of the issues that gave rise to the action and/or penalty with a copy to the Union.

16.03 An employee shall have the right to be accompanied by a Shop Steward or a Union Officer in a disciplinary meeting.

16.04 The Employer shall give a minimum of two (2) weeks notice of termination of employment or shall pay a minimum of two (2) weeks wages in lieu of notice, except in cases of dismissal for just cause or termination during the probationary period pursuant to Article 27 of this Agreement. If by law longer notice of termination must be given or a greater sum paid in lieu of notice, such longer notice must be provided or greater sum paid.

16.05 Employees shall give a minimum of two (2) weeks notice of termination unless otherwise mutually agreed between the Employer and the employee.

16.06 None of the provisions of this Article shall prevent immediate suspension or discharge for cause, subject to the grievance procedure.

ARTICLE 17 - PAID HOLIDAYS

17.01 Paid Holidays Defined

Full-time employees who have completed their probationary period shall receive the following paid holidays:

, 17.02 Computation of Paid Holiday Pay

Holiday pay will be computed on the basis of the number of hours the employee would otherwise work had there been no holiday, at the employee's regular rate of pay. For example, a regular full-time employee who works the standard seven and one-half (7.5) hour shift will be paid seven and one-half (7.5) hours straight-time holiday pay; a regular full-time LPN who works the standard seven and three-quarters (7.75) hour shift will be paid seven and three-quarters (7.75) hours straight-time holiday pay; a regular full-time employee who works the extended twelve (12) hour shift will be paid twelve (12) hours straight-time holiday pay.

17.03 Qualified for Payment

Regular employees who have completed thirty (30) calendar days employment are eligible for the Paid Holidays in Article 17.01. In order to qualify for holiday pay an employee must work the employee's full scheduled shift immediately preceding and immediately following the holiday, except where the employee is absent due to illness or bereavement leave. If an employee is scheduled to work on a paid holiday and is absent from work on that day, then the employee shall forfeit all pay for the holiday unless due to illness. However, if an employee qualifies for benefits from Workers' Compensation, or payments under a wage-loss or disability insurance plan, then the employee shall not be qualified for holiday pay.

17.04 Full-Time Employees Who Work on a Holiday

Full-time employees shall be paid at the rate of one and one-half (1.5) times their applicable hourly rate for work performed on paid holidays as set out in Article 17.01. Such employees shall also be entitled to an additional day off with pay within a period of four (4) weeks after the holiday, unless otherwise arranged between the employee and the Employer. In lieu of the provision, the Employer and the employee may agree that the employee will receive an additional day's pay; failing agreement the employer may schedule the lieu day or pay an additional day's pay. The Employer when scheduling the lieu day as provided herein will give prior consideration to the date requested by the employee.

17.05 Holiday Falling on Day Off

If any of the holidays named in Article 17.01 occur on a regular day off for a full-time employee entitled to holiday pay, the employee shall receive an additional day off in lieu thereof within four (4) weeks after the holiday unless otherwise arranged between the employee and the Employer; failing agreement the Employer may schedule the lieu day or pay an additional day's pay. The Employer when scheduling the lieu day as prOvided herein will give prior consideration to the date requested by the employee.

17.06 Holiday Pay for Part-Time Employees

For paid holidays as set out in Article 17.01, a part-time employee receives holiday pay computed as the employee's average earnings, exclusive of overtime, in the thirty (30) calendar day period immediately preceding the paid holiday.

17.07 Part-Time Employees Who Work on a Holiday

Any part time employee who actually works on any paid holiday shall be paid for all hours worked at the rate of time and one-half the employee's regular straight-time rate for hours worked, with a minimum oHour (4) hours.

17.08 Except in exceptional circumstances, an employee who requests a lieu day resulting from the application of this article, shall endeavour to make her request, in writing, at least one (1) weeks in advance of to the schedule being posting. The decision to grant the leave shall be at the discretion of the Employer, which shall not be unreasonably exercised. The Employer shall approve or deny the request for time off in writing at least by the effective date of the schedule.

ARTICLE 18 - MEDICAL LEAVE

18.01 To protect the regular employee against loss of income when the employee is absent from work due to legitimate personal illness or injury and unable to perform the employee's duties, the employee shall be entitled to receive benefits in accordance with the Sick Leave Plan, Short-Term Disability Plan and Long-Term Disability Plan in accordance with "Schedule 'B' - Benefits Program," attached to and forming a part of this collective agreement. The Employer may require provision of medical certification from a duly qualified medical practitioner, at the employee's expense, after the third day of illness.

18.02 Sick Leave Plan as Affected by Probation Period

Employees who have not completed their probation shall not be entitled to pay under the Sick Leave Plan. However, once the probation period has been successfully completed, a regular full-time employee's sick leave account will be credited with three and three­quarters (3.75) full-time eqUivalent shifts, and a regular part-time employee's sick leave account will be credited on a pro-rated basis (i.e. seven and one-half (7.5) hours credited sick leave for each one hundred and sixty-two and one-half (162.5) hours worked during the probation period).

18.03 Sick Leave Plan and Medical Certification

When an employee's utilization of the Sick Leave Plan is deemed by the Employer to be excessive, the employee may be required to obtain, at the employee's expense, timely and proper medical certification from a duly qualified medical practitioner to validate the period of absence. When frequency or utilization are deemed excessive and medical certification becomes required, the Employer will first issue advance written notice to the employee.

18.04 Termination of Sick Leave Credits

Sick Leave Plan benefits will cease on termination of employment or on retirement or on death.

18.05 Leave of Absence and Sick Leave Credits

Sick Leave Plan benefits will not accrue (except in the event of maternity leave where such benefit accrues to the end of the month in which the employee commences maternity leave) while an employee is on leave of absence, other than Union leave.

18.06 Part-Time Employees' Sick Leave Credits

Part-time employees shall accumulate sick leave credits on a pro-rata basis, (Le. seven and one-half (7.5) hours credited sick leave for each one hundred and sixty-two and one-half (162.5) hours worked).

18.07 Only normal regularly scheduled shifts missed while receiving Sick Leave Plan benents will be charged against a regular employee's accumulated Sick Leave Plan credits.

18.08 Sick Leave Benefits While on Worker's Compensation

Absence for sickness or accident compensable by Worker's Compensation will not be charged against an employee's accumulated Sick Leave Plan credits.

18.09 Notincation of Absence Due to Illness

Any employee who is unable to attend work on account of non-occupational personal illness or injury must notify the Employer on the nrst day of illness or injury in advance of the time the employee would normally report for duty. Failure to give proper notice to the Duty Supervisor or designated alternate, unless such failure is unavoidable, may result in loss of sick leave benents for that day of absence.

18.10 Notification of Return to Work

During any illness or injury, the employee will notify the Employer, as far in advance as pOSSible, of their intention and fitness to return to work. Medical evidence of ntness to return to work may be required depending on the illness or injury and the position the employee is returning to.

18.11 Leave of Absence Due to Illness

Employees whose sick leave credits are exhausted must apply for a further leave of absence without pay. The Employer will advise the employee in writing of the disposition of such request. In such circumstances the Employer agrees that it will exercise its discretion on a consistent basis.

18.12 Sick Leave During Pregnancy

Sick Leave Plan benefits shall be granted for the health-related portion of an employee's pregnancy or childbirth, such leave shall only be approved following production of a medical certificate advising that there were medical reasons that prevented the employee from doing the employee's duties during the health-related period of the employee's absence.

18.13 Notification of Sick Leave Accrual

Upon request the Employer shall advise an employee in writing of the amount of the employee's unused accrued credits in the employee's Sick Leave Plan.

18.14 Casual Employees

Casual employees shall not be entitled to Sick Leave Plan benefits.

ARTICLE 19 - LEAVE OF ABSENCE RULES

19.01 Employees who are on leave of absence will not engage in gainful employment on such leave, and if an employee does engage in gainful employment while on such leave without prior written approval by the Employer, the employee will forfeit all seniority rights and privileges contained in this Agreement unless otherwise agreed by the Union and the Employer.

19.02 An employee who has been granted a leave of absence of any kind, and who overstays the employee's leave of absence without permission of the Employer and who cannot prOVide a justifiable explanation, shall be considered to have forfeited seniority and to have abandoned employment, which shall be terminated.

19.03 Benefits will accrue from the date of return to employment follOWing such leave of absence. No employee will accumulate seniority, sick leave plan credits, or earned vacation nor will other benefits be paid or accrue while on leave of absence, other than those outlined below:

a) periods of sick leave paid by the Employer b) leaves of absence with pay c) bereavement leave d) employer paid jury/witness duty e) paid vacations f) while on approved Union leave of absence g) for the health-related portion of pregnancy or maternity leave.

19.04 Employees shall not be entitled to named holidays with pay, which may fall during the period of leave of absence.

19.05 An employee returning from any leave of absence will be reinstated within one month following notice of desire to return to work, subject however to seniority. Upon return to work the employee will be placed on the job previously held providing the employee can perform the required work satisfactorily. If the employee would not otherwise have retained the employee's previous job the employee shall, subject to seniority, be placed on a job the employee can satisfactorily perform.

LEAVE OF ABSENCE - UNION BUSINESS

19.06 Upon written request, leaves of absence without pay may be given to employees for Union business subject to the provisions of Article 20.07. The Union agrees in making request for such leave of absence that it will not unduly effect the proper operations of the Continuing Care Centre. However, the Employer agrees that permission for such leave will not be unreasonably withheld.

19.07 Leave of absence will be granted according to the following conditions:

a) No more than three (3) employees may be granted such leave at anyone time b) The aggregate total of such leaves shall not exceed thirty (30) days per person in any

calendar year.

19.08 For such leave of absence the Union will provide as much advance notice as possible, but not less than fourteen (14) days notice in writing to the Employer, whenever possible.

19.09 Where such leave is granted the Employer will continue to pay the employees for the period of leave of absence and then submit an account to the Union for recovery of the employee's wages and benefits.

BEREAVEMENT LEAVE

19.10 An employee shall be granted four (4) consecutive days bereavement leave without loss of pay for scheduled working days including the day of the funeral, in the event of the death of the following relatives: Mother, Father, legally recognized step-Parents, Husband, Wife, Son, Daughter, Step-Children, Brother, Sister, Common Law Spouse and Same Sex Partner.

An employee shall be granted three (3) consecutive days bereavement leave without loss of pay for scheduled working days including the day of the funeral, in the event of the death of the following relatives: Grandparents, Grand Children, Mother in- Law, Father in­law, Sister in- Law, Brother in- Law, Aunt and Uncle.

19.11 Common law spouse shall mean either a man or woman not being married to each other who have cohabited continuously for a period of not less than one (1) year or in a relationship of some permanence where there is a child of whom they are the natural parents.

19.12 An employee will not be eligible to receive payment under the terms of bereavement leave for any period in which the employee is receiving any other payment such as for example: holiday pay, vacation payor sick pay.

19.13 Bereavement leave without pay shall be extended upon request of an employee by two (2) days when it is necessary for an employee to travel in excess of three hundred (300) kilometers from the employee's place of residence to attend the funeral.

LEAVE OF ABSENCE FOR PREGNANCY, MATERNTITY, ADOPTION

19.14 Maternity. Parental and AdOPtion Leave

The employer will grant a leave of absence for maternity if accompanied by a certificate of a legally qualified medical practitioner stating that the employee named therein is pregnant and specifying the estimated date of delivery. Maternity and Parental leaves of absence shall be in accordance with Alberta Provincial legislation and Employment Standards regulations, as may be amended from time to time. A copy of the appropriate Employment Standards notice will be posted by the Employer on the employee bulletin board within the facility.

19.15 Regardless of whether the employee requests such leave of absence the Employer may require the employee to commence such a leave of absence at such time as the duties of her position cannot reasonably be performed by a pregnant woman or the performance of the employee's work is materially affected by the pregnancy.

19.16 The employee may not return from work for a period of a minimum of six (6) weeks following delivery or for such shorter period, as in the written opinion of a legally qualified medical practitioner, is sufficient.

19.17 Employees on such leave will accrue benefits only to the end of the month in which the leave of absence commences. Seniority shall be accrued throughout such leave of absence.

IURYDUTY

19.18 An employee required to serve jury duty shall be paid the difference between what the employee would have earned for the employee's scheduled hours, (Without taking into account any premium payor the like) and the fees received pursuant to the performance of jury duty. This will be affected by the employee signing over the employee's jury fees, less expense money received from the authorities, for meals and lodging and the Employer will continue the regular salary payments. The employee is to notify the employee's supervisor as soon as possible after receipt of the subpoena. The employee will come to work during those regularly scheduled hours that the employee is not required to attend at court. If an employee is required to be a witness in a case arising out of the employee's employment with the Employer, the Employer will abide by the above provision.

PERSONAL LEAVE OF ABSENCE

19.19 The Employer shall have the discretion to grant or refuse a request for a leave of absence without pay for extenuating personal reasons provided that the employee receives at least one month's clear notice in writing, unless impossible, and that such leave may be arranged without undue inconvenience to the normal operations of the Continuing Care Centre. Applicants when applying must indicate the date of departure and specify the date of return. Whenever possible an employee intending to return from leave of absence shall give at least three (3) weeks notice of return.

ARTICLE 20 - VACATIONS

20.01 Vacation Time

An employee shall receive an annual vacation as of January 1 st of the following year with pay in accordance with the employee's years of service, as of the vacation cutoff date, as follows:

20.02 Annual Cutoff Date

For the purpose of calculating eligibility, the vacation year shall be from the first pay period in January to the last pay period inclusive of the same calendar year in December.

With the mutual consent of the Employer and the employee, an employee may carryover unused vacation from one year to the next succeeding year, up to a maximum aggregate carry-over of one (1) week's vacation. Employees may not waive a vacation period in lieu of pay.

20.04 Compensation for General Holidays Falling Within Vacation Schedule

If a paid holiday falls or is observed during an employee's vacation period, the employee shall be allowed an additional vacation day with pay on a date mutually agreed, but where possible such day will be added to the employee's vacation. Failing agreement the Employer shall pay an additional day's pay.

20.05 Vacation Pay

Vacation pay for regular full-time employees shall be at the rate of pay currently in effect at the time of the vacation.

20.06 Vacation Pay on Termination

Upon termination of employment an employee shall be entitled to pay in lieu of vacation earned but not taken, at the follOwing percentage rates of basic pay earnings during the period that the vacation was accrued, but not taken:

20.07 Vacation Schedules

Vacation planners shall be posted by January 31 st of each year and the Employer shall confirm the employee's requested vacation period by April 15th of each year, which period shall not be changed unless mutually agreed upon by the employee and the Employer. Where possible, vacations shall commence immediately following an employee's regularly scheduled rest days. The period at which employees shall take vacation shall be based on the selection by the employees according to seniority in each department, but shall be finally determined by the Employer having due regard for the proper and efficient operation of the Continuing Care Centre. Wherever operational reqUirements permit, all regular full-time and regular part-time Employees shall be provided with two (2) weeks vacation absence during the peak vacation request period Uune,July, August, September), annually.

Employees shall indicate their vacation requests by March 15th• An employee who fails to

indicate their vacation request by March 15th shall not have preference in the choice of vacation time, where other employees have indicated their preference.

Vacation requests received after April 15th shall be granted on a first come, first served basis and shall be responded to within two (2) weeks after the positing of the approved vacation schedule, or within two (2) weeks of receipt of the request, whichever comes later.

20.08 Unbroken Vacation Period

An employee shall be entitled to receive the employee's vacation in an unbroken period unless otherwise mutually agreed upon between the employee and the Employer.

20.09 Part-Time Employees

Part-time employees shall receive a scheduled vacation pursuant to Article 20.01 based on the part-time employee's years of service and shall receive vacation pay calculated on the basis of the percentage accrual rate schedule as set forth in Article 20.06.

20.10 Casual and ReliefEmployees

Casual employees and employees hired for vacation relief shall receive no vacation time but shall receive vacation pay in accordance with the Alberta Employment Standards Code.

ARTICLE 21 - PAYMENT OF WAGES AND ALLOWANCES

21.01 Pay Days

a) The Employer shall pay salaries and wages bi-weekly for hours worked in accordance with the hourly wages set forth in Schedule 'A' attached hereto and forming part of this Collective Agreement. On bi-weekly paydays each employee shall be provided with an itemized statement of direct deposit showing the employee's wages, overtime and other supplementary pay and deductions.

b) In the event the Employer makes an overpayment on an employee's pay the correction will be made the next pay period. If the Employer error results in an underpayment by more than one (1) day's pay, the Employer will proVide payment for the shortfall within three (3) business days from the date the Employer is notified of the error.

21.02 Individual salary increases on the wage progression table in Schedule 'A' are in accordance with the employee's anniversary date of employment, or the attainment of the required seniority hours, whichever occurs later. The anniversary date shall be adjusted forward if necessary to account for leave of absence or other absences under which seniority accumulation is suspended.

21.03 A job classification will not be changed for the purpose of evading payment of the minimum rate set out in Schedule 'A'. If the Employer establishes a new classification within the bargaining unit it shall be discussed with the Union in advance and shall be subject to negotiations to determine the rate of pay.

21.04 a) When the Employer requires an employee to substitute on a higher-classified job covered by this Agreement for at least four (4) hours in a shift, she shall be paid at the next higher job rate in the higher classification for the entire shift worked.

b) Where an employee agrees to substitute on another job outside the scope of this Agreement, the employee will receive, in addition to the employee's regular salary, an amount commensurate with the additional responsibilities but not higher than the rate of such classification.

21.05 Transfers to a Lower-Rated Classification

If an employee is transferred to a lower-rated classification, the employee shall be advised the reasons for the transfer in writing and such transfer shall be subject to the grievance procedure. The employee shall receive in the new classification the next rate below the employee's present wage rate and shall progress within the scale for such lower-rated classification according to the seniority hours within such lower-rated classification subsequent to the date of transfer, provided that if the employee is at the maximum level in the present classification then the employee shall receive not less than the maximum level of the lower-rated classification.

21.06 Transfers to a Higher-Rated Classification

If an employee is transferred to a higher-rated classification, the employee shall receive in the new classification the next rate above the employee's present rate and shall progress within the scale for such higher rated classification according to the seniority hours within such higher-rated classification subsequent to the date of transfer.

21.07 Recognition of previous experience

Provided that no more than two (2) years have elapsed since the experience was obtained, when an Employee has experience satisfactory to the Employer, her starting salary shall be adjusted one step for each year of applicable, relevant experience.

ARTICLE 22 - EMPLOYEE BENEFITS PLANS

22.01 The employer shall maintain a benefits program in accordance with Schedule 'B' attached hereto and forming a part of this Collective Agreement.

ARTICLE 23 - SAFETY

23.01 Co-Operation on Safety

The Union and the Employer shall cooperate in improving rules and practices, which will provide protection to employees engaged in hazardous work.

23.02 A joint management and employee Health and Safety Committee shall be established, with representation from each department of the Continuing Care Centre, and at least two of such representatives shall be members of the bargaining unit, approved by the Union.

23.03 The Committee shall normally meet at least once a month at a mutually acceptable hour and date, however, a special meeting may be requested by any member to deal with any urgent matter. Scheduled time spent in such meetings is to be considered time worked

and paid for by the Employer. Minutes shall be kept of all meeting and copies shall be sent to the Employer and the Union.

The Chairperson of this Committee will be elected by the members of the Committee and will serve for a period of one (1) year, unless re-elected.

23.04 The Union and the Employer agree to encourage their members and employees to cooperate fully in the observation and participation of all safety rules and practices.

ARTICLE 24 - UNION/MANAGEMENT COMMITTEE

24.01 A Union/Management Committee shall be established in the Continuing Care Centre comprised of no more than two (2) representatives of the Union and two (2) representatives of the Employer. The Committee shall meet on an ongOing basis to discuss matters of mutual concern. The employee representatives' meeting time is deemed to be paid work time.

24.02 If the Continuing Care Centre has an established joint committee composed of representatives of the Employer, the Union and other recognized functional bargaining agents, the Union may agree to pursue the matters of mutual concern through this joint committee, without restricting the Union's right to request a meeting of the Committee comprised only of Management and this Union's bargaining unit representatives.

ARTICLE 25 - WORKERS' COMPENSATION

25.01 Where an employee is receiving Workers' Compensation benefits for an occupational illness or injury arising from work at this Employer's workplace, the following shall apply:

a) The employee and the Employer shall continue to pay their respective share of monthly premiums under the Employer's Benefits Program for Provincial Medicare, Extended Health Benefits, Dental Plan, and Ufe Insurance for a period up to a maximum of six (6) whole calendar months. Subsequent to the period referred to in (a) above, benefit coverage may continue by the employee, provided the employee pays the total cost of the premiums to the employer for each monthly period during the absence.

b) Where absence results from occupational illness or injury suffered when concurrently working for some other employer not a party to this collective agreement, the employee may elect to continue coverage under this Employer's Benefits Program for Provincial Medicare, Extended Health Benefits, Dental Plan, and Ufe Insurance at the employee's sole expense for monthly premiums, for a period up to a maximum of one (1) whole calendar month. Thereafter, coverage under this Employer's Benefits Program is discontinued until such time as the employee returns to active duty for this Employer.

ARTICLE 26 -IN-SERVICE EDUCATION PROGRAMS

26.01 a) The parties of this Collective Agreement recognize the value of continuing in-service education for employees and the responsibility for such continuing education lies not only with the individual but also with the Employer. For the purpose of this Article, the term 'in-service' includes: orientation, acquisition and maintenance of essential skills, and other programs, which may be offered by the Employer.

b) The Employer reserves the right to identify specific in-service sessions as being compulsory for employees and those required to attend such sessions shall be paid the applicable rate of pay for time in attendance. The in-service programs shall be compulsory, shall be provided to Employees on an annual basis, and shall include but are not limited to the following:

i) Emergency response and evacuation procedures ii) Occupational Health & Safety matters (e.g. safe lifting, prevention of back injuries,

WHMIS, etc.) iii) Prevention of abuse, Protection for Persons in Care legislation and regulations iv) Privacy and Confidentiality

26.02 Employees who, with prior approval of their supervisor, attend in-service programs that are not identified as compulsory by the Employer, shall suffer no loss of regular earnings for attending such programs.

26.03 The Employer shall make available other in-service education programs as deemed appropriate for the purpose of maintaining proficiency.

ARTICLE 27 - PROBATIONARY PERIOD AND ORIENTATION

27.01 A newly hired full-time and part-time employee must successfully complete a probationary period oHour hundred and eighty seven point five (487.5) hours worked. A newly hired full-time and part-time employee (LPN) must successfully complete a probationary period of five hundred and three point seven five (503.75) hours worked. On or before the expiry date of the initial probationary period, the Employer will advise the employee its decision to:

a) confirm the employee's appointment as having completed probation; or b) extend the probationary status in consultation with the Union; or c) terminate the employee, in which case the decision of the Executive Director is final

and binding.

ProVided, however, that each full day of absence from scheduled work for any reason will extend the probation period by one full day. lfa probationary employee is transferred to another classification, the employee may be required to complete a new probationary period, commencing on the date of transfer and the Union shall be advised. In no event

will the regular full-time and part-time employee's total probationary period exceed nine hundred and seventy (975) hours worked and one thousand and seven point five (1007.5) in the case of regular LPNS. Employees shall be kept advised of their progress during the probationary period.

27.02 The Employer shall provide a reason for the termination to the employee, ana the employee shall not have recourse to the grievance procedure set out in this Collective Agreement or the Code, with respect to such termination.

27.03 The Employer shall provide a paid orientation for all new employees, and when an employee changes areas within a department or changes departments.

27.04 Subject to Article 29, the Employer shall provide a performance appraisal of each probationary employee at least once during the employee's probationary period.

ARTICLE 28 - COPIES OF COLLECTIVE AGREEMENT

28.01 Copies ofthe Agreement

The Employer and the Union shall share the cost of printing the Collective Agreement.

28.02 The Employer shall provide each new Employee with a copy of the collective agreement at the time of hire.

ARTICLE 29 - PERSONNEL FILES AND PERFORMANCE APPRAISALS

29.01 All records of a disciplinary nature, shall be removed from the personnel files of employees not less than twenty-four (24) months from the date of the matter giving rise to such entry to the employee's record, provided there have been no further incidents of a disciplinary nature placed on the employee's file during that time period.

29.02 The parties recognize the desirability of a performance appraisal system designed to effectively utilize and develop the human resources of the Employer.

29.03 Employees shall receive a written performance appraisal regularly in accordance with the policy of the Employer.

Meetings for the purpose of the performance appraisal interview shall be scheduled by the Employer with reasonable advance notice. At the interview the employee shall be given a copy of the employee's performance appraisal document. The employee shall sign the employee's performance appraisal for the sole purpose of indicating that the employee is aware of the employee's performance appraisal, and shall have the right to respond in writing within ten (10) days of the interview and that reply shall be placed in the employees' personnel file.

29.04 By appointment made at least one (1) working day in advance, an employee may view the employee's personnel file once a year or when the employee has filed a grievance. When viewing the employee personnel file, the employee may be accompanied by a representative of the Union.

An employee shall be provided photocopies of the contents of the employee personnel file upon written request, not more frequently than once in a calendar year, or when the employee has filed a grievance, provided that the employee first pays to the Employer a reasonable fee, established by the Employer to cover the cost of copying.

ARTICLE 30 - HOURLY PREMIUMS

30.01 Weekend shift premium

A weekend premium of one dollar and seventy-five (51.75) per hour shall be paid to an employee working a shift wherein the majority of such shift falls during a fifty-six (56) hour period commencing at 2300 hours Friday until 0700 hours Monday.

30.02 Night shift premium

A night premium of one dollar and fifty cents (51.50) per hour shall be paid to an employee working a shift wherein the majority of such shift falls between 2300 hours and 0700 hours.

30.03 Evening shift premium

An evening shift premium of seventy-five cents (50.75) per hour shall be paid to an employee working a shift where the majority of such falls between 1500 and 2300 hours.

ARTICLE 31- CASUAL EMPLOYEES

31.01 Except unless otherwise specified in this Article and in this Collective Agreement, the provisions of this Collective Agreement do not apply to Casual Employees.

31.02 The provisions of Articles 1,2,4,5,6,7.01-7.05,7.08-7.10,8, 10.01-10.06, 10.12-10.13, 11.01, 11.03, 14,15,1621, 23, 26, 28, 29.01,29.04 and 30, shall apply to Casual employees.

31.03 Paid Holidays

Casual employee required to work on a paid holiday shall be paid in accordance with the Alberta Employment Standards Code.

31.04 Casual employees shall be called in to work in order of hours worked from the date of hire as a casual employee. Failure to work at least one (1) weekend shift, if offered by the employer, in a calendar month may result in removal of the casual employee's name from the casual call-in roster. A casual employee shall be terminated in the event the employee has not worked for a period of three (3) consecutive months, unless excused by the Employer.

IN WITNESS WHEREOF, the Parties hereunto executed this Agreement on the 1st day of May, 2010, and is effective to and including October 31,2012.

Schedule B - Benefits Program

The Employer maintains a benefits program in accordance with the provisions outlined below:

Provincial Medicare Plan (Alberta Health Care Insurance)

Included in the Employer's benefits program is the standard provincial Medicare plan for residents of Alberta, which provides basic medical coverage for eligible regular employees and their qualified dependents under the age of eighteen (18) years, or under the age of twenty-five (25) years provided the child is wholly dependent on the employee and is in full-time attendance at a recognized post-secondary educational institution.

Extended Health Benefits Plan

The extended health benefits plan covers major medical expenses incurred for treatments that are not covered by the provincial Medicare plan or any other government-sponsored program. Coverage applies to eligible regular employees and their qualified dependents under the age of nineteen (19) years, or under the age of twenty-five (25) years provided the child is wholly dependent on the employee and is in full-time attendance at a recognized post-secondary educational institution.

Hospitalization expenses are covered at one hundred percent (1 00%). For all other expenses, the first five hundred dollars (5500) of eligible expenses per eligible covered person per calendar year, reimbursement by the insurance carrier is at the rate of one hundred percent (1 00%). After 5500 annual reimbursement, eligible expenses are reimbursed at the rate of eighty percent (80%).

To be eligible for reimbursement, medical expenses must be medically necessary for treatment of sickness or injury and recommended by a licensed phYSiCian, and must be reasonable and customary.

Life Insurance Plan

The Employer's benefits program proVides life insurance coverage for eligible regular employees in the principal amount of 525,000. Coverage includes a provision for an Accidental Death & Dismemberment benefit, up to the same level as the principal amount oflife insurance.

Dental Plan

The Employer's Dental Plan provides coverage for eligible regular employees and their qualified dependents under the age of nineteen (19) years, or under the age of twenty-five (25) years provided the child is wholly dependent on the employee and is in full-time attendance at a recognized post-secondary educational institution. Reimbursement by the insurance carrier is in accordance with the following schedule:

a) basic treatments - coverage for basic treatments, including routine examinations once per nine (9) months, at 100% of the current fee guide.

b) major treatments - coverage for major treatments, including endodontics and periodontics, crowns, bridges, major restorative procedures, at 50% of the current fee gUide.

c) maximum annual benefit of S 1200.00 per eligible covered person per calendar year, for basic and major treatments combined.

Sick Leave Plan

For short duration absences arising from non-occupational illness or injury that prevents an eligible regular employee from working during a period up to five (5) regularly scheduled working days in a seven (7) day consecutive calendar period, the employee's wage loss is covered through the Employer's Sick Leave Plan.

a) after completion of the probationary period, and taking into account all hours worked from the date of the employee's first worked shift onward, sick leave credits accrue at the rate of one and one quarter (114) shifts for each one hundred and Sixty-two and one-half (162.5) seniority hours and one hundred and sixty-seven and point nine (167.9) seniority hours for LPNs, up to a maximum of fifteen (15) full-time equivalent shifts (i.e. 112.5 hours; 116.26 hours for LPNs) credited to the employee's accumulated sick leave account.

b) sick leave pays the employee's current normal straight-time hourly wages (exclusive of overtime, premiums, etc.) for scheduled whole work shifts lost in the five (5) regularly scheduled working days in a seven (7) day consecutive calendar period immediately following onset of the disabling condition.

c) credits in the employee's sick leave account are reduced by the hours of sick leave benefits paid out to the employee; an employee's sick leave account cannot be in deficit at any time; unused sick leave credits automatically expire on termination of employment or on retirement or death.

In the event an employee remains disabled from work after a waiting period of a seven (7) day consecutive calendar period, the employee may be eligible for Short Term Disability Benefits, see below.

Short Term Disability Plan

In the event of temporary total disability arising from non-occupational illness or injury which prevents the employee from working and which exceeds seven (7) consecutive calendar days, eligible regular employees are covered for weekly indemnity insurance through the Employer's Short Term Disability Plan, which provides the following features:

a) benefits commence on the eighth (8th) day of disability (after a waiting period of a seven

(7) day consecutive calendar period), and are payable at the rate of 66.67% of the employee's average weekly earnings.

b) disability benefits for eligible regular part-time employees are computed on the same formula as provided in (b) above, and are based on the part-time employee's scheduled work and average basic earnings preceding the date of onset of the disabling condition.

c) benefits are taxable and are issued on a weekly basis by the insurance carrier, in arrears; payments continue until the employee is either deemed no longer temporarily totally disabled from work, or for a period up to a maximum of seventeen (17) weeks from the date of onset of the disabling condition, whichever occurs first.

d) to qualify for and continue receiving short-term disability benefits, the employee must be totally disabled from work and must be actively treated by and under the continuing care of a physician licensed in Canada.

e) an employee'S application for benefits must be on the form and in the manner prescribed by the insurance carrier; application forms, physician's statements and supplementary reports required to continue benefits, and any other reports are the responsibility of the employee.

f) in the event the employee remains disabled from work after the elimination period of seventeen (17) weeks, the employee may be eligible for Long Term Disability Benefits, see below.

Long-term Disability Plan

In the event of total disability arising from non-occupational illness or injury which prevents the employee from working and which exceeds seventeen (17) consecutive calendar weeks from the date of onset of the disabling condition, eligible regular employees are covered for wage loss replacement insurance through the Employer's Long Term Disability Plan, which prOvides the following features:

a) benefits commence after an elimination period of seventeen (17) weeks and are payable at the rate of 66.67% of the employee's first fifteen hundred dollars (51,500.00) of basic monthly earnings, plus 50% of the excess earnings.

b) the disability benefit for a regular part-time employee is computed on the same formula as prOVided in (a) above, and is based on the part-time employee's scheduled work and average basic earnings.

c) benefits are non-taxable and are issued on a monthly basis by the insurance carrier, one month in arrears, and are payable for a period up to sixty (60) months prOVided that the employee remains totally disabled from the employee's own occupation during the first

two (2) years and thereafter is unable to perform the essential duties of the employee's normal occupation or any other occupation for which the employee may be reasonably qualified by reason of education, experience and qualifications; the plan provides for mandatory occupational rehabilitation, where deemed appropriate by the insurance carrier.

d) to qualify for and continue receiving long-term disability benefits, the employee must be totally disabled from any work and must be actively treated by, and under the continuing care of, a physician licensed in Canada.

e) monthly benefits are offset by other disability income the employee may be entitled to receive from other sources, including government pension plans.

f) subject to the maximum benefit period of sixty (60) months, benefits continue until the employee is no longer totally disabled, termination of employment, death, retirement or age 65, whichever occurs first.

g) an employee's application for benefits must be on the form and in the manner prescribed by the insurance carrier; application forms, physician's statements and supplementary reports required to continue benefits, and any other reports are the responsibility of the employee.

Retirement Plan

Membership in the Employer's Retirement Plan is voluntary and is open to all regular employees (including full-time employees and part-time employees who are normally scheduled to work 45 hours bi-weekly or more of the normal work hours in a biweekly pay period), after completion of 3,900 seniority hours; for LPNs after completion of 4,030 seniority hours. Employees' contributions are made by way of biweekly payroll deduction, at the rate of twenty cents ($0.20) per hour worked; payroll deductions are depOSited direct to the account of the employee into a group Registered Retirement Savings Plan (RRSP) administered by the financial institution. The Employer matches the employee's contributions on a dollar-for-dollar basis.

Employee Eligibility for Benefits Program

All regular employees, who for purposes of this benefits program are defined as all full-time employees and those part-time employees who are normally scheduled to work for 45 hours bi­weekly or more of the normal work hours in a biweekly pay period, shall participate in the Employer's Benefits Program. Plan enrolment is in accordance with the following schedule:

Effective the first (1 ") of the month following thirty (30) days from the date of ratification:

a) after completion of the three (3) month probation period (487.5 seniority hours); and for LPNs after completion of the three (3) month probation period (503.75 seniority hours):

The benefits program covers all eligible regular employees whose work is governed by this Collective Agreement. Where provided in the summary of benefits above, an employee's qualified dependents under the age of nineteen (19) years, or under the age of twenty-five (25) years provided the child is wholly dependent on the employee and is in full-time attendance at a recognized post-secondary educational institution, may be covered.

Required Enrolment

Enrolment in the Employer's benefits program is mandatory, except as provided above, and is a condition of continued employment. Coverage and premiums for eligible regular employees commence after completion of the probation period, except where the employee provides written documentation and a signed waiver that the employee has comparable coverage elsewhere (for example through a spousal plan or through another employer not governed by this collective agreement). The costs of monthly premiums are borne in accordance with the formulas provided below.

Monthly Premiums and Cost-Sharing Formulas

a) Except as provided elsewhere, the Employer and eligible regular full-time employees equally share the cost of monthly premiums (i.e. 50%/50%) for the following:

1) Provincial Medicare Plan (Alberta Health Care Insurance) 2) Extended Health Benefits Plan 3) Life Insurance Plan 4) Dental Plan 5) Short-Term Disability Plan

b) The monthly cost of accruing Sick Leave Plan benefits for eligible regular full-time employees is borne by the Employer (1 00%).

c) For the protection of eligible regular full-time employees to maintain non-taxable status for any benefits received under the Long-Term Disability Plan, monthly premiums for Long-Term Disability insurance coverage are borne by the employee (100%).

Regular part-time employees who have completed probation and are normally scheduled to work 45 hours bi-weekly or more of the normal biweekly hours, participate in the benefits program provided the employee does not have the opportunity for comparable coverage elsewhere (for example through a spousal plan or through another employer not governed by this collective agreement).

For eligible regular part-time employees, the employee pays the normal employee share of premiums for those benefits listed in (A) above, plus a portion of the Employer's share on a pro­rata basis (i.e. in inverse proportion to the employee's hours worked in the prior month).

For example, where the ratio of hours worked is:

40.0% of the hours for a full-time employee (i.e. 0.40 FTE) the part-time employee pays the employee's normal share of premiums plus 60.0% of the Employer's share of monthly premiums for those benefits listed in (A) above 66.7% of the hours for a full-time employee (i.e. 0.67 FTE) the part-time employee pays the employee's normal share of premiums plus 33.3% of the Employer's portion of monthly premiums for those benefits listed in (A) above.

McKenzie Towne Care Centre (the "Employer," of the first part)

CANADIAN UNION OF PUBLIC EMPLOYEES, LocalS (the "Union," of the second part)

RE: RESPONSIBILITY OF HEAD COOK

1. The Head Cook's responsibility is to assist the Food Services Supervisor with administrative functions in the Support Services Department, including the responsibility for calling replacement staff.

2. The Parties agree, that in the absence of the Head Cook during the morning shift, the Cook, as deSignated by the Employer, shall receive a premium of seventy-five cents (50.75) cents per hour worked.

This letter of understanding shall expire on October31, 2012.
