− Without express language, Claimant pays for Respondent and it will be included in the award. Without express authority, Tribunal is without power to declare Respondent in default or toprovide death penalty sanctions.

− Suggestion: Add express language in the arbitration provision authorizing the Tribunal to compel Respondent to pay the administration and arbitrator fees and to declare Respondent to be in default for failure to do so. Include express language consenting and authorizing Tribunal to impose death penalty sanctions.
