Our theme this year emphasises the importance of advisors from the estate planning community working together as a team. We are thrilled to bring you an outstanding lineup of speakers who will share their invaluable knowledge and expertise with you through a mix of case studies, plenary presentations and discussion panels. Our presenters will demonstrate the merits of a team of advisors sharing the sandbox: learning together, sharing knowledge, collaborating and connecting. By working together, we can expand and enhance our own individual practice and in turn provide exceptional service to our clients.
We have built in time for question and answer periods at the end of each session and there will also be time for networking and discussion during the coffee and lunch breaks. Our Wine and Cheese Reception at the end of Day One also provides an excellent networking opportunity for attendees to enjoy some social time.

Born in London, England, David attended high
school in Toronto and graduated with a Bachelor
of Arts from the University of Toronto in 1971. After
spending two years travelling and working as a
musician, he began his career in the investment
industry in 1973, working at two different life insurance companies,
where he provided technical support to financial advisors. It was
during this time that David established his business relationship with
John Nicola. In 1985, David joined a major Vancouver investment
advisory firm and spent the next 25 years providing investment and
retirement income planning to clients before joining Nicola Wealth
Management in 2011.

The intent of this case study is to give you exposure to a situation
which, to this point, is not common but will likely become common. In
this case study, we have a hypothetical situation in which a business
owner wants to undertake a very common tax plan called an “estate
freeze” to “freeze” her income tax liability on death and possibly
eliminate that income tax liability over time. As part of the plan, this
business owner wants a tax-deferred transfer of the future growth
in the value of her businesses to her children. Not considered in the
past is what an “estate freeze” can potentially do to the rights of
the spouse or surviving spouse under Wills and Estate Succession
Act (WESA), the Family Law Act and the possible application of the
Fraudulent Preference Act.

Vince has almost three decades of professional
experience in the financial services industry and
is a co-founder and leader of Promerita’s Strategic
Wealth Planning practice.
Vince’s background includes being a member of
Standard Life’s product design team, where he helped to price and
design the company’s first universal life insurance product for the
Canadian marketplace. From there, Vince had a successful career
as an Estate Planning Specialist at RBC Dominion Securities. Vince
has also served on the national advisory board and the compliance
committee for Manulife.
Vince’s technical expertise in pricing and designing complex financial
products and sophisticated planning structures is complemented by
significant experience in addressing family business succession and

Rutsu first joined Richards Buell Sutton LLP as a
summer student in 2011 and returned in 2012 to

Doug joined the insurance industry in 1986 in his
hometown of Regina, Saskatchewan. For his first
eight years, Doug specialized in the farm market
until moving to Saskatoon to focus on corporate
and business insurance. In 2003, Doug joined Daystar as their resident
Tax and Estate Planning Specialist. Now part of HUB Financial, Doug
shares his expertise with brokers across most of the country.
Doug is studying the area of heritage design to help business clients
pass on their values, along with their wealth, to the next genera-
tion. Doug will be Canada’s first Heritage Design Professional (HDP)
sometime in 2015 and he is excited about the possibilities this new
training holds for Canadian business families.

This presentation will focus on how to sell large corporate-owned
life insurance policies to small and medium size business owners.
It will include a brief discussion of the upcoming changes in 2017—specifically, what it will mean to brokers and our clients as well as
a discussion of the popular Immediate Financing Arrangements and
how they work. Doug is not from a head office. He actually uses these
exact ideas to support his family.

Sally is an experienced adviser on all aspects of
the transfer and protection of wealth, including
estate, mental incapacity and business succes-
sion planning. Her practice includes trusts, wills,
corporate reorganizations, powers of attorney, marriage contracts and
shareholders’ agreements. Before focusing on this area, she practised
as a business lawyer for many years and was general counsel at a
major public company. Working collaboratively with clients’ tax and
financial advisors and drawing on the expertise of other lawyers of
the firm on tax, real estate and litigation matters, she creates and
implements comprehensive solutions for individual or business suc-
cession needs. Her clients include individuals of all ages, and family

Topic: New Tax Rules for Trusts and Estates—Implications for Estate
Planning Professionals
This session will provide a non-technical summary of the new tax
rules that will come into force in January 2016. The changes affect
the taxation of estates and testamentary trusts as well as so-called
life interest trusts (spousal, alter ego and joint partner trusts) and are
relevant for all estate planning professionals. The session will cover
both tax and non-tax implications of the changes—including the
impact on common probate planning strategies and charitable dona-
tions and the practical implications for executors and trustees—and
will offer guidance on which of your current and future estate plans
will be affected. Immediate and longer term action items will be rec-
ommended. The goal of the session is to leave you well equipped to
face one of the most significant developments in estate planning in
recent memory.

Will Todd is associate counsel in the firm’s Vancou-
ver office where, since 2008, he has chaired the
Taxation – Wills, Estates and Trusts Practice Group.
He provides tax and estate planning solutions for
Canadian-resident U.S. citizens and their family members and Ca-
nadians holding or acquiring U.S. real property, among others with
cross-border tax exposure. He is a member of the British Columbia
and Ontario bars and is also admitted to practice law in New York

Alison Leaney is a Registered Social Worker and

(except for a two-year leave to work on the National Initiative for the
Care of the Elderly’s Elder Abuse Knowledge to Action Project) in
implementation of BC’s adult guardianship legislation. She is also
currently a National Trainer for the It’s Not Right – Neighbours Friends
and Families initiative.
Alison was recently awarded the Queens Diamond Jubilee Medal for
her work to create a coordinated response to adult abuse and neglect
in BC and Canada and was a finalist for the Premier’s Legacy Award
for the same work in 2010.
Steve Wilson

Steven Wilson is an economic and technical crime
investigator and holds current designations as a
Certified Fraud Examiner and a Certified Financial
Crime Investigator. Steven has also completed
the Forensic Investigation and Technology Degree
Program at the British Columbia Institute of Technology. As part of
his program studies, Steven developed ECISS©‐ Economic Crime
Investigation and Support Services, an innovative resource program
promoting efficient and effective investigative techniques, asset pro-
tection and risk mitigation strategies for both public and private agen-
cies. Steven is also the recipient of the 2013 Simon Fraser University
Gerontology Award for his contribution to the prevention of elder
abuse in British Columbia.
Martha Lewis, LLB, LLM
Executive Director, BCCEAS
Martha Jane Lewis, LLB, LLM, is a practicing law-
yer and executive director of the BC Centre for El-
der Advocacy and Support (“BCCEAS”). BCCEAS
is a charitable organization that delivers programs
to prevent elder abuse.
BCCEAS programs include the Seniors Advocacy and Information
Line, Victims Services Program, Legal Advocacy Program, the Elder
Law Clinic, and Education and Outreach programs.
The Seniors Advocacy and Information Line provides information
to callers who are concerned about older adults being abused. The
Victim Services Program provides information, support and referrals
to people aged 50+ who are victims of abuse.
The legal programs provide legal advice and representation to people
aged 55+ who are not otherwise able to access legal help for issues
such as financial abuse, guardianship and capacity issues, residential
care disputes, and accessing government benefits.

During this discussion, the panelists will focus on soft facts that play a vital role in the successful implementation and execution of trusts: rapport with co-trustees, beneficiaries, institutional trustees where there are irreconcilable family dynamics, including collaboration, personality and introduc-tions before implementation.

Bull Housser
Margaret provides counsel to a wide range of not-
for-profit organizations and charities. She has over
25 years’ experience working with the voluntary
sector and is a frequent writer and speaker both nationally and re-
gionally.
Her practice spans a broad range of issues that affect charities and
not-for-profits, including tax exempt status, governance, interna-
tional programs and social enterprise. Margaret assists charities
and not-for-profits with their corporate structuring, charitable reg-
istration and regulatory compliance issues and has particular ex-
pertise with respect to governance and social enterprise. She also
provides general commercial advice to not-for-profits and charities.
Margaret also advises donors with respect to their philanthrop-
ic planning and has extensive experience with trust and estate
related matters.
Doug Puffer
Director of Planned Giving, Simon Fraser University
Doug Puffer is the Director of Planned Giving for
Simon Fraser University in Burnaby, BC. His office
provides sophisticated donor centred support for
the full range of legacy gift options in both Canada
and the United States. Doug was a Senior Planned
Giving Officer at Queen’s University, and a contributor services rep-
resentative and biologist with Ducks Unlimited.
Doug is a recognized expert in gift planning in Canada with over 26
years of fundraising success in higher education and environmental
conservation. Doug takes a scientific, systematic approach to the busi-
ness of planned giving.
Topic: Technically, An Excellent Planned Gift
A planned gift can be defined as a big donation that requires the help of a pro-fessional advisor. This is because most planned gifts are assets and sometimes they are very complex assets. The most common and simplest planned gifts are appreciated securities and bequests, but they still need expertise to get it right. Sometimes a charitable gift plan starts simple and winds up needing a team of experts to make it seem easy for the donor/client to make good decisions. Margaret Mason and Doug Puffer will talk about a real life example of a technically challeng-ing charitable gift that required the involvement of legal, accounting, real estate, retirement and estate planning advisors in addition to navigating the institutional protocols of a university environment.

Geoffrey White has over 20 years of experience in
wills, estates and trust matters. He acts as Coun-
sel for Clark Wilson LLP and assists clients both in
Vancouver and at his “heritage” office in Kelowna.
He is a frequent author and lecturer for both the legal community
and others.
Geoff is an editor of BC’s Probate & Estate Administration Practice
Manual, which is acknowledged as the primary source for all estate
matters in the province. He has taken on leadership roles with the
Canadian Bar Association, the Society of Estate and Trust Practitio-
ners, and Estate Planning Societies. He has also helped the reform of
BC’s Estate Law with the BC Law Institute—including the delivery of
lawyer education programs for the Wills, Estates and Succession Act.

Faye Wightman, ICD.D, BScN

Services Ltd.
Faye has devoted most of her working life to sup-
porting society through public service—primarily
in the world of philanthropy. From 2005 to 2014,
she led Vancouver Foundation, Canada’s largest
community foundation, through a number of important changes de-
signed to increase its impact in BC communities.
Faye started out as a cardiac nurse but moved to the world of philan-
thropy with the United Way of the Lower Mainland after four years
with the Red Cross in BC. She was President and CEO of BC Children’s
Hospital Foundation for 14 years and Vice President of External Rela-
tions at the University of Victoria for two years, before returning to
Vancouver to lead Vancouver Foundation for over eight years.
She is a director on Coast Capital Savings, BC Housing, the UBC Alum-
ni Association and the Vancouver Board of Trade. She was appointed
by the Government of BC as the interim board chair of Portland Hotel
Society after they experienced a financial and governance crisis.
Faye was recognized as an “Influential Women in Business” by Busi-
ness in Vancouver. She was listed for three years on the Top 50 Pow-
erful Persons in Vancouver; received one of the City of Vancouver’s
highest awards, the Civic Medal, for her community work; and was
awarded the Queens Jubilee medal for her philanthropic work in
Canada.
