When Canada Life started selling insurance in 1847

Things have changed a great deal since then. For one, pine is no longer a preferred flavour of gum.

The province of Canada was a British colony.

Travel from Ottawa to Canada Life headquarters in Hamilton took five days by

horse and buggy.

Golf balls and chewing gum had recently been

invented, and both were made from tree sap.

SHARING THE SANDBOX: AN INTEGRATED APPROACH TO ESTATE PLANNING

1

Dear friends and colleagues—accountants, financial and insurance advisors, lawyers, planned giving officers, trust officers, administrators and support staff,

WELCOME to the 4th Annual Estate Planning Conference! Sharing The Sandbox: An Integrated Approach to Estate Planning

Our theme this year emphasises the importance of advisors from the estate planning community working together as a team. We are thrilled to bring you an outstanding lineup of speakers who will share their invaluable knowledge and expertise with you through a mix of case studies, plenary presentations and discussion panels. Our presenters will demonstrate the merits of a team of advisors sharing the sandbox: learning together, sharing knowledge, collaborating and connecting. By working together, we can expand and enhance our own individual practice and in turn provide exceptional service to our clients.

We have built in time for question and answer periods at the end of each session and there will also be time for networking and discussion during the coffee and lunch breaks. Our Wine and Cheese Reception at the end of Day One also provides an excellent networking opportunity for attendees to enjoy some social time.

As always I would like to extend my sincere thanks to all of our very generous sponsors. The funding and continued support you provide has played a significant role in the growth and success of this conference.

Our Conference Planning Committee was comprised of some familiar faces from our previous conferences and I am extremely grateful for the experience, direction and continuity they provided. We were also delighted to welcome some new members to the committee, and I think that we have all benefited from the fresh and energetic perspective they brought to the table. Charlene Taylor, VGH & UBC Hospital Foundation; Netty Vogel, Vogels Financial Services; Pat McGuire, Rogers Group Financial; Rose Shawlee, Richards Buell Sutton LLP; Tom Morton, Smythe CPA; Will Todd, DLA Piper; and Suzanne Schulhof, Cara Consulting—thank you all for your tremendous efforts and commitment!

Finally, to all of you: thank you for taking the time out of your busy schedules to be here with us over the next couple of days. We hope you enjoy the conference and we look forward to seeing you all again in 2016.

Abandoned or unclaimed property may seem like a minor concern for tax, finance and accounting departments, but it can represent a significant legal liability for companies.

The British Columbia Unclaimed Property Society is a not-for-profit society which administers the unclaimed property program in British Columbia. We work with companies and organizations to help them comply with the Unclaimed Property Act. We also help reunite owners with their forgotten money by administering a public database of dormant accounts and processing eligible claims to help put forgotten money back in the hands of the rightful owners.

CASE STUDY 1—HOW A COMMONLY USED TAX PLAN CAN POTENTIALLY RUN AFOUL OF THE RIGHTS OF A SPOUSE UNDER THE FAMILY LAW ACT AND THE WILLS AND ESTATE SUCCESSION ACT 10:30 AM

MASTER OF CEREMONIES

DAY ONE | OCTOBER 20

DAY ONE

The intent of this case study is to give you exposure to a situation

which, to this point, is not common but will likely become common. In

this case study, we have a hypothetical situation in which a business

owner wants to undertake a very common tax plan called an “estate

freeze” to “freeze” her income tax liability on death and possibly

eliminate that income tax liability over time. As part of the plan, this

business owner wants a tax-deferred transfer of the future growth

in the value of her businesses to her children. Not considered in the

past is what an “estate freeze” can potentially do to the rights of

the spouse or surviving spouse under Wills and Estate Succession

Act (WESA), the Family Law Act and the possible application of the

Fraudulent Preference Act.

DAY ONE

8:45 to 9:30 am

Doug Markewich, CLU, CH.F.C., TEP

Markewich Financial

Doug joined the insurance industry in 1986 in his

hometown of Regina, Saskatchewan. For his first

eight years, Doug specialized in the farm market

until moving to Saskatoon to focus on corporate

and business insurance. In 2003, Doug joined Daystar as their resident

Tax and Estate Planning Specialist. Now part of HUB Financial, Doug

shares his expertise with brokers across most of the country.

Doug is studying the area of heritage design to help business clients

pass on their values, along with their wealth, to the next genera-

tion. Doug will be Canada’s first Heritage Design Professional (HDP)

sometime in 2015 and he is excited about the possibilities this new

training holds for Canadian business families.

Topic: Do’s and Don’ts of Corporate Insurance in Tax

and Estate Planning

This presentation will focus on how to sell large corporate-owned

life insurance policies to small and medium size business owners.

It will include a brief discussion of the upcoming changes in 2017—specifically, what it will mean to brokers and our clients as well as

a discussion of the popular Immediate Financing Arrangements and

how they work. Doug is not from a head office. He actually uses these

exact ideas to support his family.

9:30 - 10:15am

Sally Dennis

Partner, Farris

Sally is an experienced adviser on all aspects of

the transfer and protection of wealth, including

estate, mental incapacity and business succes-

sion planning. Her practice includes trusts, wills,

corporate reorganizations, powers of attorney, marriage contracts and

shareholders’ agreements. Before focusing on this area, she practised

as a business lawyer for many years and was general counsel at a

major public company. Working collaboratively with clients’ tax and

financial advisors and drawing on the expertise of other lawyers of

the firm on tax, real estate and litigation matters, she creates and

implements comprehensive solutions for individual or business suc-

cession needs. Her clients include individuals of all ages, and family

and other private businesses, large and small.

Topic: New Tax Rules for Trusts and Estates—Implications for Estate

Planning Professionals

This session will provide a non-technical summary of the new tax

rules that will come into force in January 2016. The changes affect

the taxation of estates and testamentary trusts as well as so-called

life interest trusts (spousal, alter ego and joint partner trusts) and are

relevant for all estate planning professionals. The session will cover

both tax and non-tax implications of the changes—including the

impact on common probate planning strategies and charitable dona-

tions and the practical implications for executors and trustees—and

will offer guidance on which of your current and future estate plans

will be affected. Immediate and longer term action items will be rec-

ommended. The goal of the session is to leave you well equipped to

face one of the most significant developments in estate planning in

recent memory.

PANEL DISCUSSION B—HOW TO BE A SOFTIE: BE-ING ALERT TO THE SOFT ISSUES IN CREATING AND ADMINISTERING TRUSTS | 8:45 AM

Most advisors are aware of the hard facts related to creating and administering trusts: tax, legal, client intentions, disability benefits, jurisdiction and mechanics of administration. During this discussion, the panelists will focus on soft facts that play a vital role in the successful implementation and execution of trusts: rapport with co-trustees, beneficiaries, institutional trustees where there are irreconcilable family dynamics, including collaboration, personality and introduc-tions before implementation.

In this case study, the panelists will focus on a family-owned business that has seen tremendous growth over the past ten years. In addition to focusing on the principals of the business, their three children, one with a significant disability, will also be considered in the analysis. Doug is a recognized expert in gift planning in Canada with over 26

years of fundraising success in higher education and environmental

conservation. Doug takes a scientific, systematic approach to the busi-

ness of planned giving.

Topic: Technically, An Excellent Planned Gift

A planned gift can be defined as a big donation that requires the help of a pro-fessional advisor. This is because most planned gifts are assets and sometimes they are very complex assets. The most common and simplest planned gifts are appreciated securities and bequests, but they still need expertise to get it right. Sometimes a charitable gift plan starts simple and winds up needing a team of experts to make it seem easy for the donor/client to make good decisions. Margaret Mason and Doug Puffer will talk about a real life example of a technically challeng-ing charitable gift that required the involvement of legal, accounting, real estate, retirement and estate planning advisors in addition to navigating the institutional protocols of a university environment.

Topic: WESA 58: Hot Topics in Changes to Rules and Estates

Legislation

The estate “rules” changed last year. How are the changes affecting you? Will your clients ruin their estate plans with “napkin wills”? Will you end up in court testifying about your file notes? Should a will matter anymore? What are the key “flags” that your client’s estate needs more attention?

Topic: Philanthropy and Estate Planning—How to Make the

Connection

You have had the discussion on what your client wants to do when they pass away with respect to their spouse/partner and family. You believe you should raise the idea of giving something back to the community. But you aren’t sure what is the best way to raise the issue. What are the potential issues or argu-ments the client may put forward that may make it uncomfortable to raise the

issue? What if they ask your advice about where to make a donation—what role should you play in those decisions? Do you feel comfortable discuss-ing why philanthropy should be part of every one’s estate planning? Our final keynote speaker will address this issue and offer concrete advice about how to raise this delicate topic and where to turn to for additional advice for your clients.
