4. The number of cases in recent years of civilians or members of An Garda Siochana who were arrested for suspected fraud related to sick notes.

Between 2016 and 2019, three disciplinary investigations have been undertaken to investigate allegations concerning the altering of medical certificates and the claiming of allowances whilst on sick leave. One was found not to be in breach of discipline. The other investigations are still ongoing.

5. The related policy and practice within An Garda Siochana for dealing with suspected fraud related to sick leave. Please provide details on the criteria for escalating such a matter from a HR issue to being grounds for an arrestable offence.

The Anti-Fraud policy of An Garda Sfochana in respect of Garda members and Garcia Staff entitled the "Garcia Siochana Anti-Fraud Policy" aims to provide a clear statement on the position of An Garda Sfochana on fraud. The policy commits to dealing promptly and firmly with those who defraud the Garda organisation. All allegations of fraud within the Garda organisation are investigated as crime. Additional disciplinary investigations may be undertaken in accordance with the Garcia Sfochana (Discipline) Regulations, 2017 and Civil Service Disciplinary Code.

Where cases of fraud are suspected they are escalated for criminal investigation when necessary, Where instances of non-compliance with the sick leave regulations, falsification of records, etc. are reported to HR, the Civil Service Disciplinary Code may be invoked for misconduct/serious misconduct. The disciplinary proceedings may be put in abeyance pending the outcome of a criminal investigation.
