SESSION OF 2000 Act 2000-67 483 No. 2000-67 AN ACT HB 14 Amending the act of July 31, 1968 (P.L.805, No.247), entitled, as amended, “An act to empower cities of the second class A, and third class, boroughs, incorporated towns, townships of the first and second classes including those within a county of the second class and counties of the second through eighth classes, individually or jointly, to plan their development and to govern the same by zoning, subdivision and land development ordinances, planned residential development and other ordinances, by official maps, by the reservation of certain land for future public purpose and by the acquisition of such land; to promote the conservation of energy through the use of planning practices and to promote the effective utilization of renewable energy sources; providing for the establishment of planning commissions, planning departments, planning committees and zoning hearing boards, authorizing them to charge fees, make inspections and hold public hearings; providing for mediation; providing for transferable development rights; providing for appropriations, appeals to courts and penalties for violations; and repealing acts and parts of acts,” adding definitions; providing for intergovernmental cooperative planning and implementation agreements; further providing for repeals; and making an editorial change. The General Assembly of the Commonwealth of Pennsylvania hereby enacts as follows: Section 1. Section 107(a) of the act of July 31, 1968 (P.L.805, No.247), known as the Pennsylvania Municipalities Planning Code, reenacted and amended December 21, 1988 (P.L. 1329, No.170), is amended by adding definitions to read: Section 107. Defmitions.—(a) The following words and phrases when used in this act shall have the meanings given to them in this subsection unless the context clearly indicates otherwise: “Designated growth area,” a region within a county or counties described in a municipal or multimunicipal plan that preferably includes and surrounds a city, borough or village and within which residential and mixed use development is permitted or planned for at densities of one unit to the acre or more, commercial, industrial and institutional uses are permitted or planned for and public infrastructure services are provided or planned. “Development of regional significance and impact,” any land development that, because of its character, magnitude or location, will have substantial effect upon the health, safety or welfare of citizens in more than one municipality. “Future growth area,” an area of a municipal or multimunicipal plan outside of and adjacent to a designated growth area where residential, commercial, industrial and institutional uses and development are

The GeneralAssembly of the Commonwealthof Pennsylvaniaherebyenactsasfollows:

Section1. Section 107(a)of the act of July 31, 1968 (P.L.805,No.247),known as the PennsylvaniaMunicipalities Planning Code,reenactedandamendedDecember21, 1988 (P.L.1329, No.170), is amendedby addingdefinitionstoread:

Section 107. Defmitions.—(a) The following wordsandphraseswhenusedin this act shall havethe meaningsgiven to them in this subsectionunlessthecontextclearlyindicatesotherwise:

“Designated growth area,” a region within a county or countiesdescribedin a municipalor multimunicipalplan that preferablyincludesandsurroundsa city, boroughor village andwithin which residentialandmixedusedevelopmentispermittedorplannedfor at densitiesofoneunitto the acre or more, commercial, industrial and institutional usesarepermittedor plannedfor andpublic infrastructureservicesare providedorplanned.

“Development of regional significance and impact,” any landdevelopmentthat, becauseof its character, magnitudeor location, willhavesubstantialeffectupon the health, safetyor welfare of citizens inmorethanonemunicipality.

“Future growth area,” an area of a municipal or multimunicipalplanoutsideof and adjacentto a designatedgrowth area whereresidential,commercial, industrial and institutional uses and developmentare

permitted or planned at varying densities and public infrastructureservicesmay or may not be provided,butfuture developmentat greaterdensitiesis plannedto accompanythe orderly extensionandprovisionofpublic infrastructureservices.

“Multimunicipal plan,” a plandevelopedandadoptedby anynumberof contiguous municipalities, including a joint municipal plan asauthorizedby thisact.

“Public infrastructurearea,” a designatedgrowth area andall or anyportion of afuture growtharea describedin a countyor multimuniipalcomprehensiveplan wherepublic infrastructureserviceswill beprovidedand outsideof which such public infrastructure serviceswill not berequiredto bepubliclyfinanced.

“Public infrastructureservices,” servicesthat are provided to areaswith densitiesof one or more units to the acre, which may includesanitary sewersandfacilitiesfor the collectionandtreatmentofsewage,water linesandfacilitiesfor thepumpingandtreatingof water,parksandopenspace,streetsandsidewalks,public transportationandotherservicesthat may be appropriate within a growth area, but shall excludefireprotectionandemergencymedicalservicesandanyotherservicerequiredtoprotectthe healthandsafetyofresidents.

“Rural resource area,” an area described in a municipal ormultimunicipalplan within which rural resourceusesincluding, but notlimited to, agriculture, timbering,mining, quarryingand otherextractiveindustries, forest and game lands and recreation and tourism areencouragedand enhanced,developmentthat is compatible with orsupportiveofsuchusesispermittedandpublic infrastructureservicesarenotprovidedexceptin villages.

“Specificplan,” a detailedplanfor nonresidentialdevelopmentofanarea coveredby a municipal or multimunicipal comprehensiveplan,which, when approvedand adoptedby the participating municipalitiesthrough ordinancesand agreements,supersedesall other applicableordinances.

“Village,” an unincorporatedsettlementthat is part of a townshipwhereresidentialandmixedusedensitiesofoneunit to the acreor moreexist or are permittedand commercial, industrial or institutional usesexistorarepermitted.

Section2. Sections916.1and 1006-Aof the actareamendedby addingsubsectionstoread:

(h) Where municipalities have adopted a multimunicipalcomprehensiveplanpursuantto Article XI but havenot adoptedajointmunicipal ordinancepursuantto Article Vhf-A and all municipalitiesparticipatingin the multimunicipalcomprehensiveplanha-readoptedandare administering zoning ordinancesgenerally consistentwith theprovisionsofthe multimunicipalcomprehensiveplan anda challengeisbrought to the validity of a zoning ordinance of a participatingmunicipality involvinga proposeduse, thenthe zoninghearingboardorgoverningbody,as the casemaybe, shall considertheavailability ofusesunderzoning ordinanceswithin the municipalitiesparticipating in themultimunicipalcomprehensiveplan within a reasonablegeographicareaand shall not limit its considerationto the application of the zoningordinance on the municipality whose zoning ordinance is beingchallenged.

Section 1006-A. JudicialRelief._* * *

(b.1) Where municipalities have adopted a multimunicipalcomprehensiveplanpursuantto Article XI but havenot adopteda jointmunicipal ordinancepursuantto Article Vhf-A and all municipalitiesparticipating in themultimunicipalcomprehensiveplan haveadoptedandare administrating zoning ordinancesgenerally consistent with theprovisionsof the multimunicipalcomprehensiveplan anda challengeisbrought to the validity of a zoning ordinance of a participatingmunicipality involvinga proposeduse, thenthe court shall considertheavailability of usesunderzoning ordinanceswithin the municipalitiesparticipating in the multimunicipal comprehensiveplan within areasonablegeographicarea andshall not limit its considerationto theapplication of the zoning ordinanceon the municipality whosezoningordinanceis beingchallenged.

Section 3. The headingof Article XI andsections1101, 1102, 1103,1104,1105, 1106and1107of theactareamendedto read:

ARTICLE XI[Joint MunicipalPlanningCommissions]IntergovernmentalCooperativePlanning

andImplementationAgreements

Section 1101. [LegislativeFinding andDeclarationof Policy.—.Forthe purposeof encouragingmunicipalitiesto effectively plan for theirfuture developmentandto coordinatetheir planningwith neighboringmunicipalities, counties and other governmental agencies, andpromotinghealth,safety, moralsandthegeneralwelfareof the variousareasin the Commonwealththroughthe effectivedevelopmentof suchareas,the following powersfor theestablishmentandoperationof jointmunicipal planningcommissionsareherebygranted.]Purposes.—Itisthepurposeofthisarticle:

(1) Toprovidefordevelopmentthat is compatiblewithsurrounding-land usesand that will complementexistinglanddevelopmentwith abalanceofcommercial,industrialandresidentialuses.

(2) ToprotectandmaintaintheseparateidentityofPennsylvania’scommunitiesand to preventthe unnecessaryconversionof valuableandlimitedagricultural land.

(3) To encouragecooperation and coordinatedplanning amongadjoining municipalitiesso that eachmunicipalityaccommodatesitsshare of the multimunicipal growth burden and does not induceunnecessaryorprematuredevelopmentofrural lands.

(4) To minimizedisruption of the economyand environmentofexistingcommunities.

(5) To complementthe economicand transportationneedsof theregionandthis Commonwealth.

(6) Toprovidefor thecontinuationofhistoriccommunitypatterns.(7) To providefor coordinatedhighways, public servicesand

development.(8) To ensure that newpublic water and wastewatertreatment

systemsare constructedin areas that will result in the efficientutilization of existing systems,prior to the developmentandconstructionofnewsystems.

(9) To ensurethat newor major extensionof existingpublic waterand wastewatertreatmentsystemsareconstructedonly in Ehoseareaswithin which anticipatedgrowth and developmentcanadequatelybesustainedwithin the financial and environmentalresourcesof thearea.

(10) To identify those areas wheregrowth and developmentwilloccurso that afull rangeofpublic infrastructureservices,includingsewer, water, highways,police and fire protection, public schools,parks,open spaceand otherservices,canbe adequatelyplannedandprovidedasneededto accommodatethegrowth thatoccurs.

(11) To encourageinnovations in residential, commercialandindustrial developmentto meetgrowing populationdemandsby anincreasedvariety in type, designand layout of structuresand by theconservationand more efficientuseof openspaceancillary to suchstructures.

(12) Tofacilitate the developmentofaffordableandother typesofhousing in numbersconsistentwith the needfor such housingasshownbyexistingandprojectedpopulationand employmentdatafortheregion.Section 1102. [Creation, Appointment and Operation of Joint

Municipal Planning Commission.—Thegoverning bodies of two ormoremunicipalitiesmayby ordinanceauthorizethe establishmentandparticipationor membershipin and support of, a joint municipalplanningcommission.The numberandqualificationsof the membersof

suchplanningcommissionand their termsandmethodof appointmentor removalshall be suchas maybe determinedandagreeduponby thegoverningbodies.Membersof a joint municipal planningcommissionshall servewithout salary but maybe paid expenses,incurredin theperformanceof their duties.The joint municipal planningcommissionshall electachairmanwhose term shall not exceedone yearandwhoshallbeeligible for reelection.The commissionmaycreateandfill suchother offices as it may determine.Every joint municipal planningcommission shall adopt rules for the transactions, findings anddeterminations, which record shall be a public record. Eachparticipatingor membermunicipalitymayfrom time to time, upontherequestof the joint municipal planningcommission,assignor detail tothe commissionany employeesof the municipality to make specialsurveys or studies.] IntergovernmentalCooperative Planning andImplementationAgreements.—.Forthe purpose of developing,adoptingand implementinga comprehensiveplanfor the entire countyor for anyarea within the county, the governingbodiesof municipalities locatedwithin the county or counties may enter into intergovernmentalcooperativeagreements,as provided by 53 Pa.C,S. Ch. 23 Subch.A(relating to intergovernmentalcooperation), exceptfor any provisionspermitting initiative and referendum.Such agreementsmay also beenteredinto betweenandamongcountiesandmunicipalitiesfor areasthat include municipalitiesin more than one county, and betweenandamongcounties,municipalities,authoritiesandspecialdistrictsprovidingwater and sewerfacilities, transportationplanning or other serviceswithin the area of a plan and with the opportunity for the activeparticipationofStateagenciesandschooldistricts. Implementationofthecomprehensiveplan and subdivision and zoning ordinancesshall beaccomplishedin accordancewith articlesofthisact.

Section 1103. [Finances,Staff and Program..—4a) The governingbodiesof municipalitiesshall have the authorityto appropriatefundsfor the purposeof contributingto the operationof ajoint municipalplanningcommission.A joint municipal planningcommission,with theconsentof all the governingbodies,may also receivegrantsfrom theFederalor State governments,or from individualsor foundations,andshall havethe authority to contracttherewith.Every joint municipalplanningcommissionshallhavethe power to appointsuch employeesand staff as it may deem necessaryfor its work, and contractwithplannersandother consultantsfor the servicesit may require to theextentpermittedby its financial resources,Eachsuchcommissionmayalso perform planning servicesfor any municipality which is not amemberthereofandmaychargefeesfor the work. A joint municipalplanningcommissionmayalsoprepareandsell maps,reports,bulletinsor othermaterialandestablishreasonablechargestherefor.

(a.!) A joint municipalplanningcommissionshall,at the requestofthe governingbodies of the participatingor membermunicipalities,havethe powerandshall be requiredto undertakeanyof the activitiesspecified in section 209.1. Such activities shall relate to the areaencompassedby theparticipatingor membermunicipalities.

(b) For this purpose,ajoint municipalplanningcommissionmay,with the consentof all the governing bodies, acceptand utilize anyfunds, personnelor otherassistancemadeavailableby the FederalorState governmentsor any of their agencies,or from individuals orfoundations,and for the purposesof receivingand using FederalorStateplanninggrantsfor provision of planningassistancemay enterinto agreementsor contractsregardingacceptanceor utilization of thefundsor assistance.

(c) The ordinance which creates a joint municipal planningcommissionshall:

(1) Statethe purposefor thecreationof theplanningcommission.(2) Specify which of the activities identified by this act thejoint

municipalplanningcommissionshallbeauthorizedto undertak-e.(3) Specifywhich activitiesshall remainwith the local planning

commissions,whentheyareretained.(4) Specify the notice and procedures which a member

municipality mustfollow whenwithdrawingfrom thejoint municipalplanningcommission.

(5) Specify the notice and procedureswhen the membermunicipalities decide to dissolve the joint municipal planningcommission.] County or Multimunicipal ComprehensivePlans.—(’a) The comprehensiveplan that is the subject of anagreementmay bedevelopedby themunicipalitiesor, atthe requestofthe municipalities,by the countyplanningagency,or agenciesin thecaseof a plan coveringmunicipalities in more than one county, incooperationwith municipalitieswithin the areaand shall includealltheelementsrequiredorauthorizedin section301for theregionoftheplan, includinga plan to meetthe housingneedsofpresentresidentsand those individualsandfamiliesanticipatedto residein the area oftheplan, which mayincludeconservationofpresentlysoundhousing,rehabilitation of housing in declining neighborhoods and theaccommodationsofexpectednew housingin differentdwelling typesand of appropriate densitiesfor householdsofall incomelevels.Theplanmay:

(1) Designategrowthareaswhere:(i) Orderly and efficient developmentto accommodatethe

projectedgrowth ofthe area within the next20 yearsis plannedforresidentialandmixedusedensitiesofoneunit or moreperacre.

(ii) Commercial,industrialand institutional usestoprovideforthe economicandemploymentneedsofthe areaand to insurethatthearea hasan adequatetaxbaseareplannedfor.

(iii) Servicesto servesuchdevelopmentareprovidedorplannedfor.(2) Designate potential future growth areas where future

developmentis planned for densities to accompanythe orderlyextensionandprovisionofservices.

(3) Designaterural resourceareas,ifapplicable, where:(i) Ruralresourceusesareplannedfor.(ii) Developmentat densitiesthat are compatiblewith rural

resourceusesare ormaybepermitted.(iii) Infrastructureextensionsor improvementsarenot intended

to be publicly financedby municipalities,exceptin villages, unlesstheparticipating or affectedmunicipalitiesagreethat suchserviceshouldbeprovidedto an areafor health or safetyreasonsor to accomplishoneormoreofthepurposessetforth insection1101.

(4) Planfor the accommodationofall categoriesofuseswithin theareaoftheplan,provided,however,that all usesneednot beprovidedin everymunicipality but shall beplannedand providedfor within areasonablegeographicareaoftheplan.

(5) Planfor developmentsof areawidesign4flcanceand impact,particularly thoseidentifiedin section301(3)and(4).

(6) Plan for the conservationand enhancementof the natural,scenic,historicandaestheticresourceswithin theareaoftheplan.(b) Thecountymayfacilitate a multimunicipalprocessandmay:enter

into cooperativeplanningagreementswith participating municipalitiesgoverningparticularplanningsubjectsandresponsibilities.Theplanningprocessshall include a public participation processto assurethat allgoverningbodies, municipal authorities, schooldistricts and agencies,whetherpublicorprivate,havingjurisdictionor operatingwithin the areaof the plan and landownersand citizens affectedby the plan haveanopportunity to be heardprior to the public hearingsrequiredfor theadoptionoftheplanundersection302(a).

(c) Adoptionofthe plan andplan amendmentsshall conformto therequirementsof section302 andmay be reflectedon the official mapofeachparticipating municipalitypursuantto section401. Wherea countyandmunicipalityhavedevelopedandadopteda comprehens~ecountyormultimunicipal plan that conformsto the requirementsof this articlewithinfiveyearsprior to the dateofadoptionof thisarticle, theplanmaybe implementedbyagreementsasprovidedfor in thisarticle.

Section1104. [Preparationof ComprehensivePlan.—(a)Everyjointmunicipal planning commission may prepare and maintain acomprehensiveplan, in accordancewith the provisionsof this act, forthe guidanceof thecontinuingdevelopmentof the areaencompassedby

the participatingor membermunicipalities.The governingbodiesshallhavethepower to adoptandamendthejoint municipal comprehensiveplan. Said joint municipal comprehensiveplanshall be aprerequisitefor ajoint municipal zoningordinanceasspecifiedin thisact.

(b) Such joint municipal comprehensiveplan shall specificallyidentify issuesof significanceto the areawhich is encompassedby theparticipating or member municipalities and shall specify thosemunicipal activities which will require coordinationor cooperationamongthem.

(c) In the preparationof the joint municipal comprehensiveplan,considerationshall be given to the comprehensiveplans of the county,adjoining municipalities and the member or participatingmunicipalitiesin orderthattheobjectivesof eachplancanbeprotectedto the greatestextentpossible and to attain consistencybetweenthevarious plans and the joint municipal comprehensive plan.]implementationAgreements.—(a)In orderto implementmultimunicipalcomprehensiveplans under section 1103, counties and municipalitiesshall have authority to enter into intergovernmental cooperativeagreements.

(b) Cooperativeimplementationagreementsshall:(1) Establishthe processthat the participating municipalitieswill

use to achieve general consistency between the county ormultimunicipal comprehensiveplan and zoning ordinances,subdivision and land developmentand capital improvementplanswithin participating municipalities, includingadoption ofconformingordinancesby participating municipalities within two yearsand amechanismfor resolving disputes over the interpretation of themultimunicipal comprehensiveplan and the consistency ofimplementingplansandordinances.

(2) Establishaprocessfor reviewandapprovalofdevelopmentsofregional significance and impact that are proposedwithin anyparticipatingmunicipality.Subdivisionandlanddevelopmentapprovalpowersunder thisact shall only be exercisedby the municipality inwhich the property where the approval is sought. Under nocircumstancesshall a subdivisionor land developmentapplicant berequiredto undergomorethan oneapprovalprocess.

(3) Establish the role and responsibilities of participatingmunicipalitieswith respectto implementationof the plan, includingthe provision of public infrastructure services within participatingmunicipalities as described in subsection(d), the provision ofaffordablehousingandpurchaseofrealproperty, including rights-of-wayandeasements.

(4) Requirea yearly report by participating municipalitiesto thecountyplanning agencyand by the county planning agencyto theparticipatingmunicipalitiesconcerningactivitiescarried outpursuant

to the agreementduring the previousyear. Suchreportsshall includesummariesofpublic infrastructureneedsin growthareasandprogresstoward meetingthose needsthrough capital improvementplans andimplementingactions and reports on developmentapplicationsanddispositionsfor residential,commercialand industrialdevelopmentineach participating municipality for the purpose of evaluating theextentofprovisionforall categoriesof useandhousingfor all incomelevelswithin theregion oftheplan.

(5) Describeanyotherdutiesandresponsibilitiesasmaybeagreeduponby theparties.(c) Cooperative implementationagreementsmay designategrowth

areas,future growthareasandrural resourceareaswithin the plan. Theagreementshall alsoprovidea processfor amendingthe multimunicipalcomprehensiveplan and redefining the designatedgrowth area, futuregrowtharea andrural resourcearea within theplan.

(d) The county may facilitate convening representativesofmunicipalities, municipal authorities, special districts, public utilities,whetherpublic or private, or otheragenciesthat provide or declareaninterest in providing a public infrastructure service in a publicinfrastructureservice area or a portion ofapublic infrastructureservicearea within a growth area,asestablishedin a countyor multimunicipalcomprehensiveplan, for the purpose of negotiatingagreementsfor theprovision of such services. The county may provide or contract withothers to provide technicalassistance,mediation or dispute resolutionservicesin orderto assistthepartiesin negotiatingsuchagreements.

Section 1105. [Cooperation Among Joint Municipal PlanningCommission, Municipalities and Others.—Every joint municipalplanning commission shall encourage the cooperation of theparticipatingmunicipalitiesin matterswhich concernthe integrity ofthe comprehensiveplanor mapspreparedby the commission,and, asan aid toward coordination,all municipalitiesandpublic officials shallupon requestfurnish to thejoint municipalplanningcommissionwithinareasonabletime the availablemaps,plans,reports,statisticalor otherinformation such commission may require for its work.] LegalEffect.—(a) Where municipalitieshave adopteda county plan or amultimunicipalplan is adoptedunder this article and the participatingmunicipalitieshaveconformedtheir local plans and ordinancesto thecounty or mnultimunicipalplan by implementingcooperativeagreementsand adoptingappropriateresolutionsand ordinances,thefollowingshallapply:

(1) Sections916.1and1006-4.(2) Stateagenciesshall considerandmayrely upon comprehensiec

plans and zoning ordinanceswhen reviewing applications for thefundingorpermittingofinfrastructureorfacilities.

(3) State agencies shall consider and may give priorityconsiderationto applicationsfor financial or technicalassistanceforprojectsconsistentwith thecountyormultimunicipalplan.(b) Participatingmunicipalitiesthat haveenteredinto implementation

agreementsto carry outa county ormultimunicipalplan asdescribedinthisarticle shallhavethefollowingadditionalpowers:

(1) Toprovide by cooperativeagreementfor the sharing of taxrevenuesandfeesby municipalitieswithin the regionoftheplan.

(2) Toadopta transferofdevelopmentrightsprogramby adoptionofan ordinanceapplicable to the regionofthe plan soas to enabledevelopmentrights to betransferredfrom rural resourceareas in anymunicipality within the plan to designatedgrowth areas in anymunicipalitywithin theplan.(c) Nothing in this article shall be construed to authorize a

municipality to regulatethe allocation or withdrawal of water resourcesbya municipalauthorityor watercompanythat is otherwiseregulatedbythe PennsylvaniaPublic Utility Commissionor other Federal or Stateagenciesorstatutes.

(d) Exceptasprovidedin section619.2,nothingin thisarticle shall beconstruedas limiting the authority of the PennsylvaniaPublic UtilityCommission over the implementation, location, construction andmaintenanceofpublicutility facilitiesandthe renderingofpublicutilityservicesto thepublic.

Section 1106. [Established Regional PlanningCommission.—Municipalitieswhich are presentlyparticipating in anexisting regional planningcommission or a joint municipal planningcommissionshall complywith andbe governedby the provisionsof thisact within five yearsfrom the effectivedate of this amendatoryact.]SpecificPlans.—(a) Participating municipalitiesshall haveauthority toadopt a specificplanfor the systematicimplementationof a county ormultimunicipal comprehensiveplanfor any nonresidentialpart of thearea coveredby the plan. Suchspecificplan shall includea textand adiagram or diagramsand implementingordinanceswhich specifyall ofthefollowingin detail:

(1) Thedistribution, location,extentofareaandstandardsfor landusesandfacilities, including designof sewage,water, drainageandotheressentialfacilitiesneededtosupportthelanduses.

(2) The location, classificationand designof all transportationfacilities, including, but not limited to, streetsand roads neededtoservethelandusesdescribedin thespecificplan.

(3) Standardsfor population density, land coverage, buildingintensityandsupportingservices,includingutilities.

(4) Standardsfor the preservation,conservation,developmentanduseofnatural resources,including the protectionofsignificant open

spaces,resourcelandsandagricultural landswithin or adjacentto thearea coveredby thespecificplan.

(5) A program ofimplementationincludingregulations,financingofthe capital improvementsandprovisionsfor repealingor amendingthe specific plan. Regulationsmay include zoning, storm water,subdivision and land development,highway accessand any otherprovisionsfor whichmunicipalitiesareauthorizedby law to enact.Theregulationsmaybe amendedinto the countyor municipal ordinancesor adoptedasseparateordinances.If enactedasseparateordinancesfor the area coveredby the specificplan, the ordinancesshall repealand replaceany countyor municipalordinancesin effectwithin thearea coveredby thespecificplan, andordinancesshall conformto theprovisionsofthe specificplan.(b) (1) No specificplan may be adoptedor amendedunless theproposedplan or amendmentis consistentwith an adoptedcountyormultimunicipalcomprehensiveplan.

(2) No capitalprojectby anymunicipal authorityor municipalityshall be approvedor undertakenand nofinal plan, developmentplanor plat for anysubdivisionor developmentoflandshall be approvedunlesssuch projects,plans or plats are consistentwith the adoptedspecificplan.(c) In adopting or amending a specific plan, a county and

participating municipalitiesshall usethe sameproceduresasprovidedinthisarticleforadoptingcomprehensiveplansandordinances.

(d) Whenevera specificplan has been adopted, applicants forsubdivisionor landdevelopmentapprovalshall berequiredtosubmitonlya final plan asprovided in Article V, providedthat suchfinal plan isconsistentwith andimplementstheadoptedspecWcplan.

(e) A county or counties and participating municipalities areprohibitedfrom assessingsubdivisionand land developmentapplicantsfor thecostofthespecificplan.

Section 1107. Saving Clause.—(a) The passageof this act and therepealby it of any prior enablinglaws relating to regionalplanningshallnot invalidate any regionalplanningcommissioncreatedundersuchotherlaws. This act, in such respect,shall be deemed a continuation andcodificationof suchprior enablinglaws.

(b) The amendmentof this article shall not invalidate any jointmunicipalplanning commissionestablishedundertheformerprovisionsof this article. A joint municipalplanningcommissionshall continuetofunctionunderthe amendedprovisionsofthisarticle.

Section4. Section1202of theactis amendedtoread:Section 1202. GeneralRepeal.—Allother acts and partsof acts are

repealedin so far as they are inconsistentherewith,but this actshall notrepealor modifyanyof theprovisionsof 66Pa.C.S,Pt. I (relating topublicutility code), 68 Pa.C.S.Pt. II Subpt. B (relating to condominiums)~,the

“Public Utility Law,”] or any laws administeredby the Departmentof[Highways]Transportationof theCommonwealthof Pennsylvania.

Section5. Thisactshalltakeeffect in 60 days.
