Second Amendment Foundation BELLEVUE, WA --(Ammoland.com)- On March 16, the New Jersey Attorney General filed its final lower court response in the recently-filed lawsuit challenging New Jersey’s extreme and subjective handgun carry laws. As in its previous papers, the Attorney General again trashed the Second Amendment, arguing that the right to bear arms does not apply outside the home, and that New Jersey’s carry laws are constitutional and necessary to protect the public from those who legally carry firearms. The federal lawsuit, filed in November of last year by Association of New Jersey Rifle and Pistol Clubs, the Second Amendment Foundation, and six individual plaintiffs, challenges New Jersey’s unconstitutional “justifiable need” standard for issuance of handgun carry permits – a nearly impossible standard to meet that has all but eliminated the right to self defense with a firearm in the Garden State. “It is now crystal clear that the State of New Jersey has no intention of ever respecting the right to defend yourself with a firearm outside the home, and will have to be dragged, kicking and screaming, into compliance with the Heller and McDonald decisions,” said ANJRPC President Scott Bach. “With this lawsuit, we intend to do just that, even if we have to go all the way to the U.S. Supreme Court,” said Bach. BELLEVUE, WA --(Ammoland.com)- On March 16, the New Jersey

Attorney General filed its final lower court response in the recently-filed

lawsuit challenging New Jersey’s extreme and subjective handgun carry

laws.

As in its previous papers, the Attorney General again trashed the Second

Amendment, arguing that the right to bear arms does not apply outside

the home, and that New Jersey’s carry laws are constitutional and

necessary to protect the public from those who legally carry firearms.

The federal lawsuit, filed in November of last year by Association of New

Jersey Rifle and Pistol Clubs, the Second Amendment Foundation, and

six individual plaintiffs, challenges New Jersey’s unconstitutional

“justifiable need” standard for issuance of handgun carry permits – a

nearly impossible standard to meet that has all but eliminated the right

to self defense with a firearm in the Garden State.

“It is now crystal clear that the State of New Jersey has no

intention of ever respecting the right to defend yourself with

a firearm outside the home, and will have to be dragged,

kicking and screaming, into compliance with the Heller and

McDonald decisions,” said ANJRPC President Scott Bach.

Anti-Gun Group Sends Paid Impostor to Testify at Maryland

House Hearings

The group, Ceasefire Maryland, continues to trade off of the name and

misrepresent itself before the General Assembly as a legitimate

organization.

Maryland Shall Issue

Maryland -–(Ammoland.com)- As many of you know, the organization

formally recognized as Ceasefire Maryland no longer exists as such in the

eyes of the Maryland government due to forfeiting their corporate

charter.

Contrary to all common sense, this group continues to trade off of the

name and represent itself before the General Assembly as a legitimate

organization.

On March 8th, professional lobbyist Eric Gally testified before the House

Judiciary Committee as representing Ceasefire Maryland. After his brief

and predictable testimony in favor of HB1043, which would have given

the Maryland State Police the authority to inspect gun dealers’ records

without cause, much hilarity ensued as Delegate Michael Smigiel

proceeded to dismantle Mr. Gally’s charade before the entire committee

and audience.

We took the time to cull the pertinent video from the more than 5 hours

of testimony.

Aside from the obviously distasteful manner in which this group of

individuals continues to represent itself, it is even more so that, while

our people are true grassroots activists who take leave time from work in

order to attend these hearings, the other side can’t be bothered with such

trivialities and brings in hired guns to do their dirty work.

SHACKLESFORD, VA --(Ammoland.com)- Morgan Allen of Team

International Training, Inc. (ITI) took home the title of ESP Division

Champion, as well as the Most Accurate, with a score of 148.67 (38) at

the 2011 IDPA FL State Championship, held March 11-13, 2011 in

Pinellas Park, FL.

Although IDPA does not officially recognize High Overall, Allen was able

to successfully clinch this title as well. Over 275 competitors, including

some of the country’s top shooters, came out to compete in the Florida

heat and humidity.

fantastic job assembling and running a collection of

challenging stages that had more than one top shooter

mulling over plans longer than usual for how to address each

one,” commented Allen.

“That’s the mark of a great IDPA match: stages every shooter

can accomplish, and in the same breath, ones that force every

shooter to think about the stages and come up with their best

plans. And then execute. Sounds simple, and it’s a lot easier

when you have good tools to work with, including training

like that offered at ITI.”

MADISON, WI --(Ammoland.com)- Wisconsin department of natural

resources wild turkey update – leftover 2011 spring turkey permits go on

sale next week!

The 2011 Spring Turkey Season is just around the corner and leftover

spring turkey permits will be sold on a first-come, first-served basis

starting next week! Sales begin Monday, March 21 and leftover permits

will be first issued for sale by zone, one zone per day, with each zone

having a designated sales date as follows:

• Zone 1 = Monday, March 21st, 10am – midnight

• Zone 2 = Tuesday, March 22nd, 10am – midnight

• Zone 3 = Wednesday, March 23rd, 10am – midnight

• Zone 4 = Thursday, March 24th, 10am – midnight

• Zone 5 & Zone 6 = Friday, March 25th, 10am – midnight

• Any permits still remaining for all zones = Saturday, March 27th

until end of season, 10am – midnight

License.

The equivalent of Constitutional Carry.

Elected Republicans passed Constitutional Carry for themselves!

Apparently it’s politics as usual down at the State Capitol in Atlanta.

and takes steps to preserve Barrens unique habitat.

STATE COLLEGE, PA --(Ammoland.com)- Pennsylvania Game

Commission officials today announced they plan to begin the second

phase of controlled burns on the Scotia Barrens on State Game Land 176

in Patton, Ferguson and Halfmoon Townships, Centre County, to

improve habitat conditions within this unique ecosystem. This year, the

Game Commission has scheduled using prescribed fire on four different

burn units totaling 630 acres when weather conditions are appropriate

between March 21 and May 6.

Originally outlined in public meetings and meetings with news media in

the area in March of 2009, the Game Commission’s use of prescribed fire

in the area last year has already reduced the risk of a wildfire to

surrounding developed communities and improved habitat for unique

Barrens plants and animals.

“If weather conditions cooperate, we will begin phase two of

our habitat improvement project on State Game Land 176

that involves the use of prescribed fire,” said Bill Capouillez,

Bureau of Wildlife Habitat Management director. “Last year,

we used prescribed fire on three parcels totaling about 300

acres near the periphery of the surrounding community. This

reduced the fuel load closest to the nearby homes, and

created a large safe area for our interior burns this year.”

In reiterating the importance for this controlled burn, Capouillez said

that the Scotia Barrens ecosystem, which is a scrub oak/pitch pine

barrens, depends on fire to regenerate itself.

“Prescribed burns are a tool used by the Game Commission to

improve habitat and, in this case, will help maintain the

ecological integrity of this unique habitat, which supports a

number of wildlife and plant species of special concern,”

Capouillez said. “Also, this controlled burn will reduce the

fuel load – the leaf litter, pine needles and twigs on the forest

floor – that increases the chance of a catastrophic wildfire

being ignited by a lightening strike or by a cigarette carelessly

tossed on the ground. Because of decades of fire suppression,

fuel loads are unnaturally high. Prescribed fire allows us to

control when and where fire occurs rather than react to an

emergency situation.”

To begin the preparation, agency employees have coordinated with all

other jurisdictional agencies on the protection of any known cultural

resources, as well as plants and animals designated as having a higher

status of special concern. To alert the public, a series of news advisories

will be issued closer to the time the burn will be conducted, including a

news advisory on the day of the burn.

Capouillez noted that residents may see smoke emerging from the Scotia

Barrens during the window of opportunity that the agency has targeted

for the controlled burn, which is from March 21 to May 6. This window

was specifically selected to avoid peak incubation period for ruffed

grouse (May 8), songbird nesting (May 14) and the birth of fawns (June

1).

“While we want to avoid the nesting, brooding and birthing

cycles, the low-intensity heat from a slow, controlled burn

will enable wildlife in the burn areas to escape in advance of

the fire,” Capouillez said. “We had a woodcock flush from an

empty nest on Scotia last year and return to the burned area

to lay eggs and successfully hatch a brood. That would not be

the result in the case of a wildfire.”

Capouillez emphasized that burning will be done when the weather is

suitable to allow for a safe burn, including the rapid rising and dispersal

of smoke. Also, he noted that the partnerships involved in this burn will

ensure safety throughout the process.

“Once again, the Nature Conservancy has agreed to serve as

‘burn boss,’ and oversee the entire project,” Capouillez said.

“Since controlled burning requires careful timing and a

thorough knowledge of weather and fire behavior, highly

trained fire personnel with either state or national

certification from the Game Commission, The Nature

Conservancy, U.S. Fish and Wildlife Service, National Park

Service and Department of Military and Veterans Affairs will

partner to conduct this burn, as well as to provide equipment,

materials and support.”

Capouillez said the agency has also notified local elected officials,

emergency management agencies, fire companies, local airports and

local Pennsylvania Department of Transportation officials.

Optimal weather conditions will be chosen for smoke dispersal, but

Capouillez noted that during these controlled burns nearby residents will

certainly see and smell smoke. The majority of the smoke disappears by

the end of the first day, but a small amount of smoke will be generated by

slow burning trees inside the units for up to three days.

“People become upset when there is smoke in the air if they

don’t know the reason for the fire,” Capouillez said. “That’s

why we’re trying to get the word out about prescribed fire. If

we carefully plan and conduct a burn when weather

conditions favor smoke dispersal, this reduces smoke-related

problems. Dealing with a little bit of smoke now is infinitely

better than trying to control a raging wildfire later.”

“We also would like the public to remain out of the burn areas

while there is still smoke being generated, and on any windy

days, because of the large number of gypsy moth killed trees.

Last year we had mountain bikers back in the area while we

were still mopping up the burn, which creates safety issues

for both the bikers and the firefighters.”

Capouillez noted that the Game Commission has conducted prescribed

burns on more than 2,000 acres of State Game Lands over the past four

years.

“Added benefits from this prescribed burn will be a

temporary reduction in ticks, a reduction in exotic and

invasive species, training for those who participate in

prescribed burns and informing the public about the benefits

of prescribed burns,” Capouillez said.

Pennsylvania’s Wildlife Action Plan cites fire as an important tool in

managing certain habitats, including barrens, forests and grasslands,

and for species of greatest conservation need. For more information,

SGL 176 currently contains 6,231 acres in Ferguson, Half Moon and

crew-cuts, field agent Jack Owens wore loafers and long hair. Yes, he was

a dedicated career agent, but viewed some policies as unnecessary and

enjoyed doing things his way.

“One night I sat alone in a tree during a rainstorm wearing a

government-issue waterproof coat that wasn’t waterproof,

waiting for a fugitive to walk into my handcuffs,” Owens says.

“You can’t have that much fun being sensible.”

The title of his book, Don’t shoot! We’re Republicans!, refers to one

of the many zany incidents that occurred during his pursuits, stakeouts,

and arrests. Fun-loving and fearless, he considered each assignment an

adventure, from chasing army deserters and bank robbers to putting

down prison riots and working undercover in counterintelligence.

Owens combines his personal stories with an in-depth look at the

workings of the FBI. He describes the rigid but effective management

style of J. Edgar Hoover, critiques the methods of Hoover’s successors,

and praises the Bureau’s move to recruit women and minorities.

He recounts in detail the handling of a number of nationally publicized

crimes such as the Atlanta child murders. After the collapse of the Soviet

Union, he describes new directions for FBI activities, such as cooperative

efforts to fight global crime and terrorism, and programs to train former

What never changed in 30 years was Owens’ sense of humor, his deep

respect for the Bureau, and his admiration for his competent fellow

agents. While he writes that “the FBI lives on gripes and stale air” and

acknowledges that mistakes are made, he asserts that “the Bureau is

still the best equipped and trained law enforcement organization

anywhere.”

About the Author

Jack Owens spent 30 years in the FBI trenches, mostly in Birmingham,

Alabama. After retiring from the Bureau, he took up writing and has

written articles for a variety of magazines. In 2003 he appeared in the

CBS reality TV show Big Brother (BB4). With his winning smile and

charming disposition, he was voted the most popular cast member.

Owens was born in Texas and spent his youth in small towns in West

Virginia. He has a BA in Public Administration from American

University, and a law degree from the University of Alabama Law School.

He joined the FBI in 1969, spent a year in Denver and 29 years in

Birmingham, Alabama, where he investigated bank robberies, extortions,

kidnappings, terrorism, and other crimes. He spent four years in

counterintelligence, and served on Alabama’s first SWAT team.

He and his wife live in Birmingham. He has six children and eight

grandchildren.

Resources and Great Lakes Indian Fish & Wildlife Commission

(GLIFWC) today announced a number of updates to the court-approved

rules that govern Chippewa Indian hunting, fishing and trapping off-

reservation rights in Wisconsin’s Ceded Territory.

The 1991 court judgment in Lac Courte Oreilles Indians v. State of Wis.,

most commonly known as the Voigt decision, required the six Wisconsin

Chippewa bands to establish a conservation code by which their off

reservation treaty rights would be exercised. They did so by creating the

Off Reservation Model Code.

“Changes in hunting, fishing and trapping opportunities since

the original agreement support these modifications both to

maintain the original intent of the agreement and to

streamline implementation,” said DNR Secretary Cathy Stepp

“These changes will not endanger our wildlife, fish and forest

resources but will make things simpler and more efficient.”

GLIFWC and DNR representatives worked closely over the past year and

a half to address the areas where changes were needed to the Off

Reservation Model Code and succeeded in producing modifications

without the need for litigation. Both the tribes and the state view the

result as a step forward in the way these issues are handled for all

parties. “It is really significant that we were able to institutionalize the

communication and dialogue between the parties,” said James Zorn,

GLIFWC Executive Administrator.

Many of the modifications mirror changes in state hunting, fishing and

trapping codes, and other changes represent an increase in the level of

shared knowledge and cooperation between the department and

GLIFWC staff.

Updates include changes in walleye spearing harvest monitoring for

small-quota lakes, streamlining of tribal wildlife quota declarations for

antlerless deer, bear, fisher, otter and bobcat and a pilot project that

allows tribal offices to issue gathering permits for certain forest products.

The changes in walleye harvest reporting procedures apply only to lakes

with a harvestable walleye quota of 75 or fewer fish. All fish speared in

these lakes must still be reported. In the past, walleye harvest could only

be reported at the landing of the lake just speared. Fish speared in these

small-quota lakes can now be reported at a location other than the

landing of the speared lake. Quotas are not increased, only the reporting

procedure has been modified.

DNR can now also move ahead with season structure setting ahead of

receiving tribal harvest declarations for antlerless deer, bear, fisher, otter

and bobcat if tribal harvests remain below 15% of the tribal share of

these species, thereby simplifying the season setting process.

The changes were filed with the court as an amendment to the final

judgment entered in 1991.

A summary of the changes:

Meetings of the Agency Leadership. Allows for a regularized process to

coordinate communication by agency leaders in DNR and GLIFWC, and

agrees that both parties will make good faith efforts to coordinate

regarding their respective management and regulatory authorities.

Biennial Stipulation Review. Allows both parties to coordinate discussion

of proposed management and regulatory issues and to provide a regular

schedule for stipulation review and possible amendment in that the

parties agree to make good faith efforts to undertake a review of, and

propose changes to, the stipulations no less than biennially.

Technical Updates and Amendments. Establishes a mechanism that

allows for automatic implementation of provisions of a GLIFWC

“Commission Order,” after consultation with the state and agreement of

the parties, for issues that substantially mirror existing and future state

law changes to the management of resources within the ceded territory.

A Tribe may choose to adopt more restrictive measures thereby reserving

each Tribe’s authority. This amendment makes the implementation of a

Commission Order less cumbersome by eliminating the need for

continuous ratification of the tribal codes that previously had to be

amended after the issuance of each Commission Order.

Adjacent Spawning Stream Segments. Establishes designated adjacent

spawning stream segments as one “unit” for spearing purposes where the

walleye declaration for a particular lake applies to both to the lake and

designated river segment.

Designated River and Stream Segment Regulation – Long Term Six Year

Joint Study

Establishes a six year joint study of existing stream segments which may

be amended upon agreement of the parties, that allows for the harvest of

60 walleye per segment per day without restrictions on the number of

boats or spearers, and without the five fish daily bag limit, while

maintaining the 120 fish total annual harvest per segment with a

maximum of two days allowed for harvest.

Additional Designated River and Stream Segments – Long Term Six Year

Joint Study

Establishes a long term six year joint study for spearing in eight

designated stream segments that the tribes have had annual recurring

access for ongoing study.

Calculation of Safety Factors. Establishes defined timeline for the parties

to review data, methodology and calculations for the appropriate “safety

factors” used in setting walleye and muskellunge safe harvest levels every

10 years, unless both parties agree to meet earlier, or if such review is

unnecessary.

Gillnet Mesh Size – Six Year Joint Study. Establishes a six year joint

study that makes permanent existing ongoing annual studies which may

be amended upon agreement of the parties, that continues to allow for

the use of additional gillnet mesh sizes on lakes 1,000 acres or larger.

Alternative Monitoring of Tribal Walleye Harvest on Certain Lakes.

Creates an administrative mechanism that sets forth the list of certain

low quota harvest lakes (maximum quota of 75 walleye) where on-site

monitoring is not required, upon agreement of the parties. Registration

of the harvest is still required.

Wildlife Quotas/Bag Limits – Thresholds. Establishes a stipulation

change identical to what is currently in place for turkey to implement the

threshold harvest system in Wisconsin for the following species;

antlerless deer, black bears, fishers, otters and bobcats. The shift from a

declared quota prior to harvest to a system limiting harvest in the

following year is designed to mirror the state’s management system for

the species listed, and is based on the fact that the tribes rarely approach

the 50% harvest limitation for those species. Tribal members would be

regulated by a daily bag limit, registration would still be required (within

3 working days of harvest), and carcass tags are still required.

Tribal Gathering on State Lands – Two Year Joint Assessment.

Establishes management and regulatory principles pertaining to tribal

gathering on select DNR properties for a two year trial study period. This

stipulation change will provide a means for tribal self regulation while

establishing the necessary assurance that the tribes will ensure that their

members’ gathering activities are consistent with the state’s

management objectives.

Tribal Mentored Hunting Regulations. Codifies the regulatory change

established via state law for mentored state youth less than 12 years in

age and GLIFWC Commission Order #2009-01, that established

culturally appropriate regulations to provide tribal members more treaty

harvest opportunities in line with state harvesters by expanding hunting

opportunities for tribal hunters less than twelve years of age and for

tribal hunters that have not been issued a certificate of accomplishment

from a tribal hunter education and firearm safety course.

Deer Unit Goal Review. Allows the Department the flexibility to re-

evaluate the three (3) year time frame for deer unit goal review by

establishing a deer unit goal review every five (5) years.

Committee Updates. Updates the list and mechanism for on going

updates to the current DNR committees that routinely address treaty

reserved resources covered by the Voigt decision while continuing to

deepen and further the ongoing GLIFWC-DNR relationships established

to date, and providing for a framework for continued dialogue.

Tribal State Park Hunting Document Established. Establishes an

administrative mechanism that sets forth the regulations and state parks

available to tribal harvest entitled.

CITES Export Program. Establishes a stipulation change pertaining to

GLIFWC’s Convention on International Trade in Endangered Species

(CITES) Export Program. CITES tags issued under this program would

be provided to GLIFWC, which would be responsible for distributing

them to the tribes, and which would report to the U.S. Management

Authority as required by the program delegation.
