EPA was sued by a small number of parties (one state, less than 20 power companies, and two small trade associations) on various aspects of CAIR

The Court issued its decision on July 11, 2008 to vacate both CAIR and the FIP in their entirety and sent the rules back to EPA

Mandatory GHG ReportingRulemaking

Objective - To collect comprehensive and accurate data relevant to future climate policy decisions, including potential future regulation under the Clean Air Act

Scope of Coverage - Define gases “…to require mandatory reporting of greenhouse gas emissions” (CO2, CH4, N2O, HFC, PFC, SF6)

Sections 114 & 208 of the CAA allow for data collection, measurement & recordkeeping from stationary or mobile related sources

Proposed rule expected by September 2008 and final rule by June 2009

EPA welcomes stakeholder input and plans to reach out to stakeholders through information sharing sessions

Advance Notice of Proposed Rulemaking (ANPR)

Greenhouse Gas Emissions

One of the steps EPA has taken in response to the U.S. Supreme Court’s decision in Massachusetts v. EPA

Seeks input on a variety of topics including potential regulatory approaches and technologies for reducing GHG emissions

ANPR published in the Federal Register on July 30, 2008 (comment period closes November 28, 2008)
